Relatório EPE - Relatório de estágio em Educação Pré-Escolar: O presente relatório foi realizado no âmbito da unidade curricular Prática Pedagógica Supervisionada, inserida no Mestrado em Educação Pré-Escolar e Ensino do 1.º Ciclo do Ensino Básico, da Escola Superior de Educação do Porto, durante o ano letivo 2013/2014, atribuindo qualificação profissional no contexto de pré-escolar. Este documento pretende descrever e analisar o percurso formativo desenvolvido pela mestranda ao longo da sua prática pedagógica supervisionada, numa perspetiva reflexiva sobre a construção dos saberes profissionais para a Educação. Este percurso formativo comprometeu uma atitude investigativa, bem como a mobilização de saberes científicos e legais por forma a articular as vertentes de teoria e prática, perspetivando uma construção integrada dos saberes. A prática pedagógica foi sustentada numa perspetiva construtivista, atribuindo um papel ativo à criança na construção das suas aprendizagens. Esta baseou-se num trabalho de equipa cooperativo, o qual se concretiza através do debate e da partilha de ideias, entre os vários intervenientes da ação, como meio para a transformação da realidade educativa. Ao longo da prática foi, ainda, atribuído um papel fundamental à observação do contexto, sendo esta essencial para a compreensão e conhecimento pleno da criança. Em suma, todo o percurso formativo no qual está englobado a prática pedagógica, levou a uma problematização das questões emergentes da prática, desenvolvendo uma atitude indagadora e reflexiva. Apesar da significante contribuição para a aquisição de competências pessoais e profissionais, o percurso formativo deve ser assumido como uma construção contínua, fundamentado num princípio da aprendizagem ao longo da vida.

RESUMO - O cancro colorretal é um dos tumores mais comuns nos países desenvolvidos e um grave problema de saúde pública. Em Portugal constitui a terceira causa de morte por cancro em ambos os sexos e a segunda para cada sexo separadamente. A sua importância tem vindo a aumentar devido aos custos pessoais e sociais, surgindo internacionalmente como a segunda doença oncológica com os custos económicos mais elevados. No contexto atual, onde os gastos continuam a aumentar e os recursos são limitados, é importante tornar acessível aos decisores políticos o valor dos custos do cancro do cólon, para comparar opções para a prevenção e tratamento desta doença, no momento de afetar os recursos e financiamento do cancro. O objetivo do estudo é medir os custos diretos do tratamento do cancro do cólon na região do Algarve no ano de 2007. Para além da caracterização sociodemográfica e clínica dos doentes, pretende-se relacionar os custos das diferentes tipologias de diagnóstico e tratamento com os estádios da doença, com a idade e com o sexo. Propõe-se um estudo retrospetivo, analítico, transversal, que segue a abordagem custos da doença baseada na prevalência, adotando a perspetiva dos serviços de saúde. A principal fonte dos dados é a plataforma do ROR-Sul, extraindo-se a população constituída por todos os doentes com diagnóstico de cancro do cólon entre 1 de janeiro de 2007 e 31 de dezembro de 2007, residentes no distrito de Faro (n=170). Para a valorização dos custos recorre-se às Portarias que regulam as tabelas de preços dos serviços do Sistema Nacional de Saúde, à contabilidade analítica dos hospitais e ao Infarmed. Os resultados serão analisados através do Statistical Program for Social Sciences (SPSS) versão 20. De forma a verificar a existência de diferenças estatísticas, em termos de médias e da existência de relações, entre as variáveis sociodemográficas e clínicas utilizaram-se vários testes. Consideramos que este estudo será um importante ponto de partida para posteriores análises económicas completas, em termos dos seus custos e suas consequências, nomeadamente a realização da análise custo-efetividade de programas de prevenção primária e secundária do cancro do cólon.

