Life of children exposed to alcohol or drugs in utero This study focused on the growth environment, physical development and socio-emotional development of children, aged 16 and under, who had been exposed to alcohol (n=78) or drugs (n=15) in utero. The aim of the study was to obtain a comprehensive picture of the living conditions of these children and to examine the role of the growth environment in their development. The study was carried out using questionnaires, written life stories and interviews. Attachment theory was used as a background theory in the study. Over half of the children exposed to alcohol were diagnosed with foetal alcohol syndrome (FAS), one quarter was diagnosed with foetal alcohol effects (FAE), and one fifth had no diagnosis. Most of the children exposed to drugs had been exposed to either amphetamines or cannabis, and a smaller number to heroin. Some of the children exposed to alcohol were mentally handicapped or intellectually impaired. The children exposed to drugs did not exhibit any serious learning difficulties but a considerable number of them had socio-emotional development problems. Language and speech problems and attention, concentration and social interaction problems were typical among both the children exposed to alcohol and those exposed to drugs. Only one child had been placed into long-term foster care in a family immediately after leaving the maternity hospital. In biological families there had been neglect, violence, mental health problems, crime and unemployment, and many parents were already dead. Two of the children had been sexually abused and four were suspected of having been abused. From the point of view of the children's development, the three most critical issues were 1) the range of illnesses and handicaps that had impaired their functional capacity as a result of their prenatal exposure to alcohol, 2) child's age at the time of placement on a long-term basis, and 3) the number of their traumatic experiences. The relationship with their biological parents after placement also played a role. Children with symptoms were found in all diagnosis categories and types of exposure. Children with the smallest number of symptoms were found among those who had never lived with their biological parents. Almost all children were exhibiting strong symptoms at the time of placement in foster care. In most cases, they were behaving in a disorderly manner towards others, but some children were withdrawn. The most conspicuous feature among those with the most severe symptoms was their disorganized behaviour. Placement in a foster family enhanced the children's development, but did not solve the problems. The foster parents who brought these children up did not receive as much therapy for the children and support for the upbringing as they appear to have needed. In Finland, transfer to long-term custody is based on strict criteria. The rights of children prescribed in the child protection law are not fulfilled in practice. This doctoral thesis explores the development of drug markets and drug related crime in Finland since the mid 1990s, as well as public control measures aimed at solving problems related to drug crime. The research further examines the criminal career of persons having committed drug crime, as well as their socio-economic background. The period since the mid 1990s is, on the one hand, characterized by increasing use of drugs and increasingly severe drug problems. On the other hand, this period is also characterized by intensified drug control. Also criminality associated with drugs has increased and become more severe. During this period the prevention of drug problems became a focal issue for authorities, and resources were increased for activities geared towards fighting drugs. Along with this development, Finnish drug policy has been balancing between therapeutic activities and control. A focal point in this thesis is the question how society addresses drug problems, as well as how this differs from efforts to solve other problems. Why are criminal means so readily used when dealing with drug problems; why have the police received an extended mandate to use coercive force; and why has the field for imposing administrative sanctions been extended? How has the extension of drug control affected general thinking in criminal policy? The subject matter in this thesis is approached in a criminological and criminal policy perspective. The thesis is made up of four research articles and a Summary Article. In the Summary Article the studies were placed into the Finnish research context of drug criminality and drug control as well as criminal policy. Furthermore, the author has assessed his own research location as a drug control researcher. Applying the notion of risk, an analysis was made of threats posed by drugs to society. Theoretical perspectives were also brought to the fore on how society may regulate drug problems and threats associated with them. Based on research literature and administrative documents, an analysis was made of the relation between drug related social and health policy and criminal justice control. An account was also made of the development of drug control in Finland since the mid 1990s. There has been a strong increase in control by the criminal justice system since the mid 1990s. Penalties have been made more stringent, more efficient means have been developed to trace the financial gain from the offence, opportunities for money laundering have been prevented and the police has obtained ample new powers of inquiry. New administrative measures have been directed towards drug users, such as introducing drug tests in working life, checking the applicants criminal record for certain jobs, as well as the threat of losing one s driving licence in cases where a physician has established drug addiction. In the 1990s the prevention of drug crimes and their disclosure were made part of the police s control activities nationwide. This could clearly be seen in increased criminal statistics. There are humiliating elements associated with the police s drug control that should be eliminated for the benefit of everybody. Furthermore, the criminal control is directed towards persons in a weak socio-economic position. A drug verdict may set off a marginalization process that may be very difficult to halt. Drug control is selective and generates repressive practises. The special status accorded drug problems is also revealed in the way in which the treatment of drug addicts has developed.

