The citizenship is a fundamental category to the democratic progress and the development and concretization of human rights, in addition to being one of the essential foundations of democratic contextualized in the rule of law of the Federative Republic of Brazil. That’s exactly why the discussion about its concept and content is a paramount requirement to the understanding and interpretation-application-concretization of the Federal Constitution of 1988, as well as its democracy, since there is no democracy without citizenship. That is why the general objective of the research is to determine the characteristics of the citizenship, relating it to the Law, as well as to discuss (critically) its inclusion in the list of fundamental rights and delimitate the scope of protection and the limits of this right, in the context of Brazilian law post-1988 Constitution. The specific objectives are: a) to analyze the concept of citizenship, its extent and scope, contextualizing it historically; b) to examine the evolution of the legal and regulatory treatment of the citizenship in Brazilian constitutions, focusing on the 1988 Constitution; c) assess whether citizenship can be considered a fundamental right; d) to investigate which implications, theoretical and practical, of assignment fundamentality character to the right to citizenship. This research identifies and deconstructs current conceptual confusions, such as the lack of distinction between citizenship and nationality; citizenship and electoral capacity; citizenship and person. It also helps to identify and oppose the generalizations, as well as the excessively abstract associations which tend to purely metaphysical understandings, fluid and empty of any content. The main virtue, however, is the proposed of understanding of the citizenship as a fundamental right and the examination of the relationship between citizenship and human dignity. In this context, citizenship appears as a corollary of human dignity and it goes beyond. This (human dignity) requires equality, non-arbitraries, non-excessive, disproportionate or unreasonable impositions affecting their freedom rights, and, yet, doesn’t affect a minimum core of possibilities of have to a decent life, in conditions of freedom and self-conformation involved in the necessary consideration of the individual as a subject. All of this requires a decision-making process, molded by the citizenship, which reaches the entire development process of possible state interventions, to ensure the person as a subject, the right holder and the objective point of reference of the juridical relations. Thus, the citizenship represents a substantial and beneficial addition to the human dignity, since the emancipated citizen is a person, formally and materially, qualified, to be able to build their own and collectively organized history, to participate effectively in the making processes decision juridical and social

A inclusão da comunidade cigana requer uma postura diferente por parte desta comunidade que passa pela assunção das normas por que todos os cidadãos portugueses se devem reger, em termos de direitos e deveres, exercendo a sua cidadania plena, de forma ativa e participada. Objetivo: Promover a inclusão das crianças ciganas nas escolas do Concelho do Seixal. Metodologia: utilizou-se a metodologia de planeamento em saúde, recorrendo à entrevista e grelha de observação, como instrumentos de recolha de dados. Resultados: Deficit de conhecimentos sobre cuidados de higiene nas crianças ciganas; Deficit de conhecimentos sobre cultura cigana pelos professores; Desvalorização da preservação dos espaços comuns do bairro pelas famílias ciganas. Conclusões: Importância da promoção de hábitos de higiene pessoal junto das crianças ciganas, necessidade de formação para professores sobre multiculturalidade e cultura cigana e de intervenção articulada e em parceria, no bairro, promovendo a mudança de comportamentos para preservação dos espaços comuns; ABSTRACT: The inclusion of the Roma community requires a different attitude on the part of this community that goes by the assumption of standards that all Portuguese citizens should be governed in terms of rights and duties, exercising their full citizenship, active and participatory way. Objective: To promote the inclusion of Roma children in the Municipality of Seixal schools. Methodology used the health planning methodology, using interview and observation grid, such as data collection tools. Results: Deficit of knowledge about hygiene in the Roma children; Deficit of knowledge about Roma culture by teachers; Devaluation of preservation of the common areas of the neighborhood by Roma families. Conclusions: The importance of promoting personal hygiene habits with Roma children, the need for training for teachers on multiculturalism and gypsy culture and coordinated intervention and partnership, in the neighborhood, promoting behavior change to preserving public spaces.

