The concern with issues related to consumer protection has emerged in North America and then spread throughout the world. In Brazil, consumer‟s rights and interests only gained greater importance after their consolidation in the Constitution of 1988 and the enactment of the 8078/90 Law (Consumer‟s Protection and Defense Code), which established the consumerist microsystem. The understanding of the legal relationship of consumption concept is necessarily connected to knowledge of the elements that compose it. Among these, we can find the consumer and the provider (subjective elements), the product or service (objective elements), and the consumer‟s condition as final receiver of the consumption object (finalistic element). In order to elucidate the configuration of consumer protection before advertising communication, this work will analyze the advertising through the prism of consumerist laws, conceptualizing it and presenting a differentiation of it in relation to practices such as marketing, offer and commercial communication as well as examining its several kinds of manifestation, focusing mainly the ones categorized as misleading or unfair advertising. All kinds of advertising communication against the consumerist microsystem are subject to judicial control exercised by the State. Besides individual protection possibilities, this state-owned control can be collectively exercised as a result of the utilization of public civil action and popular action. Some specific categories of advertising (smoking products, alcoholic beverages, pesticides, medicines and therapies) are still subject to a set of particular restraints provided by the 9294/96 Law, which enables the performance of a special control in relation to them. In addition to state control, there is also a system of advertising communication self-regulation, which develops itself through the actions of the National Council of Advertising Self-Regulation that are based mainly on the laws established by the Brazilian Code of Advertising Self-Regulation and its annexes. However, this system of advertising self-regulation still has some deficiencies that hinder its effectiveness

Este trabalho tem a missão de analisar a Responsabilidade Civil do consumidor – pessoa física – superendividado no Direito Brasileiro, e está dividido em quatro capítulos. O primeiro capítulo ressalta as noções básicas para a análise do conceito de superendividamento da pessoa física e como os sistemas dos diversos regimes jurídicos de outros países tratam o tema. Mostra , ainda, a forma de prestigiar a dignidade do devedor e o direito de satisfação ao crédito dos credores, ambos integrantes de uma relação horizontal de eficácia de direitos fundamentais. O capítulo 2 aborda a evolução do tema no Poder Legislativo Brasileiro, bem como as propostas de órgãos de defesa do consumidor e sugestões verificadas no estudo metodológico como alternativa para amenizar a problemática no Brasil. No terceiro capítulo, há um estudo que demonstra a distinção de situações possíveis do regime geral da Responsabilidade Civil do superendividado pessoa física ativo e passivo em comparação com o fornecedor que atue com boas ou más condutas em face do endividamento da pessoa física. O capítulo 4 tratou de apresentar, como proposta principal, os métodos de julgamentos do tema Responsabilidade Civil do consumidor superendividado na perspectiva do Poder Judiciário Brasileiro, com destaque o endividamento do produtor rural pessoa física. O estudo do tema é uma proposta inovadora no direito consumerista brasileiro. Tem por objetivo aperfeiçoar boas práticas comerciais no mercado de consumo no Brasil, pois o consumo voraz frente à produção desenfreada de produtos e um mercado publicitário agressivo deve existir em coerência e razoabilidade com uma propensa relação jurídica eficaz em que consumidor e fornecedor são atores que objetivam sempre o equilíbrio contratual, em preservação ao sinalagma genético do contrato de consumo.

Consumer relations, established between the Consumer and the Creditor, which carry a consequent inequality of contractual positioning between the parties, have been pushing the legislator to adopt more rigid regulations with regard to lending for the purchase of goods or services of consum issues. In this sense, the Decree-Law 359/91 was approved, meanwhile repealed by the Decree-Law 133/2009, which regulates the consumer credit agreement’s regime in the portuguese legal system. Through this contract, the financier makes available to the consumer a certain amount of money, which the consumer must repay, plus the respective remuneration (interest) and other charges, according to a refund plan agreed by the parties. The consumer will be in delay if he breaches this stipulation. In case of default, the creditor, notwithstanding, can choose to wait for the performance by the debtor, promote the loss of benefit of the term or the termination of the contract. From the outset it would seem that, in one way or another, the financier, by imposing a forced shortening of the contract duration initially agreed, will lose the right to remuneration for the provision of capital agreed, but not verified. Nevertheless, unlike presently, the previous regime allowed the parties to rule otherwise, being permitted to agree to the payment of interest of outstanding installments. On the other hand, in the consumer credit contract the principle of freedom of contractual provision of the parties is strongly mitigated by the special legislation, which prevents the waiver of rights by the consumer, and by the regime of general contractual terms, which restricts the freedom of the financier to stipulate the contractual content freely and the freedom of the consumer to negotiate. For all these reasons, associated with the growing need of credit resource to satisfy their needs of consumption, it is confirm the relevance of legislative intervention on consumers protection in the context of hiring credit.

The scope of the present work is to study the legal protection conferred upon the consumer in Angola, especially as regards electronic communication agreements. Its purpose is to promote consumers’ rights and contribute to its defence given the relatively privileged position of professionals in their relationship with consumers. With this in mind, we have made a description of the Consumer Law in Angola based on the Angolan Constitution (as the law that establishes the fundamental rights and guarantees of citizens) and on the Consumer’s Defence Law, which, as the basic law regarding consumers’ rights, provides the framework for this dissertation. We have analysed several aspects relating to consumer relationships, starting from its concept and rights of consumers and covering the legal and contractual mechanisms put in place for their protection. We have also analysed the Advertising Law with a view to better understand consumer’s rights before advertising campaigns carried out by professionals whilst promoting their goods and services and, additionally, to understand the duties and principles that shall be complied with in such campaigns with the purpose to protect the rights and interests of consumers. From a criminal point of view, we have briefly covered the crimes against consumers provided for in the Penal Code and the Law of Infractions against the Economy. In the second part of this work, we have summarised the institutions that protect the rights and interests of consumers, which include the Public Prosecutor Office, the National Institute for the Defence of the Consumers and the Consumers’ Associations. The third and last part of this work covers electronic communications agreements. Given the fact that there is no specific legislation in this matter, our analysis was based on the Civil Code – specifically the part relating to contracts – the Law on General Contractual Terms and Conditions and the Consumer’s Defence Law. We have analysed the formation of contracts, compliance and consumers’ rights resulting from contract breach. We further have appealed to the Angolan legislator to legislate certain aspects of consumer relationships, especially those where breach of consumers’ rights are blatant and facilitated by the lack of specific laws addressing such cases.