Resumen: La prisión preventiva es la medida cautelar más grave e intensa del proceso penal, en tanto importa la coactiva privación de la libertad personal del imputado. Se trata de un instituto problemático, que plantea un contrapunto particularmente dilemático con la presunción de inocencia. Posee un fundamento constitucional, directamente vinculado con la necesidad de asegurar, en la medida de lo posible, la realización del derecho penal material. Aunque la regla general es que durante el desarrollo del proceso penal el imputado debe permanecer en libertad, no puede negarse la existencia de ciertos supuestos legitimadores de la prisión preventiva. La realidad social y la necesidad de respuestas racionales a los fenómenos de la inseguridad y de la delincuencia violenta han revelado serias fisuras en el paradigma según el cual los únicos supuestos legitimadores son los llamados peligros procesales de fuga o entorpecimiento de la investigación. Surgen así como datos que deben ser también necesariamente tenidos en cuenta para la detención cautelar tanto la especial gravedad del delito cometido y su relación con la preservación del orden público, como la existencia de un peligro de reiteración delictiva constatable. Estos dos últimos presupuestos legitimadores de la prisión preventiva cobran independencia conceptual de los primeramente mencionados. Además, cuando la prisión preventiva se funda en la especial gravedad del delito o en el peligro de reiteración delictiva, se transforma, aunque sin mutar su esencia, en un instrumento más en las políticas de seguridad dirigidas a combatir el fenómeno de la delincuencia.

Resumen: El delito penal es aquello que la tradición, vivida en la experiencia de la familia y de la comunidad, permite a cada uno reconocer como un grave alejamiento de lo verdadero, lo bueno y lo correcto. El fundamento de la punibilidad penal es la imputación, el reconocimiento de la pertenencia del delito al sujeto como a su causa. Se intenta mostrar cómo este vínculo del derecho penal con la tradición jurídica sufrió dos rupturas: con el iluminismo jurídico y el kantismo se separó la imputación jurídica de su fundamento moral y con la codificación, se quebró la unidad del derecho penal universal fundado en lo bonum et aequum otorgando prevalencia a la idea de la legalidad esclava de los intereses de los Estados. Al mismo tiempo, se produjo una segunda ruptura: se predica una responsabilidad que se atribuye desde afuera, en forma objetiva, a centros de imputación –con frecuencia colectivos– que realizan la producción industrial. Así, según exigencias de la seguridad y la salud, el derecho penal se transforma en un instrumento de la política criminal y los contornos del tipo penal se operan a través de jueces y fiscales en prevención de las consecuencias futuras del “riesgo” progresivo de la producción industrial. La nota dominante es el “riesgo” colectivo y no el “hecho”.

Trata-se de estudo sobre a política de criminalização imposta aos jovens residentes das comunidades carentes do Estado do Rio de Janeiro. Pretende-se identificar as visões antagônicas sobre essa questão e as discussões sobre o aumento do uso de drogas, associado à criminalidade e ao interesse de amplos setores da sociedade no combate a esse consumo e ao tráfico. Destacam-se os motivos que pressionam o Estado a construir uma política de combate às drogas, assim como a economia da droga influenciando e determinando os rumos de uma mentalidade que persegue uma eficácia questionável de consumo zero de drogas nas sociedades. Para melhor entendimento dessa questão, pretende-se examinar a influência da política norte-americana antidrogas numa economia globalizada. A análise está fundamentada nos estudos teóricos sobre economia das drogas, redução de danos e na legislação brasileira. Também foram consideradas as fontes orais, extraídas de discursos de parlamentares e especialistas em criminalização de comportamentos transgressores sociais. Os relatos, retirados de periódicos, discursos e entrevistas, receberam a forma de texto-relato, seguindo os métodos utilizados pelas Ciências Sociais.

