. Este proyecto tiene por objeto el desarrollo y la implantación de un sistema de optimización económica de instalaciones de producción de Régimen Especial, en una compañía eléctrica que representa a este tipo de instalaciones para su participación en los distintos mercados de electricidad. Inicialmente, se analizarán las opciones de participación en los distintos mercados de cada tecnología, en función de la legislación a la que pudieran estar acogidas las instalaciones del Régimen Especial; según tamaño y tipología de instalaciones, características o combustibles utilizados. En segundo lugar, se estudiará la relación entre dichas instalaciones y los distintos organismos reguladores del mercado; la Comisión Nacional de la Energía, el Ministerio de Industria y Turismo, Red Eléctrica de España y el Operador del mercado eléctrico. Posteriormente, se realizará un modelo de análisis estático de la situación actual de los mercados eléctricos, su estructura y funcionamiento, obteniendo para cada tipo de instalación el escenario de optimización de base, a partir del cual se podrá desarrollar el modelo dinámico que permitirá conocer en cualquier momento cuál será la mejor opción técnico-económica para cada tipo de instalación, optimizando así el presupuesto de las instalaciones objeto del estudio. Finalmente, este modelo se implementará en los sistemas de la compañía eléctrica, como una herramienta que permitirá asegurar la optimización en tiempo real a las instalaciones a las que representa en el mercado, optimizando sus propios costes a través de la implementación de este sistema automático y logrando así maximizar los ingresos de la compañía eléctrica. ABSTRACT DEVELOPMENT OF A SYSTEM OF ECONOMIC OPTIMIZATION FOR PLANTS OF SPECIAL REGIME. This project takes as an object the development and the implantation of a system of economic optimization of facilities of production of Special Regime, in an electrical company that it represents to this type of facilities for his participation in the different markets of electricity. Initially, there will be analyzed the options of participation in the different markets of every technology, depending on the legislation to which there could be received the facilities of the Special Regime; according to size and typology of facilities, characteristics or used fuels. Secondly, the relation will be studied between the above mentioned facilities and the different regulatory organisms of the market; the National Commission of the Energy, the Department of Industry and Tourism, Electrical Network of Spain and the Operator of the electrical market. Later, there will carry out a model of static analysis of the current situation of the electrical markets, his structure and functioning, obtaining for every type of installation the scene of base optimization, from which there will be able to develop the dynamic model who will allow to know at any time which will be the best technical - economic option for every type of installation, optimizing this way the budget of the facilities I object of the study. Finally, this model will be implemented in the systems of the electrical company, as a tool that will allow to assure the real time optimization to the facilities to which it represents on the market, optimizing his own costs across the implementation of this automatic system and managing this way to maximize the income of the electrical company.

A description of the first renewable forward market mechanisms in the Iberian Electricity Market is provided. A contract for difference mechanism is available in Spain since March 2011between the last resort suppliers and the special regime (renewables and cogeneration) settling the price differences between the equilibrium price of the forward regulated auctions for the last resort supply and the spot price of the corresponding delivery period. Regulated auctions of baseload futures of the Portuguese zone in which the Portuguese last resort supplier sells the special regime production exist since December 2011. The experience gained from renewables auctions in Latin America could be used in the Iberian Electricity market, complementing these first market mechanisms. Introduction of renewable auctions at least for the most mature technologies (i.e. wind) in Spain and Portugal providing a fair price for the renewable generation will be of utmost importance in the short term to diminish the tariff deficit caused by the massive deployment of the feed-in-tariff scheme. Liquidity in the forward markets will also increase as a result of the entry of renewable generation companies intending to maximize their profits due to gradual suppression of feed in tariff schemes.

Over the past ten years in Italy, Spain and France, the demographic pressure and the increasing women’s participation in labour market have fuelled the expansion of the private provision of domestic and care services. In order to ensure the difficult balance between affordability, quality and job creation, each countries’ response has been different. France has developed policies to sustain the demand side introducing instruments such as vouchers and fiscal schemes, since the mid of the 2000s. Massive public funding has contributed to foster a regular market of domestic and care services and France is often presented as a “best practices” of those policies aimed at encouraging a regular private sector. Conversely in Italy and Spain, the development of a private domestic and care market has been mostly uncontrolled and without a coherent institutional design: the osmosis between a large informal market and the regular private care sector has been ensured on the supply side by migrant workers’ regularizations or the introduction of new employment regulations . The analysis presented in this paper aims to describe the response of these different policies to the challenges imposed by the current economic crisis. In dealing with the retrenchment of public expenditure and the reduced households’ purchasing power, Italy, Spain and France are experiencing greater difficulties in ensuring a regular private sector of domestic and care services. In light of that, the paper analyses the recent economic conjuncture presenting some assumptions about the future risk of deeper inequalities rising along with the increase of the process of marketization of domestic and care services in all the countries under analysis.

