Desde o fim da era das remoções, o foco de preocupação do Estado em relação às favelas tem se deslocado da urbanização para a violência, em especial para o tráfico de drogas. A militarização da questão da violência urbana se manifesta de forma definitiva com a inauguração das Unidades de Polícia Pacificadora nas comunidades carentes cariocas. A despeito dos aspectos positivos imediatos, a ausência de participação popular no processo de ocupação pelo Estado desses espaços segregados têm levantado preocupações, não apenas quanto à eficiência do programa em longo prazo, como também com a possibilidade de instauração de um Estado policial altamente repressivo. Esse trabalho analisa a utilização de mecanismos de gestão e planejamento democráticos como forma de aprimorar o programa de ocupação das favelas, partindo do pressuposto de que a participação política pode contribuir para a maximização dos direitos fundamentais. Para isso, estuda-se com profundidade a história dos atores políticos presentes nessas comunidades, além dos instrumentos existentes e possíveis no Direito Brasileiro para participação popular. Após a análise dos aspectos sociológicos e históricos que explicam a situação atual das favelas cariocas, ao fim, propõe-se um modelo de gestão democrática que aproveite ao máximo seu potencial de participação.

According to a recent Eurobarometer survey (2014), 68% of Europeans tend not to trust national governments. As the increasing alienation of citizens from politics endangers democracy and welfare, governments, practitioners and researchers look for innovative means to engage citizens in policy matters. One of the measures intended to overcome the so-called democratic deficit is the promotion of civic participation. Digital media proliferation offers a set of novel characteristics related to interactivity, ubiquitous connectivity, social networking and inclusiveness that enable new forms of societal-wide collaboration with a potential impact on leveraging participative democracy. Following this trend, e-Participation is an emerging research area that consists in the use of Information and Communication Technologies to mediate and transform the relations among citizens and governments towards increasing citizens’ participation in public decision-making. However, despite the widespread efforts to implement e-Participation through research programs, new technologies and projects, exhaustive studies on the achieved outcomes reveal that it has not yet been successfully incorporated in institutional politics. Given the problems underlying e-Participation implementation, the present research suggested that, rather than project-oriented efforts, the cornerstone for successfully implementing e-Participation in public institutions as a sustainable added-value activity is a systematic organisational planning, embodying the principles of open-governance and open-engagement. It further suggested that BPM, as a management discipline, can act as a catalyst to enable the desired transformations towards value creation throughout the policy-making cycle, including political, organisational and, ultimately, citizen value. Following these findings, the primary objective of this research was to provide an instrumental model to foster e-Participation sustainability across Government and Public Administration towards a participatory, inclusive, collaborative and deliberative democracy. The developed artefact, consisting in an e-Participation Organisational Semantic Model (ePOSM) underpinned by a BPM-steered approach, introduces this vision. This approach to e-Participation was modelled through a semi-formal lightweight ontology stack structured in four sub-ontologies, namely e-Participation Strategy, Organisational Units, Functions and Roles. The ePOSM facilitates e-Participation sustainability by: (1) Promoting a common and cross-functional understanding of the concepts underlying e-Participation implementation and of their articulation that bridges the gap between technical and non-technical users; (2) Providing an organisational model which allows a centralised and consistent roll-out of strategy-driven e-Participation initiatives, supported by operational units dedicated to the execution of transformation projects and participatory processes; (3) Providing a standardised organisational structure, goals, functions and roles related to e-Participation processes that enhances process-level interoperability among government agencies; (4) Providing a representation usable in software development for business processes’ automation, which allows advanced querying using a reasoner or inference engine to retrieve concrete and specific information about the e-Participation processes in place. An evaluation of the achieved outcomes, as well a comparative analysis with existent models, suggested that this innovative approach tackling the organisational planning dimension can constitute a stepping stone to harness e-Participation value.