A presente dissertação busca, através da análise das teorias sobre o crime e o desvio disponíveis, encontrar um caminho de pesquisa que responda a seguinte pergunta: Por que alguns jovens e não outros se envolvem em atividades ligadas ao tráfico de drogas nas favelas do Rio de Janeiro? Este é, portanto, essencialmente um trabalho de revisão bibliográfica, tanto da literatura brasileira quanto da literatura norte-americana sobre o tema. O objetivo principal é levantar questões para uma pesquisa futura que incorpore tanto os pontos fortes da produção acadêmica nacional quanto da produção estrangeira, incorporando metodologias essencialmente quantitativas e qualitativas. Nesse sentido, o presente trabalho defende o desenvolvimento de análises que enfatizem a capacidade de agência dos indivíduos, através da observação dos efeitos de suas aspirações e expectativas de futuro sobre suas trajetórias de vida; sem, contudo, perder de vista que a conformação de tais expectativas depende da estrutura e das interações sociais que os circundam

No final do século XIX, a preocupação em torno da raça e com os possíveis impactos que a composição racial do povo brasileiro traria ao futuro da nação (notadamente a mestiçagem enquanto causa da degenerescência da população) marcou profundamente o pensamento da intelectualidade brasileira. A constituição da psicologia social no Brasil se deu em um contexto em que essas e outras questões correlatas pautaram a agenda política, literária e científica dos intelectuais. Raimundo Nina Rodrigues (1862-1906), médico maranhense que exerceu suas atividades profissionais principalmente na Bahia, foi um dos principais pensadores da época a debruçar-se sobre esse conjunto de questões, a partir de parâmetros e paradigmas provenientes da medicina legal, da criminologia e da psiquiatria. O presente trabalho, focando-se nas detalhadas análises de casos empreendidas por Nina Rodrigues, que abarcaram temas tão diversos como a alienação, a religião, a criminalidade e a loucura, investiga como este autor dialogou com teorias médicas, psiquiátricas e jurídicas produzidas sobretudo na Europa e como elas foram apropriadas e adaptadas à realidade brasileira e às conclusões de seus estudos de caso, a partir das quais ele derivou suas ideias, proposições e teorias

[ES]Se aborda la Mediación Penal desde la perspectiva de la nueva normativa que ha entrado en vigor o estará vigente próximamente. Incluye un estudio sobre la supresión de las faltas, la creación de los denominados Delitos Leves en el Código Penal y la incorporación del Principio de Oportunidad. (Reforma del Código Penal y Ley de Enjuiciamiento Criminal). Especial relevancia del Estatuto de la Víctima del Delito, y la influencia y aplicación a Víctimas de Violencia de Género. Así como la especial consideración a la Justicia Restaurativa en la Mediación Penal. Se elabora un estudio sobre la Mediación Penal en los Anteproyectos de Reforma de 2011 y 2012.

My research investigates a recent tendency in Italian literature, characterized by elements of renewal within the novel-writing tradition and of discontinuity with postmodern culture. It proposes an interpretation of the genres of the historical novel and crime fiction in the last fifteen years, in order to underline the important role played by these types of narrative in revitalizing contemporary Italian literature. These modalities of writing are considered both individually and in their connections beyond a traditional notion of genre, emphasizing those characteristics which may be assumed as irreconcilable with a postmodern approach to fiction and those which, furthermore, seem to indicate attempts to take a new course. In particular, my study analyses the recent literary tendency to combine the elements of ‘crime’ and ‘history’ in order to represent political and social reality, and how the works examined relate to postmodern narrative. For this reason, I pay particular attention to the relationship between literature and the past and to the socio-political aspects connected with the praxis of narrating, offering an original interpretation of the way in which the authors studied engage with these characteristics.