Este documento describe una investigación, para identificar el desconocimiento de los estudiantes de primero a noveno grado de los Centros Escolares del municipio de San Vicente, sobre la LEPINA (Ley de Protección Integral de la Niñez y Adolescencia); y a su vez el desarrollo de una aplicación informática interactiva para divulgar dicha ley. La aplicación consta de tres módulos (Primero, Segundo y Tercer Ciclo), los cuales incluyen diversas actividades acordes al nivel académico de los estudiantes, para que conozcan sus derechos y deberes. Finalizada la investigación se comprobó que los estudiantes desconocen la LEPINA, por lo que la aplicación constituye una herramienta importante en la divulgación de dicha ley, ya que además, el contenido de la aplicación fue aprobado por la Sub dirección de políticas del CONNA (Consejo Nacional de la Niñez y Adolescencia). SUMMARY. This document describes a research to identify the ignorance of students from first to ninth grade of schools in the municipality of San Vicente, about the LEPINA (Law of Integral Protection of the Childhood and Adolescence); and also the development of an interactive computer application to disseminate this law. The application consists of three modules (First, Second and Third Cycle), which include various activities according to the academic level of the students, so they know their rights and duties. After the investigation it was found that students do not know the LEPINA, so the application is an important tool in the dissemination of this law, as also the content of the computer application was approved by the Subdirection of policies CONNA (National Council of the Childhood and Adolescence).

The experimental legislation follows the development of legislative evaluation practices. Being a legislative technique used not only with the aim of gathering political and social consensus, but also, especially in controversial matters, to provide data and information that will serve as basis for a clarified and justified legislative decision. The characteristic features of the experimental laws are its limited application in time and/or in territory and the prediction, in the law itself, of an evaluation after the experimental period. The application of an experimental law just in a specific geographic area raises constitutional issues because of the implications of the principle of equality. Indeed, the principle of equality, despite admitting some treatment differences between people, commands that these differences have to be legitimate, reasonable and proportional, namely, not arbitrary. Besides the constitutionality problem for the violation of the principle of equality, the experimental laws may also consist of laws restricting fundamental rights and be the cause of the liability of the State, within its legislative function.

A presente dissertação tem por escopo um estudo comparado sobre os direitos fundamentais e o uso de meios coercivos na actuação das forças de segurança no Estado de direito democrático, em Cabo Verde e Portugal. Em primeiro lugar, analisam-se os direitos fundamentais susceptíveis de serem postos em causa pelas forças de segurança, quando estas têm que fazer uso dos meios coercivos no cumprimento da sua missão. Neste sentido, destaca-se a importância da qualificação dos elementos policiais na defesa e protecção dos direitos, liberdades e garantias dos cidadãos. Ao longo do trabalho procura-se demonstrar que a protecção dos direitos fundamentais pelas forças de segurança é indissociável do conhecimento do regime de tais direitos. Em termos metodológicos, este trabalho tem uma componente comparativa, assente no cotejo dos ordenamentos jurídicos de Cabo Verde e de Portugal, apoiado em consultas bibliográficas. Resolvemos ocupar-nos desta temática em virtude da sua importância para a organização policial, com vista a contribuir para a adopção de métodos adequados, visando habilitar os agentes policiais de Cabo Verde a melhor garantir os direitos fundamentais. Os objectivos do estudo foram alcançados, permitindo-nos concluir que os pressupostos e requisitos legais do uso de meios coercivos em Cabo Verde podem gerar equívocos na sua correcta aplicação, pelo que se torna premente a implementação de uma instrução de serviço ou norma de execução permanente (NEP), à semelhança daquela que existe na Polícia de Segurança Pública portuguesa.

Toleration is a key concept of liberalism, both from the historical and conceptual points of view. On the other hand, as people’s freedom to live according to their moral and religious ideas has long become a basic value for liberal societies and their political constitutions, it is reasonable to understand that there is nothing to be tolerated nor by citizens neither by the State. However, a part of the scope and meaning of the fundamental rights and freedoms is subject to what John Rawls calls reasonable disagreements and this is a field where toleration understood in the classic way is compatible with equality: not to intervene against that which is being disapproved understood has a raison d'être. Since the 1980s, toleration has been present in the debates on how to deal with pluralism in a constitutional democracy. This has to be connected to the rise of identity politics: political and intellectual movements such as multiculturalism or comunitarism that questioned whether social order based on neutral criteria was either possible or desirable or both things at the same time. Outstanding liberal philosophers were among those demanding political priority for comunitarian values and those who showed interest for toleration as a key concept to articulate pluralism. Key distinctions between them can be explained as the result of the different approaches they take when facing classical theories on toleration: whereas John Locke’s is a major influence on Rawls, John Stuart Mill’s is on the others, while Gray, Walzer and Rorty follow Isaiah Berlin’s reading of Mill.

Este texto plantea la posibilidad de recuperar el nos-otros-originario como clave para la superación del «sufrimiento inútil» del sujeto; de este modo, muestra al nos-otros-originario como una zona de protección de los derechos de el-otro, hace una crítica en contra del nos-otros-caído como vulnerador de derechos fundamentales, y aborda la posibilidad de recuperar el nos-otros-originario a través de una consumación definitiva de la "justicia".

