The article analyzes the legal regime of Euskara in the education system of the Autonomous Community of the Basque Country (capv). In the capv, the legislation recognizes the right to choose the language of study during the educational cycle. The students are separated into different classrooms based on their language preference. This system of separation (of language models) has made it possible to make great strides, although its implementation also suggests aspects which, from the perspective of a pluralistic Basque society on its way towards greater social, political and language integration, call for further reflection The general model for language planning in the capv was fashioned in the eighties as a model characterized by the guarantee of spaces of language freedom, and the educational system was charged with making the learning of the region’s autochthonous language more widespread. At this point, we already have a fair degree of evidence on which to base an analysis of the system of language models and we are in a position to conclude that perhaps the educational system was given too heavy a burden. Official studies on language performance of Basque schoolchildren show (in a way that is now fully verified) that not all the students who finish their mandatory period of schooling achieve the level of knowledge of Euskara required by the regulations. When faced with this reality, it becomes necessary for us to articulate some alternative to the current configuration of the system of language models, one that will make it possible in the future to have a Basque society that is linguistically more integrated, thereby avoiding having the knowledge or lack of knowledge of one of the official languages become a language barrier between two communities. Many sides have urged a reconsideration of the system of language models. The Basque Parliament itself has requested the Department of Education to design a new system. This article analyzes the legal foundations on which the current system is built and explores the potential avenues for legal cooperation that would make it possible to move towards a new system aimed at guaranteeing higher rates of bilingualism. The system would be sufficiently flexible so as to be able to respond to and accommodate the different sociolinguistic realities of the region.

The territory of the European Union is made up of a rich and wide-ranging universe of languages, which is not circumscribed to the «State languages». The existence of multilingualism is one of Europe’s defining characteristics and it should remain so in the constantly evolving model of Europe’s political structure. Nonetheless, until now, the official use of languages has been limited to the «State languages» and has been based on a concept of state monolingualism that has led to a first level of hierarchization among the languages of Europe. This has affected the very concept of European language diversity. The draft of the treaty establishing a European Constitution contains various language-related references that can be grouped in two major categories: on the one hand, those references having to do the constitutional status of languages, and on the other, those regarding the recognition of European language diversity. Both issues are dealt with in this article. In analyzing the legal regime governing languages set forth in the draft of the constitutional treaty, we note that the draft is not based on the concept of the official status of languages. The language regulation contained in the draft of the constitutional treaty is limited in character. The constitutional language regime is based on the concept of Constitutional languages but the official status of languages is not governed by this rule. The European Constitution merely enunciates rights governing language use for European citizens vis-à-vis the languages of the Constitution and refers the regulation of the official status of languages to the Council, which is empowered to set and modify that status by unanimous decision. Because of its broad scope, this constitutes a regulatory reservation. In the final phase of the negotiation process a second level of constitutional recognition of languages would be introduced, linked to those that are official languages in the member states (Catalan, Basque, Galician, etc.). These languages, however, would be excluded from the right to petition; they would constitute a tertium genus, an intermediate category between the lan guages benefiting from the language rights recognized under the Constitution and those other languages for which no status is recognized in the European institutional context. The legal functionality of this second, intermediate category will depend on the development of standards, i.e., it will depend on the entrée provided such languages in future reforms of the institutional language regime. In a later section, the article reflects on European Union language policy with regard to regional or minority languages, concluding that the Union has not acted in accordance with defined language policy guidelines when it has been confronted, in the exercise of its powers, with regional or minority languages (or domestic legislation having to do with language demands). The Court of Justice has endeavoured to resolve on a case by case basis the conflicts raised between community freedoms and the normative measures that protect languages. Thus, using case law, the Court has set certain language boundaries for community freedoms. The article concludes by reflecting on the legal scope of the recognition of European language diversity referred to in Article II-82 of the European Constitution and the possible measures to implement the precept that might constitute the definition of a true European language policy on regional or minority languages. Such a policy has yet to be defined.

