Since the mapping of the human genome and the technical innovations in the field of biotechnology, patent law has gone through great controversies. Protection is required for an investor to make an investment but how broad should the given protection be? Whether the invention is a mi- cro-organism capable of dissolving crude oil, or the gene of a soya plant, the genetic engineering required for their production entails vast amounts of capi- tal. The policy in that respect is tailored by legislative acts and judicial decisions, ensuring a fair balance be- tween the interests of patent right holders and third parties. However, the policy differs from jurisdiction to jurisdiction, thus creating inconsistencies with re- gards to the given protection to the same invention, and as a result this could deter innovation and pro- mote stagnation. The most active actors shaping the patent policy on an international level are the patent offices of the United States of America, Japan and the European Patent Organization. These three patent offices have set up a cooperation programme in order to promote and improve efficiency with regards to their patent policies on a global scale. However, recent judicial de- velopments have shown that the policy in respect to the field of biotechnology differs between the patent regimes of the United States of America and the two- layer system of the European Patent Organisation/ the European Union.

Social norms pervade almost every aspect of social interaction. If they are violated, not only legal institutions, but other members of society as well, punish, i.e., inflict costs on the wrongdoer. Sanctioning occurs even when the punishers themselves were not harmed directly and even when it is costly for them. There is evidence for intergroup bias in this third-party punishment: third-parties, who share group membership with victims, punish outgroup perpetrators more harshly than ingroup perpetrators. However, it is unknown whether a discriminatory treatment of outgroup perpetrators (outgroup discrimination) or a preferential treatment of ingroup perpetrators (ingroup favoritism) drives this bias. To answer this question, the punishment of outgroup and ingroup perpetrators must be compared to a baseline, i.e., unaffiliated perpetrators. By applying a costly punishment game, we found stronger punishment of outgroup versus unaffiliated perpetrators and weaker punishment of ingroup versus unaffiliated perpetrators. This demonstrates that both ingroup favoritism and outgroup discrimination drive intergroup bias in third-party punishment of perpetrators that belong to distinct social groups.

Stream-mining approach is defined as a set of cutting-edge techniques designed to process streams of data in real time, in order to extract knowledge. In the particular case of classification, stream-mining has to adapt its behaviour to the volatile underlying data distributions, what has been called concept drift. Moreover, it is important to note that concept drift may lead to situations where predictive models become invalid and have therefore to be updated to represent the actual concepts that data poses. In this context, there is a specific type of concept drift, known as recurrent concept drift, where the concepts represented by data have already appeared in the past. In those cases the learning process could be saved or at least minimized by applying a previously trained model. This could be extremely useful in ubiquitous environments that are characterized by the existence of resource constrained devices. To deal with the aforementioned scenario, meta-models can be used in the process of enhancing the drift detection mechanisms used by data stream algorithms, by representing and predicting when the change will occur. There are some real-world situations where a concept reappears, as in the case of intrusion detection systems (IDS), where the same incidents or an adaptation of them usually reappear over time. In these environments the early prediction of drift by means of a better knowledge of past models can help to anticipate to the change, thus improving efficiency of the model regarding the training instances needed. By means of using meta-models as a recurrent drift detection mechanism, the ability to share concepts representations among different data mining processes is open. That kind of exchanges could improve the accuracy of the resultant local model as such model may benefit from patterns similar to the local concept that were observed in other scenarios, but not yet locally. This would also improve the efficiency of training instances used during the classification process, as long as the exchange of models would aid in the application of already trained recurrent models, that have been previously seen by any of the collaborative devices. Which it is to say that the scope of recurrence detection and representation is broaden. In fact the detection, representation and exchange of concept drift patterns would be extremely useful for the law enforcement activities fighting against cyber crime. Being the information exchange one of the main pillars of cooperation, national units would benefit from the experience and knowledge gained by third parties. Moreover, in the specific scope of critical infrastructures protection it is crucial to count with information exchange mechanisms, both from a strategical and technical scope. The exchange of concept drift detection schemes in cyber security environments would aid in the process of preventing, detecting and effectively responding to threads in cyber space. Furthermore, as a complement of meta-models, a mechanism to assess the similarity between classification models is also needed when dealing with recurrent concepts. In this context, when reusing a previously trained model a rough comparison between concepts is usually made, applying boolean logic. The introduction of fuzzy logic comparisons between models could lead to a better efficient reuse of previously seen concepts, by applying not just equal models, but also similar ones. This work faces the aforementioned open issues by means of: the MMPRec system, that integrates a meta-model mechanism and a fuzzy similarity function; a collaborative environment to share meta-models between different devices; a recurrent drift generator that allows to test the usefulness of recurrent drift systems, as it is the case of MMPRec. Moreover, this thesis presents an experimental validation of the proposed contributions using synthetic and real datasets.

