The so-called "residential tourism" came to intensify the previous occupation of the coastal zones, characterized by traditional beach houses, and brought significant consequences for their spatial configuration, and especially for its scenic value of the landscape. Although there is the intention to regulate the activities of enterprising groups by some legal instruments to control the use and occupation of land, and to contain some negative effects, the actions of government are still inefficient in trying to follow the implications on the landscape from the accelerated growth of the real estate and touristic sectors. Supported in the speech of economic development and income generation, public managers prioritize areas to attract tourists to the detriment of preserving important physical attributes of the natural environment that contribute significantly to the quality of life. The result can be noticed in the use of natural elements as one of the major components in the land valorization, and in the immediate attraction of investors and enterprising. Therefore, the objective of this work is to contribute to the debate on the landscape preservation a little detailed thematic in view of their relevance in the current context - by indicating subsidies to the creation of a methodology for the evaluation and protection of coastal zones that may assist the government in creating new instruments, and better prepare it in control of the occupation of these areas. For such, was followed two ways to analysis: the indirect method and the direct method. The first is grounded in the evaluation of landscape attributes, which is based on the work of Raquel Tardin (2008) and Eduardo Cuesta, Encarnación Algarra and Isabel Pastor (2001). The second, based on the research of Leticia and Carlos Hardt (2010) and on the concepts of phenomenology - expressed by Antonio Christofoletti (1985) and Yi-Fu Tuan (1983) - considers the population perspective on the quality of the natural scenery. Developed through cartographic materials, photographic collections and quantitative tables, this dissertation utilized as a case study the beaches of Barra de Tabatinga and Camurupim, located in the city of Nísia Floresta/RN. Despite already being sighted spaces of advanced stage of landscape degradation in these locations, areas of remarkable scenic value can still be found, what reinforce the urgency in adopting preservationists actions. The absence of laws focused on the management and protection of the landscape singularities associated with the inefficiency of the government to invigilate the land occupation in coastal zones, encourage the excessive action of the real estate-tourism, and consequently make the government the main responsible for the environmental and landscape impacts in these areas - by its omission or by their connivance. Therefore, the legislation permeates this entire process and constitutes itself as the most effective way to guarantee the right to the landscape to present and future generations. Are also pointed some important considerations to build a methodology, especially concerning possibilities of improvements and adaptations of its applicability in each case

Na década de 1980 a questão urbana no Brasil ganhou visibilidade a partir de uma gama de ocupações de imóveis ociosos que ocorreram em diversas cidades importantes do país. Às mobilizações pela redemocratização somou-se a luta pela reforma urbana. Com o advento do Processo Constituinte, ganhou importância a intervenção dos movimentos populares na esfera institucional, cuja principal ferramenta foi a apresentação da Emenda Popular da Reforma Urbana, convertida numa espécie de manifesto-programa pelos defensores da causa. Com a Constituição já promulgada, o movimento pela reforma urbana celebrou o fato de, pela primeira vez na História Constitucional brasileira, a questão urbana ter sido contemplada. O Capítulo de Política Urbana necessitou, contudo, de regulamentação para ter efeitos práticos, o que veio a acontecer com a aprovação do Estatuto da Cidade em 2001. Fazer um balanço da luta pela reforma urbana no Brasil e a da influência do movimento popular no delineamento da legislação urbanística desde o Processo Constituinte é o objetivo primeiro deste trabalho. A intenção de fundo é refletir acerca do modelo de democracia brasileira, tendo por pressuposto a ideia de que a participação popular modelou um regime democrático que avança em relação ao clássico modelo da democracia representativa vigente no mundo ocidental.

Este estudo trata da avaliação da legislação urbanística que promove a implantação e qualificação de espaços públicos de lazer e recreação e de equipamentos e serviços urbanos básicos, e questiona a metodologia empregada para a elaboração e a eficácia dos mesmos. Para alcançar os objetivos desta investigação fez-se necessário: analisar as propostas existentes para a implantação dos equipamentos urbanos, serviços e áreas de lazer nos conjuntos habitacionais de baixa renda; avaliar a provisão e adequação dos serviços e equipamentos urbanos tais como áreas de pequeno comércio e serviços, escola de 1º grau, centro de educação infantil, posto de saúde, praças para recreação e lazer, oferecidos à população de conjuntos habitacionais; medir o impacto da adequação/inadequação ou inexistência desses serviços e equipamentos na avaliação de desempenho do conjunto, no nível de apropriação dos espaços abertos do conjunto, e no relacionamento entre os moradores e na interação social da comunidade. Foram selecionados quatro conjuntos habitacionais destinados a população de baixa renda, localizados no município de Bagé/RS. Neste estudo foram utilizados levantamento de arquivo, entrevistas, questionários, levantamento físico através de levantamento fotográfico, medições e observações de comportamento, que permitiram cruzar as informações e dar maior confiabilidade às análises. Este estudo mostra que os critérios para localização de equipamentos urbanos, serviços e áreas de lazer variam conforme autores, planos diretores e cidades. O estudo demonstra também que em Bagé, apesar da falta de planejamento e de critérios determinados no plano diretor do município, os equipamentos urbanos, com algumas exceções, estão distribuídos de maneira satisfatória, mas nem por isso deve–se deixar de lado a preocupação em definir essas normas para implantação de projetos futuros que contemplem o uso e ocupação do solo de forma ordenada.