Introdução É missão do farmacêutico hospitalar aumentar a segurança e qualidade de todos os processos associados à utilização do medicamento1,2. Os erros de medicação são a principal causa de eventos adversos preveníveis, comprometem a confiança dos doentes nas instituições prestadoras de cuidados de saúde e aumentam os custos3. O presente trabalho centra-se na problemática da identificação unitária das formas farmacêuticas orais sólidas (FFOS) a propósito de duas histórias actuais de segurança com medicamentos no HSJ: paracetamol 500mg comprimidos e de acetilcisteína 600mg comprimidos efervescentes. Objetivos Evidenciar a intervenção dos Serviços Farmacêuticos (SF) na garantia da segurança das FFOS no contexto das exigências das Boas Práticas de Farmácia Hospitalar e dos constrangimentos na selecção e aquisição de medicamentos. Desenvolvimento Os SF são responsáveis pela selecção e aquisição de medicamentos com a máxima qualidade, para o suprimento das necessidades terapêuticas dos doentes do Centro Hospitalar de Lisboa Central (CHLC)4. A indústria farmacêutica não disponibiliza a totalidade dos medicamentos em embalagem unitária devidamente identificada. Os hospitais públicos têm a obrigatoriedade de adquirir os medicamentos que constam no catálogo dos Serviços Partilhados do Ministério da Saúde (SPMS), sendo critério de adjudicação único o preço mais baixo5. Muitos destes medicamentos não cumprem os requisitos de identificação adequados para a prevenção de erros de medicação e garantia da segurança do doente. Para colmatar esta lacuna e promover a segurança do circuito do medicamento, os SF reembalam os medicamentos disponibilizando-os de forma individualizada adequadamente identificados. Metodologia Pesquisa e análise bibliográfica. Recolha, através do Sistema de Gestão Integrada do Circuito do Medicamento (SGICM), dos dados de consumo de paracetamol 500mg comprimidos e de acetilcisteína 600mg comprimidos efervescentes dos anos 2014/2015. Recolha dos dados de produção da unidade de reembalagem dos SF do Hospital de São José de FFOS desde Janeiro 2011 a Agosto de 2015. Conclusões Verifica-se um aumento continuado do número de FFOS reembaladas ao longo do período analisado. A capacidade instalada da unidade de reembalagem de FFOS é limitada. Idealmente a indústria farmacêutica deve responder efectivamente às necessidades de qualidade e segurança na utilização dos medicamentos que coloca no mercado. A inclusão no catálogo dos SPMS deve exigir a completa identificação unitária das FFOS; senão, deverá ser ponderada a ampliação da capacidade da unidade de reembalagem das FFOS dos SF para garantir a segurança no circuito do medicamento. RESUMO - As descobertas realizadas na área da genética levaram ao desenvolvimento de aplicações práticas, entre as quais se destacam os testes genéticos, cujas aplicações em saúde tiveram um impacto considerável na prática clínica. Uma das consequências deste desenvolvimento foi o nascimento de um novo mercado na área da saúde, o mercado dos Testes Genéticos de Venda Direta ao Consumidor (TGVDC). Este mercado está associado a questões do foro ético e legal muito específicas e importantes. Através da realização do presente trabalho de projeto pretende-se analisar e discutir as principais questões éticas e legais suscitadas pelos TGVDC, com maior enfoque no mercado português e na aplicação do enquadramento ético-legal em vigor em Portugal. No que toca à metodologia, no âmbito do presente trabalho de projeto, realizou-se uma análise da literatura científica e ético-legal do tema em estudo. Posteriormente realizou-se uma entrevista exploratória, a uma personalidade de reconhecido mérito na área da genética humana, a fim de compreender quais as principais questões suscitadas pelo mercado de TGVDC. Seguidamente realizou-se um mapeamento das entidades que operam no mercado de TGVDC, seguido de um inquérito a essas mesmas entidades, a fim de avaliar as características do serviço oferecido em Portugal e a aplicação do regime normativo ético-legal em vigor. Verificou-se, como era expectável, que o mercado português de TGVDC apresenta reduzida dimensão quando comparado com outros mercados a nível internacional, designadamente o mercado norte-americano que é, claramente, o mais desenvolvido nesta área. Os resultados obtidos apontaram ainda, no que toca à realidade portuguesa, para a pertinência de questões discutidas na literatura analisada. Em suma, apesar das limitações inerentes à realização de um projeto pioneiro e ambicioso num curto espaço de tempo, as conclusões deste trabalho permitem extrair conclusões importantes acerca do mercado português de TGVDC, sob a perspetiva ético-legal, bem como efetuar recomendações importantes para futuros estudos nesta área.

