El objeto del presente trabajo final de grado es analizar la viabilidad de la implementación de la figura del jurado de conciencia en el sistema penal colombiano, que fue suprimida mediante el Decreto 1861 de 1989. A su vez, hacer un análisis de derecho comparado con el fin de determinar los aspectos positivos y negativos de la implementación de los jurados en otros sistemas jurídicos. El resultado del análisis propuesto pretende determinar si es procedente la implementación de los jurados de conciencia en Colombia.

The present paper, based on the concept of surplus of vision discussed in some works of the bakhtinian Circle, as, mainly Bakhtin (2010a) and Bakhtin (2010b), has the main aim to analyse the image of evangelicals in a cover delivered by Veja magazine from the bakhtinian categories of exotopy, otherness and expressive intonation and, consequently, the meaning effects resulting from them. Therefore, anchored by the perspective of Bakhtinian Studies (BS), we analysed the magazine cover, seeking to apprehend the meanings constructed by this genre of verb-visual basis. To the constitution of the corpus of analysis, we selected the cover of the edition 1555, published on July, 15, 1998, entitled A fé contra o crime: Numa cruzada em presídios e redutos de traficantes, os evangélicos estão convertendo bandidos em soldados de Jesus, to analyse in which way the magazine, from its discursive place, appropriates the image of the evangelicals and represents it with its intonations in its statements. From the analysis, we can state that Veja constructs an image that tends to the homogenization of the evangelicals in Brazil, from its surplus of vision, with its tone of sarcasm, prejudice and vilification of this group, attempting to position the consumer/reader of Veja against the protestant sphere. The conclusion of this research, therefore, is that the exotopic position assumed by Veja with regard to its otherness, the evangelical discursive sphere, articulates axiologic aprehensions materialized in the form of intonation on the cover of the magazine that we analysed, disseminating, with the character of truth, the protestant group as integrant of mere dualities. Although the cover figures the group as an agent of change in society, this change gets the intonation by the magazine so that it seems false or, at least, incomplete, which equips the Veja readers of mistrust and, therefore, discredit to the actions of the discussed discursive sphere.

The scope of the present study is to comprehend the professional identity of a group of English Teachers. The research sought the answer to the following question: How does the mastery of the speaking aspect of the English Language influence teacher’s professional identity? The choice of the topic arose during a continuing education course offered by the authors of the present work, whose partakers were EFL teachers. The research took into consideration both, experiences observed during the continuing education course and relevant data collected with the help of an open questionnaire, which participants answered at the end of the course. Contemporary literature also supported the conclusions concerning teacher’s professional identity and its close relation to two important factors: the way teachers perceive themselves and how others see them. Regarding the English Language Teacher professional identity, the participants of the research stated that professionals from this area are not as valued as they should; in their opinion, the lack of oral fluency of most teachers is a key factor on the existence of a professional misrepresentation. Results have shown that, for them, oral fluency is essential for academic and social recognition of their profession. All participants stressed the need of continuing education in terms of oral practice, due to the lack of opportunity of practicing the English Language daily. They also pointed that teachers with limited-fluency tend to avoid the use of the target language in order to “hide their deficit” on EL; on the other hand, teachers that are fluent in English “feel safer and with self-steam”. We have concluded, from our research, that the oral fluency is indeed important for the constitution of English Language teacher’s professional identity, exerting a positive influence on it. On the other hand, the fact of not being fluent in English Language contributes for the so called “teacher’s professional identity crisis”.

Teachers, as professionals, carry out an essential role in the process of the social change. For this purpose, the process of teachers’ formation are deserving highlighted in the research field of Applied Linguistics, aiming to enhance the work of language professionals. In this term, the current paper seeks to investigate the previous knowledge of the students of Letters Course at Unioeste, subjects of this study, about teaching career and professor’s identity constitution.  Simultaneously, it is discussed some implications between the educational trajectory and these students’ Professional choice, considering that it is found in the initial stage of this formative process. The adopted methodology consists of a qualitative approach from memorials, seeking to stand out the conceptions and representations of those subjects about constitution of the teacher. Among some characteristics that stand out in the narratives regarding teacher identity, are the complexity of teaching, like the profession, as well as the diverse teaching practices and 'transgressive'.

