This dissertation deals with the constitutional limits on the exercise of patent rights and its effects on the oil, natural gas and biofuels. Held with the support of ANP / PETROBRAS, It seeks to show how the law will limit the exercise of industrial property, based on a reinterpretation of private law by the constitutional development perspective . Today it is a fact that Petrobras, a Brazilian joint venture, has the latest technology in various sectors of the oil industry, and is one of the highest investments in developing new technologies. The overall objective of this thesis is to establish the relationship between the public interest of the Petroleum Industry, Natural Gas and Biofuels and constitutional limits to the free exercise of patent rights, then confirm or refute our hypothesis that Article 71 on Industrial Property Law is contrary to the existing objectives in Article 3 of the Constitution of the Federative Republic of Brazil. The research aims to examine the relevant aspects of the legal nature attributed to IPGN constitutionally confronting the constitutional limits on the free exercise of patent rights, with the purpose to outline the state of the performance limits in the regulation of the economy, in particular the application of feasibility limitations on the right of property in favor of national interest on the strategic energy industry. The aim is to confront the fundamental rights to property and economic development, against the public interest, limiting these first. As to the objectives, the research will be theoretical and descriptive and harvest of industrial property, respect the possible impact of regulatory standards and limiting the right of ownership in the oil industry. To establish how the state will mitigate the intellectual property right, we discuss, at first, a definition of public interest from the general theory of state and sovereign character in order to establish a new concept of national interest and popular interest, which will in turn the definition of our concept of public interest. In the second phase, will be addressed the issue of industrial property rights and how to will be free exercise thereof, in the constitutional sphere, infra, and demonstrating the use of industrial property rights with examples of market and IPGN . After situating the industrial property rights in the constitution and national legislation, establish their relationship with the national and regional development, will be addressed in this chapter in particular the patent law, as most usual form of intellectual property protection in IPGN. Used a study highlighting the number of patents in the area of the analyzed industry, demonstrating with hard data the importance of a sector for industrial development. The relationship between the social function of intellectual property and the constitutional objective of development was characterized to demonstrate the strategic nature of oil to Brazil in the national and international scene, and put into question the hypothesis of the research which provides that even with large investments the lack of legal certainty in the sector turns out not to have a considerable volume of investment as it could.

The Federal Constitution, in Article 1, sections III and IV, lifted the work as the foundation of the Federative Republic of Brazil, including work as a social guarantee in Article 6, listing in its Article 7 minimal guarantees role with respect to social rights of workers. Although elevated to constitutional rights, these social rights of workers have in the judicial interpretation of the characteristic elements of the employment relationship, sometimes a mismatch with the legal and constitutional order, when, in deciding not ponder such elements, causing damage economic and social benefits to all workers, thus affecting the very constitutional basis of worker protection, there is therefore situations in which there must be part of unavailability of rights by the employee. Therefore, identifying the characteristic elements of employment, means allow immediate legal finding about possible illegality perpetrated by the employer, precisely because the sentence recognizes be merely declaratory noting, therefore, the elements that make up the juridical system normative in order to establish the characterization of employment in step with the effective observance and guarantee of social rights and therefore the employer's performance limiter as pertains to hiring and employee dismissal. This point is it's main element of this work, which is fundamental for the exegesis of the theme to limit the autonomy of the will. There is no denying, therefore, the need to extend the effects of these guarantees in the employment contract. In this context, therefore, jumping the guarantees of employees, embodied in particular in the Consolidation of Labor Laws, and especially in the Federal Constitution and international protection instruments to ensure the fundamental right to secure employment relationship, where technological advancement, social and economic, reflect directly, such as the parassubordinação, and claiming more and more systematic resolutions, especially when evidence gaps' values, which elevate the debate about the need for increased use of precedents of order to support the judgments, often beset with aspects of unconstitutionality, all in compliance with the integration of standards, seeking legal enforcement of this bond and providing legal certainty, there emerged, so the essence of the theme: discuss to what extent the distortion of employment limits the effectiveness of social rights and what its legal effects, since the constitutional standard for social guarantees protects equally worker admission.

