The need for mutual recognition of accurate measurement results made by competent laboratories has been very widely accepted at the international level e.g., at the World Trade Organization. A partial solution to the problem was made by the International Committee for Weights and Measures (CIPM) in setting up the Mutual Recognition Arrangement (CIPM MRA), which was signed by National Metrology Institutes (NMI) around the world. The core idea of the CIPM MRA is to have global arrangements for the mutual acceptance of the calibration certificates of National Metrology Institutes. The CIPM MRA covers all the fields of science and technology for which NMIs have their national standards. The infrastructure for the metrology of the gaseous compounds carbon monoxide (CO), nitrogen monoxide (NO), nitrogen dioxide (NO2), sulphur dioxide (SO2) and ozone (O3) has been constructed at the national level at the Finnish Meteorological Institute (FMI). The calibration laboratory at the FMI was constructed for providing calibration services for air quality measurements and to fulfil the requirements of a metrology laboratory. The laboratory successfully participated, with good results, in the first comparison project, which was aimed at defining the state of the art in the preparation and analysis of the gas standards used by European metrology institutes and calibration laboratories in the field of air quality. To confirm the competence of the laboratory, the international external surveillance study was conducted at the laboratory. Based on the evidence, the Centre for Metrology and Accreditation (MIKES) designated the calibration laboratory at the Finnish Meteorological Institute (FMI) as a National Standard Laboratory in the field of air quality. With this designation, the MIKES-FMI Standards Laboratory became a member of CIPM MRA, and Finland was brought into the internationally-accepted forum in the field of gas metrology. The concept of ‘once measured - everywhere accepted’ is the leading theme of the CIPM MRA. The calibration service of the MIKES-FMI Standards Laboratory realizes the SI traceability system for the gas components, and is constructed to enable it to meet the requirements of the European air quality directives. In addition, all the relevant uncertainty sources that influence the measurement results have been evaluated, and the uncertainty budgets for the measurement results have been created.

The aim of this thesis was to study the seismic tomography structure of the earth s crust together with earthquake distribution and mechanism beneath the central Fennoscandian Shield, mainly in southern and central Finland. The earthquake foci and some fault plane solutions are correlated with 3-D images of the velocity tomography. The results are discussed in relation to the stress field of the Shield and with other geophysical, e.g. geomagnetic, gravimetric, tectonic, and anisotropy studies of the Shield. The earthquake data of the Fennoscandian Shield has been extracted from the Nordic earthquake parameter data base which was founded at the time of inception of the earthquake catalogue for northern Europe. Eight earlier earthquake source mechanisms are included in a pilot study on creating a novel technique for calculating an earthquake fault plane solution. Altogether, eleven source mechanisms of shallow, weak earthquakes are related in the 3-D tomography model to trace stresses of the crust in southern and central Finland. The earthquakes in the eastern part of the Fennoscandian Shield represent low-active, intraplate seismicity. Earthquake mechanisms with NW-SE oriented horizontal compression confirm that the dominant stress field originates from the ridge-push force in the North Atlantic Ocean. Earthquakes accumulate in coastal areas, in intersections of tectonic lineaments, in main fault zones or are bordered by fault lines. The majority of Fennoscandian earthquakes concentrate on the south-western Shield in southern Norway and Sweden. Onwards, epicentres spread via the ridge of the Shield along the west-coast of the Gulf of Bothnia northwards along the Tornio River - Finnmark fault system to the Barents Sea, and branch out north-eastwards via the Kuusamo region to the White Sea Kola Peninsula faults. The local seismic tomographic method was applied to find the terrane distribution within the central parts of the Shield the Svecofennian Orogen. From 300 local explosions a total of 19765 crustal Pg- and Sg-wave arrival times were inverted to create independent 3-D Vp and Vs tomographic models, from which the Vp/Vs ratio was calculated. The 3-D structure of the crust is presented as a P-wave and for the first time as an S-wave velocity model, and also as a Vp/Vs-ratio model of the SVEKALAPKO area that covers 700x800 km2 in southern and central Finland. Also, some P-wave Moho-reflection data was interpolated to image the relief of the crust-mantle boundary (i.e. Moho). In the tomography model, the seismic velocities vary smoothly. The lateral variations are larger for Vp (dVp =0.7 km/s) than for Vs (dVs =0.4 km/s). The Vp/Vs ratio varies spatially more distinctly than P- and S-wave velocities, usually from 1.70 to 1.74 in the upper crust and from 1.72 to 1.78 in the lower crust. Schist belts and their continuations at depth are associated with lower velocities and lower Vp/Vs ratios than in the granitoid areas. The tomography modelling suggests that the Svecofennian Orogen was accreted from crustal blocks ranging in size from 100x100 km2 to 200x200 km2 in cross-sectional area. The intervening sedimentary belts have ca. 0.2 km/s lower P- and S-wave velocities and ca. 0.04 lower Vp/Vs ratios. Thus, the tomographic model supports the concept that the thick Svecofennian crust was accreted from several crustal terranes, some hidden, and that the crust was later modified by intra- and underplating. In conclusion, as a novel approach the earthquake focal mechanism and focal depth distribution is discussed in relation to the 3-D tomography model. The schist belts and the transformation zones between the high- and low-velocity anomaly blocks are characterized by deeper earthquakes than the granitoid areas where shallow events dominate. Although only a few focal mechanisms were solved for southern Finland, there is a trend towards strike-slip and oblique strike-slip movements inside schist areas. The normal dip-slip type earthquakes are typical in the seismically active Kuusamo district in the NE edge of the SVEKALAPKO area, where the Archean crust is ca. 15-20 km thinner than the Proterozoic Svecofennian crust. Two near vertical dip-slip mechanism earthquakes occurred in the NE-SW junction between the Central Finland Granitoid Complex and the Vyborg rapakivi batholith, where high Vp/Vs-ratio deep-set intrusion splits the southern Finland schist belt into two parts in the tomography model.