The European Union considers modern languages among the basic skills or key competencies required by all its citizens and is concerned to promote excellence in the teaching and learning of languages as well as greater diversity in the range of languages available to learners in the Member States, as witnessed by the recent European Commission Action Plan, Promoting Language Learning and Linguistic Diversity: An Action Plan 2004-2006. This consideration, the changing socio-cultural demography of Ireland, the need for more joined-up thinking in the context of language teaching in schools, and in the context of language teacher education in particular, form the back-drop to the paper. Among the challenges facing modern/world languages’ education in Ireland identified in the paper are, lack of a languages’ policy, lack of a languages’ strategy, and lack of an integrated language curriculum and by implication, a whole school approach to language teaching and learning. The paper refers to positive signs that are occurring in this context as well, e.g. official recognition to Irish as a working language in the European Union and in the Official Languages Act in Ireland (2003). The paper reports on the recent first ever all Ireland cross-border conference in the context of language teacher education. It outlines the background, aims, and content of the conference that includes findings from a study about the impact of autonomous language teaching and learning supported by the European Language Portfolio in the context of post-primary language teacher education in Ireland. The paper shows data from the first ever survey on language teacher education provision, policy and practice across colleges in Ireland, North and South. Initial teacher education is on the cusp of change. This paper highlights several key issues facing language teacher education. This paper has implications for Irish as well as international readers, and is aimed at supporting all those who want to bring about improvement in this important area.

Le nombre d'unions où les deux conjoints n'ont pas la même langue maternelle est en augmentation depuis les dernières décennies au Québec. Sachant que les enfants issus de ces unions gravitent dans un univers familial plurilingue, l'objectif de ce mémoire est de connaître les langues qui leur sont transmises. En utilisant les données du questionnaire long du recensement canadien de 2006, nous avons procédé à différentes analyses descriptives nous permettant de cerner les langues maternelles véhiculées aux enfants issus d'une union mixte, de vérifier si ces enfants héritent davantage de la langue maternelle de leur mère ou de leur père et s'ils opèrent des substitutions linguistiques avant l'âge de 18 ans, c'est-à-dire si leur langue maternelle diffère de leur langue d'usage. De plus, par le biais de régressions logistiques, nous avons étudié les déterminants contextuel, ethno-culturel et socio-économique les plus susceptibles d'expliquer le choix de la langue transmise aux enfants. Les résultats obtenus démontrent la place prédominante des langues officielles canadiennes, au détriment des langues non officielles, chez les familles exogames. De plus, le choix de la langue maternelle transmise s'avère principalement conditionné par le lieu de résidence, le parcours migratoire des parents et le pays de naissance des enfants.

Notre recherche a comme objectif de déterminer si le statut d’immigrant agit comme modérateur de la relation entre l’état de faible revenu et ses déterminants au Canada. Elle est basée sur les données du Recensement de 2006. Notre étude cherche à comprendre s'il existe des différences selon l'appartenance à la population immigrante ou à la population native quant à la probabilité d’être dans un état de faible revenu. Également, nous avons accordé une attention particulière à la région d'origine des immigrants. Nos résultats soutiennent qu'effectivement l'effet des déterminants retenus sur la probabilité de connaître l’état de faible revenu varie entre les immigrants et les natifs ainsi qu’entre les immigrants selon leur région d'origine. C'est surtout chez les immigrants issus des pays non traditionnels que l'écart dans l'effet des variables est le plus marqué et ce, par rapport aux natifs. Les immigrants issus des pays traditionnels se trouvent dans une situation intermédiaire, soit entre les deux groupes. Par exemple, l'éducation a un effet négatif moins important sur la probabilité d’être dans un état de faible revenu chez les immigrants originaires des pays non traditionnels comparativement aux natifs et aux immigrants originaires des pays traditionnels. Par contre, l’appartenance à une minorité visible, le statut d’étudiant et l’intensité de travail produisent un effet plus important sur la probabilité en question chez les immigrants issus des pays non traditionnels comparativement aux autres groupes. La connaissance des langues officielles du Canada produit un effet négatif bien plus important dans le cas des immigrants issus des pays non traditionnels. C’est surtout les immigrants bilingues qui sont les moins exposés à l’état de faible revenu, alors que ceux qui ne parlent aucune langue officielle du Canada sont les plus touchés. Nous retrouvons les mêmes effets chez les immigrants issus des pays traditionnels, mais dans une moindre mesure. En somme, cette étude apporte des nouvelles connaissances dans le domaine et permet d’arriver à une meilleure compréhension de l’état de faible revenu chez les personnes âgées de 15 ans et plus au Canada.