Assuming a concrete dispute that has no legal answer in the Portuguese civil statutes, this article attempts to discover the right solution according to existing doctrinal and legal materials. We begin with a brief analysis of the answer, as it would be provided by the modern theory of law to said dispute. This answer will then be compared with the result that is found in accordance with Article 10(3) of the Portuguese civil code (provision on legal gaps).

This study specifically addresses the situation of minority shareholders after the transfer of control in an listed company. The various underlying interests and reasons that shareholders have for investing in a company can demonstrate shareholders’ reasoning for taking radically different positions on issues relating to the transfer of control of the referred company. This study analyses the current legal system in Portugal and in the European Union in order to assess whether, in the event of a takeover bid of a listed company where there is a transfer of control, minority shareholders have the same appraisal rights as other shareholders to sell their shares and leave the company. The study then examines the European Court of Justice decision on whether a general principle of equal treatment of minority shareholders exists upon a transfer of control (Audiolux) and the Portuguese Securities Market Commission decision regarding the delisting of Brisa - Autoestradas de Portugal, S.A. based on the principle of investor protection. The study concludes that although the principle of equality amongst shareholders has made progress in the European legal system e.g. it is laid down in Directive 2004/25/EC of 21 April 2004 on takeover bids and the Portuguese Securities Market Code, there is also a need for further improvement, which can be accomplished by allowing minority shareholders to exercise an appraisal right in similar unregulated situations.

Currently, Angola portrays a notorious economic growth and due to recent innovative legislations, it has become the major investment attracting pole, especially in Sub-Saharan Africa, having, thus, an extraordinary potentiality for a rapid and sustainable development, likely to place her in outstanding positions in the world economic ranking. Yet, such economic growth entails demanding levels of intensive investment in infrastructure, what has been reported of the Angolan Government to be unable to respond to, save if recurring to very high index of external debt, poisoning, in this way, the future budgeting of the country. Due to these infrastructure investment shortages, the cost of production remains highly onerous and the cost of life extremely unaffordable. On this account, the current study disserts about the contract of Project Finance; an alternative finance resource given as a viable solution for the private financing of infrastructure, aiming to demonstrate that such contractual figure, likewise the experience of several emerging economies and others, is a contract bid framework to take into account in today’s world. It refers to a financing technique – through which the Government may satisfy a common need (for example, the construction of a public domain or public servicing), without having to pay neither offer any collateral – based on a complex legal-financial engineering, arranged throughout a coalition of typical and atypical agreements, whereby it is mandatory to look back at the basic concepts of corporate law. More than just a simple financial study, the dissertation at stake analyses the nature and legal framework of Project Finance, which is a legally atypical and innominate contract, concluding that there is a relevant need for regulating and devoting a special legal regime in the Angolan jurisdiction for this promising legal form in the contemporary corporate finance world.