Neutralization theory, though a popular framework for understanding deviant behavior, remains badly underdeveloped. Few attempts have been made to connect it to narrative and sociocognitive research in psychology and related fields. From this wider perspective, one reason neutralization theory has received only mixed empirical support is that it has been understood as a theory of criminal etiology. This makes little sense (how can one neutralize something before they have done it?) and makes the theory difficult to test. Neutralization should instead be seen as playing a role in persistence in or desistance from criminal behavior. The theory's central premises need to be substantially complicated. The notions that all excuses or justifications are "bad" and that reform involves "accepting complete responsibility" for one's actions are not tenable.

El rol desempeñado por la opinión pública en el desarrollo de la política criminal actual justifica el incremento de investigaciones destinadas a evaluar las actitudes de los ciudadanos hacia el castigo. No obstante, los avances en este ámbito han sido limitados debido a la utilización de rudimentarios instrumentos de medida. Por ello, el presente trabajo tiene como propósito explorar el efecto que generan en la opinión ciudadana ciertas variables referidas al hecho delictivo y al infractor, precisando su contribución relativa y la interacción existente entre ellas. Para satisfacer este objetivo se recurrió a un diseño factorial de la encuesta, creando una población de 256 casos-escenario fruto de la combinación de cuatro factores: la edad del joven, su historial delictivo, el grado de implicación en el hecho y el tipo de delito cometido. Los mismos fueron distribuidos en grupos de ocho casos ordenados aleatoriamente y fueron suministrados a 32 sujetos. Posteriormente se aplicaron análisis de regresión logística binaria. Los resultados obtenidos revelan que la naturaleza violenta de los hechos, la implicación activa de los jóvenes y el historial delictivo son predictores importantes de las condenas punitivas. Sin embargo la edad, una variable fundamental en la configuración de la justicia juvenil, no resulta significativa. De este modo, el trabajo muestra el potencial explicativo de este conjunto de factores y debate sus implicaciones teóricas y metodológicas para la investigación futura en este terreno.

Self-report research suggests that much violence is triggered by perceived insults and disrespect. This may be particularly true in the context of a prison or another environment of acute deprivation, whereby individuals have little other recourse to means of reputation enhancement. This paper presents the findings of two studies conducted with prisoner volunteers inside a Category C (minimum security) prison in England. In the first study, the authors randomly assigned a sample of 89 prisoners to one of two conditions: the experimental group were asked to discuss times they have been disrespected by authority figures inside and outside the prison; the control group were asked more neutral questions. Both groups then completed several measures of cognitive beliefs, distortions, and hostile attribution biases. None of the measures differed across the two groups except the measure of excuse and justification acceptance. Controlling for other factors, the experimental group endorsed these rationalisations at a significantly higher rate than the control group. This finding suggests that raising the salience of disrespect - reminding prisoners of times they have been made to feel unworthy of consideration - may raise the risk that prisoners will engage in violence by providing prisoners with justifications or excuses for actions they might not otherwise endorse. These findings received some additional validation in the second study, a qualitative analysis of offender accounts of violence and aggression within the prison. Implications for reducing violence within prisons are discussed.

This paper introduces a new technique for palmprint recognition based on Fisher Linear Discriminant Analysis (FLDA) and Gabor filter bank. This method involves convolving a palmprint image with a bank of Gabor filters at different scales and rotations for robust palmprint features extraction. Once these features are extracted, FLDA is applied for dimensionality reduction and class separability. Since the palmprint features are derived from the principal lines, wrinkles and texture along the palm area. One should carefully consider this fact when selecting the appropriate palm region for the feature extraction process in order to enhance recognition accuracy. To address this problem, an improved region of interest (ROI) extraction algorithm is introduced. This algorithm allows for an efficient extraction of the whole palm area by ignoring all the undesirable parts, such as the fingers and background. Experiments have shown that the proposed method yields attractive performances as evidenced by an Equal Error Rate (EER) of 0.03%.
