This paper addresses the broader unresolved issues posed by the patenting of genetic materials that are central to dealing with the tension between the patenting and competition schemes, namely distinguishing between what has already been 'discovered' and economically useful innovations (including the thresholds for novelty and non-obviousness), the exclusion of some subject matter from patenting and the restrictions on access to genetic resources to facilitate further innovation. The possible solutions of raising the threshold patenting standards, taking advantage of international intellectual property law developments and compulsory licensing are examined as ways to ameliorate the possibly detrimental consequences of current genetic material patenting practices. Diverse infectious and inflammatory environmental triggers, through unknown mechanisms, initiate autoimmune disease in genetically predisposed individuals. Here we show that IL-1b, a key cytokine mediator of the inflammatory response, suppresses CD25+CD4+ regulatory T cell function. Surprisingly, suppression by IL-1b occurs only where antigen is presented simultaneously to CD25+CD4+ T cells and to CD25CD4+ antigen-specific effector T cells. Further, NOD mice show an intrinsic over-production of IL-1 that contributes to reduced CD25+CD4+ regulatory T cell function. Thus, inflammation or constitutive over-expression of IL-1b in a genetically predisposed host can initiate a positive feedback loop licensing autoantigen-specific effector cells to inhibit the regulatory T cells maintaining tolerance to self.

Internet gambling presents substantial new challenges to governments and regulatory agencies. Existing approaches to betting, lotteries and gaming are limited by the nature of Internet technology, and the international nature of the activity. Particular aspects of Internet gambling are considered, and the conclusion is reached that prohibition is an ineffectual alternative, and that licensing of gambling services providers is the appropriate approach. This article examines child welfare workers' understanding of physical child abuse and the Implications for those supervising these workers. The article Is based on the results of a study that involved In-depth Interviews and focus groups with statutory child welfare workers. Analysis revealed that workers' understanding of physical child abuse embodied a wide range of ideas that were generally consistent with existing literature. The study highlights the value and utility of a reflective approach In stimulating and making explicit the theoretical underpinnings of child welfare workers practice. Specific Implications for professional supervision are addressed.

With evidence of increasing accident risk due to age-related declines in health and cognition affecting driver performance, there is a need for research promoting safe mobility of older people. The present study aimed to identify transport options and licensing issues for a group of older people in an Australian community. Ninety-five participants aged 75 and over were interviewed about their driving status and accident record and tested for cognitive ability. After stratification on cognitive level and driver status (current, ex-driver or non-driver), 30 were selected for further in-depth interviews concerning demographics, licence status and impact of change, travel options available and used, and travel characteristics. Considerable reliance on the motor vehicle as the mode of transport and the decision to cease driving were major quality-of-life issues. There was little evidence of planning and support in making the decision to stop driving. Some differences in transport decisions on the basis of cognitive level were evident; however, people with severely compromised cognitive ability (and, therefore, unable to give informed consent) had been excluded. The study suggested the need for resources to assist older people/carers/health professionals to plan for the transition from driver to non-driver and to manage alternative transport options more effectively

Little is known about risk management in the public sector This study reports on a survey of senior officers in Australian Commonwealth companies and statutory authorities concerning their practice and attitudes towards the use of derivative instruments for risk management. Using a variety of tests, the most important issue identified by respondents concerning the use of derivatives is for budgeting purposes. Of note, respondents rank commonly cited reasons advanced in the private sector such as reduced bankruptcy costs and taxation, as being relatively unimportant, which is consistent with arguments advanced in the paper The results also indicate that there are significant differences in the level of importance in some issues regarding derivatives use across public sector organisations, particularly those differentiated by a documented risk management plan. The study also documents for the first time the extent of derivatives use in the Australian public sector.