The study analyses European social policy as a political project that proceeds under the guidance of the European Commission. In the name of modernisation, the project aims to build a new idea for the welfare state. To understand the project, it is necessary to distance oneself from both the juridical competence of the European Union and the traditional national welfare state models. The question is about sharing problems, as well as solutions to them: it is the creation and sharing of common views, concepts and images that play a key role in European integration. Drawing on texts and speeches produced by the European Commission, the study throws light on the development of European social policy during the first years of the 2000s. The study "freeze-frames" the welfare debate having its starting points in the nation states in the name of the entity of Europe. The first article approaches the European social model as a story in itself, a preparatory, persuasive narrative that concerns the management of change. The article shows how the audience can be motivated to work towards a set target by using discursive elements in a persuasive manner: the function of a persuasive story is to convince the target audience of the appropriateness of the chosen direction and to shape their identity so that they are favourably disposed to the desired political targets. This is a kind of "intermediate state" where the story, despite its inner contradictions and inaccuracies, succeeds in appearing as an almost self-evident path towards a modern social policy that Europe is currently seen to be in need of. The second article outlines the European social model as a question of governance. Health as a sector of social policy is detached from the old political order, which was based on the welfare state, and is closely linked to economy. At the same time the population is primarily seen as an economic resource. The Commission is working towards a "Europe of Health" that grapples with the problem of governance with the help of the "healthisation" of society, healthy citizenship and health economics. The way the Commission speaks is guided by the Union's powerful interest to act as "Europe" in the field of welfare policy. At the same time, the traditional separateness of health policy is effaced in order to be able to make health policy reforms a part of the Union's wider modernisation targets. The third article then shows the European social policy as its own area of governance. The article uses an approach based on critical discourse analysis in examining the classification systems and presentation styles adopted by Commission communications, as well as the identities that they help build. In analysing the "new start" of the Lisbon strategy from the perspective of social policy, the article shows how the emphasis has shifted from the persuasive arguments for change with necessary common European targets in the early stages of the strategy towards the implementation of reforms: from a narrative to a vision and from a diagnosis to healing. The phase of global competition represents "the modern" with which European society with its culture and ways of life now has to be matched. The Lisbon strategy is a way to direct this societal change, thus building a modern European social policy. The fourth article describes how the Commission uses its communications policy to build practices and techniques of governance and how it persuades citizens to participate in the creation of a European project of change. This also requires a new kind of agency: agents for whom accountability and responsibilities mean integration into and commitment to European society. Accountability is shaped into a decisive factor in implementing the European Union's strategy of change. As such it will displace hierarchical confrontations and emphasise common action with a view to modernising Europe. However, the Union's discourse cannot be described as being a political language that would genuinely rouse and convince the audience at the level of everyday life. Gender perceptions, religious belief systems, and political thought have excluded women from politics, for ages, around the world. Combining feminist and modernisation theorists in my theoretical framework, I examine the trends in patriarchal Europe and I highlight the gender-sensitive model of the Nordic countries. Retracing local gender patterns from precolonial to postcolonial eras in sub-Saharan Africa, I explore the links between perceptions, needs, resources, education and women's political participation in Cameroon. Democratisation is supposed to open up political participation, to grant equal opportunities to all adults. One ironic feature of the liberalisation process in Cameroon has been the decrease of women in parliamentarian representation (14% in 1988, 6% in 1992, 5% in 1997 and 10% in 2002). What social, cultural and institutional mechanisms produced this paradoxical outcome, the exclusion of half the population? The gender complementarity of the indigenous context has been lost to male prevalence privileged by education, church, law, employment, economy and politics in the public sphere; most women are marginalised in the private sphere. Nation building and development have failed; ethnicism and individualism are growing. Some hope lies in the growing civil society. From two surveys and 21 focus groups across Cameroon, in 2000 and 2002, some significant results of the processed empirical data reveal low electoral registration (34.5% women and 65.9% men), contrasted by the willingness to run for municipal elections (33.3 % women and 45.2% men). The co-existence of customary and statutory laws, the corrupt political system and fraudulent practices, contribute to the marginalisation of women and men who are interested in politics. A large majority of female respondents consider female politicians more trustworthy and capable than their male counterparts; they even foresee the appointment of a female Prime Minister. The Nordic countries have institutionalised gender equality in their legislation, policies and practices. France has improved women's political inclusion with the parity laws; Rwanda is another model of women's representation, thanks to its post-conflict constitution. From my analysis, Cameroonian institutions, men and more so women, may learn and borrow from these experiences, in order to design and implement a sustainable and gender-balanced democracy. Corporate social responsibility (CSR) is no longer only an issue of companies but a concern shared by e.g. the European Union, the International Labour Organization, labour market organizations and many others. This thesis examines what kind of voluntary corporate social responsibility exceeding the minimum level set in the legislation can be expected from the Finnish companies. The research was based on the interviews of some representatives of Finnish companies and of external stakeholders. Earlier Finnish empirical research on the topic has solely analysed the stakeholder thinking and the ethics of the views of the company representatives. The views of the external stakeholders brought ht up a much more versatile perspective on the voluntary corporate social responsibility of the companies. That is the particular surplus value of this research. This research, founded on stakeholder thinking, evaluated what kind of starting points and ideas on responsibility the views of the representatives of the companies and the external stakeholders were based on the voluntary social responsibility. Furthermore, the research also investigated how their views about the corporate social responsibility indicated the benefits achieved on the cooperative actions with different partners - for example companies, communities and public administration. To fulfil the aims of the research, the following questions were used as part tasks in mapping the basic foundations and starting points expressed by the representatives of the companies and the external stakeholders: 1) How do laws, directions concerning social responsibility of companies, and opinions and demands of the stakeholders guide and affect the voluntary corporate social responsibility? 