This article aims to study the historical constitution of Portuguese Language Teaching Manuals in Brazil (PLT) in Brazil. To do this, we offer firstly an overview view of research on these Teaching Manuals as used in schools and in Portuguese language classes throughout the whole time they have existed. From this extensive period we draw attention to some historical perspectives that have decisively changed the direction of PLT, its classes and the day to day life in schools. From these we shall single out the public policies regarding quality pertaining to the National Program for Teaching Manuals (NPTM) and to the National Program for Teaching Manuals for High Schools, specifically and for 2015 (NPTMHS 2015). We seek theoretical support in: Comenius (1954), Oliveira et al. (1984), Soares (1986, 1998, 2001), Bittencourt (1993), Freitag et al. (1993), Munakata (1997), Coracini (1999), Batista (2001, 2003, 2004), Batista and Costa Val (2004), Bunzen (2001, 2005, 2009), Bunzen and Rojo (2008) Rojo and Batista (2008), among others. The result of this research will give a history of PLT made up of diverse social and political factors, as well as those continually arising.

The study of institutions and policy processes in the formation of culture have been a major concern of the "cultural policy debate", which has been a major debate in Australian cultural studies in the 1990s (Bennett 1992a; Cunningham 1992; O'Regan 1993; cf. McGuigan 1996). Bennett (1992) argues that culture in modern societies is defined less by a distinct series of artistic and intellectual practices, the ways of life of distinctive communities or social groups, or as a system for the structuring of meaning in a society, but rather in terms of "the specificity of the governmental tasks and programmes in which those practices come to be inscribed." (Bennett 1992a: 397) Within such a framework, policy becomes "not... an optional add-on but... central to the definition and constitution of culture" (Bennett 1992a: 397). This understanding of culture as "intrinsically governmental" has in turn been linked to an increasingly strategic role for discourses of citizenship as a basis for the engagement of cultural studies intellectuals with the political sphere...

This study asks the central question, ‘Are social entrepreneurs using foresight to create innovation based on triple bottom line sustainability measures?’ and ‘if so, how?’ Sustainability is the emergent criteria for evaluating many aspects of the social world, including corporate governance, health systems, economics, social welfare and the environment. All the while, innovation is one of the key factors in the constitution of our social worlds, be this legislative, organisational, social or technical change. Therefore, it appears that the drive toward sustainability should be coupled with an emphasis on innovation – in particular creating innovation toward sustainability. Yet unexamined assumptions exist behind such language. Sustainability is a concept within the context of ‘the future’, requiring one to question ‘what is the future’ – in essence a utilisation of the strategic capacity for foresight. Foresight, moreover, ranges from the tacit assumed personal foresight of the ordinary individual to the specialised foresight of the professional forecaster, scenario planner, or foresight practitioner.

The range of legal instruments informing how the Murray-Darling Basin (MDB)is managed is extensive. Some provide guidance; a number indicate strategies and policies; some assume the form of protectable rights and enforceable duties.What has emerged is a complicated and sophisticated web of interacting normative arrangements. These include: several international agreements including those concerning wetlands,biodiversity and climate change; the Constitution of the Commonwealth; the Water Act 2007 of the Commonwealth; the Murray-Darling Basin Agreement scheduled to the Act; State water entitlements stated in the Agreement; Commonwealth environmental water holdings under the Act; the Murray-Darling Basin Plan; water-resource plans under the Act or State or Territorial water legislation; State and Territorial water legislation; and water entitlements and water rights under State or Territorial water legislation.