Ce mémoire porte sur la question de l’insertion sur le marché du travail, des Haïtiens arrivés au Québec après le tremblement de terre désastreux qui frappa Haïti le 12 janvier 2010. Notre objectif est d'analyser la trajectoire professionnelle de ce groupe et de déterminer les difficultés rencontrées au cours de leur projet d'insertion en emploi. Notre projet s’inscrit dans le cadre de l'approche plurielle développée par Victor Piché qui propose de porter attention à la fois aux facteurs macro-structurels, micro-individuels et à la force du réseau, dans l'étude du phénomène migratoire et du processus d'intégration de la personne immigrante au sein du pays d'accueil. Dans le cadre de ce mémoire, nous avons choisi de réaliser des entretiens avec douze immigrants haïtiens. Cela nous a permis de recueillir des informations de première main sur les différents éléments qui les ont amenés à la décision d'immigrer au Québec et sur leurs parcours sur le marché du travail dans le pays d’accueil. Il ressort des entretiens que l'évaluation que font les répondants du bon déroulement de leur intégration socio-professionnelle dépend particulièrement de facteurs micro-individuels tels que : la maitrise des langues officielles, la connaissance des stratégies favorisant l'insertion en emploi, la connaissance des pratiques locales et du fonctionnement du marché du travail et le statut d'immigration. Très peu des immigrants haïtiens que nous avons rencontrés ont abordé la question de la discrimination, notamment parce qu’ils semblent avoir intégré le discours sur la compétition et l'individualisation et ramènent à des facteurs individuels les succès et les échecs qu'ils ont connus lors de la recherche d'emploi. En d’autres mots, les personnes interrogées semblent avoir intériorisé le discours sur « la lutte des places » les enjoignant à ne pas se contenter « d'être bon », mais d’être « le/la meilleur(e) » pour pouvoir concurrencer les "Québécois de souche" sur le marché de l'emploi.

For this paper, heterolingualism or language plurality will be considered as the presence in a single text or in a social environment of both French and English, Canada’s official languages. Language plurality will here be studied from an institutional viewpoint: the influence of the Canadian government on the translation of political speeches. The first part of this article will establish that political speeches are written in a bilingual environment where the two official languages are often in contact. In recognizing 11 official languages, the 1996 South African Constitution provides a context for the management of diversity with important implications for the redistribution of wealth and power. The development and implementation of the language-in-education policies which might be expected to flow from the Constitution, however, have been slow and ineffective. One of the casualties of government procrastination has been African language publishing. In the absence of well-resourced bilingual education, most learners continue to be taught through the medium of English as a second language. Teachers are reluctant to use more innovative pedagogies without the support of adequate African language materials and publishers are cautious about producing such materials. Nonetheless, activity in this sector offers many opportunities for African language speakers. This paper explores the challenges and constraints for African language publishing for children and argues that market forces and language policy need to work in mutually reinforcing ways. Further progress is necessarily dependent on the political will to implement language-in-education policies that promote additive bilingualism and, in the process, guarantee sales for risk-averse publishers.

Informed by family language policy (FLP) as the theoretical framework, I illustrate in this paper how language ideologies can be incongruous and language policies can be conflicting through three multilingual families in Singapore representing three major ethnic groups – Chinese, Malay and Indian. By studying their family language audits, observing their language practices, and engaging in conversations about their language ideologies, I look at what these families do and do not do and what they claim to do and not to do. Data were collected over a period of 6 months with more than 700 minutes of recording of actual interactions. Analysis of the data reveals that language ideologies are ‘power-inflected’ and tend to become the source of educational and social tensions which in turn shape family language practices. In Singapore these tensions are illustrated by the bilingual policy recognising mother tongues (MTs) and English as official languages, and its educational policy establishing English as the medium of instruction. The view of English as having instrumental values and MTs as having cultural functions reveals that language choices and practices in family domains are value-laden in everyday interactions and explicitly negotiated and established through FLP.

Taking the South African experience as an example, this article considers the interpretive benefits to be reaped from having access to bi- and multilingual versions of a statutory text. The discussion takes place against the backdrop of a history of statutory bi- and multilingualism in the said jurisdiction as well as, at present, constitutional guarantees of language rights and the “parity of esteem” of eleven official languages. It is argued that, if invoked with due discretion and in a non-rigid way, statutory multilingualism can be a boon to statutory and constitutional interpretation. The South African courts – whose traditional approach to statutory inter-pretation has tended to be literalist, formalistic and formulaic – are, generally speaking, to be commended for their supple use of bilingualism as an aid to interpretation over the years. The advent of constitutional multilingualism and the (potential) availability of statutory texts (and the Constitution) in more than two languages, have moreover created conditions conducive to the further development and refinement of reliance on multilingualism in statutory and constitutional interpretation – certain challenges notwithstanding.