2) How can companies assume voluntary corporate social responsibility in addition to their core functions and without compromising their profitability, and how does, for example, the tightening competition affect the possibility of taking responsibility? 3) What kind of ethic and moral foundations is the corporate social responsibility based on? 4) What kind of roles can companies have in securing and promoting the well-being of citizens in Finland and on the global market as one subsystem of the society? The views on the voluntary corporate social responsibility of nine big companies, one medium-sized company and one small company, all considered responsible pioneer companies, were studied with surveys and half-structured theme interviews between 2003 and 2004. The research proceeded as a theory-bounded study. The empirical material and the previous stakeholder thinking theories (Takala 2000b, Vehkaperä 2003) guided the thesis and worked abductively in interplay with each other during the research process. (Tuomi, Sarajärvi 2002.) The aims and the methods of the research and the themes of the interviews were defined on the basis of that information. The aims of the research were surveyed qualitatively with the strategy of a multiple case study. Representatives from nine big peer companies and nine external stakeholders were interviewed with half-structured themes between 2004 and 2005. The external stakeholders and the peer companies were chosen with the "thinking" of theoretical replication by Yin, according to which the views of the representatives of those groups would differ from those of the pioneer companies and also from those of each others. The multiple case study supports analysing the internal cohesion of the views of different groups and comparing their differences, and it supports theoretical evaluation and theory-building as well. (Yin 2003.) Another reason for choosing the external stakeholders was their known cooperation with companies. The spoken argumentations of the company and stakeholder representatives on the voluntary social responsibility of the companies were analysed and interpreted in the first place with an analytic discourse analysis, and the argumentations were classified allusively into the stakeholder discourses in three of the part tasks. In the discourse analysis, argumentations of the speech is seen to be intervowen with cultural meanings. (Jokinen, Juhila 1999.) The views of the representatives of the pioneer companies and the external stakeholders were more stakeholder-orientated than the views of the representatives of the peer companies. For the most part, the voluntary corporate social responsibility was seemingly targeted on single, small cooperation projects of the companies and external stakeholders. The pioneer companies had more of those projects, and they were participating in the projects more actively than the peer companies were. The significant result in this research was the notion that, in particular, the representatives of the pioneer companies and external stakeholders did not consider employing and paying taxes to be enough of reciprocal corporate social responsibility. However, they still wanted to preserve the Finnish welfare model, and the interviewees did not wish major changes in the present legislation or the social agreements. According to this study, the voluntary corporate social responsibility is motivated by ethical utilitarianism which varied from very narrow to very wide in relation to benefits achieved by companies and stakeholders (Velasquez 2002, Lagerspetz 2004). Compared with the peer companies, more of the representatives of the pioneer companies and of external stakeholders estimated that companies in their decision-making and operations considered not only the advantages and the benefits of the owners and other internal stakeholders, but also those of the external stakeholders and of the whole society. However, all interviewees expressed more or less strongly that the economic responsibility guides the voluntary responsible actions of the companies in the first place. This kind of utilitarian foundation of behaviour appeared from this research was named as business-orientated company moral. This thesis also presents a new voluntary corporate social responsibility model with four variables on the stakeholder discourses and their distinctive characteristics. The utilitarian motivation of a company s behaviour on their operations has been criticized on the grounds that the end justifies the means. It has also been stated that it is impossible to evaluate the benefits of the utilitarian type of actions to the individuals and the society. It is expected however that companies for their part promote the material and immaterial well-being of the individuals on the global, national and local markets. The expectations are so strong that if companies do not take into account the ethical and moral values, they can possibly suffer significant financial losses. All stakeholders, especially consumers, can with their own choices promote the responsible behaviour of the companies. This study analyzes civic activity, citizenship and their gendered manifestations in contemporary Russia. It is based on a case study conducted in the city of Tver , located in the vicinity of Moscow, during 2001-2005. The data consists of interviews with civic activists and municipal and regional authorities; observations of civic organizations; and a quantitative survey conducted among local civic groups. The theoretical and methodological framework of the study draws upon a micro perspective on organization, discourse analysis, gender and citizenship theories and Pierre Bourdieu s theory of fields and capital. This study develops theoretical understanding of the characteristics and logic of civic organization in Russia. It shows that social class centrally structures the field of civic activity. Organizations can be seen as a vehicle of the educated class to advocate their interests, help themselves and seek both social and individual-level change. The study also argues that civic organizations founded during the post-Soviet era are often an institutionalized form of informal social networks. Networks, which were a central element of everyday interaction in Soviet society, are a resource and often the only resource available that can be made use of in contemporary organizational activities. The study argues that gender operates as a key structuring principle in the Russian socio-political community. Civic activity is often discursively associated with femininity and institutional politics with masculinity. Women tend to participate more than men in civic organizations, while men dominate the formal political domain. The study shows that civic organizations are important loci of communality. This communality, however, differs from the communality envisioned in the communitarian and social capital debates in the West. It is selective communality , as it is restricted to the members of the organizations and does not create generalized reciprocity and trust. Civic organizations tend to build upon and reproduce the traditional Russian organizational form of circles , kruzhki. Along with the analysis of civic activities, the study also examines the redefinition of the role and functions of the state. The authorities interviewed in this study understand civic organizations as serving those goals and interests determined by the authorities, instead of viewing them as sites of citizens self-organization around interests and problems citizens themselves deem important, or as a counterforce to the state. By contrast, civic activists understand the core of organizational activity to be advocacy of their interests and rights, tackling social problems, the pursuit of wider social change and self-help. Co-operation between authorities and organizations tends to be personified and based upon unequal, hierarchical patron-client arrangements, which inhibits the development of democratic governance. The study will be published in Routledge Contemporary Russia and Eastern Europe Series later this year.