Trata da utilização do fenômeno da extrafiscalidade como instrumento de planejamento urbano. Aborda aspectos teóricos dos tributos como elementos reguladores do de senvolvimento municipal, relacionando meios de atuação e comportamentos que podem ser induzidos pela extrafiscalida de. Estuda a legislação tributária do Municipio de São Paulo, no período de 1950 a 1980, identificando emprego do instrumento e analisando os resultados obtidos. Indica possibi1idades de aprimoramento da utilização dos aspectos regulatórios do sistema tributário municipal.

The `Outorga Onerosa do Direito de Construir - OODC` (Public Concession of Building Rights), instrument instituted by The City Statute in 2001, has as main objective the recovery of urban property, seeking for a fair distribution the urbanization benefits. The possibility of usage of the OODC instrument is linked to the maximum utilization coefficient, determined to specific areas in accordance to existing infrastructure conditions, further taking into account the formal real estate market, expansion axis and crowding. Being an instrument which establishes values to be paid for a better use of land, it maintains a narrow relation to the real estate, incentivizing or discouraging the crowding in specific areas. The present study investigates the relationship between the criteria for the making of the Public Concession of Building Rights instrument and the dynamics of the formal real estate market. It takes as empiric universe Parnamirim (RN), part of the Natal Metropolitan Area (RN), focusing on the application of the OODC in the period of 2008-2010. It seeks to better understand the necessary basis for the formulation of the instrument, about how it works and its relation to the formal real estate market. It aims to depict the formal real estate market by presenting the production of urban space in Parnamirim in terms of intensity and nature of the real estate, furthermore identifying the licensed properties through the application of the municipality instrument. For the conclusion, it is discussed the criteria for the formation of OODC, its relationship to the dynamics of the formal real estate market and its influencing possibilities in the processes of usage and occupation of land in the context of urban planning

O presente trabalho discutirá a gestão ambiental e o planejamento urbano enquanto instrumentos da política pública municipal, através das concepções e ações que envolvem os órgãos e agentes sociais na dinâmica sócio-ambiental no espaço urbano de Abaetetuba. Analisando as atuações da administração municipal no que concernem as atividades desenvolvidas pela SESMAB e SEMOB, no período de 2004-2006, tentará esclarecer as visíveis e inegáveis contradições na paisagem urbana do Município, principalmente no que tange a qualidade do meio ambiente (o qual implica na qualidade de vida das pessoas) e a ausência de mecanismos mais específicos para desenvolver a proteção do meio ambiente e a inclusão social nos fóruns de decisão. Considerando o enorme potencial legislativo e jurídico brasileiro, esta pesquisa vai tentar mostrar que a falta de mobilidade político-administrativa municipal, mesmo com o recém criado Plano Diretor Municipal (Out./2006) ainda compromete os padrões ambientais urbanos, devido, entre outros, a desarticulação entre as secretarias municipais, o caráter físico-territorial das políticas urbanas e o centralismo do investimento público em áreas já servidas de infra-estrutura.

O texto é uma nova aproximação dos autores a um tema cujo núcleo é a questão da gestão meio ambiental com enfoque na sustentabilidade. A preocupação aqui apresentada refere-se à questão da participação popular e traz alguns exemplos quanto ao protagonismo do Estado em relação ao tópico. Mostra que a legislação brasileira é atualíssima em relação ao assunto e que ela estaria em condições de lidar com as “ruínas”, com as “regressões” resultantes de uma visão de progresso que marca o processo civilizatório ocidental. Sugere a necessidade de “alargar os espaços de participação da grande massa popular nas decisões”. Reconhece, nesse quadro, a importância da mudança da realidade através da mudança do próprio sujeito da transformação. E, justo por reconhecer isso, aponta a fundamentalidade da educação ambiental. Pede ajuda a exemplos tirados de Araraquara, cidade do interior paulista para mostrar os limites e as possibilidades de avançar em um paradigma de participação popular na construção de uma sociedade sustentável.
