Este es un estudio sobre la garantía y aplicabilidad de los derechos humanos de las poblaciones indígenas colombianas durante los primeros cuatro años de mandato de la administración Santos. La investigación busca explicar la manera en que las adversas condiciones socio económicas que caracterizan el desarrollo de las poblaciones indígenas, denotan la incapacidad del Estado Social de Derecho para garantizar la protección y aplicabilidad de los derechos fundamentales de estas comunidades. Las disposiciones constitucionales han tenido un desarrollo truncado debido a las escasas medidas proferidas por diferentes gobiernos frente a las necesidades de estos grupos en particular. En razón de lo anterior, el estudio se inscribe dentro del marco teórico referente al neo constitucionalismo debido al alto valor explicativo que ofrecen los postulados de Gustavo Zagrebelsky y Luigi Ferrajoli en relación al fenómeno que se pretende analizar. Se concluye que frente a la persistencia de los factores que afectan el desarrollo de las poblaciones indígenas, el reconocimiento constitucional debe ser complementado por una efectiva normatividad que asegure la aplicabilidad de los derechos fundamentales por parte de las administraciones políticas: no debe existir un desfase entre las nociones de principio y la ley.

ResumenEste trabajo pretende ser un instrumento de reflexión sobre el rol histórico de la autoridad en el aula. El supuesto es que los períodos autoritarios han dejado huellas en las cosmologías docentes y por ello el autoritarismo se resiste a partir. Esto último impide enfatizar en actitudes y acciones didácticas de tipo cooperativo; invisibilizando derechos fundamentales, principalmente aquellos referidos en la infancia y adolescencia. Se hace hincapié en la participación democrática de docentes y estudiantes, enfatizando en la exaltación de un tipo de socialización enmarcada en la participación democrática desde la escuela, que pueda aportar hábitos trasladables a otros ámbitos sociales, contribuyendo a formar actitudes deliberativas, necesarias para participar activamente. El marco utilizado es, en el caso de las teorías del aprendizaje y como soporte metodológico, el principio de Zona de Desarrollo Próximo (Vigotsky) y el supuesto de aprendizaje práctico/participativo (Rogoff), además de brindar algunas concepciones sobre filosofía política en educación (Gutman).Respecto al marco normativo, se presta atención al cuerpo jurídico internacional sobre derechos humanos poniendo énfasis en la esfera de la educación, las recientes leyes argentinas de educación (2006) y de protección de la infancia y la adolescencia (2006). Palabras clave: autoridad democrática, diálogo horizontal, ciudadanía activa, talleres pedagógicos. AbstractThis work aims to be an instrument of reflection on the historical role of authority in the classroom. The assumption is that authoritarian periods have left footprints in the cosmologies of teacher, hence authori­tarianisms resists to leave. This prevents the emphasis on didactic cooperative attitudes and actions, thus subduing fundamental rights, mainly those referred to infancy and adolescence. The teachers´ and students´ democratic participation is emphasized, remarking the exaltation of a kind of socialization framed by the democratic participation from the school, which can bring habits transferable to other social areas, facilitating the development of the deliberative attitudes needed to participate actively. The theoretical framework is, in the case of learning theories and as a methodological support, the principle of Near Area Development (Vigotsky) and as the second argument, we use the assumption of learning by doing/participatory (Rogoff). In the first case, a task that is done with help today will be autonomously tomorrow. For the latter, it means participatory activities in order to achieve habits that may relocate to other social environments. In the case of Guttmann, it is looking for framing issues of political theory of education, mainly those related to the new skills a twenty-first century citizenship must acquire. Regarding the regulatory framework, attention is paid to international norms on human rights with empha­sis on education, recent Argentinean education laws (2006) and new laws on childhood and adolescence protection (2006). Keywords: democratic authority, horizontal dialogue, active citizenship, pedagogical workshops.