The thesis examines urban issues arising from the transformation from state socialism to a market economy. The main topics are residential differentiation, i.e., uneven spatial distribution of social groups across urban residential areas, and the effects of housing policy and town planning on urban development. The case study is development in Tallinn, the capital city of Estonia, in the context of development of Central and Eastern European cities under and after socialism. The main body of the thesis consists of four separately published refereed articles. The research question that brings the articles together is how the residential (socio-spatial) pattern of cities developed during the state socialist period and how and why that pattern has changed since the transformation to a market economy began. The first article reviews the literature on residential differentiation in Budapest, Prague, Tallinn and Warsaw under state socialism from the viewpoint of the role of housing policy in the processes of residential differentiation at various stages of the socialist era. The paper shows how the socialist housing provision system produced socio-occupational residential differentiation directly and indirectly and it describes how the residential patterns of these cities developed. The second article is critical of oversimplified accounts of rapid reorganisation of the overall socio-spatial pattern of post-socialist cities and of claims that residential mobility has had a straightforward role in it. The Tallinn case study, consisting of an analysis of the distribution of socio-economic groups across eight city districts and over four housing types in 1999 as well as examining the role of residential mobility in differentiation during the 1990s, provides contrasting evidence. The third article analyses the role and effects of housing policies in Tallinn s residential differentiation. The focus is on contemporary post-privatisation housing-policy measures and their effects. The article shows that the Estonian housing policies do not even aim to reduce, prevent or slow down the harmful effects of the considerable income disparities that are manifest in housing inequality and residential differentiation. The fourth article examines the development of Tallinn s urban planning system 1991-2004 from the viewpoint of what means it has provided the city with to intervene in urban development and how the city has used these tools. The paper finds that despite some recent progress in planning, its role in guiding where and how the city actually developed has so far been limited. Tallinn s urban development is rather initiated and driven by private agents seeking profit from their investment in land. The thesis includes original empirical research in the three articles that analyse development since socialism. The second article employs quantitative data and methods, primarily index calculation, whereas the third and the fourth ones draw from a survey of policy documents combined with interviews with key informants. Increasing antimicrobial resistance in bacteria has led to the need for better understanding of antimicrobial usage patterns. In 1999, the World Organisation for Animal Health (OIE) recommended that an international ad hoc group should be established to address human and animal health risks related to antimicrobial resistance and the contribution of antimicrobial usage in veterinary medicine. In European countries the need for continuous recording of the usage of veterinary antimicrobials as well as for animal species-specific and indication-based data on usage has been acknowledged. Finland has been among the first countries to develop prudent use guidelines in veterinary medicine, as the Ministry of Agriculture and Forestry issued the first animal species-specific indication-based recommendations for antimicrobial use in animals in 1996. These guidelines have been revised in 2003 and 2009. However, surveillance on the species-specific use of antimicrobials in animals has not been performed in Finland. This thesis provides animal species-specific information on indication-based antimicrobial usage. Different methods for data collection have been utilized. Information on antimicrobial usage in animals has been gathered in four studies (studies A-D). Material from studies A, B and C have been used in an overlapping manner in the original publications I-IV. Study A (original publications I & IV) presents a retrospective cross-sectional survey on prescriptions for small animals at the Veterinary Teaching Hospital of the University of Helsinki. Prescriptions for antimicrobial agents (n = 2281) were collected and usage patterns, such as the indication and length of treatment, were reviewed. Most of the prescriptions were for dogs (78%), and primarily for the treatment of skin and ear infections most of which were treated with cephalexin for a median period of 14 days. Prescriptions for cats (18%) were most often for the treatment of urinary tract infections with amoxicillin for a median length of 10 days. Study B (original publication II) was a retrospective cross-sectional survey where prescriptions for animals were collected from 17 University Pharmacies nationwide. Antimicrobial prescriptions (n = 1038) for mainly dogs (65%) and cats (19%) were investigated. In this study, cephalexin and amoxicillin were also the most frequently used drugs for dogs and cats, respectively. In study C (original publications III & IV), the indication-based usage of antimicrobials of practicing veterinarians was analyzed by using a prospective questionnaire. Randomly selected practicing veterinarians in Finland (n = 262) recorded all their antimicrobial usage during a 7-day study period. Cattle (46%) with mastitis were the most common patients receiving antimicrobial treatment, generally intramuscular penicillin G or intramammary treatment with ampicillin and cloxacillin. The median length of treatment was four days, regardless of the route of administration. Antimicrobial use in horses was evaluated in study D, the results of which are previously unpublished. Firstly, data collected with the prospective questionnaire from the practicing veterinarians showed that horses (n = 89) were frequently treated for skin or wound infections by using penicillin G or trimethoprim-sulfadiazine. The mean duration of treatment was five to seven days. Secondly, according to retrospective data collected from patient records, horses (n = 74) that underwent colic surgery at the Veterinary Teaching Hospital of the University of Helsinki were generally treated according to national and hospital recommendations; penicillin G and gentamicin was administered preoperatively and treatment was continued for a median of three days postoperatively. In conclusion, Finnish veterinarians followed well the national prudent use guidelines. Narrow-spectrum antimicrobials were preferred and, for instance, fluoroquinolones were used sparingly. Prescription studies seemed to give good information on antimicrobials usage, especially when combined with complementary information from patient records. A prospective questionnaire study provided a fair amount of valuable data on several animal species. Electronic surveys are worthwhile exploiting in the future.

The doctoral thesis deals with Finnish and foreign expert s analyses of Finland s military strategic position and defence capability, dating back to the early years of the Cold War. Finland s military high command prepared assessments of the country s strategic position and of the capability of the Defence Forces as grounds for defence planning. Since Finland was located on the Cold War dividing line, the foreign powers were also monitoring the development of Finland s situation. The research carried out had access to the armed forces internal assessments, as well as to analyses prepared by the military intelligence services of Sweden, Britain and the United States. One of the working hypotheses was that after the WWII the ability military leadership to estimate the security political needs of the country and the organisation of its defence was severely weakened so that the dangers of the international development were not perceived and the gradual erosion of defence capability was partly unnoticed. This hypothesis proved to be wrong. Even if the Finnish military intelligence was much weaker than during the war, it was able to provide the military leadership with information of the international military development for the most part. The military leadership was also fully aware of the weakening of the defence capability of the country. They faced the difficult task of making the country s political leadership, i.e. President Paasikivi and the government, also understand the gravity of the situation. Only in the last years of his term in office Paasikivi started to believe the warnings of the military. According to another hypothesis, outside observers considered the Finnish armed forces to primarily act as reinforcements for the Soviet Red Army, and they believed that, in the event of a full-scale war, the Finns would not have been able or even willing to resist a Soviet invasion of Sweden and Norway through Finland. The study confirmed that this was approximately the view the Swedes, the British and the Americans had of the Finnish forces. Western and Swedish intelligence assessments did not show confidence in Finland s defence ability and the country was regarded almost as a Soviet satellite. Finland s strategic position was, however, considered slightly different from that of the Soviet-occupied Eastern European countries. Finland had been forced to become part of the Soviet sphere of interest and security system and this was sealed by the Finno-Soviet Treaty of Friendship, Cooperation, and Mutual Assistance in 1948. Finland had little importance to the military interests of the Western powers. In Sweden s defence planning, however, Finland played a significant role as an alarm bell of a possible Soviet surprise attack, as well as defensive frontline and buffer zone.

