Technologic and socio-economic mutations have always determined challenges not only to lawyers, but to law itself. These phenomena have occurred specially when trying to deal with the hard task of finding solutions for the current increasing mismatch of social interests, for example, bank secrecy and money laundering. Usually occurring simultaneously, they are typical examples of outcomes generated by technological and socio-economic innovations that have become fashionable and captured international attention. At the same time, bank secrecy and money laundering support interests belonging to different dimensions, deserving to be balanced in the light of the heterogeneous mechanisms provided by the law to its practitioners and society as a hole. In order to achieve an outcome in accordance with the Rule of Law´s principles, lawyers´ tools are consequently subordinated to constitutional and social justice. Guided by this purpose, we performed the present study, aiming to analyse bank secrecy and money laundering in the light of the current stablished juridical procedures. We intended to develop a prudent point of view that is also in accordance with social reality. In sum, we demonstrate that bank secrecy should adopt a flexible character, embedding new settings and following the socio-economic path in a globalized world with constant innovations.

La recherche que nous avons mené à bien avait pour but, dans un premier temps de comprendre la notion de contrat, ses caractéristiques, fonctions et les garanties qui en peuvent être fournies. Nous invoquerons le contenu du contrat, c'est à dire, les effets de celui-ci en essayant de montrer les droits et obligations auxquels les parties seront liées. Bien qu'étant un contrat assez requérant dans la pratique bancaire, celui-ci n'a pas encore attiré l'attention du législateur de façon à établir un régime qui pourrait lui être appliqué au lieu de s'appuyer sur d'autres contrats lui étant similaires. Nous proposons l'analyse de la cessation du contrat, en se concentrant sur les moyens de la dissolution, survenue suite à la conclusion de l'accord comme la plainte, l'abrogation, l'expiration et la résolution du contrat, en laissant de côté la dissolution du contrat pour des raisons survenues avant la conclusion du contrat, comme la nullité et l'annulation.

The aim of the present dissertation is the analysis of the regime established by Decree-Law No. 227/2012 of 25 October. Reflecting on the referred regime, as a measure to prevent and manage situations of failure to meet the obligations assumed by consumers, the study focuses on the plan of action for debt risk and the extrajudicial procedure to regularize situations of default. The main point is to analyze the purpose and the scope of the regime, and to discuss some key-concepts relevant to its application. In addition, another two figures presented in the regime of Decree-Law No. 227/2012 are considered, namely: the Credit Mediator and the Extrajudicial Network for Bank Clients Support, making reference to their role and the scope of their intervention. Finally, along the work on the present Decree-Law, the some international practices are also analyzed, making reference to the problem of financial illiteracy, and mentioning three foreign examples regarding the adopted solutions to the problem of different legal systems, with reference to consumers’ over-indebtedness.

Tax evasion and fraud threaten the economic and social objectives of modern tax systems, precluding the state funding for the satisfaction of collective needs and the fair distribution of wealth, being a violation of basic principles and values of our society. In tax law, to give tax administration the necessary powers to supervise and control the information provided by taxpayers and combat tax evasion and fraud, over the last years the grounds for a derogation of bank secrecy without judicial authorization have been extended, which raises some constitutional compatibility issues. Similarly, this tendency of making this legal regime more flexible and increasing automatic exchange of information has been followed by the European Union and the international community. Banking secrecy, as a professional secrecy, is an instrument to protect the right to privacy but also appears as an anti-abuse and repressive mechanism of evasive and fraudulent behaviors. Because of the conflict of interests will always be necessary to make a practical agreement between them, ensuring the legality and the due guarantees of the taxpayers but also an effective way to combat tax evasion and fraud. Bank secrecy cannot be one method to, behind the right to privacy, taxpayers practice illegal activities. But the practice of these irregular conducts also does not justify a total annihilation of the right to banking secrecy, uncovering all documents and bank information’s. Although considering the legislative changes, the administrative derogation of bank secrecy will always be what the tax administration does of it.