ResumenLos derechos humanos y el desarrollo humano comparten la misma visión y objetivo: garantizar la libertad, el bienestar y la dignidad de todas las personas del mundo. Para alcanzar un desarrollohumano alto es necesario el respeto y el ejercicio eficiente de los derechos humanos, como el acceso a la educación, a los servicios de salud, a la alimentación, a un trabajo dignoy bien remunerado, a la participación activa de las decisiones económicas, entre otros. Al mismo tiempo, es importante tener un nivel de desarrollo suficiente para proporcionar y garantizarlos derechos humanos más fundamentales. En este artículo se presenta un análisis de la situación de los derechos humanos y el desarrollo humano en México. Se utilizan informes e índices de diferentes instituciones, examinando la situación específica de algunos estados. Los resultados indican que aunque México es considerado como un país de desarrollo humano “alto”, no necesariamente ha implicado que el nivel de vida de toda su población sea mejor ytampoco ha garantizado el respeto y ejercicio eficiente de los derechos humanos.Palabras clave: derechos humanos, desarrollo humano, derecho al desarrollo, México. AbstractHuman rights and human development share common visions and goals: to ensure the freedom, well-being and dignity of all the people. The achievement of a high level of human development requires both respect for and the effective exercise of fundamental human rights, including the right to: education, healthcare services, adequate food, dignified and justly remunerated work, and meaningful participation in economic decision-making, among other fundamental rights. The provision for and protection of the most basic human rights and the achievement of an acceptable level of human development are interdependent. This paper presents an analysis of human rights and the human development situation in Mexico. Reports and indices sourced from various institutions are cited and the specific conditions that exist in some Mexican states are evaluated. The results show that although Mexico has a high level of human development, it does not implies that the standard of living of all of its citizens has improved or that respect for and the effective exercise of human rights has accompaniedthis development in Mexico.Keywords: human rights, human development, right to the development, Mexico.

Big data and AI are paving the way to promising scenarios in clinical practice and research. However, the use of such technologies might clash with GDPR requirements. Today, two forces are driving the EU policies in this domain. The first is the necessity to protect individuals’ safety and fundamental rights. The second is to incentivize the deployment of innovative technologies. The first objective is pursued by legislative acts such as the GDPR or the AIA, the second is supported by the new data strategy recently launched by the European Commission. Against this background, the thesis analyses the issue of GDPR compliance when big data and AI systems are implemented in the health domain. The thesis focuses on the use of co-regulatory tools for compliance with the GDPR. This work argues that there are two level of co-regulation in the EU legal system. The first, more general, is the approach pursued by the EU legislator when shaping legislative measures that deal with fast-evolving technologies. The GDPR can be deemed a co-regulatory solution since it mainly introduces general requirements, which implementation shall then be interpretated by the addressee of the law following a risk-based approach. This approach, although useful is costly and sometimes burdensome for organisations. The second co-regulatory level is represented by specific co-regulatory tools, such as code of conduct and certification mechanisms. These tools are meant to guide and support the interpretation effort of the addressee of the law. The thesis argues that the lack of co-regulatory tools which are supposed to implement data protection law in specific situations could be an obstacle to the deployment of innovative solutions in complex scenario such as the health ecosystem. The thesis advances hypothesis on theoretical level about the reasons of such a lack of co-regulatory solutions.

This article explores the role of the European Union in the human rights protection, implementation and promotion in Serbia. It is clear that the EU demands on democratisation in the region of Western Balkans are crucial to achieve the respect for human rights. The human rights standards as part of the conditionality criteria of the EU is a clear message towards the countries aspiring membership. However, Serbia progress in the field has been difficult due to several internal constraints. This paper aims to uncover the democratisation process of Serbia on its path towards the EU, and its progress (or not) regarding human rights protection and implementation.

This article addresses the consequences of economic sanctions for the protection of human rights in Latin America. The literature on sanctions and compliance informs three hypotheses, which investigate the relationship between sanctions and the level of rights protection in two groups of countries: those that were targeted by sanctions and those that were not. Using data from the Political Terror Scale (PTS) and from Freedom House, I find empirical evidence that sanctions do improve the level of protection in countries that were not targeted. This finding can be explained by the deterrent effect attributed to sanctions by the compliance literature, broadly interpreted. The presence of economic sanctions in a given year increases the probability of observing better human rights practices by almost 50%. These results hold for the 12 Latin American countries that were not subject to economic sanctions for the period 1976-2004.

Colapso do sistema informático da Justiça, Citius?! É que, a ser verdade, então seria o kaos da justiça e teria que haver consequências imediatas na tutela, pois poderia estar em causa a aplicação prática dos Direitos Fundamentais dos cidadãos e das organizações legais, tendo que ser declarado, ouvido o Conselho de Estado, o “estado de emergência”, de acordo com o art. 19º da Constituição. § Mas mais incrível ainda é o facto de estar por cumprir desde 2011 (dois mil e onze!), a Lei-Quadro de Política Criminal! Abstract: Collapse of the computer system of justice, Citius ?! Is that to be true, then it would be the kaos justice and would have to be immediate consequences in the protection, it could be because the practical application of fundamental rights of citizens and legal organizations, having to be declared, after hearing the Council of State the "state of emergency", according to art. 19 of the Constitution. § But more amazing is the fact of being unfulfilled since 2011 (two thousand and eleven!), The Framework Law for Criminal Policy!