This report will describe the activities undertaken during my internship at the Personnel Department (DPE-UPE4.1) in Caixa Geral de Depósitos (CGD), Lisbon, between September 22, 2014, and February 28, 2015. I consider that it is important to note from the outset i) that the subject of my training was suggested by my supervisor in the DPE and accepted by me; and ii) that the internship consisted essentially of carrying out research and information gathering into the different social systems that coexist within the bank and the application of each legal system in solving concrete situations of the CGD employees. The research and analysis of information was important not only for my study but for the CGD itself, as it enables the department to have such an important matter, full of specific characteristics, condensed into a single document, i.e. this report. This is a complex reality. The various welfare systems differ according to the contractual agreement linking the employee to the employer at the date when the labour contract is signed, and also the unique/singular characteristics of the CGD. In the early stage I started by trying to understand the financial institution and its organization and role and the department where I worked. So I analyzed the CGD Statutes and the legal measures that crystallized the scheme for its employees and I also researched its domestic and international operations. The first month was devoted to the research and analysis of such legislation to understand the creation of the CGD and its path to date. In the second and third months I studied the legal social systems that are applied to different groups of CGD workers. This period was quite important to identify and understand the differences between those regimes of CGD employees as well as the procedure inherent in each case. I highlighted the non-implementation of “the social protection regime of convergence” to the workers of this institution; the differences regarding the allocation of sickness subsidies paid to workers who belong to Social Security and CGA contributors, as well as the enforcement of internal rules to all the workers when a work-related accident happens. Then I focused on to assessing and examining external legislation and several internal regulations in order to obtain solutions to questions raised and situations involving by the workers, in order to understand how the DPE solves these situations. Over the last three months of internship, after this more theoretical work, I began the analysis of concrete situations involving employees carrying out their duties in Portugal and abroad. Some of these situations had been received by the department before the beginning of my internship and others over this period. When I was “working” in the DPE I analyzed “cases” that had been solved and some others without a final solution because they were still in courts. As for the last ones (new cases) I was able to follow their assessment and sometimes their outcome. Some of them became study cases for me. Over these five months of my internship, several cases were analyzed and discussed by legal experts of DPE in which I could participate. I always worked hard. I know that this action contributed to elucidate me about the treatment of the issues, and allowed me to have a direct contact with some workers and be part of a dynamic work team. For these reasons, my internship report is not merely descriptive of activities. It consists of an analysis of rules (legislation) and a regulatory framework of activities and it is also a description of several specific situations solved or in a solution process. Through this work I intend to make known the particular reality of a modern Portuguese financial institution not only because of its importance in our country but also such a large number of employees work here (in Portugal and abroad). I should add that throughout my internship I was allowed to attend conferences, within the scope of the bank in order to get a broader view of some issues related to the daily life of the DPE and the CGD. So, I participated in I Jornadas Bancárias and the Conferência Internacional do Contrato a Termo, given that the CGD is a bank and the DPE deals with legal and labour relations.

Currently, gambling doesn’t have a strong social disapproval. However, the phenomenon of gambling raises several issues related to property protection, compulsive gambling, the youngest personality development, the State taxes and social development measures, which some authors believe to be the protected legal interest in the criminalization of illegal gambling exploitation. However, the authorization system, and because several of those interests, constitutionally protected, are also violated in the authorized gambling places, it appears that the legislator intended to define the legal interest as the order and public tranquility. The purpose of this study is to understand what is protected with the illegal gambling exploitation. This will involve defining the concept of exploitation and the concept of gambling. Still, we will try to know if there are situations without ethical and social resonance and what their consequences.

After reading about the current legal regime regarding the foreign workers we realize the high relevance this area has, nevertheless the research about these issues has been lying somewhat stagnant in Portugal, particularly as it refers to non-EU citizens. At a time when we witness a progressive increase of the migratory movements we propose ourselves, in this study, to understand more clearly the current legal system in the matter of foreign worker rights, and, from a pragmatic point of view, to question some choices of the legislator in order to understand if these serves to the best protection of the rights and duties of the foreign workers and the new situations arising from this phenomenon, considering any system weaknesses. However, we realize that much remains to be done in this field, both in terms of true equal rights between nationals and foreigners, and either as what regards to an effort to harmonize these issues by the States, which tend to favor national sovereignty and its economic interests rather than protecting the fundamental rights of workers.