En se basant sur le principe organisationnel des deux types d’ensembles politiques rencontrés au Bénin, le but de cette recherche est d’explorer un ou des modèles conjoints, classiques et coutumiers, de participation en vue de promouvoir une démocratie participative plus proche des citoyens. Trois échelons spatiaux ont constitué le terrain de la recherche : l’Afrique, le Bénin centre et les milieux proches des anciennes royautés. La documentation et les données d’observations et d’entrevues ont été analysées par la démarche de théorisation ancrée et l’appréhension des phénomènes socio-spatiaux. Des quatre modèles originaux avec les critères endogènes d’appréciation de la participation mis en évidence et caractérisés dans les cultures du Bénin, deux, Togbésso-Hon-Togbassa et Daŋnou, émergent comme représentatifs des exigences d’une démocratie avec des formes territorialisées de la participation. La mise en perspective de la participation au Bénin avec les États d’Afrique montre une bonne performance qui le fait référencer comme le plus performant pour ses procédures et pratiques et comme source d’inspiration de mise en place des dispositifs participatifs dans le palmarès des grandes démocraties. Ses deux instruments de la décision, l’analyse participative et l’audience publique, restent perfectibles. La première, une innovation intéressante à encadrer, limite la participation à des acteurs choisis selon des critères généralement non énoncés. L’audience publique reste insatisfaisante par son inadéquation à la production de la décision collective et un modèle antinomique de la pensée politique africaine qui vise le consensus dans une démarche inclusive à essence délibérative sous forme de palabre. Fondement de la démocratie participative, la palabre offre le soubassement pour un modèle synergique basé sur les principes de délibération collective, d’offre de l’initiative de la décision au citoyen, de l’invitation aux débats et de l’écoute active (DROIE), d’un dispositif décisionnel flexible et adapté, au centre duquel se trouvent la délibération, le huis clos, la validation populaire et la reddition de compte, le recours et la réparation ainsi que le contrôle de qualité de la décision, essentiels à la gestion, et structurants à l’évaluation environnementale.

Las nuevas Tecnologías de la Información y Comunicación –TICs-, como herramientas influyentes en las estructuras sociales y los procesos económicos, han permitido transformar las relaciones del Estado y el ciudadano, y aún más, aspirar a fortalecer las prácticas democráticas fundamentadas en la participación. Con este propósito, surgió la iniciativa de Gobierno Electrónico o e-Government, que para el caso colombiano, se encuentra actualmente en manos del programa Agenda de Conectividad y la estrategia de Gobierno en Línea –GEL-. Con dicha estrategia, el Ministerio de Educación Nacional, diseñó en el año 2006, un modelo de participación basado en la utilización de medios electrónicos por parte de los ciudadanos para realizar aportes, contribuir al debate, y finalmente construir el documento final del Plan Nacional Decenal de Educación –PNDE- 2006-2016. Este proceso de construcción del PNDE, ha permitido visualizar cómo las soluciones electrónicas utilizadas para tal fin y la creación de espacios de deliberación de ésta naturaleza, elevan los niveles de inclusión política y social (si se tiene en cuenta la gran variedad de actores involucrados), favorecen la participación, y contribuyen al compromiso del Estado con la disminución de la Brecha Digital existente en el país.

En el presente trabajo de grado, estudiaremos la utilidad de la Consulta Previa como instrumento político, a partir del análisis del proceso adelantado entre el Resguardo Santa Teresita del Tuparro y la Petrolera BHP Billiton en el año 2010, en el municipio de Cumaribo, Vichada, identificando si existen fortalezas y buenas prácticas que permitan equilibrar el interés general y el de las minorías, en beneficio de la gobernabilidad dentro del contexto colombiano. Para cumplir con el objetivo descrito, haremos un análisis de los diferentes roles de los actores involucrados en el presente estudio de caso, desde los conceptos de legitimidad y representatividad y analizaremos si la Consulta Previa adelantada de manera idónea, mediante la aplicación de principios como buena fe, transparencia, comunicación asertiva, y reconocimiento mutuo entre los actores, puede ser una herramienta eficaz, dentro de la democracia participativa.

Esta dissertação pretende examinar a relação entre democracia representativa (eleitoral) e democracia participativa, assim como os diferentes graus de influência da participação, direta ou indireta através de representantes, de atores e grupos socioculturais, antes excluídos, em espaços deliberativos, especialmente em conferências, conselhos, seminários e fóruns abertos para a elaboração de políticas públicas. Para tanto, o trabalho baseia-se na discussão sobre a crise da representação política e a relação com a participação social desenvolvida no âmbito da teoria democrática contemporânea e são utilizados aspectos extraídos da literatura sobre a elaboração de políticas públicas, o conceito de capital social de Pierre Bourdieu e a ideia de democracia comunicativa de Iris Young. A metodologia do trabalho consiste em três estudos de caso interligados: o nacional, relativo à participação em espaços deliberativos e à representação político-eleitoral principalmente para elaboração do Plano Nacional de Cultura; o estadual, relativo à representação política e participação para elaboração de políticas de cultura em Pernambuco; e um caso municipal, a análise da participação em espaços deliberativos abertos para a elaboração do plano e de políticas de cultura no município de Recife.