Only recently has imprisonment become a central feature of both t across every level of government and involving civil and criminal law enforcement tools. Examining the population as a whole provides crucial insights as to how we arrived at this state of mass immigration imprisonment. While political motivations — parallel to those that fueled the rapid expansion of criminal mass incarceration — may have started the trend, this Article demonstrates that key legal and policy choices explain how imprisonment has become an entrenched feature of immigration law enforcement. In fact, legislators and immigration officials have locked themselves into this choice, as there are now literally billions of dollars, tens of thousands of prison beds, and innumerable third parties invested in maintaining and expanding the use of immigration imprisonment. Using the literature on path dependence and legal legitimacy, this Article explains the phenomenon of immigration imprisonment as a single category that spans all levels of government. Rather than continue further along this path, the Article concludes by suggesting that policymakers should seek a future reflective of immigration law enforcement’s past when imprisonment was the exception rather than the norm.

A resolução em benefício da massa constitui um dos mecanismos mais relevantes do Direito da Insolvvência, tendo por finalidade destruir os efeitos provocados por actos praticados ou omitidos pelo devedor durante um específico período anterior à declaração de insolvência em prejuízo da massa insolvente e dos interesses dos credores. Este trabalho tem como objectivo analisar o conceito de actos prejudiciais de acordo com os princípios basilares de Direito Civil e do Direito da Insolvência, nomeadamente dos princípios da prevalência do interesse dos credores e da par conditio creditorum, bem como os efeitos e o procedimento. Todos os actos que causem uma diminuição do património do devedor ou que lesem a par conditio creditorum podem ser integrados no conceito de actos prejudiciais. A existência de prejuízo pode ser presumida iuris et de iure em determinados casos ou deve ser provada pelo administrador da insolvência. É, igualmente, relevante a má fé do terceiro, que pode ser presumida iuris tantum e é excluída na resolução incondicional. Constituindo um instrumento de protecção dos interesses dos credores na insolvência do devedor, a resolução em benefício da massa ergue-se a direito da colectividade dos credores e torna inoponíveis em relação a estes os actos praticados pelo devedor e por um terceiro. A lei prevê excepções à oponibilidade a terceiros. A resolução em benefício da massa ou outras acções de idêntica natureza previstas na lei civil devem ser exercidas de forma exclusiva pelo administrador da insolvência na pendência do processo de insolvência, ainda que o CIRE permita o exercício pelos credores da impugnação pauliana. No entanto, os efeitos da referida acção devem aproveitar a todos os credores.

A presente Dissertação versa sobre a aplicação do princípio da consensualidade à transmissão contratual do direito de propriedade na ordem jurídica portuguesa, dando especial destaque à transmissão contratual dos bens imóveis. A transmissão contratual do direito de propriedade sobre os bens imóveis suscita a problemática da articulação entre o princípio da consensualidade e as restantes normas do ordenamento jurídico, principalmente as normas da ordem registal, na medida em que, se discute se no plano da transmissão contratual dos bens imóveis o princípio da consensualidade consiste numa regra geral ou, por outro lado, assume um papel residual ou supletivo. Tanto a Doutrina maioritária como a Jurisprudência portuguesas defendem a prevalência do Direito substantivo e do princípio da consensualidade na transferência do direito de propriedade, mesmo no caso dos bens imóveis. Já uma Doutrina minoritária defende a prevalência do Direito Registal ao dar relevância ao papel da inscrição registal da transmissão do direito de propriedade sobre os bens imóveis, defendendo que a transferência de bens imóveis por mero efeito do contrato é uma regra supletiva ou residual na ordem jurídica portuguesa. Da análise da ordem jurídica portuguesa verificou-se que o sistema do título português possui “efeitos fracos”; a transmissão contratual do direito de propriedade ocorre por efeito do contrato mesmo em relação aos bens imóveis, logo, o princípio da consensualidade é a regra geral; o sistema de registo é semi-obrigatório; o registo não é elemento de transmissão do direito de propriedade mas condição de oponibilidade face aos terceiros (apenas os terceiros tutelados pelo legislador), por isso, o registo possui um efeito consolidativo do direito registado.