Smart State is a Queensland Government initiative that recognises the central role of knowledge-based economic growth. In this context, the management of intellectual property (IP) within Queensland and Australian government research and development agencies has changed dramatically over recent years. Increasing expectations have been placed on utilising public sector IP to both underpin economic development and augment taxes by generating new revenues. Public sector research and development (R&D) management has come under greater scrutiny to commercialise and/or corporatise their activities. In a study of IP management issues in the Queensland Public Sector we developed a framework to facilitate a holistic audit of IP management in government agencies. In this paper we describe this framework as it pertains to one large public sector Agriculture R&D Agency, the Queensland Department of Primary Industries (QDPI). The four overlapping domains of the framework are: IP Generation; IP Rights; IP Uptake; and Corporate IP Support. The audit within QDPI, conducted in 2000 near the outset of Smart State, highlighted some well developed IP management practices within QDPI's traditional areas of focus of innovation (IP Generation) and IP ownership and licensing (IP Rights). However, further management practice developments are required to improve the domains of IP Uptake and Corporate IP Support.

No contexto da reforma do Estado brasileiro, a descentraliza????o das compet??ncias pol??ticas e administrativas na arena ambiental tem se mostrado um processo din??mico. Muitas inst??ncias locais j?? respondem pela quest??o ambiental. No entanto, isso n??o significa mais compet??ncia administrativa, sustentabilidade institucional, tampouco participa????o democr??tica. Dois casos de pol??tica ambiental s??o retratados no texto: o licenciamento industrial pelos munic??pios brasileiros e o a gest??o florestal pelo Estado do Mato Grosso. A descentraliza????o do licenciamento ambiental para o ??mbito municipal ainda parece fr??gil em munic??pios menores, em um processo que parece ser induzido pelo Estado e n??o pelo controle social local. Em rela????o ?? pol??tica florestal, o caso do Mato Grosso ?? emblem??tico. Ele mostra que a coopera????o com o poder p??blico federal e, em determinados momentos, sua coordena????o s??o de suma import??ncia para que as pol??ticas p??blicas ambientais n??o fiquem ?? merc?? de governos estaduais, que podem envies??-las em favor do ???desenvolvimentismo???, nem percam a legitimidade adiante da fragilidade financeira e institucional dos ??rg??os ambientais locais.

Para tanto, foram selecionados munic??pios da regi??o sul catarinense, tendo em vista o processo recente de cria????o de ??rg??os locais de gest??o ambiental e tamb??m a peculiaridade de a grande maioria desses munic??pios estarem optando pelo estabelecimento de funda????es p??blicas municipais de meio ambiente. Como resultado da investiga????o, se percebeu que um dos fatores principais para a cria????o de organiza????es municipais de gest??o ambiental tem sido a necessidade de maior agilidade nos processos de licenciamento ambiental. Em rela????o ?? op????o pela figura jur??dica das funda????es, o principal argumento dos munic??pios tem sido a maior autonomia e independ??ncia em rela????o ao Executivo municipal para a execu????o de suas a????es.

Com base neste trabalho, poder-se-ia hoje afirmar com maior seguran??a que: i) o movimento de recomposi????o de pessoal no setor p??blico brasileiro, observado durante toda a primeira d??cada de 2000, mostrou-se apenas suficiente para repor praticamente o mesmo estoque de servidores ativos existentes em meados da d??cada de 1990; ii) tampouco se deduz dos dados analisados que os gastos com pessoal tenham sa??do do controle do governo federal, pois, em termos percentuais, essa rubrica permaneceu praticamente constante ao longo da primeira d??cada de 2000, em um contexto de retomada relativa do crescimento econ??mico e tamb??m da arrecada????o tribut??ria; e iii) do ponto de vista qualitativo, evid??ncias da pesquisa indicam que esse movimento atual deve trazer melhorias gradativas ao desempenho institucional, pois vem sendo promovido a partir de crit??rios meritocr??ticos de sele????o (concursos p??blicos), e diante disso as atividades-fim, que exigem n??vel superior de escolariza????o, s??o mais contempladas do que as atividades-meio, indicando a possibilidade de maiores impactos sobre a produtividade agregada do setor p??blico; e tem assumido a forma de vincula????o estatut??ria, em detrimento do padr??o celetista ou de v??rias formas de contrata????o prec??rias, o que coloca o novo contingente sob direitos e deveres comuns e est??veis, podendo com isso gerar maior coes??o e homogeneidade no interior da categoria como um todo, aspecto considerado essencial para um desempenho satisfat??rio do Estado a longo prazo.