The 1988 Constitution was the legal marc to define changes in Brazilian State with major importance to the layout of public politician. In that moment of redefinitions e openness to new ways the redemocratization, participation and decentralization of public school had as their starter the elementary school. This work focus on the manage of FUNDESCOLA, particularly one of its politics called PDE (Educational Development Plan) wich purpose is guarantee a better quality in teaching and spread out democracy throughout its methodology. It was chosen two public schools: Professor Ulisses de Góis and Antonio Campos. The theoretical and methodological orientation is based on the theory of participative democracy developed by authors such as Putnam and Pateman. They says that a cultural background precedes individual participation in society. The collected data (educational legislation, surveys with all sectors of schools and technicians of Natal educational secretary, and relevant documents of de institutions) showed that PDE. Implementation had opposite runnings in the schools studied. In one, as a consequence of bad preparations of its teachers to absorve its methodology, PDE failed. In another way, PDE achieved its goals, especially helping the structure of action plans of the school and the administrative organization making possible several pedagogic activities planned. The work concludes that the main factor the failure or success of PDE relies on the organizational (both political and pedagogical) structure of each school. This discovery implies three important guidelines when comes to formulation of public politicians: a) Constitution of school; b) the local actors who manages the actions; c) the colletive interest in taking part of decisions

The following study proposes an analysis of the politic process which the brazilian constitutional justice faces, emphasizing the Supremo Tribunal Federal . For that purpose, we start by examining the intimate relationship between Politics and Law, in view of the most recent social systems theories, so that the political system is distinguished by the exclusiveness of using the physical force, intending to make coletive tying decisions, and the juridical system as a congruent generalization of the expectations towards the rules and principles, brought together under an interdependence by which both gather legitimacy and effectiveness. In this manner we can notice the political effects of the constitutional interpretation conducted by Judges as well as by other juridical professionals, because these ones decrease the overload of expectations which are pointed to the Judicature. Constitutional interpretation is democratized since the participative democracy arises and stablishes a permanent state of awareness around the exercise of power and favours the preservation of the pluralism (counter-majoritary principle) where we can find the origin of the democratic nature of constitutional courts, once, in most cases, their members are not elected by the people. After that, we analyse the historical posture of the Supremo Tribunal Federal as a constitutional court in Brazil, so we can realize the attempts to make it vulnerable to the appeals of governability and economical aims, agains which this court somehow has resisted, stressing its particularities. At the end, it s concluded that even the so-called acts of government, whose judiciary control is mostly repelled, are subjected to a constitutional analysis, last frontier to be explored by the Supremo Tribunal Federal in its role of exposing our republican Constitution

The article searches to launch some analyses and investigations on the historical reach of produced participative processes in Spain and Brazil. Evidently, both the processes if had uncurled in historical, social, economic contexts and distinct politicians, but, exactly thus, keep some approaches that we intend to give prominence in the present article. For example, the popular mobilization in the two presented cases after occurred a long period of not attendance of social demands socials. In the same way, the processes of democratic renewal of both are related with historical landmarks “end of the Cold War” and the dismantlement of the Walfare State that introduced new rationalists in the relation between governing and governed dynamic, over all in the coinage and offer of public politics. How much to the dismantlement of the Welfare State, we present, still, that in the case of Spain it provoked consequences in the modus operandi of the formularization process and implementation of public politics. It occurred, in other words, a decentralization of its formulator power to decide arrangement of public politics that started to count on the participation of social actors in the called relational city (BECERRA, 2011). In the case of Brazil, the dictatorial period (1964-1985), the fast urban growth and the generation of precarious peripheries in the main cities, the distension and the Constituent (1986-1988) had generated the enough forces of pressure so that, gradually, if it incorporated the participative arrangement in the power to decide process. We identify that in both the cases, kept the had ratios, the instauration of a critical scene of suppression/absence of formulated public politics from an interface with the social movements were the propeller spring of the transformations in the power to decide mechanisms of formularization and implementation of public politics.