This dissertation analyzes how the current Constitution and the Brazilian law establish consumer protection, arbitration and access to justice. Following we try to demonstrate why arbitration is a method rarely used in the resolution of consumer disputes in Brazil. It also examines the doctrinal and jurisprudential aspects of the conflict between the Brazilian Arbitration Law (Law nº. 9.307/96), which allows the arbitration clause in contracts of adhesion, and the Consumer Protection Code (Law nº 8.078/90) that in article 51, VII, considers as abusive the arbitration clause. Furthermore, analyzes new proposed bills under scrutiny by the National Congress on the issue and identifies the causes, in the Brazilian legal system, hampering the use of arbitration in consumer relations. Concludes that there are no principle obstacles preventing consumer litigations to be settled by arbitration. High costs, mistrust, oppression, misinformation of consumers and non-participation of the State, being a totally private institute, are factors that generate distrust, suspicion, and have prevented the development of arbitration in consumer relations in Brazil.

Esta pesquisa refere-se à análise da utilização do comércio eletrônico (CE) por parte de grandes empresas da região sul do Brasil. Justifica-se a escolha porque pesquisas recentes indicam que as empresas brasileiras ainda não utilizam plenamente as várias possibilidades oferecidas pela Tecnologia de Informação em seus negócios e seus administradores ainda não têm em mente muitas vantagens proporcionadas pelo CE em relação aos canais de venda tradicionais. Há, portanto um campo oportuno de negócios a ser explorado. A pesquisa visou avaliar o estágio de utilização do CE, de modo a verificar aspectos de adoção tecnológica e relacionamento com clientes e fornecedores, a adequação de produtos e serviços ao novo canal, assim como a estratégia e o comprometimento organizacional, a partir do referencial teórico e baseada em um foco regional. Através da lista divulgada anualmente pela Revista Expressão, sobre as 300 Maiores Empresas do Sul, conduziu-se um estudo quantitativo exploratório com executivos da área de Informação, que pudesse fornecer subsídios para processos de tomada de decisão por parte das empresas em relação ao CE. Os resultados indicam que são empresas que atuam em setores tradicionais da economia e que ainda não estão conscientes das possibilidades trazidas por processos de CE, embora já se observe o surgimento de vantagens competitivas através da adoção destes processos, no que se refere ao contato entre empresas e a alianças mais sólidas entre os membros da cadeia produtiva.

Esse artigo tem por objetivo mostrar que a Lei 8.002, de14/3/1990, que dispõe sobre a repressão de infrações atentatórias contra os direitos do consumidor, pode ter efeitos nefastos àquele que pretende proteger, o consumidor. Ilustra-se tal afirmação com o estudo das relações contratuais entre fornecedores e distribuidores. O artigo conclui com uma sugestão para modificação da Lei que permitiria que, em casos justificados, a sua aplicação pudesse ser flexibilizada.

O presente artigo parte do contrato de crédito ao consumidor para iniciar uma reflexão sobre o aparente descompasso entre o papel da autonomia nos direitos subjetivos patrimoniais e extrapatrimoniais. Para isso, aborda os limites de aplicação do Código de Defesa do Consumidor - Lei 8.078/90 – nas relações bancárias, especialmente as de crédito. Em seguida, analisa a atual configuração da equação autonomia e dirigismo contratual. O objetivo final é abrir espaço de reflexão sobre o alcance da liberdade contratual, no âmbito dos contratos de crédito, tantas vezes considerada inexistente.

Apesar das referências explícitas nos correspondentes textos normativos, das óbvias conexões semânticas entre as "partes" constitucional e infraconstitucional da afirmação da defesa da concorrência no direito brasileiro, bem como da aparente semelhança estrutural entre as formas desta afirmação nos arts. 170 e 173, §4º da CF, e 1º e 20 da Lei 8.884/94, os processos de decisão das autoridades responsáveis pela implementação da Lei Antitruste têm permanecido impermeáveis a argumentos substantivos de natureza constitucional. Em particular, a fundamentação das decisões tem dispensado quaisquer referências aos princípios constitucionais expressos, inclusive, no art. 1º da Lei, e seguido um caminho alternativo à divisão das normas em princípios e regras e à construção dos argumentos a partir da sua combinação (entre si e uns perante as outras) segundo métodos de decisão jurídica razoavelmente difundidos (e.g., a "ponderação de princípios"). O propósito do presente artigo é apresentar e discutir o significado desse peculiar e notável fenômeno de impermeabilização e "desconstitucionalização metodológica" do direito de defesa da concorrência brasileiro.

Analysis focusses on the emergence of the consumer in the public space, both as a social character and as a issue, the stage through which consumer protection evolved and its present perspectives. The international analysis aimed at illuminating the case of consumer protection in Brazil, being the USA the mais evidence for First world countries and some European contries the secondary one. The sources are both primary and secondary.