Esta investigación tiene como objetivo estudiar la relación que existe entre política criminal y los derechos humanos carcelarios durante el desarrollo del gobierno de Álvaro Uribe Vélez (2002-2010), y su incidencia en la cárcel Modelo de Bogotá. Pues en Colombia, al amparo de un discurso meramente punitivo, la pena privativa de la libertad se ha vuelto el fin último del aparato judicial, lo que ha ocasionado altos índices de hacinamiento y, colateralmente, violaciones a los derechos fundamentales de la población reclusa en Colombia. Esta investigación se centra en el análisis de la política criminal, entendida como el estudio del conjunto de medidas empleadas por los órganos de gobierno para hacer frente a la criminalidad que afecta a un Estado. En este sentido, se pretende demostrar que la política criminal se ha enfocado en la pena más que en la prevención y/o la reinserción.

Recibido 01 de noviembre de 2010 • Aceptado 09 de marzo de 2011 • Corregido 24 de abril de 2011 El objetivo de este artículo es llevar a la reflexión sobre el tema de las relaciones asimétricas entre los hombres y las mujeres, las cuales representan una desventaja en especial para las mujeres. Lo anterior representa una realidad histórica que se vive en todos los contextos sociales, y la institución educativa no escapa a esta situación. Las relaciones de desigualdad e inequidad han venido a permear los roles asignados socialmente en razón de la identidad sexual, y en los cuales las mujeres se ven discriminadas en la igualdad de oportunidades para su pleno desarrollo como ser humano.Resulta importante reconocer las luchas que se han venido dando para acabar con esta desigualad y discriminación; pero todavía quedan muchas tareas pendientes. Es justamente la educación un camino que puede conducir a la senda donde hombres y mujeres gocen de los mismos derechos y deberes, no sólo en el papel, sino que esas políticas se concreten en la vida cotidiana. De ahí que la formación de las futuras educadoras y educadores, requiere de una nueva mirada en el diseño e implementación de los planes de estudios, los cuales incorporen, de manera explícita y profunda, la categoría analítica de género, para promover, desde el preescolar hasta el nivel universitario, cambios en las prácticas sexistas.

Resumen El desarrollo progresivo del derecho a la vida, la libertad y la seguridad personal se han visto enriquecidos con la lucha y posterior positivación de los derechos reproductivos, en tanto estos han generado una ampliación de los criterios sobre los cuales se basa la obligación del Estado respecto de los derechos humanos en general, y en particular de aquellos consagrados en el primer artículo de la Declaración Americana de Derechos y Deberes. Los países de América Latina, en el marco de dicha obligación, han adoptado posturas diversas frente a los derechos reproductivos, específicamente en lo que refiere a la despenalización del aborto consolidando tres grandes tendencias regionales que muestran aciertos y desaciertos. El presente artículo que surge como reflexión personal propuesta como aporte académico en el marco de los debates jurídicos llevados a cabo durante el I Congreso Latinoamericano Jurídico sobre Derechos Reproductivos, tiene como objetivo realizar una mirada a dichas tendencias con el fin de dar un panorama general de la situación de América Latina y su deuda frente a los derechos reproductivos y de esta manera pensar propuestas más holísticas para alcanzar la realización de dichos derechos, y consecuentemente seguir promoviendo progresivamente el desarrollo del derecho a la vida, la libertad y la seguridad personal.Palabras clave: derechos reproductivos, vida, libertad personal, progresividad.AbstractThe progressive development of the right to life, liberty and personal security has been enriched by the struggle for and subsequent onset of reproductive rights, in as much as they have widened the State’s obligations towards the respect of human rights and in particular those enumerated in the first article of the American Declaration of the Rights and Duties. Latin American countries, within these requirements, have taken diverse stances towards reproductive rights, specifically with regards to the decriminalization of abortion, which can be reduced into three major trends representing successes as well as errors. This article comes as a personal reflection, and proposed as an academic contribution, in the context of legal debates held during the First Latin American Congress on Reproductive Rights Law. It is aimed at taking a look at these trends in order to give an overview on the situation in Latin America and its debt to reproductive rights, and, in this way, to ponder about more holistic proposals to achieve their fulfillment, hence progressively promoting the development of the right to life, to liberty and to personal security. This document is aimed first of all, make a small introductory reference on the three levels of protection of fundamental rights in Europe with the idea of helping to clarify and understand mainly to non-European systems that we are not talking. For that, based on this, going on to assess the impact generated in these systems suggest that the complaints alleged involvement of European countries in secret CIA flights to combat international terrorism, as well as investigate the responses that have given each protection of these areas to try to clarify them.