Em termos de dinheiros públicos, devemos ter em consideração a necessidade de ter que existir uma boa governança. É importante a participação. Também a transparência. E se os direitos e deveres sociais fundamentais estão interligados, não é menos verdade que é preciso a apresentação de boas contas à população. E aqui temos que falar também em plena responsabilidade pública. Num sentido lato, podemos falar num princípio geral de anticorrupção. O mau uso dos dinheiros públicos pode conduzir à responsabilidade de índole criminal. O crime de branqueamento/lavagem, um crime secundário, pode ter por origem ilícitos e/ou crimes que se relacionam com a utilização indevida de dinheiros públicos. A responsabilidade financeira e criminal pode aliás constituir um incremento na boa gestão dos dinheiros públicos. Deste modo – não tendo o direito penal finalidades de promoção ou de “combate”, mas ainda assim retributivos, preventivos gerais e especiais positivos e restaurativos -, podemos estar a caminhar para uma melhor concretização dos direitos, e dos deveres, que são garantidos do ponto de vista constitucional-constitucional. Afinal, todas as áreas do direito, são peças do mesmo jogo de xadrez. O Tribunal Constitucional em Portugal, o Supremo Tribunal Federal no Brasil, o Supremo Tribunal de Justiça em Portugal, o Superior Tribunal de Justiça no Brasil, os Tribunais de Contas em ambos os países. § In terms of public money, we should take into account the need to have to be good governance. It is important to participate. Also transparency. And if fundamental rights and social duties are interrelated, it is also true that we need to present good accounts to the population. And here we must also speak in full public accountability. In a broad sense, we can speak of a general principle of anti-corruption. The misuse of public funds can lead to criminal nature of responsibility. The crime of money laundering, a secondary crime, may have as illicit origin and / or crimes that relate to the misuse of public funds. The financial and criminal liability may in fact be an increase in the sound management of public funds. Thus - not having the criminal law purposes of promotion or "combat", but still remunerative, general and special preventive and restorative positive - we may be heading for a better realization of the rights, and duties, which are guaranteed the constitutional-constitutional point of view. After all, all areas of the law are parts of the same game of chess. The Constitutional Court in Portugal, the Supreme Court in Brazil, the Supreme Court in Portugal, the Superior Court of Justice in Brazil, the Audit Courts in both countries.

Pelos fundamentos expostos no Acórdão nº 377/2015, de 27/7, o T.C. decidiu pronunciar-se pela inconstitucionalidade das normas constantes do n.º 1 do artigo 1º e do artigo 2º do Decreto da Assembleia da República nº 369/XII, por violação dos artigos 18º/2 (necessidade, adequação, proporcionalidade e intervenção mínima do Direito Criminal/Penal), 29º/1 (Princípio da Legalidade Criminal) e 32º/2 (Presunção da Inocência) da Constituição. Imagine-se que depois de se ser condenado pela Comunicação Social, ainda temos que provar a nossa inocência! § On those grounds in Judgment No 377/2015 of 27/7, the Constitutional Court decided to rule the unconstitutionality of the rules in paragraph 1 of Article 1 and Article 2 of Decree of the National Assembly No. 369 / XII, for violation of articles 18/2 (necessity, appropriateness, proportionality and minimum intervention of Criminal Law / Criminal), 29/1 (Principle of Criminal Legality) and 32/2 (Presumption of Innocence) of the Constitution. Imagine that after being convicted by the Social Communication, we still have to prove our innocence!

Dizíamos no último artigo, um dia antes de Nª Srª da Assunção (ainda é feriado!), que o Art. 1º da Constituição, “República Portuguesa”, diz: “Portugal é uma República soberana, baseada na dignidade da pessoa humana e na vontade popular e empenhada na construção de uma sociedade livre, justa e solidária”. § If some are afraid of the current Portuguese Constitution, one of the humanists of the world, others want a 'Constitution of Fear. "We said in the last article, the day before Our Lady of the Assumption (it's still holiday!), That Article 1 of the Constitution, "Portugal", he says. “Todos têm o direito de resistir a qualquer ordem que ofenda os seus direitos, liberdades e garantias e de repelir pela força qualquer agressão, quando não seja possível recorrer à autoridade pública”. É o que consagra o art. 21º da Constituição da República Portuguesa. Trata-se não apenas dum direito fundamental, mas também dum dever fundamental. § "Everyone has the right to resist any order that offends the rights, freedoms and guarantees and to resist by force any aggression when it is not possible recourse to a public authority." It is what establishes the art. 21 of the Portuguese Constitution. It is not just of a fundamental right, but also as a fundamental duty.