The creation of the National Council of Justice (CNJ) through the Constitutional Amendment nº 45/2004, derived from countless gaps in Brazilian law, mainly relating to procedural delays, ineffectiveness of judicial decisions, and the lack of mechanisms that enable, effectively, disciplinary accountability of judges. The council is constitutionally designed as a member of the Judiciary, which has administrative nature and laid assignments in art. 103-B, § 4 of the current Constitution, among which is to edit regulations to instrument its performance. However, since it came into force, the amendment raised extensive discussions, linked in particular to the constitutionality of the CNJ, which was made through the direct action of unconstitutionality nº 3367, against the alleged violation of the principles of separation of powers and federative form, as well as the limits of its regulatory powers, as has fanned out in ADI nº 3823/ DF, this one dealing on Resolution nº 07, which regulates the seal of nepotism practice in the judiciary. However, despite the Supreme Court has already pronounced on the matter, recognizing the constitutionality of the council, as well as the resolution already said, the debate is in a state of latency, and may erupt again with each new manifestation of regulatory CNJ, given the lack of agreement between doctrine and jurisprudence around the constitutional treatment of its regulatory powers. In this context undeniably reflection on the definition of the regulatory power of the CNJ, presents itself as extremely relevant, and current, in particular in the ambience of the Constitutional Rule of Law, where he strives for legal certainty and consolidation of regulatory institutions. So that it could reach a satisfactory result, skilled at resolving the problems raised, the present study analyzed the reasons that gave rise to the creation of the CNJ, demonstrating their indispensability, but also sought to characterize the status of their administrative and constitutional body, noting finally, the compatibility of its regulatory activities to constitutional principles. From this perspective, we adopted the deductive method and carried out research and bibliographic nature documentary.

This work analizes the financing of Health Policies on the state of Rio Grande Do Norte, starting at the presumption that SUS is “Bombarded” by fiscal ajustments, as a neoliberal strategy to face capital crises.The trafectory of the financing of SUS demands the comprehension of two principles which are, in essence, contradictory: the “principle of universatility”, which is caracterized by the uncompromising defence of the fundaments of the Sanitary Reform, and the “principle of containment of social costs”, articulating the macroeconomic policy that has being developed in Brazil since the 1990s and which substantiantes itself on the 2000s.This last defends the reduction of the social costs, the maintanance of primary surplus and the privatization of public social services. Considering these determinations, the objective of this research constitues in bringing a critical reflection sorrounding the financing of the Health Policies on the state of Rio Grande do Norte, on the period from 2004 to 2012.Starting from a bibliografic and documentary research, it sought out to analyze the budget planning forseen on the Budget Guideline Law (LDO) and on the Multiannual Plans (PPA), investigating the reports of the Court of Auditors of the State of RN and gathering information about expenses with health, available on the System of Information About Public Budgeting in Health (SIOPS).The Analises of the data obtained, in light of the theoretic referece chosen, reveals trends in the public budget setting for health on the State of Rio Grande do Norte, which are: a tiny share of investment expenditure on health, when compared to other expenses, the amount used in daily fees and advertising; the high expense in personnel expenses, especially for hiring medical cooperatives;the strong dependence of the state on revenue transferences from the Union; the aplication of resources in actions of other nature considered as health, in exemple of the expenditures undertaken by the budgeting unit Supplying Center S/A (CEASA) on the function of health and subfunction of prophylactic and therapeutic and on the Popular Pharmacy program. Since 2006, expenses refering to Regime Security Servers (RPPA) on the area of health also have being considered as public actions and services in health for constitutional limit ends, beyond the inconsistencies on the PPAs with the actions performed efectively.

This master thesis aims to research the tension established between the judicial review and democratic theory which was always present in the constitutional doctrine of separation of powers. In this regard, the expansion of the Brazilian constitutional jurisdiction checked after the occurrence of the Federal Constitution of 1988 and the inertia of the Legislature in disciplinary relevant legal aspects of Brazilian society contributed to a hyperactivity of the Supreme Court. However, in a complex society of context, as is the Brazilian society, there are contained demands and political controversies that hardly would be well represented or resolved through the action of the Court of ministers at the expense of other government bodies. Among the supremacy of Parliament and the legitimacy deficit of these magistrates, is the constitutional text and the social fabric that makes this legal status of the political. Participatory democracy established by the guidelines of the Federal Constitution requires this perspective when the Supreme Court acting in place of concentrated constitutionality control. In a plural society, there is no reason to get rid of state decision moments popular participation. Lack the Supreme Court, this time, the democratizing perception that the institute brings to the interior of the Court, as state determination of space in which to come together and meet the aspirations of society and state claims. The dissertation investigates thus the possibility of amicus curiae Institute serve as a mediator of the democratic debate, to assist the Supreme Court in the preparation of the decision is, historically, that which is of greater legitimacy, from the perspective of a theory participatory democracy. Analyzes, likewise, the unfolding of abstract judicial review in the context of Brazilian law. Proposes, incidentally, a rereading of the separation of powers, with the call for the Judiciary be careful not to become the protagonist of national political decisions. It maintains, finally, that procedural opening the interpreters of the constitution, through the amicus curiae Institute, shows up as able to decrease the legitimacy deficit in the performance of the Brazilian Supreme Court.

