Estrategias de control ciudadano: una aproximación a la intervención megaminera en Cajamarca Tolima. (2007-2013)

El presente estudio de caso busca describir y analizar a la luz de los conceptos de resistencia civil y acción colectiva cómo las movilizaciones sociales en el Tolima han logrado generar cambios en el modo de operar de la transnacional minera Anglogold Ashanti en la mina la Colosa entre el año 2007 y el año 2013. Con este fin, se realizaron una serie de entrevistas y visitas de campo que permitieron un acercamiento al movimiento de los Comités Ambientales y Campesinos del Tolima. Este acercamiento dio como resultado una reconstrucción del panorama de la problemática que enfrentan las comunidades locales cuando las empresas megamineras llegan a sus territorios transformando, en diferentes aspectos, la dinámica del lugar. Dicho panorama se constituye en un insumo que puede ser utilizado por las comunidades para empoderarse frente al derecho de decidir sobre el uso que le quieren dar a su territorio.

Los indígenas de Colombia y el riesgo global

En este artículo se analiza la relación existente entre la Sociedad del Riesgo Global, descrita por Beck, y la situación que viven los indígenas en Colombia en la actualidad. Este análisis se desarrolla a través de la exposición de la problemática indígena, aquella expresada en sus demandas y movimientos sociales, y de la posición que tienen estas demandas frente al estado. Finalmente se demuestra como la obligada inmersión de los territorios indígenas en la dinámica del libre mercado y de la industrialización, conlleva un riesgo extremo para la perdida de las costumbres y de la cultura de estos pueblos, así como de un alto riesgo físico.

Incidencia del cambio climático en la seguridad ambiental de las maldivas. Un desafío para la construcción de un régimen internacional de refugiados ambientales (2000-2012)

El interés de esta investigación diagnóstica es evaluar el tema de los refugiados ambientales en las legislaciones internacionales que se encuentran en vigencia actualmente. Es un elemento de análisis pertinente debido a que durante los últimos años el cambio climático y sus efectos adversos han causado estragos en algunas poblaciones, dando origen a lo que se conoce como refugiados ambientales. Así, la falta de inclusión del concepto en la normatividad internacional, representa una problemática, en tanto que estas personas no tienen ningún tipo de apoyo por parte de la Comunidad Internacional. En este trabajo se centra en el caso de las Islas Maldivas y refleja la necesidad de crear un nuevo régimen internacional que cubra a la figura de refugiados ambientales, para así hacer frente a esta problemática internacional.

Freedom of contract and the coexistence of trademark registrations in Colombia

In trademark systems such as the Andean Community, a state authority verifiesthat the marks are distinctive, lawful and do not affect third parties, and after that,given their ownership. In this context, particular interest has sparked the possibilityof individuals by agreements or statements of co-existence, are who ensure that theirsigns meet the conditions for simultaneous registrations.Such agreements for the coexistence of marks are problematic if one thinks thatthe holders of interests that would be available also seem to matter to consumers,competitors and the market. Therefore, define the scope of contractual freedom inthe field of trademark law, whose rules are considered imperative, acquire practicaland theoretical importance because its realization i) recognizes the risks that maybe relevant to evaluating trade agreements and ii) contributes to debates on the roleof private autonomy in areas reserved for non-derogable norms. Thus, this researchputs the declarations of consent for the coexistence of registrations in Colombia, ina larger scope of the limits of freedom of contract.

Conscientious objection and ideological impositions: The Drift of The Mayflower

This article discusses the problematic and evading development of conscientiousobjection in the context of the Colombian constitutional jurisprudence. From a historical allusion to the famous case of the “Mayflower Pilgrims” –which serve as areference to the central problems that faces the objector–, it seeks to define the scopeof conscientious objection as a fundamental right (as a fundamental justice claim)in regard to the “factual” and “legal” possibilities for its exercise, for which there willbe a brief contrast between the most representative cases decided by the ColombianConstitutional Court in such matter. The core of the article is the idea that thereis an ideological prevalence that, unjustifiably, makes it difficult and in some casesdenies the exercise of the right to object in consciousness, particularly when it comes tothe right of life in regard to the abortion case.