Globalisaatio on luonut uuden maailmanjärjestelmän jonka myötä yksittäisten valtioiden vaikutusvalta on vähentynyt entisestään. Tämä pitää paikkansa erityisesti kehittyvien maiden kohdalla, esimerkiksi Afrikassa. Afrikka on pyrkinyt taistelemaan globalisaation tuomia negatiivisia vaikutuksia vastaan alueellistumisen ja maanosan yhtenäisyyttä ajavien hankkeiden kautta jo vuosikymmenien ajan, mutta toistaiseksi tulokset eivät ole olleet vakuttavia. Tällä hetkellä Afrikan Unionissa keskustellaan hankkeesta muodostaa Afrikan Yhdysvallat. Aiemmista hankkeista poiketen tämän uuden aloitteen ajatus perustuu ylikansallisuudelle, jossa yksittäiset valtiot luovuttavat valtaansa ylikansallisille elimille, kuten Afrikan Unionin hallitukselle. Näin ollen on tärkeää tarkastella aloitetta Afrikan Yhdysvaltojen perustamiseksi ja arvioida, voisiko tällainen ylikansallinen organisaatio auttaa Afrikkaa kääntämään globalisaation haittavaikutukset myönteisiksi. Tämä Pro Gradu-tutkielma väittää sen olevan mahdollista, mutta vain siinä tapauksessa että Afrikka on valmis hyväksymään yhtenäisyyden rajoitukset. Aiemman tutkimuksen vähyyden vuoksi on myös tarpeen tutkia Afrikan Yhdysvalloista kansallisilla tasoilla käytävää keskustelua. Tämän vuoksi tässä tutkielmassa painotetaan esimerkkimaa Sambian kautta yhden Afrikan Unionin jäsenmaan keskinäistä keskustelua aiheesta ja verrataan sitä Afrikan Unionin tason keskusteluun. Tutkielma sisältää kirjallisuuskatsauksen sekä tapaustutkimuksen. Tutkimusaineisto koostuu sambialaisista sanomalehtiotteista sekä Sambian valtion ja Afrikan Unionin virallisista asiakirjoista. Pääasiallisena tutkimusmenetelmänä on laadullinen sisällönanalyysi. Teoreettinen viitekehys perustuu afrikkalaisen valtion ja kansalaisyhteiskunnan, alueellistumisen, globalisaation hallinnan, pan-afrikkalaisuuden ja poliittisen integraation teorioihin sekä historialliseen katsaukseen Afrikan yhtenäisyydestä. Perimmäisenä tarkoituksena on lisätä ymmärrystä afrikkalaisesta valtiosta ja politiikasta. Tutkimuksen tulosten mukaan on havaittavissa aukko valtioiden virallisten toimijoiden näkemysten ja kansalaisyhteiskunnan huolenaiheiden välillä. Viralliset toimijat näyttävät olevan kansalaisyhteiskuntaa vahvemmin Afrikan Yhdysvaltojen kannalla. Virallisten toimijoiden korostaessa Afrikan aatteellista yhtenäisyyttä kansalaisyhteiskunta on huolissaan sen toteutumisesta käytännössä. Esiin nousee myös kysymys 'afrikkalaisesta' identiteetistä ja kansalaisuudesta sekä kommunikaatiosta valtion ja kansalaisten välillä.

Naton Kosovon-interventiolla vuonna 1999 ja Venäjän Georgian-interventiolla vuonna 2008 ei äkkiseltään katsottuna ole juurikaan yhteistä. Molemmissa tapauksissa kuitenkin suurempi valtio tai organisaatio toteutti sotilaallisen intervention suvereenin valtion fyysiselle alueelle ilman legitiimin kansainvälisen auktoriteetin, Yhdistyneiden kansakuntien turvallisuusneuvoston, siunausta. Molemmissa tapauksissa intervention kohteena oli monikulttuurinen, monien sosiaalisten, taloudellisten ja poliittisten jakolinjojen maa ja alue, jossa vähemmistöjen asema oli voimakkaan debatin aiheena. Tämän ”Pahaa hyvän puolesta?” -tutkielman tavoitteena on Yhdysvaltain ja Venäjän presidenttien puheissaan esittämien interventioiden oikeusperusteiden sekä niiden samankaltaisuuksien ja erojen määritteleminen. Tutkimuksen aineiston muodostavat presidentti Clintonin maalis-huhtikuussa 1999 ja presidentti Medvedevin elokuussa 2008 pitämät puheet, joissa he pyrkivät oikeuttamaan johtamaansa interventiota. Keskustelu Kosovon ja Georgian tapausten yhteneväisyyksistä heräsi syksyllä 2008: esimerkiksi pääministeri Vladimir Putin käytti Kosovon itsenäistymistä Georgian separatistialueiden itsenäistymisen esikuvana ja suomalaisten Venäjän-tutkijoiden piirissä interventioiden yhtäläisyyksiä pohdittiin jo pian Georgian tapahtumien alettua elokuussa 2008. Tähän keskusteluun haluan tällä tutkimuksella osallistua. Tutkimuksen teoreettinen tausta muodostuu valtiota, suvereniteettia, interventiota, sotaa, uhkaa ja identiteettiä käsittelevistä teorioista, Chaïm Perelmanin retoriikan teoriasta sekä aiemmasta Venäjän ja Yhdysvaltain ulkopolitiikkaa ja Georgiaa ja Kosovoa käsittelevästä tutkimuksesta. Aineiston analyysi osoittaa, että presidenttien esittämissä oikeusperusteissa oli sekä samankaltaisuuksia että eroavaisuuksia. Medvedevin esittelemät oikeutusperusteet voidaan jakaa neljään eri ryhmään, joita ovat kansainvälisen lainsäädännön rikkominen, humanitaariset syyt ja omien kansalaisten suojelu, rauhanturvaamisen ja historiallisen tehtävän täyttäminen sekä interventio rangaistuksena. Clintonin esittämät oikeutusperusteet jaan tässä tutkimuksessa viiteen ryhmään: interventio suuremman katastrofin estämiskeinona, humanitaarisen katastrofin, etnisen väkivallan ja julmuuden lopettamiskeinona, Yhdysvallat rauhantekijänä, vapaan, rauhallisen ja vakaan Euroopan puolesta sekä interventio moraalisena valintana ja vastauksena kansainvälisten sopimusten rikkomiselle. Puheissa esiintyy voimakkaita tunteisiin vetoavia ilmaisuja ja niissä on havaittavissa ajallinen evoluutio, ilmaisujen vähittäinen muuttuminen ajan kuluessa. Aineisto keskittyy erityisesti intervention alkuvaiheeseen, jolloin legitimiteetin vahvistaminen oli erityisen tärkeää. Molemmissa presidenttien puheissa uhka ja toiseus määritellään selkeästi. Oma toiminta esitetään korostetun positiivisessa valossa, viattomien pelastajana ja lain, oikeudenmukaisuuden ja turvallisuuden puolustajana. Puheet on suunnattu tarjoamaan jotain jokaiselle yleisölle. Poliittisina, virallisina dokumentteina niiden tehtävänä on vallankäyttö ja yleisöjen asenteisiin ja mielipiteisiin vaikuttaminen myös arvoihin vetoamalla. Puheet ovat viimeisteltyjä poliittisen teatterin näytöksiä. Näiden näytösten rooleja näyttelevät niin suuri valtio, pieni valtio, kansainvälinen yhteisö ja viattomien ihmisten kohtalokin.