En el Ecuador la base legal como la Constitución del 2008 y el Código Orgánico de Organización Territorial, Autonomía y descentralización (COOTAD), establecen la organización político administrativa del territorio en diferentes niveles de gobierno, sean estos regiones, provincias, cantones, parroquias rurales y también de régimen especial, para ello estos niveles adquieren funciones de integridad para realizar legislación, ejecución, fiscalización y de participación ciudadana, en donde se alcanzará y se promoverá el desarrollo sustentable en el marco del plan nacional del buen vivir. Para lograr este legado, los diferentes Gobiernos Autónomos Descentralizados deben elaborar y ejecutar el Plan de Ordenamiento Territorial (POT) y el Plan de Desarrollo y Ordenamiento Territorial (PDOT), de acuerdo a sus competencias de circunscripción territorial. Por competencia exclusiva les corresponde a los gobiernos municipales " formular, aprobar y evaluar los planes, programas y proyectos destinados a la preservación, mantenimiento y difusión del patrimonio arquitectónico, cultural y natural de su circunscripción..... Para el efecto, el patrimonio en referencia será considerado en todas sus expresiones tangibles e intangible...” (COOTAD Art. 144). Lamentablemente la mayoría de estos gobiernos municipales poco o nada han incorporado el patrimonio cultural tangible e intangible en sus fases de análisis de, diagnóstico, propuesta y modelo gestión. Como base fundamental tomaremos la guía metodológica para la elaboración de planes de desarrollo y ordenamiento que presenta la SENPLADES en el año 2014y la propuesta que realiza el Dr. Domingo Gómez Orea en su libro Ordenación Territorial 2da edición, de ahí se propone una alternativa metodológica de articulación del patrimonio cultural y ordenamiento territorial. Y para lograr este objetivo, utilizaremos la información disponible que cuenta el Instituto nacional de Patrimonio Cultural (INPC) en su sistema informatizado que se encuentra en la página Web www.inpc.gob.ec, denominado Sistema de Información Patrimonial Cultural del Ecuador (SIPCE), esta base de información que contiene fichas de inventario en sus diferentes ámbitos culturales como inmuebles, muebles, documentos. Arqueológicos y manifestaciones inmateriales, previamente analizadas y georreferenciadas nos permitirán territorializar en el espacio cantonal y con ello poder realizar un análisis integrado con los otros componentes como es el medio físico, poblacional, económico, núcleos de población etc. Esta nueva metodología permitirá visualizar, conocer, aprender y empodéranos del patrimonio cultural material e inmaterial, con aquellas manifestaciones culturales y tradicionales que existen y se encuentran en vigencia. También poder recuperar y rescatar aquellas que están en peligro de desaparecer, este potencial cultural será una gran posibilidad de generar emprendimientos y desarrollo sustentable. La manera más idónea de concretar y fomentar este desarrollo sustentable en territorio será a través de la formulación de programas, planes y proyectos que deberán plantearse en los planes de ordenamiento territorial y los planes de desarrollo territorial. Finalmente para comprobar esta nueva propuesta metodológica de articulación entre el patrimonio cultural y el ordenamiento territorial, la aplicaremos al cantón Paltas de la provincia de Loja.

This chapter examines why policy decision-makers opt for command and control environmental regulation despite the availability of a plethora of market-based instruments which are more efficient and cost-effective. Interestingly, Sri Lanka has adopted a wholly command and control system, during both the pre and post liberalisation economic policies. This chapter first examines the merits and demerits of command and control and market-based approaches and then looks at Sri Lanka’s extensive environmental regulatory framework. The chapter then examines the likely reasons as to why the country has gone down the path of inflexible regulatory measures and has become entrenched in them. The various hypotheses are discussed and empirical evidence is provided. The chapter also discusses the consequences of an environmentally slack economy and policy implications stemming from adopting a wholly regulatory approach. The chapter concludes with a discussion of the main results.