In an increasingly globalized society, the crime appears as a reality that crosses borders. Globalization has potentiated the emergence of new forms of crime, which have been the subject of more interventional, particularly in terms of political, judicial and police authorities as well as civil society approaches. The media allow rapid expansion of criminal methodologies, which aggregate to the ease of movement of itinerant criminal groups, increases the opportunities for the continuation of the practice of criminal offenses, threatening, increasingly, the tranquility and safety of populations. Criminal organizations are characterized by their complexity, thus contributing to the difficulty in combat, by police and judicial authorities, forcing rapid adaptation to new political and criminal reality, particularly at the level of institutional cooperation, national and international, as exemplified by the creation of the "European Area of Freedom, Security and Justice" and new agencies in the field of police cooperation. It was intended with this paper to answer the central question: Is it possible to define a concept of Itinerant Crime in the European regulatory framework (Police and Judiciary)? To fulfill this aim, we performed the characterization of the concept of itinerant crime including itinerant criminal group, we analyzed the work that is being done by the authorities, police and judiciary, in order to contain the phenomenon. Finally, we studied type of existing cooperation at European level between the Member States and the authorities with responsibilities in this area. At the end, we conclude that efforts are being made towards the enhancement of operational, police and judicial cooperation, between the competent authorities of the European Union by combating this phenomenon. Define, and also proposed, a unique concept of Itinerant Crime, in order to be included in the legal standards, in order to facilitate research, in particular to better fit the itinerant crime and assist the prosecution of offenders.

Images have gained a never before seen importance. Technological changes have given the Information Society extraordinary means to capture, treat and transmit images, wheter your own or those of others, with or without a commercial purpose, with no boundaries of time or country, without “any kind of eraser”. From the several different ways natural persons may engage in image processing with no commercial purpose, the cases of sharing pictures through social networks and video surveillance assume particular relevance. Consequently there are growing legitimate concerns with the protection of one's image, since its processing may sometimes generate situations of privacy invasion or put at risk other fundamental rights. With this in mind, the present thesis arises from the question: what are the existent legal instruments in Portuguese Law that enable citizens to protect themselves from the abusive usage of their own pictures, whether because that image have been captured by a smartphone or some video surveillance camera, whether because it was massively shared through a blog or some social network? There is no question the one's right to not having his or her image used in an abusive way is protected by the Portuguese constitution, through the article 26th CRP, as well as personally right, under the article 79th of the Civil Code, and finally through criminal law, articles 192nd and 193rd of the Criminal Code. The question arises in the personal data protection context, considering that one's picture, given certain conditions, is personal data. Both the Directive 95/46/CE dated from 1995 as well as the LPD from 1998 are applicable to the processing of personal data, but both exclude situations of natural persons doing so in the pursuit of activities strictly personal or family-related. These laws demand complex procedures to natural persons, such as the preemptive formal authorisation request to the Data Protection National Commission. Failing to do so a natural person may result in the application of fines as high as €2.500,00 or even criminal charges. Consequently, the present thesis aims to study if the image processing with no commercial purposes by a natural person in the context of social networks or through video surveillance belongs to the domain of the existent personal data protection law. To that effect, it was made general considerations regarding the concept of video surveillance, what is its regimen, in a way that it may be distinguishable from Steve Mann's definition of sousveillance, and what are the associated obligations in order to better understand the concept's essence. The application of the existent laws on personal data protection to images processing by natural persons has been analysed taking into account the Directive 95/46/CE, the LPD and the General Regulation. From this analysis it is concluded that the regimen from 1995 to 1998 is out of touch with reality creating an absence of legal shielding in the personal data protection law, a flaw that doesn't exist because compensated by the right to image as a right to personality, that anyway reveals the inability of the Portuguese legislator to face the new technological challenges. It is urgent to legislate. A contrary interpretation will evidence the unconstitutionality of several rules on the LPD due to the obligations natural persons are bound to that violate the right to the freedom of speech and information, which would be inadequate and disproportionate. Considering the recently approved General Regulation and in the case it becomes the final version, the use for natural person of video surveillance of private spaces, Google Glass (in public and private places) and other similar gadgets used to recreational purposes, as well as social networks are subject to its regulation only if the images are shared without limits or existing commercial purposes. Video surveillance of public spaces in all situations is subject to General Regulation provisions.

Foundations’ importance in the actual economy has been increasingly recognized. This work project assesses the impact of the new legal framework in the foundations’ financial reporting and offers a financial statement analysis of the Portuguese foundational sector. It unveils links between financial performance and characteristics of foundations, and profiles foundations in three clusters, each with different approaches to disclosure, volunteer workforce, and taxes. It is concluded that foundations are not respecting the benefits trusted to them, calling for a tighter control to their financial reporting, and that even though that slowly, the sector is expected to continue growing.