The use of animals in scientific experiments tends to arouse strong emotional reactions among the general public, the most essential concern being the pain and suffering they cause. It is felt that suffering inflicted on other beings, including animals, is not morally acceptable. Is the function of a researcher who uses animals morally acceptable and beneficial for humans and animals? May such a researcher him/herself decide what animal experiments he/she can perform or should some outsider have the right to decide what kind of experiments a researcher can or cannot perform? The research material comprises the legislation of Finland and that of some member and non-member states of the European Union, together with European Union directives and pertinent preparatory parliamentary documents. The author has likewise studied the vast literature on animal rights, both pro and contra writings and opinions. The opinions of philosophers on the moral and legal rights of animals are markedly conflicting. Some strongly support the existence of rights, while others totally refute such an opinion, claiming that the question is only of the moral principles of man himself which imply that animals must be treated in a human manner. Speaking of animal rights only tends to muddle ideas on the one hand in philosophical considerations and in legal analyses on the other. The development of legislation in Finland and some other member states of the European Union has in principle been similar. In Finland, the positive laws on animal experiments nowadays comply with the EU directive 86/609/EEC. However, there are marked differences between member states in respect of the way they have in practice implemented the principles of the EU directive. No essential alterations have in practice been discernible in the actual performance of animal experiments during the decades when legislation has been developed in different countries. Self-regulation within the scientific community has been markedly more effectual than legislative procedures. Legal regulation has nevertheless clearly influenced the quality of breeding and life conditions of experimental laboratory animals, cages for example being nowadays larger than hitherto. EU parliament and council have now accepted in September 2010 a new directive on animal experiments which must be implemented in the national legislations by January 1, 2013.

Tämän tutkimuksen tarkoituksena on hahmottaa, millaisena toimijana kolmas sektori eli järjestöt nähdään maaseutumaisissa kunnissa nyt, kun kunta- ja palvelurakenne on muuttumassa ja väestö ikääntymässä. Tutkimuksen perusteella maaseutukunnat odottavat kolmannelta sektorilta ja järjestöiltä panosta kaikkein eniten sosiaalisten verkostojen, niitä vahvistavan ihmisten kanssakäymisen ja yhteisöllisyyden vahvistajana. Erilaisten tapahtumien, kulttuuri-, liikunta-, nuoriso-, harrastus- ja vapaa-ajan toiminnan järjestäminen, ympäristönhoito, perinteen ja historian tallentaminen sekä asukas- ja kylätoiminnan ylläpitäminen ovat maaseutukunnissa toimivien järjestöjen vahvaa toimintakenttää. Tällaisen perinteisen järjestötoiminnan myös taloudellisen merkityksen nähdään korostuvan väestön terveyden ja toimintakyvyn eteen tehtävän ennaltaehkäisevän työn tarpeen kasvaessa. Toinen tutkimuksessa vahvasti esille noussut kolmannen sektorin toiminnan vahvuus liittyy järjestöjen toiminnan ihmisläheisyyteen ja inhimillisyyteen. Kuntakoon kasvaessa ja palvelutuotannon järjestelmien monimutkaistuessa monet tutut arkiset tavat hoitaa asioita menevät uusiksi. Varsinkin ikääntyville nämä muutokset ovat suuria ja aiheuttavat inhimillistä hätää, pelkoja ja kasvavaa yksinäisyyttä. Järjestöissä tämä avun tarve nähdään usein läheltä, ja ne ryhtyvät toimimaan avun ja palvelujen järjestämiseksi. Järjestöjen koetaan toimivan inhimillisesti, lähellä ihmisiä, helposti lähestyttävänä, tutuin kasvoin, kuuntelevin korvin, todellisiin tarpeisiin vastaten. Ajankohtainen poliittinen puhe tuo kolmannen sektorin esille nimenomaan palvelujen tuottajana. Järjestöt ovat myös monissa maaseutukunnissa paikallisesti merkittäviä palvelujen tuottajia ja työllistäjiä. Tutkimuksessa tuli kuitenkin selvästi esille se, ettei kolmannen sektorin palveluntuottajaroolin vahvistumista nähdä varsinkaan harvaan asutun maaseudun pienissä kunnissa kovin realistisena. Järjestöjen roolin ja tehtävien kasvua palvelujen tuottajana jarruttaa erityisesti rahoituksen epävarmuus sekä järjestöväen ikääntyminen ja aktiivisten toimijoiden