Following a trial in June 2009 where the Federal Court heard submissions regarding whether Merck Sharpe and Dohme Australia should be held liable for an increased risk of cardiovascular conditions noted in patients who had taken the anti-inflammatory drug Vioxx, a judgment was handed down against MSDA in March 2010. MSDA appealed to the Full Federal Court, where they were successful. Special leave to appeal to the High Court of Australia was rejected in May 2012. This article will examine the themes raised in the trial judgment and the appropriateness of Australia’s statutory consumer protection regime through the lens of pharmaceutical drug injuries and side effects.

A presente dissertação versa sobre limites para a intervenção do Estado na economia sob a forma empresarial e os controles a ela aplicáveis. Além de abordar o papel do Estado como acionista de sociedades privadas e a compatibilidade dessa forma de intervenção com o ordenamento jurídico brasileiro, promove-se uma releitura da doutrina e jurisprudência sobre as sociedades de economia mista e sobre as empresas públicas. Estuda-se as razões que levam o Estado a intervir na economia de uma maneira geral, seja de forma direta ou indireta, a partir das teorias econômicas normativas e descritivas sobre a intervenção estatal na economia. Discorre-se sobre os fundamentos constitucionais à intervenção do Estado na economia e os possíveis motivos para a criação de empresas estatais e participação minoritária em sociedades privadas, bem como sobre os condicionamentos impostos pelo princípio da livre iniciativa à intervenção do Estado na economia, em especial à luz da jurisprudência dos Tribunais Superiores. Foram abordados, ainda, os princípios da eficiência, da livre concorrência e da proporcionalidade, que também constituem fundamentos e limites gerais à intervenção do Estado na economia, além da necessidade de autorização legal. Além de apresentarmos um breve resumo da discussão histórica sobre a criação das empresas estatais no Brasil e os motivos para a escolha de um ou outro tipo de sociedade estatal, analisa-se o regime jurídico aplicável a essas entidades, à luz dos dispositivos constitucionais e da jurisprudência sobre o tema, incluindo-se o estudo do seu regime de pessoal, de bens, tributário, licitações, contratual, responsabilidade civil e falência. Estudaremos, ainda, as formas de controle incidentes sobre essas entidades. Por fim, a dissertação também abrange o estudo da intervenção do Estado como acionista minoritário em sociedades privadas, abordando os motivos para essa participação societária, bem como a natureza dessa intervenção. Trata-se de empresas controladas pela iniciativa privada, mas que têm algum grau de participação estatal em seu capital. São muitos os motivos que podem levar o Poder Público a participar sem poder de controle em empresas privadas. A participação minoritária pode visar a permitir um maior controle do Estado sobre a empresa participada, ou mesmo a tomada de controle gradual de determinada companhia, mas também pode constituir uma forma de parceria entre a iniciativa estatal e a privada, como forma mais eficiente de fomento de atividades consideradas de interesse público ou de compartilhamento de riscos e custos envolvidos em determinada atividade explorada pelo Poder Público e pela iniciativa privada. Aborda-se a relação das sociedades meramente participadas com a Administração pública, bem como os condicionamentos constitucionais à participação minoritária estatal sem controle em sociedades privadas (proporcionalidade, eficiência, necessidade de autorização legal, realização de procedimento licitatório com vista à escolha do parceiro privado, e controle do Tribunal de Contas da União).

Marine ecosystems are complex networks of organisms interacting either directly or indirectly while under the influence of the physical and chemical properties of the medium they inhabit. The interplay between these biological agents and their abiotic environment results in complex non-linear responses to individual and multiple stressors, influenced by feedbacks between these organisms and their environment. These ecosystems provide key services that benefit humanity such as food provisioning via the transfer of energy to exploited fish populations or climate regulation via the sinking, subsequent mineralization and ultimately storage of carbon in the ocean interior. These key characteristics or emergent features of marine ecosystems are subject to rapid change (e.g. regime shifts; Alheit et al., 2005 and Scheffer et al., 2009), with outcomes that are largely unpredictable in a deterministic sense. The North Atlantic Ocean is host to a number of such systems which are collectively being influenced by the unique physical and chemical features of this ocean basin, such as the Atlantic Meridional Overturning Circulation (AMOC), the basin’s ventilation with the Arctic Ocean, the dynamics of heat transport via the Gulf Stream and the formation of deep water at high latitudes. These features drive the solubility and biological pumps and support the production and environments that results in large exploited fish stocks. Our knowledge of its functioning as a coupled system, and in particular how it will respond to change, is still limited despite the scientific effort exerted over more than 100 years. This is due in part to the difficulty of providing synoptic overviews of a vast area, and to the fact that most fieldwork provides only snapshots of the complex physical, chemical and biological processes and their interactions. These constraints have in the past limited the development of a mechanistic understanding of the basin as a whole, and thus of the services it provides.