Kosrae is the most remote island of the Federated States of Micronesia (FSM), with a population of less than 7,000 inhabitants, located in the Pacific Ocean between Hawaii and Guam. FSM is an independent sovereign nation consisting of four states in total: Pohnpei, Chuuk, Yap, and Kosrae. Having passed through the hands of Spain, Germany and Japan, the United States gained administrative control of FSM after WWII, as commissioned by the UN. The FSM became an independent nation in 1986 while still retaining affiliation with the US under a ‘Compact of Free Association’. Now both Kosraean and English are considered to be the two official languages and the variety of Kosraean English which has arisen proves for an interesting comparative study. In order to obtain the relevant data, I spent three months on the island of Kosrae, interviewing 90 local speakers, ranging in age (16-70), occupation, sex and time spent off island. The 45 minute long interviews were informal but supported by participant information to capture relevant data and conversations were guided in a way that aimed to reveal language and cultural attitudes. With reference to these samples, I examine the effects of American English on the language use in Kosrae. This paper aims to present a broad analysis of phonological, morphosyntactic and pragmatic features, such as pro-dropping, discourse markers and other practices in order to demonstrate the similarities and differences between the two varieties, which are coming to shape the variety developing on Kosrae. Having transcribed conversations using the tool Elan, I will put particular focus on [h] deletion and insertion, a rare occurrence found in a variety of post-colonial American English which I believe is of particular interest. I assess the presence of English in Kosrae with reference to sociological influences, past and present. First, I discuss the extralinguistic factors which have shaped the English that is currently used on Kosrae, including migration between US and FSM, and English as a language of administration, social media usage and visual media presence. Secondly, I assess the use of English in this community in light of Schneider’s (2007) ‘Dynamic Model’, with reference to America’s contribution as an ‘exploitation colony’ as defined by Mufwene (2001). Finally, an overview of the salient linguistic characteristics of Kosraean English, based on the data collected will be presented and compared to features associated with standard American English in view of examining overlap and divergence. The overall objective is to present a cross-linguistic description of a hitherto unexamined English emerging in a postcolonial environment with a juxtaposed contact variety. In a globalised world, knowledge of foreign languages is an important skill. Especially in Europe, with its 24 official languages and its countless regional and minority languages, foreign language skills are a key asset in the labour market. Earlier research shows that over half of the EU27 population is able to speak at least one foreign language, but there is substantial national variation. This study is devoted to a group of countries known as the Visegrad Four, which comprises the Czech Republic, Hungary, Poland and Slovakia. Although the supply of foreign language skills in these countries appears to be well-documented, less is known about the demand side. In this study, we therefore examine the demand for foreign language skills on the Visegrad labour markets, using information extracted from online job portals. We find that English is the most requested foreign language in the region, and the demand for English language skills appears to go up as occupations become increasingly complex. Despite the cultural, historical and economic ties with their German-speaking neighbours, German is the second-most-in-demand foreign language in the region. Interestingly, in this case there is no clear link with the complexity of an occupation. Other languages, such as French, Spanish and Russian, are hardly requested. These findings have important policy implications with regards to the education and training offered in schools, universities and job centres.

This work focuses on translated political speeches made by Canadas prime minister during times of national crises. Delivered orally in both English and French, this translation-based political discourse is examined in a tripartite manner, offering the reader contextualisation of the corpus researched; description of the translation shifts encountered; and interpretation of the discourse varies greatly depending on the era observed. Since the latter half of the 20th century, for instance, different text types have been assigned to different categories of translators. As for translative shifts revealed in the corpus, they have been categorised as either paratextual or textual divergences. Paratextual differences indicate that the Canadian prime ministers national statements in English and French do not necessarily seek to portray symmetry between what is presented in each language. Each version of a national speech thus retains a relative degree of visual autonomy. In sum, accumulated instances of paratextual divergence suggest an identifiable paratextual strategy, whereby translation contributes to the illusion that there is only one federal language: the readers. The deployment of this paratextual strategy obscures the fact that such federal expression occurs in two official languages. The illusion of monolingualism generates two different world views one for each linguistic community. Similarly, another strategy is discerned in the analysis of translative textual shifts a textual strategy useful in highlighting some of the power struggles inherent in translated federal expression. Textual interpretation of data identifies four federal translation tendencies: legitimisation and characterisation of linguistic communities; dislocation of the speech-event; neutralisation of (linguistic) territory; and valorisation of federalism.