vähäinen määrä. Kolmas sektori nähtiin varsinkin maaseutukunnissa tehdyissä haastatteluissa vapaaehtoistyön paikkana. Tämä työn järjestämisen periaate kolmatta sektoria määrittävänä tekijänä tuli esille huomattavasti useammin kuin esimerkiksi se, tavoitellaanko toiminnalla voittoa vai ei. On helppo ymmärtää, että kolmas sektori pyritään hahmottamaan vapaaehtoistyön paikaksi, varsinkin kun palvelujen tuottamisen rahoitus on sekä kunnissa että järjestöissä muodostumassa entistä vaikeammaksi kysymykseksi. Siihen, tehdäänkö työ järjestöissä palkattuna työnä vai vapaaehtoistyönä, sisältyy myös yksi kolmatta sektoria koskevan poliittisen keskustelun sokeista pisteistä. Keskustelussa ei ole edetty vielä siihen asti, että puhuttaisiin niistä rajoista, mitä maaseudun yhdistyksiltä ja niissä vapaaehtoiselta pohjalta toimivilta ihmisiltä voidaan ylipäätään edellyttää. Tämän tutkimuksen perusteella voidaan todeta, että mikäli kolmannen sektorin odotetaan osallistuvan sellaisten palvelujen tuottamiseen, jotka edellyttävät sitoutumista, säännöllisyyttä ja pitkäjänteisyyttä, ei tällaisia tehtäviä voida edellyttää hoidettavaksi järjestöissä vapaaehtoisvoimin, ilman korvausta. Tällaisten tehtävien hoitamiseen tarvitaan palkattuja työntekijöitä myös järjestöissä. Tarkasteltaessa kolmannen sektorin roolin ja tehtävien muuttumista maaseutumaisissa kunnissa ja peilattaessa sitä kuntien kasvaviin haasteisiin palvelujen järjestäjänä huomio keskittyy väistämättä ikääntyvän väestön tuki-, hoiva- ja hoitopalvelujen kysynnän kasvuun. Kolmannen sektorin kannalta keskeinen kysymys on, kuka tuottaa ja rahoittaa tulevaisuudessa nuorisopalvelut, liikuntapalvelut, kulttuuripalvelut, vapaa-ajan palvelut, virkistys- ja harrastustoimintaa tai ne välttämättömät tuki- ja hoivapalvelut, joihin kunnilla ei ole varaa. Suomessa on sellaisia alueita ja sellaisia palveluja, joissa julkiset palvelut eivät riitä ja yritysmäiselle palvelutuotannolle ei ole edellytyksiä. Järjestöjen palvelutoimintaa syntyy usein juuri tällaisiin tilanteisiin ja sinne, missä taloudellista voittoa tavoittelevia yrityksiä ei ole, joko toiminnan matalan tuottavuuden, pitkien välimatkojen ja harvan asutuksen aiheuttamien korkeampien tuotantokustannusten tai asiakkaiden alhaisen maksukyvyn takia. Ongelmallista on, ettei näitä maaseudun olosuhteita ja palvelumarkkinoiden erityispiirteitä ole otettu huomioon tuotaessa ja sovellettaessa EU-lähtöistä valtiontuki- ja kilpailulainsäädäntöä kansalliseen lainsäädäntöömme. Tämän tutkimuksen perusteella voidaan todeta, että Suomessa on alueita ja palveluja, joissa kansalaisten perusoikeuksien ja yhdenvertaisuuden toteutuminen on kyseenalaista, jos näitä maaseudun olosuhdetekijöitä ei huomioida esimerkiksi valtiontukea koskevissa säädöksissä ja palvelujen tuottamiseen ei ohjata julkista tukea. Tutkimuksessa tarkastellaan niitä määritelmiä ja rajapintoja, jotka liittyvät yritystoimintaan ja järjestötoimintaan, elinkeinotoimintaan ja yleishyödylliseen toimintaan, yleishyödyllisiin ja julkisiin palveluihin, taloudellisiin ja ei-taloudellisiin palveluihin, kuntien lakisääteisiin ja ei-lakisääteisiin tehtäviin sekä vapaaehtoistyöhön ja palkattuun ammattityöhön. Tutkimuksessa kysytään, miksi palveluja tuottavien järjestöjen ja yritysten välisen kilpailuneutraliteetin tulkinnoissa ja tätä koskevissa säädöksissä ollaan oltu Suomessa niin tarkkoja ja miksi aihe on noussut niin keskeiseksi keskusteltaessa järjestöjen roolista palvelujen tuottajana. Maaseudun pitkien etäisyyksien ja pienten asiakasmäärien palvelumarkkinoilla kilpailua suurempi ongelma on pikemminkin palvelutuottajien vähäinen määrä tai se, ettei tuottajia ja kilpailua ole lainkaan. Aiheellista on myös kysyä, mistä yritykset ja järjestöt kilpailevat, onko niiden tuottamien palvelujen sisältö sama, onko asiakasryhmä sama tai miten palvelujen tuottamiseen liittyvät laajemmat yhteiskunnalliset ja sosiaaliset tekijät tulee ottaa huomioon todellista kilpailutilannetta arvioitaessa. Tutkimus vahvistaa tarvetta keskustella ja tehdä poliittiset linjaukset siitä, miten Suomessa suhtaudutaan sellaisiin organisaatioihin, joiden lähtökohtana on taloudellisen voiton tavoittelun asemesta yhteiskunnallisen ongelman ratkaiseminen tai tietyn väestöryhmän, kuten lasten, vanhusten tai vammaisten tarpeisiin vastaaminen. Euroopan parlamentin tätä yhteisötaloutta koskeva päätös vuodelta 2009 velvoittaa jäsenmaat ottamaan omassa lainsäädännössään huomioon tämäntyyppisen sosiaaliset ja taloudelliset näkökohdat yhdistävän toiminnan.