Digital creatives are spread widely across the economy, and growing rapidly in number. New industries such as mobile applications (apps) development are creating new occupations and services, and transforming some older ones. Digital creatives are driving innovation and economic growth in these industries and service sectors. Digital technologies and processes are becoming increasingly important in virtually all spheres of creative work, as they are across the economy. And yet there is no broad agreement either in Australia or worldwide about the constitution of the digital creative grouping, and only limited understanding of both the role of creatives in the digital economy and innovation, and of the issues and challenges they face. Who are they? Where are they working? Where are their numbers growing? The answers to these questions will help to inform the development of policy and the fostering of an environment that promotes digital content and creativity.

There is a long and fundamental connection between rural place and the land. Whereas land is simply the foundation for the construction of towns and cities, whose urban culture and economy thrives on human ingenuity and industry that may have little direct attachment to the physical ground over which it occurs, historical discourses of rurality place the land at the heart of the rural economy and society. Rural people, such discourses hold, live on the land, work the land, tend the land and know the land. The land formed not only the base of the rural economy (as ‘a physical, tangible resource which can be ploughed, sown, grazed, built upon’ (Macnaghten and Urry 1998, 200)), but also shaped rural culture and the rural calendar, and contributed to the constitution of the rural character (see Bell 1994). As such, the land is central to rural sense of place.

Discussions of public diplomacy in recent years have paid a growing amount of attention to networks. This network perspective is understood to provide insights into various issues of public diplomacy, such as its effects, credibility, reputation, identity and narratives. This paper applies the network idea to analyse China’s Confucius Institutes initiative. It understands Confucius Institutes as a global network and argues that this network structure has potential implications for the operation of public and cultural diplomacy that are perhaps underestimated in existing accounts of Chinese cultural diplomacy. In particular, it is noted that the specific setup of Confucius Institutes requires the engagement of local stakeholders, in a way that is less centralised and more networked than comparable cultural diplomacy institutions. At the same time, the development of a more networked for of public cultural diplomacy is challenged in practice by both practical issues and the configuration of China’s state-centric public diplomacy system informed by the political constitution of the Chinese state.

Summary: This book explores the fascinating topic of heritage language learning, looking in particular at Chinese Australians' learning of Chinese. The author studies the investment, challenges and benefits of heritage language learning across varied contexts including school, work, home and in the community. The book investigates how Chinese Australians navigate and negotiate their Chineseness and how resources are used to support their learning. The book is based on a mixed methods study which uses Bourdieu's sociological theory, and offers implications for sociologists of language and education, Chinese heritage language learners and teachers, as well as language and cultural policy makers. Purpose This chapter discusses the constitution of Shared Services and the value of a consensual agreement of a definition for academe and practice. It explores the operating principles and services, the concepts of internal customer and internal service, and their importance for the practitioner and research communities. Methodology/approach This chapter employed a broad review of the literature to examine Shared Services. The research team used NVivo as a tool to create a database of key articles and books to analyze the key concepts and topics. Findings There is a lack of consensus on the definition of Shared Services in the research and practitioner community. Additionally, the concept of internal customer requires greater exploration and understanding within the context of Shared Services. How Shared Services provides competitive advantage to organizations is also not well understood. Research limitations/implications This discussion provides a challenge to the research community to focus on the contributions of shared services to business management theory. This requires a consensus that is currently nonexistent, to ensure the correct use of the terminology and model. Practical implications By establishing a clearer understanding of what is Shared Services, the academic and the practitioner community, in particular, will gain greater competencies on Shared Services to support change management programs during the implementation phases and minimize implementation costs by lowering organizational and people resistance. The variants in shared services terminology create confusion which is likely to result in ambiguity during implementation and have practical implications on governance, customers and service, benefits realization and performance. Originality/value of chapter This chapter addresses the lack of agreed definition of the term Shared Services and the role of the internal customer and consequent internal service delivery.