Research on Legal Deontology dedicated to theoretical and applied ethics on judicial conduct grounded in legal principles and rules set out in the Constitution of the Federative Republic of Brazil and the Organic Law of the National Judiciary, also contemplating propositional instruments covered by the constitutional system, which conveys behavioural paradigms inserted in the Bangalore Principles of Judicial Conduct, in the Universal Statute of the Judge and in the Latin-American Code of Judicial Ethics, as well as highlight the influence of those instruments in the Brazilian Ethical Code of the Magistrates and in the official complementary training of judges in charge of Judiciary Schools. The study provides the theoretical influxes of moral norm, passing by behavioural social norm to consolidate the ideal standards of judicial conduct into legal standards and related instruments. The Legal Deontology directed to the ethical judicial conduct is confronted with the stereotype that society expressed in relation to the judge's person, who is the political agent that interprets the law for making decisions which directly influences the realization of access to justice, that is constitutionally guaranteed to all. Core values inserted in the constitutional system intended to discipline the judicial conduct are presented and analysed under a critical view, since they are enclosed in prescriptive language that conveys behavioural aspects open to interpretation and which compliance is revealed as a proposition focused on promoting a better solution of interest’s conflicts under the responsibility of those who constitute the distinctive corporation of the Judiciary. The theme’s contextualization also focuses on applied ethics, based on the approach of normative and propositional instruments of deontological content, still focusing on the study of real cases examined by the Brazilian National Council of Justice, as part of its correctional goals.

Many changes have taken place in contemporary society causing impacts in its different sectors, making it much more complex and insecure than in past times. The alteration on the decision-making system of the Brazilian society is among the main changes today. The post-modern context contributed to the occurrence of the transfer of state power of the Legislative and Executive Powers to the Judiciary Power, specifically to the Federal Court of Justice, leading to an expansion on the actuation range of this institution mainly through the exercise of the constitutional jurisdiction. This has caused a crisis of legitimacy in society once the Court will now decide the political and social fundamental issues. In this scenario, the Direct Action of Unconstitutionality n° 3937/SP and n° 3357/RS are highlighted and both are being tried by the Supreme Court. Such emphasis is given, since it is a matter of high complexity and social repercussion that will be decided by a legal institution and not a political one. Thus, this work aims to analyze the role of the Supreme Court in the context of contemporary society on the trial of complex and controversial cases, particularly on the trial of Direct Action of Unconstitutionality n° 3937/SP and n° 3357/RS. This study has noticed that due to the post-modern context the majority of the Supreme Court Ministers tend to base their votes in constitutional principles and no longer limit themselves to a formal review of the constitutionality of laws, which indicates a substantialist approach. Moreover, it can be noticed the deliberative potential of the Court as well as the influence of the post-modern features, such as risk, uncertainty and insecurity on the elaboration of the Minister‟s votes. Therefore, sometimes, such as the case in study, the Supreme Court has acted as a technocratic agent in Brazilian society once fundamental political and social decisions for society especially when it comes to complex and controversial cases are being taken by the Supreme Court, which is composed by “Law technicians” and such decisions are mainly based in technical data and scientific studies. For the accomplishment of this work, it has been adopted the inductive approach and monographic procedure method and the bibliographical and documentary research technique.