Very little empirical work exists on cyberstalking. The current study analysed detailed questionnaires completed by 1051 self-defined stalking victims. Almost half (47.5%) reported harassment via the Internet, but only 7.2% of the sample was judged to have been cyberstalked. Ordinal regression analyses of four groups of victims, categorized according to degree of cyber involvement in their victimization, revealed a general picture of similarity between the groups in terms of the stalking process, responses to being stalked, and the effects on victims and third parties. It was concluded that cyberstalking does not fundamentally differ from traditional, proximal stalking, that online harassment does not necessarily hold broad appeal to stalkers, and that those who target ex-intimates remain the most populous stalker type.

The study aimed to identify in the professionals and students of health courses that work in a health Basic Unit in the city of Natal/RN their perceptions of the care of deaf patients, and with the population's needs with hearing loss in relation to health care. This is a cross-sectional, exploratory, descriptive study, conducted between April to July 2014, with a population composed of 21 health professionals, 17 students and 8 deaf users. For data collection, we used a structured questionnaire with open and closed questions applied to groups composed of health professionals (doctors, dentists, nurses and health workers) and students of medical schools, nursing, physical education, nutrition and social service. The professionals/students answered a semi-structured questionnaire with open and closed questions concerning the possible difficulties the care of the deaf and hearing impaired. Data collection with deaf users was conducted through filmed interview for the Brazilian Sign Language (Libras) could be interpreted as to the Portuguese by the researcher. With the latter it was conducted a survey of their reactions when looking for a care in the health service. Regarding the profile of identification of the subjects, it was analyzed by simple descriptive statistics (absolute and relative frequencies). The open questions were analyzed through the content analysis technique which allowed the categorization process preserving all the points raised in the discussion so that the lines were representative of the whole. When asked about the professionals and students attitude used to communicate with deaf patients possible the following categories emerged: the "writing", the "gestures" and the "third party assistance". With regard of the deaf, when asked about their experiences in seeking care in health, the elucidated categories were: "quality of care to the hearing impaired", "communication with the hearing impaired adequacy" and "dependence on third parties." The closed questions were measured and adapted to the 5 degrees of variation Likert Scale, which comprised three of these issues: degree of difficulty in communication to meet a patient with hearing loss (minimum to great difficulty); feeling of comfort while using sign language (minimum to severe discomfort); and knowledge of the Law 10.436, which provides for the Brazilian Sign Language (Libras) (low knowledge to entirely clear). The data collected with professionals and students revealed some misunderstanding and discomfort in health care for deaf patients, reality also evidenced in the opinion of the deaf participants. This study revealed problems in communication, resulting in negative consequences in serving this population. This diagnosis may be relevant to public policy development and curriculum guidelines essential to the training of health professionals, inclusion and improving assistance to deaf.

En este artículo, basado en el derecho a la libertad de iniciativa, se discute la constitucionalidad de la medida judicial que determina la intervención en sociedades comerciales en conflicto mediante administradores judiciales provisionales. Por lo tanto, se eligió el método hipotético-deductivo de enfoque, comenzando con laclasificación de la libre empresa como un derecho fundamental. Posteriormente, se presenta el panorama de las medidas judiciales dichas. Más que buscar y proporcionar una respuesta simple, se diseñan métricas de constitucionalidad basadas en argumentos que se encuentran en la teoría de los derechos fundamentales y en el derecho de sociedades. Como resultado principal, se vio que, incluso si toman la designación de terceros a la función de gestor comercial, la intervención judicial en conflictos societarios conserva el núcleo esencial de la libre empresa y los intereses corporativos y extra-sociales que rodea la organización empresarial, estableciendose de forma abstracta, como una medida legítima y constitucional.

Con el fin de la Segunda Guerra Mundial y el escenario que planteaba la Guerra Fría, la manera de entender y explicar la seguridad en la comunidad internacional se amplió, y pasó de ser concebida únicamente en términos políticos y militares, a incluir aspectos como el medio ambiente, la economía y la sociedad. Por esta razón el concepto de seguridad se complejizó dando paso a la construcción de distintas definiciones y debates alrededor de la ampliación de la agenda de seguridad y los temas que en ella se debían tratar. Así pues el fin principal del presente trabajo es el análisis de un fenómeno socialmente relevante en el marco de las relaciones internacionales como lo es la configuración de seguridad, a partir de intervenciones de terceros actores que involucran poblaciones afectadas como en el caso somalí, la cual enfrentó una situación de crisis como producto de la emergencia de seguridad que se produce en el año 1991 con la expulsión de Siad Barre del poder. Su importancia radica en la reivindicación de la trascendencia tanto de los derechos humanos, como de la relevancia del papel de las organizaciones internacionales y de los Estados más poderosos del Sistema Internacional, en la protección de esos derechos y de las comunidades vulnerables que conforman dicho sistema.