Alcohol consumption in young college students

Descriptive Cross-sectional study involving 787 students from a private university in Bogota. Its objectives were to determine the alcohol consump- tion prevalence, alcoholism and risk of alcoholism and determine the current pattern of alcohol con- sumption. A survey –which included the CAgE index– was used to collect the data. A prevalence of alcoholism of 23%, and of risk of alcoholism of 15% were found. Results show that alcohol con- sumption in university students begins in high school and it is a problematic conduct that it is worth being enlarged and analyzed in greater detail including other variables and perfecting the diag- nosis of alcoholism and its risk in order to achieve early identification and intervention.

Imaginarios de belleza en estudiantes de Educación Física

“Imaginarios de belleza en estudiantes de Educación Física de la Universidad Pedagógica Nacional (UPN) Centro Valle de Tenza (CVT)” tiene como propósito describir los imaginarios de los estudiantes acerca del cuerpo y la Educación Física en su relación con la belleza. Esta investigación muestra cómo el cuerpo de los estudiantes es objeto de discursos hegemónicos por parte de la publicidad y los medios de comunicación. Así mismo, evidencia la importancia de formar futuros licenciados en Educación Física que asuman de forma crítica las problemáticas de la educación del cuerpo contemporáneo.

Metacognitive knowledge and self-regulation: A qualitative lecture of students functioning in writing

This research emerges from the world-wide problematic concerning student's failure. It particularly analyzes the meta-cognitive competences in the writing process of this population. Based on Flavell's (1992) viewpoint about meta-cognition and the socio-cognitive approach of self-regulation, two variables were measured: meta-cognitive knowledge and self-regulation strategies. A qualitative study was conducted on a sample of 12 French students at first year university. This study uses a specific technique of interview known as "explicitation interview". The data analysis included the categorization, codification and quantification of the information obtained with the interviews. In conclusion, even though the students had metacognitive knowledge related to the written tasks, they did not show strategies that could help to go beyond the descriptive modality of written discourses by taking into account the readers' expectations. Their writing processes focused on transcription of ideas with little control on the planning and revision phases.

Imaginarios, biomedicina y normatividad: una respuesta a los procesos de estigmatización y discriminación por VIH

El tratamiento del VIH/sida, como problemática que ocupa a la salud colectiva, requiere nuevas perspectivas teóricas para su análisis. Objetivo: reconstruir algunas matrices imaginarias, configu- radoras de la infección de VIH, vinculadas con prácticas normativas y con la formación del saber clínico, visibilizar consecuencias de estos procesos y articular estas matrices con las problemáticas de discriminación y estigmatización que pesan sobre el diagnóstico. Materiales y métodos: se efectuaron entrevistas en profundidad a jóvenes entre 18 y 35 años y a profesionales de la salud dedicados al tratamiento del VIH/sida de hospitales públicos de las ciudades de Santa Fe y Paraná (Argentina). Resultados: el discurso biomédico –nodal en tanto exigencia de la norma y garante del ejercicio de normalización de los individuos y de las poblaciones a partir del binomio normal/ patológico– incide en la apropiación de la diagnosis y la convivencia con la infección. Conclusión: a partir de los resultados, es posible comprender los procesos de estigmatización y discrimina- ción como mecanismos privilegiados de estas instancias normativas que median la configuración discursiva del VIH. A su vez, se advierte que el rechazo prevalente en jóvenes a realizarse las pruebas diagnósticas, como las dificultades de acceso a los servicios de salud, es consecuencia de los procesos indicados.