Ao longo desta dissertação, será apresentada uma investigação qualitativa no domínio da perceção dos reclusos e profissionais sobre a saúde, do Estabelecimento Prisional de Santa Cruz do Bispo, procurando compreender o fenómeno. Pretende-se explorar os diferentes pontos de vista sobre a saúde, incluindo, cuidados e procedimentos por parte dos reclusos e profissionais, analisar e compreender a experiência do recluso quanto ao atendimento das suas necessidades e a sua relação com o profissional, analisar a formação e a equipa técnica no auxílio à saúde, compreender a perceção do técnico e do recluso em relação à saúde e até que ponto isso poderá afetar a forma como são concedidos os cuidados e, por fim, analisar e compreender as representações sobre a saúde na área preventiva e interventiva. Na conceção da dissertação, realizou-se duas entrevistas (uma aplicada aos reclusos e outra aplicada aos profissionais de saúde) semiestruturadas para a exploração e compreensão do tema. Foi esperado, com estas entrevistas, que todos os entrevistados reportem as experiências vividas, permitindo obter resultados sobre os objetivos em análise. Assim, ao longo desta dissertação, poder-se-á refletir sobre as possíveis aplicações práticas no futuro e as potencialidades e limitações do sistema de saúde do Estabelecimento Prisional de Santa Cruz do Bispo.

Introdução: A Monarquia Constitucional, de 1821 a 1910, funcionou com seis Câmaras de Representantes. A pergunta é: o que discutiam as elites, nestes palcos, relacionado com a enfermagem? Através de descritores relacionados com enfermagem, identificámos nos diários das sessões, em todo o período, 1317 páginas com referência a enfermagem. O ano 1896 mostrou a frequência mais elevada, 89 entradas. Nesse ano, funcionava a Câmara dos Pares do Reino (CPR) e a Câmara dos Senhores Deputados da Nação Portuguesa (CSDNP). Objectivos: Identificar os assuntos tratados nas Câmaras de Representantes durante a Monarquia Constitucional, relacionados com a enfermagem, enfermeiros e enfermarias, no ano 1896, ano de frequênciamais elevada das citações nos diários das sessões, verificado em estudo prévio.Descrever, analisar e enquadrar os assuntos encontrados.Verificar se existem diferenças nos assuntos e na sua abordagem nas duas câmaras em funcionamento, dos Pares do Reino e dos Senhores Deputados da Nação. Metodologia: Levantamento e análise de fontes diretas, segundo uma metodologia de análise histórica. Através dos descritores, enfermeiro(s), enfermeira(s),enfermagem, enfermaria(s), pesquisa nos diários das sessões das câmaras de representantes em funcionamento no ano 1896, localizados no site da Assembleia da República. Levantamento das páginas sensíveis aos descritores. Leitura e análise das problemáticas e seu enquadramento diacrónico e sincrónico. Identificação dos temas e análise em pormenor das suas ligações e do seu contributo para a história de enfermagem. Num processo de exame do passado, construção mental desse exame e comunicação desse resultado. Resultados: Em 1896 encontrámos 89 entradas, 58 páginas dos diários da CSDNP e 31 dos diários da CPR. Na distribuição numérica das entradas pelos descritores verificámos a preponderância institucional sobre os descritores pessoais, para a CPR 21 em 31 e na CSDNP 38 em 58. Na CPR os assuntos de enfermagem ocuparam cinco dias de sessões. Quatro relacionados com a problemática dos delinquentes alienados e da construção de uma enfermaria anexa à Penitenciária de Lisboa. Outra sessão ocupou-se com a reorganização geral dos serviços de saúde do ultramar. Na CSDNP registamos a presença em oito dias, três com o assunto delinquentes alienados e construção de enfermaria, um com a reorganização dos serviço de saúde do ultramar, onde se estipula formação, funções, organização e vencimentos, noutro dia, uma representação dos empregados dos HUC mostrando seu descontentamento, noutro a cedência de instalações para Hospital da Misericórdia de Elvas, e por fim a organização de enfermarias nos barcos da linha Lisboa - Ilhas. Conclusões: A existência de enfermarias anexas aos estabelecimentos prisionais responde ao imperativo de direito dos alienados/inimputabilidade. A reorganização dos serviços de saúde do ultramar contabiliza enfermeiros, problematiza as irmãs hospitaleiras, dá conta de maqueiros. Temas comuns às duas câmaras. Em 1896, elites, nas Câmaras, realçam e discutem, relacionado com enfermagem e enfermarias, os seguintes aspectos: política de saúde (direitos dos alienados; ocupação do espaço ultramarino; higienismo); institucionais (enfermarias para inimputáveis; organização de serviços no ultramar; melhoria de instalações hospitalares; enfermarias em barcos); disciplinaridade (formação especifica para o ultramar); profissionalidade (embrião decarreira; funções e vencimentos; polémica com irmãs; manifestação de descontentamento).