This article is derived in in-depth qualitative research in the women’s unit of a male prison in Northern Ireland. The researchers had unprecedented observational and interview access and moved freely within the unit including the punishment block. What follows focuses primarily on the experiences of women and girls, recording their accounts of the impact on their lives of a harsh and neglectful regime. It demonstrates how the institutionalisation of violation and neglect within women’s prisons is often gender specific. Finally, it considers the key research recommendations, noting official responses.

The present work deals with the development of robust numerical tools for Isogeometric Analysis suitable for problems of solid mechanics in the nonlinear regime. To that end, a new solid-shell element, based on the Assumed Natural Strain method, is proposed for the analysis of thin shell-like structures. The formulation is extensively validated using a set of well-known benchmark problems available in the literature, in both linear and nonlinear (geometric and material) regimes. It is also proposed an alternative formulation which is focused on the alleviation of the volumetric locking pathology in linear elastic problems. In addition, an introductory study in the field of contact mechanics, in the context of Isogeometric Analysis, is also presented, with special focus on the implementation of a the Point-to-Segment algorithm. All the methodologies presented in the current work were implemented in a in-house code, together with several pre- and post-processing tools. In addition, user subroutines for the commercial software Abaqus were also implemented.

The obligation of accountability, or the need to make known the economic and financial state of the companies, ceased to be a purely internal activity, becoming a necessity of a general nature. The knowledge of the financial state of the companies, wich is provided by accountability documents, reveals more and more elementary for all interested in the results obtained, whether in terms of profitability, either with a view to assessing the economic and financial health of the companies. This essay aims to a deeper analysis to matters of accountability, in particular, to the special invalidity scheme of corporate resolutions, wich is enshrined in art. 69º of Portuguese Companies Code. We chose to reference the accrual basis accounts approval, through the analysis of financial statements, laying down a set of principles and criteria applicable to different entities. After consideration of the special scheme versed in art. 69º, we conclude there is a certain ambiguity in the adoption of the criteria do delimit each of the hypotheses of the precept, since the legislator uses indeterminate concepts. Nevertheless, if there is a rule, this will be the annulment, and only exceptionally will apply the nullity scheme, where there is injury to the public interest and the interests of the creditors.

The continental shelf of southwest coast of India (Kerala) is broader and . flatter compared to that of the east coast. The unique characteristic feature of the study area (innershelf between Narakkal and Purakkad) is the intermittent appearance of 'mud banks' at certain locations during southwest monsoon. The strong seasonality manifests significant changes in the wind, waves, currents, rainfall, drainage etc., along this area. Peculiar geomorphological variation with high, mid and lowlands in the narrow strip of the hinterland, the geological formations mainly consisting of rocks of metamorphic origin and the humid tropical weathering conditions play significant role in regulating the shelf sedimentation. A complementary pattern of distri bution is observed for clay that shows an abundance in the nearshore. Silt, to a major extent, depicts semblance with clay distribution . Summation of the total asymmetry of grain size distribution are inferred from the variation of skewness and kurtosis.Factor I implies a low energy regime where the transportation and deposition phases are controlled mostly by pelagic suspension process as the factor loadings are dominant on finer phi sizes. The second Factor is inferred to be the result of a high energy regime which gives higher loadings on coarser size fractions. The third Factor which might be a transition phase (medium energy regime) representing the resultant flux of coastal circulation of the re-suspension/deposition and an onshoreoffshore advection by reworking and co-deposition of relict and modern sediments. The spatial variations of the energy regime based on the three end-member factor model exhibits high energy zone in the seaward portion transcending to a low energy one towards the coast.From the combined analysis of granulometry and SEM studies, it is concluded that the sandy patches beyond 20 m depth are of relict nature. They are the resultant responses of beach activity during the lower stand of sea level in the Holocene. Re-crystallisation features on the quartz grains indicate that they were exposed to subaerial weathering process subsequent to thei r deposition