Työni tavoitteena on vertailla unkarilaisia ja suomalaisia idiomeja, joissa esiintyy jokin perusvärinnimi. Perusvärinnimiä ovat fehér (valkoinen), fekete (musta), szürke (harmaa), piros tai vörös (punainen), zöld (vihreä), sárga (keltainen), kék (sininen) ja barna (ruskea). Erityisesti pyrin ottamaan selvää käytetäänkö samaa värinnimeä molemmissa kielissä samasta asiasta vai onko värinnimien käytössä tarkasteltujen kielten välillä eroja. Vertailen unkarilaisia idiomeja suomalaisiin ja käytän vertailussa Tamás Forgácsin esittämää mallia ekvivalenssin lajeista. Aineisto on kerätty unkarin- ja suomenkielisistä fraasi- ja idiomisanakirjoista sekä yleissanakirjoista. Idiomi on yksi fraseologismien alaryhmistä. Idiomi koostuu vähintään kahdesta lekseemistä, jotka voidaan kirjoittaa joko yhteen tai erikseen. Idiomi on puhtaimmillaan opaakki, kiteytynyt sanaliitto, mutta idiomi voi olla myös osittain sananmukaisesti tulkittavissa. Idiomaattisuuden ja metaforisuuden aste on jatkumo, jonka toisessa päässä ovat täysin läpinäkymättömät ja toisessa transparentit sanaliitot. Idiomit ovat puhtaimmillaan tiettyyn kieleen sidottuja. Idiomit voivat olla kuitenkin laajalevikkisiä, koska niitä on lainattu eri kieliin suoraan kääntämällä esimerkiksi Raamatusta tai antiikin teksteistä. Viime vuosisatojen ja vuosikymmenten idiomit ovat hypoteettisesti useimmiten käännöslainoja jostain Euroopan valtakielestä. Värinnimitutkimuksen tunnetuimpia teorioita on Berlinin ja Kayn teoria kielessä esiintyvien värinnimien järjestyksestä. Heidän mukaansa musta, valkoinen ja punainen esiintyvät maailman kielissä kaikista yleisimmin, sininen, ruskea ja harmaa puolestaan esiintyvät vain korkeakulttuureissa, eivät esimerkiksi luonnonkansojen kielissä. Hypoteesini on, että aineistossa esiintyvien värinnimien lukumäärä korreloi jossain määrin Berlinin ja Kayn esittämän värinnimien järjestyksen kanssa. Täysin identtisiä idiomeja sanastoltaan ja merkitykseltään löytyy aineistosta suhteellisen paljon, useimmat näistä ovat valkoisen, mustan tai harmaan värin sisältäviä idiomeja. Täysin toisiaan vastaavista idiomeista suurin osa on tullut unkariin ja suomeen Raamatusta tai lainattu sellaisenaan englannista, saksasta tai ranskasta. Osittaisessa vastaavuussuhteessa ja funktionaalisessa vastaavuussuhteessa löytyy värinnimien kannalta mielenkiintoisimmat idiomit: keltainen ja vihreä esiintyvät parissa idiomissa ristikkäin. Pääasiassa idiomeissa esiintyvät värinnimet ovat unkarin ja suomen välillä identtisiä, mikäli unkarilaiselle idiomille löytyy vastine suomen kielestä. Idiomit ilman vastinetta ovat aineiston suurin ja samalla myös kirjavin ryhmä analysoitavaksi, pienin ryhmä puolestaan ovat leksikaalisen vastaavuuden ryhmään kuuluvat idiomit. Suurin osa unkarilaisista idiomeista on työssä analysoitu, mutta suomenkieliset vastineettomat idiomit jäävät vähäiselle huomiolle tutkimusongelman näkökulmasta johtuen. Aineiston 143 unkarilaisesta idiomista noin puolet sijoittuu nollaekvivalenssin eli vastineettomien idiomien ryhmään. Täydellisen ekvivalenssin ryhmä on toiseksi suurin, leksikaalisen vastaavuuden ryhmä pienin. Idiomeissa esiintyvistä väreistä yleisimpiä ovat musta, valkoinen, punainen ja vihreä. Ruskeaa väriä ei esiinny unkarilaisissa idiomeissa lainkaan, suomalaisissa idiomeissa viidessä. Unkarin ja suomen värien merkityskentät vastaavat pitkälti toisiaan. Ainoastaan keltainen ja vihreä esiintyivät selkeästi ristikkäin: unkariksi kateus on keltaista ja suomeksi vihreää, tulokkaaseen liitetään unkarissa vihreä, suomessa keltainen väri.

This study addresses the issue of multilingualism in EU law. More specifically, it explores the implications of multilingualism for conceptualising legal certainty, a central principle of law both in domestic and EU legal systems. The main question addressed is how multilingualism and legal certainty may be reconciled in the EU legal system. The study begins with a discussion on the role of translation in drafting EU legislation and its implications for interpreting EU law at the European Court of Justice (ECJ). Uncertainty regarding the meaning of multilingual EU law and the interrelationship between multilingualism and ECJ methods of interpretation are explored. This analysis leads to questioning the importance of linguistic-semantic methods of interpretation, especially the role of comparing language versions for clarifying meaning and the ordinary meaning thesis, and to placing emphasis on other, especially the teleological, purpose-oriented method of interpretation. As regards the principle of legal certainty, the starting-point is a two-dimensional concept consisting of both formal and substantive elements; of predictability and acceptability. Formal legal certainty implies that laws and adjudication, in particular, must be predictable. Substantive legal certainty is related to rational acceptability of judicial decision-making placing emphasis on its acceptability to the legal community in question. Contrary to predictability that one might intuitively relate to linguistic-semantic methods of interpretation, the study suggests a new conception of legal certainty where purpose, telos, and other dynamic methods of interpretation are of particular significance for meaning construction in multilingual EU law. Accordingly, the importance of purposive, teleological interpretation as the standard doctrine of interpretation in a multilingual legal system is highlighted. The focus on rational, substantive acceptability results in emphasising discourse among legal actors among the EU legal community and stressing the need to give reasons in favour of proposed meaning in accordance with dynamic methods of interpretation including considerations related to purposes, aims, objectives and consequences. In this context, the role of ideal discourse situations and communicative action taking the form of interaction among the EU legal community in an ongoing dialogue especially in the preliminary ruling procedure is brought into focus. In order for this dialogue to function, it requires that the ECJ gives persuasive, convincing and acceptable reasons in justifying its decisions. This necessitates transparency, sincerity, and dialogue with the relevant audience.