Em tempos nos quais muito se discute acerca dos reflexos da crise ambiental na educação, e dos valores, princípios e objetivos que melhor lhe caberiam para proporcionar caminhos inovadores à superação da problemática ecológica, em toda a sua complexidade, esta pesquisa buscou investigar as contribuições da edição de 2012 do projecto de educação ambiental não-formal “Histórias de Quintal”, da Organização Não-Governamental EMCANTAR, para o empoderamento de seu público-alvo. Num primeiro momento, elaboramos um mosaico teórico acerca da educação ambiental emancipatória, a única que, a nosso ver, revela os verdadeiros sentidos da educação ambiental. Para isso, (i) promovemos um breve resgate histórico da educação ambiental no cenário mundial; (ii) oferecemos uma visão geral da perspectiva emancipatória da educação ambiental (pressupostos e fundamentos, princípios, características gerais e objetivos); (iii) estabelecemos um corte diferencial entre as perspectivas convencional e emancipatória; (iv) ofertamos uma crítica à expressão “Educação para o desenvolvimento sustentável”; (v) realizamos um voo panorâmico sobre a dimensão não-formal da educação ambiental; (vi) discutimos o empoderamento sob a óptica da pedagogia libertária de Freire (1987); e (vii) concatenamos essas ideias entre si e com outras correlatas, como desigualdade social, cidadania e participação social. Num momento seguinte, apresentamos o projecto em estudo e discorremos acerca de seus pontos principais, bem como das atividades que foram realizadas em seu âmbito no ano de 2012. Por último, realizámos entrevistas com os participantes nas actividades e confrontamos os dados colhidos com o que fora apresentado sobre a educação ambiental emancipatória para, assim, apresentar as conclusões alcançadas. Constatamos que a educação ambiental promovida pelo “Histórias em Quintal”, em 2012, teve um perfil emancipatório e que, enquanto projecto de educação não-formal, ele teve também as características, princípios, objetivos e metodologias que permitem a promoção de uma educação ambiental verdadeiramente compromissada com a libertação dos oprimidos (Freire, 1987) e com a transformação da sociedade, e que, por isso, contribuiu para um empoderamento inicial e a nível individual do grupo-alvo.

A presente dissertação pretende analisar a luta contra a pobreza na Comunidade para o Desenvolvimento da África Austral (SADC), através do estudo do “Caso de Moçambique, 1987 – 2000”. Este estudo analisa também aspetos pertinentes para a Regionalização do Sistema Internacional, dando maior enfase ao surgimento da SADC, os seus obstáculos e a Segurança na região. Relativamente à luta contra a pobreza na Região, Moçambique tem como posição que o combate à pobreza é a forma de luta pela segurança, pois considera um risco existirem “pessoas que vegetam na pobreza e serem facilmente recrutados por grupos interessados em por em causa a segurança mundial, aliás a pobreza provou que é uma ameaça sistémica e sistemática à paz mundial” (Teleinforma 27/09/2013). Neste contexto, este trabalho enfoca o Plano de Ação para a Redução da Pobreza Absoluta (PARPA), estudando o caso do Fundo para o Desenvolvimento Local, vulgo 7 milhões de meticais em Moçambique, alocados anualmente aos Distritos e Municípios. Da pesquisa efetuada verifica-se que, a forma usada para a atribuição do Fundo para o Desenvolvimento Local aos camponeses, não tem sido a mais criteriosa, razão pela qual não reembolsam, depois dos prazos estabelecidos. Nota-se ainda, existência de fraca capacidade de controlo de aplicação pela entidade gestora. Como tal, conclui-se que o Governo tem agido como Banco, vocação que não lhe é competente. Assim, se propõe: a) Criação de um Instituto de Apoio ao Desenvolvimento Local onde cada Distrito teria um Gabinete de Apoio e Monotorização ao Fundo. b) O Gabinete assessoraria os camponeses na promoção dos produtos de forma a rentabilizar os projetos, devido a fraca sensibilização das comunidades locais na gestão do fundo, na elaboração de projetos que possam ser elegíveis ao financiamento bancário.

The following report aims to present the internship developed under the Master in Legal Sciences Business in the Legal Affairs management of Caixa Geral de Depósitos S.A. Activities were developed in the field of Banking Law, focusing on the Special Revitalization Process. The aim of these activities was to promote the construction of a study that, apart from its doctrinal and jurisprudential research, also excels in the practical adequacy of the regime lectured. The revitalizing effectiveness of the Special Revitalization Process is erected in the Article 17-E, nº 1, which establishes a series of procedural – stand still effects - which aim to allow the debtor "breathing space", ie, a period during which creditors are prevented from setting up "actions for debt collection" against him, suspending the pending actions with identical purposes. Therefore, this report essentially studies these effects, considering "actions in debt collection" executive actions that are intended to recover a debt of any kind, including anticipatory precautionary procedures of an action of this nature. In addition, it is necessary to set boundaries temporally and subjectively to the standstill period, understanding that this period should be extended beyond the legally established period, in order to preserve the ratio of the process, concretely, until the recovery plan effects. In turn, we understand that the standstill effects only apply to the established material in connection with the debtor, remaining the rights of creditors unaffected over the ones of the guarantors and debtors.

Contractual provisions directed towards the fulfillment of the contract itself or concerning the promisor’s conduct are nowadays widespread (both geographically and regarding the situations in which they are used), posing interpretative problems that demand the consideration of private autonomy’s extent and its limits on their application. A number of such clauses or covenants proliferate on all sectors of juridical activity, although with different configurations in each particular situation, whereby the study of negative pledge, pari passu, cross-default and ownership clauses merely constitutes a conceptual framework for considerations concerning the virtues and challenges of this type of contractual arrangements, particularly in relation to the precepts of the legal system as a whole. This study also aims to display the special characteristics that justify their prevalence in banking and financial law. We intend to analyze their, mostly preventive, function, typifying the main problems that arise, as well as their limitations and advantages.
