With the recent technological development, we have been witnessing a progressive loss of control over our personal information. Whether it is the speed in which it spreads over the internet or the permanent storage of information on cloud services, the means by which our personal information escapes our control are vast. Inevitably, this situation allowed serious violations of personal rights. The necessity to reform the European policy for protection of personal information is emerging, in order to adapt to the technological era we live in. Granting individuals the ability to delete their personal information, mainly the information which is available on the Internet, is the best solution for those whose rights have been violated. However, once supposedly deleted from the website the information is still shown in search engines. In this context, “the right to be forgotten in the internet” is invoked. Its implementation will result in the possibility for any person to delete and stop its personal information from being spread through the internet in any way, especially through search engines directories. This way we will have a more comprehensive control over our personal information in two ways: firstly, by allowing individuals to completely delete their information from any website and cloud service and secondly by limiting access of search engines to the information. This way, it could be said that a new and catchier term has been found for an “old” right.

No julgamento do recurso especial referente à ação ajuizada pela apresentadora Xuxa Meneghel para compelir o Google Search a desvincular dos seus índices de busca os resultados relativos à pesquisa sobre a expressão “Xuxa pedófila” ou qualquer outra que associasse o nome da autora a esta prática criminosa, a relatora da decisão, a Ministra Nancy Andrighi, definiu de maneira clara a controvérsia de que cuida este trabalho: o cotidiano de milhares de pessoas depende atualmente de informações que estão na web, e que dificilmente seriam encontradas sem a utilização das ferramentas de pesquisas oferecidas pelos sites de busca. Por outro lado, esses mesmos buscadores horizontais podem ser usados para a localização de páginas com informações, URLs prejudiciais resultantes da busca com o nome das pessoas. Diante disso, o que fazer? Existiria realmente um direito de ser esquecido, isto é, de ter uma URL resultante de uma pesquisa sobre o nome de uma pessoa desvinculado do índice de pesquisa do buscador horizontal? Há quem afirme que a medida mais apropriada para lidar com esse problema seria ir atrás do terceiro que publicou essa informação originariamente na web. Há também quem defenda que a proteção de um direito de ser esquecido representaria uma ameaça grande demais para a liberdade de expressão e de informação. Diante deste quadro, esta dissertação visa a estabelecer quais podem ser as características e os limites do direito ao esquecimento na era digital, de acordo com o estado atual da legislação brasileira a respeito, confrontando-se tal direito com outros direitos e interesses públicos e privados (especialmente o direito à liberdade de expressão e à informação) e levando em conta as características de funcionamento da própria rede mundial de computadores, em especial das ferramentas de buscas. Tendo em vista a importância dos buscadores horizontais no exercício do acesso à informação e, além disso, as dificuldades relacionadas à retirada de URLs de todos os sítios em que tenham sido publicadas, nossa pesquisa focará no potencial – e nas dificuldades – de se empregar a regulação de tais ferramentas de busca para a proteção eficaz do direito ao esquecimento na era digital.

The present dissertation has as object of study the right to be forgotten, a new right for increase the control of subject over their data. It’s analyzed the data protection on Internet, especially, some scenarios of processing and the regulation applicable to it (directive 95/46/CE and directive 2002/58/CE).

The so-called "residential tourism" came to intensify the previous occupation of the coastal zones, characterized by traditional beach houses, and brought significant consequences for their spatial configuration, and especially for its scenic value of the landscape. Although there is the intention to regulate the activities of enterprising groups by some legal instruments to control the use and occupation of land, and to contain some negative effects, the actions of government are still inefficient in trying to follow the implications on the landscape from the accelerated growth of the real estate and touristic sectors. Supported in the speech of economic development and income generation, public managers prioritize areas to attract tourists to the detriment of preserving important physical attributes of the natural environment that contribute significantly to the quality of life. The result can be noticed in the use of natural elements as one of the major components in the land valorization, and in the immediate attraction of investors and enterprising. Therefore, the objective of this work is to contribute to the debate on the landscape preservation a little detailed thematic in view of their relevance in the current context - by indicating subsidies to the creation of a methodology for the evaluation and protection of coastal zones that may assist the government in creating new instruments, and better prepare it in control of the occupation of these areas. For such, was followed two ways to analysis: the indirect method and the direct method. The first is grounded in the evaluation of landscape attributes, which is based on the work of Raquel Tardin (2008) and Eduardo Cuesta, Encarnación Algarra and Isabel Pastor (2001). The second, based on the research of Leticia and Carlos Hardt (2010) and on the concepts of phenomenology - expressed by Antonio Christofoletti (1985) and Yi-Fu Tuan (1983) - considers the population perspective on the quality of the natural scenery. Developed through cartographic materials, photographic collections and quantitative tables, this dissertation utilized as a case study the beaches of Barra de Tabatinga and Camurupim, located in the city of Nísia Floresta/RN. Despite already being sighted spaces of advanced stage of landscape degradation in these locations, areas of remarkable scenic value can still be found, what reinforce the urgency in adopting preservationists actions. The absence of laws focused on the management and protection of the landscape singularities associated with the inefficiency of the government to invigilate the land occupation in coastal zones, encourage the excessive action of the real estate-tourism, and consequently make the government the main responsible for the environmental and landscape impacts in these areas - by its omission or by their connivance. Therefore, the legislation permeates this entire process and constitutes itself as the most effective way to guarantee the right to the landscape to present and future generations. Are also pointed some important considerations to build a methodology, especially concerning possibilities of improvements and adaptations of its applicability in each case