Interdisciplinary Pedagogical Experience for Health Human Resources Focused on the Holistic Promotion of Health and the Prevention of the Disease

The object of this experience is to offer the students the opportunity to take part in the construction of a pedagogic strategy centred on the ludic, for the promotion of the integral health and the prevention of the disease with an educational community; directed to supporting and qualifying the well-being so much individually as group. The project is designed to five years, about interdisciplinary character (Speech Therapy, Medicine, Psychology, Nursery, Occupational Therapy), interinstitutional (Universidad del Rosario, Universidad de San Buenaventura y Universidad de Cundinamarca) and intersectorial (Education and Health). It considers the different actors of the educational community and school and the home as propitious scenes for the strengthening potential, beside being the fundamental spaces for the construction of knowledges and learnings concerning the integral health. To achieve the target, one has come constructing from the second semester of 2003, one pedagogic strategy centred on the ludic and the creativity, from which they are planned, they develop and evaluate the actions of promotion of skills, values, behaviors and attitudes in the care of the health and the prevention of disease, orientated to the early, opportune and effective detection of risk factors and problematic of the development that they affect the integral health. The above mentioned strategy raises a so called scene Bienestarópolis: A healthy world for conquering, centred on prominent figures, spaces and elements that alternate between the fantasy and the reality to facilitate the approximation, the interiorización and the appropriation of the integral health. Across this one, the children motivated by the adults enter an imaginary world in that theirs desires, knowledges and attitudes are the axis of his development. Since Vigotsky raises it, in the game the child realizes actions in order to adapt to the world that surrounds it acquiring skills for the learning. The actions of the project have involved 410 children and 25 teachers, of the degrees Zero, The First and The Second of basic primary; 90 parents of family, and an average of 40 students and 8 teachers of the already mentioned disciplines.

Modelos de decisión bajo una perspectiva de análisis de sus procesos

Executives must walk in a fine line between two ends: by a part, the arbitrary decision making without a rigorous study of the problematic situation, being based on hunches or intuition; on the other hand, to lean too much in rational and quantitative analyses. The decisions generally are not taken by a single executive, requires of the participation of certain groups involved in the problematic one and in this social sense, it is doubtless that, sometimes, conflict of interests coexists frustating the participating and collaborative context on the solution and implantation have arisen from decisions; whereas on the other hand, contexts arise where the collaboration is converted in consensus solutions.

El sistema de transporte de carga en la Ciudad de México Factores a considerar en el análisis del transporte de carga y la movilidad de mercancías

El artículo presenta un análisis del sistema de transporte de carga en la Ciudad de México desde el punto de vista sistémico, considerando las variables económicas, políticas, técnicas, sociales que permitan comprender la problemática que actualmente enfrenta esta ciudad en la movilidad de mercancías. Es una reflexión de carácter multidisciplinario basada en el método cualitativo para explicar y comprender la situación actual del transporte de carga en México dentro del contexto de la globalización económica, para identificar así la naturaleza profunda de la estructura dinámica del transporte de carga en la Ciudad y la nueva forma de conceptualizar al transporte de mercancías. Se estudia el comportamiento de los flujos e infraestructura de las redes viales, las características urbanas, los instrumentos jurídicos en las políticas del transporte, la problemática del transporte de carga, así como la movilidad y los diferentes problemas que enfrenta el sector en relación con la ciudad. El objetivo principal de presente artículo es enunciar las razones por las que no existe un sistema de transporte articulado y se privilegia el uso del autotransporte de carga. Finalmente, de acuerdo a las diversas variables analizadas, se establece en las conclusiones que el análisis y la planificación de los transportes debe ser multi e interdisciplinario por naturaleza, con una visión integral para establecer un equilibrio entre los modos de transporte. 

¿Se han transformado las acciones populares con ocasión de los cambios normativos y jurisprudenciales ocurridos en el periodo 2006-2012?

El trabajo realizado tiene como objetivo revisar la problemática planteada en la jurisdicción contencioso administrativa, a través de un estudio concentrado de aspectos procesales esenciales en la estructura de la acción popular como (i) el incentivo (en este caso, se evaluará el impacto de su eliminación), (ii) la efectividad de la audiencia de pacto, (iii) las medidas cautelares como quiera que fueron objeto de modificación en la Ley 1437 de 2011 y por último, (iv) el estudio del mecanismo de revisión eventual incorporado en el año 2009 como mecanismo de unificación.