Everyone has a right to health and the State’s duty is to provide it. SUS (unified health system) main principles are universalization, integrality and equality which are based on the decentralization, regionalization and hierarchization directives and shows the importance of a territorial perspective for planning healthcare actions. Decentralization was the strategy chosen to implant SUS, since municipalities were in charge of providing and organizing the municipal healthcare services. Nevertheless regionalization, that’s to say service, institution and practice integration, was not performed satisfactorily, thus jeopardizing the health system decision making process and causing disputes between municipalities over financial resources instead of developing an interdependent and cooperative net. This way, it is important to analyze if health regionalization has a good potential for being used as public governance tool. The present study aims at giving answers to the following research problem: What are the contributions of regionalism to the State of Paraná public governance applied to health? Besides that, it also aims at assessing the State of Parana health regionalization to identify healthcare gaps and help the State actions through public governance principles applied to healthcare. Therefore, the study used a quantitative-qualitative, exploratory and descriptive research, plus secondary data concerning bibliographic and documental research. The present study analyzed the current hospital bed distribution by compared to the ideal distribution allowing the identification of healthcare gaps in the regional healthcare centers, besides considering medical specialties in the State of Paraná. The study conclusion is that health regionalization is an important tool for reducing healthcare gaps concerning hospital beds permitting the use of seven to ten public governance principles applied to healthcare, as established in the present study, and shows health regionalization is an important pubic governance tool.

A saúde e o bem-estar dos adolescentes são hoje evidenciados como determinantes do desenvolvimento humano, a afetividade, a formação de personalidades moral e socialmente sólidas relativamente à sexualidade, passam por atitudes pedagógicas, particularmente na adolescência, porque podem influenciar a saúde (Moura 1992). Promover a compreensão da sexualidade é tão imperativo, que seria inconcebível deixar ao acaso (Young 1995; Prazeres 1998). Se este processo adolescente decorrer de forma saudável, a sexualidade evoluirá sem grandes receios e ansiedades (Sampaio 2006). Metodologia: Quantitativa, amostra aleatória composta por 1735 enfermeiros que exerciam em 226 centros de saúde de Portugal. Colheita de dados feita por questionário, respeitando as considerações éticas. Resultados: Dos enfermeiros (67,3%), considera que a escola não lhe proporcionou formação sobre sexualidade. Enfermeiros dos Açores (56,1%), Madeira (38,4%) e Sub-regiões Saúde Viana Castelo (48,8%), Porto (41,6%), Lisboa (35,4%), Guarda (34,7%), Castelo Branco (32,7%) apresentam percentagens superiores à média relativamente à formação sobre sexualidade. Análise replicada às Regiões de Saúde, permite inferir que os enfermeiros do Norte (36,3%), Açores (56,1%) e Madeira (38,4%) sugerem ter recebido formação sobre sexualidade. Discussão: Enfermeiros com formação sobre sexualidade, têm idades entre 22-30 anos. Da análise estatística (p<0,01) podemos inferir que a formação sobre sexualidade dos enfermeiros, não é independente da escola frequentada, nem da Sub-região (p<0,001) e Região de Saúde (p<0,001) onde trabalham Enfermeiros com 22-30 anos têm 2,736 vezes mais probabilidades da escola lhes ter proporcionado formação sobre sexualidade que enfermeiros com idades entre 31-68 anos. Enfermeiros de escolas privadas apresentam 1,367 vezes maiores probabilidades de ter recebido formação sobre sexualidade que os das escolas públicas. Educação afectivo-sexual deve entender-se como direito de todos, colaborando a família, a escola e a saúde pelo que é imperativo que as escolas repensem os seus programas nesta área.

Breve histórico do Sistema Nacional de Saúde e do respectivo financiamento a partir da Emenda Constitucional da Saúde até 2015, apresenta dados afetos à execução orçamentária da União em Ações e Serviços Públicos de Saúde (ASPS) a partir da vigência da Lei Complementar nº 141, de 2012, e estima o mínimo constitucional a ser aplicado frente à legislação e às revisões do PIB pelo IBGE.