This dissertation stands out the religious and social role of Christian religious minorities in Portuguese society, where the vast majority of the believers profess the Catholic faith. This work serves to demystify the widespread prejudice against minorities and clarify its place in the religious phenomenon in Portugal. We intend to define the concept of Religion, missing in the Portuguese legislation, framing it in Portuguese constitutional history, which allows us to evaluate the relations State/Catholic Church and State/religious minorities, since Liberalism. We attempt to measure how the legal system accepts the religious phenomenon and how to deal with religious diversity, according to the principle of religious freedom postulated in the Constitution of the Portuguese Republic. It is also our intention to relate the concepts of sect and religious minority, which tendentiously are misunderstood. In order to understand the underlying dynamics of religious minorities, we take the example of the Portuguese Evangelical Alliance, which we monitored closely throughout the investigation. We will give some space for a small analysis of the state and social discrimination experienced by the minorities. With this work we can conclude in general that Portugal, despite its weak religious diversity, has a good advance on the religious freedom. The Portuguese State has made a remarkable effort to cooperate with the churches, an effort that must be continued in order to fill some gaps found, particularly in the absence of legislation regarding the criminalization of religious discrimination and competence of the Committee on Religious Freedom in case of a possible complaint. We prove similarly that there is also a special attention to the Catholic Church in the composition of the Committee on Religious Freedom and the Committee Broadcast Time of Religious Confessions. In the end, we prove that the society is the major source of discrimination against minorities.

Primeiro registro da participação feminina no Parlamento brasileiro, organizada em uma linha do tempo. A obra relaciona os discursos das parlamentares aos principais fatos da história política do país - do Estado Novo à ditadura militar, da redemocratização à Constituição de 1988 - e, também, narra o papel das mulheres no processo de construção da atual sociedade brasileira.

Seminário realizado pela Comissão de Direitos Humanos e Minorias da Câmara dos Deputados em 2009. As atividades foram dividido em 4 mesas: a primeira Da Comissão sobre Mortos e Desaparecidos Políticos a uma nova Comissão Memória e Verdade, nos moldes propostos pela ONU, teve como finalidade ouvir e debater as avaliações e as propostas de equacionamento de questões não resolvidas no período da ditadura militar; na segunda mesa foram apresentadas as recomendações elaboradas pelo Ministério Público Federal a partir da análise do livro Orvil, O Livro Negro do Terrorismo no Brasil, escrito por ordem do Ministro do Exército em 1986; na terceira mesa foram analisadas as revelações feitas por um agente secreto da ditadura militar, contidas no livro Sem Vestígios, de autoria de Taís Morais; a quarta mesa tratou do tema Tortura - crime imprescritível: estudo sobre a prática no Brasil durante o período 1964-1985.

Coletânea organizada pela Comissão de Desenvolvimento Urbano em comemoração aos dez anos da edição do Estatuto da Cidade. Contém o estatuto - Lei nº 10.257, de 10 de julho de 2011, e as principais normas nacionais no campo do direito urbanístico. Inclui também uma lista das normas integrantes do direito ambiental que possuem interfaces com a legislação urbanística de aplicação nacional.

Este trabalho critica a tese do positivismo normativista que afirma que o Estado e o Direito formam uma unidade indissociável. Para isso, apresenta a experiência histórica da sobrevivência do Direito Hebraico na época da Diáspora como exemplo de Direito válido e eficaz sem que existisse na época o Estado hebreu que a ele deveria corresponder, na ótica normativista.

Analisa a pretensão da criminalização primária das ocupações de propriedades públicas e privadas por movimentos sociais, tendo como marco teórico o pensamento de Alessandro Baratta sobre os limites de intervenção penal estatal, especialmente os princípios da “proporcionalidade abstrata” e da “articulação autônoma dos conflitos e das necessidades reais”.
