This paper discusses some economic integrations in Latin America, which have become an expression of governance in the neoliberalist context -- These integrations are also the results of second-generation adjustments in terms of trade openness, sale of state assets, free short-term capital mobility and Asian and European integrations that preceded the regional ones -- In addition to this, this paper provides answers to the following questions: Are integrations aiming to achieve development? Would North-countries integrations take the same endangering course as in South America? Who should benefit from the integrations? Is there a link between development and demographics?

The Philippines are currently facing a process of regional economic integration inside the ASEAN, in some way similar to the process undertaken by Spain and the European Union decades ago. Since January 2016, the ASEAN has become a Common Market, for whose effective achievement Competition and Innovation Law and Policies may play a crucial role. The scope of these pages is to overview the importance of the regulation in these issues and the promotion of competition within the member States throughout the process of regional economic integration. Then, we will consider the role that Competition and Intellectual Property Law and Policies have played in the construction of the European Union, and we will point out some current challenges that are still to be faced. Finally, we will offer some comparative conclusions considering the importance that these norms and policies will have in the construction of the ASEAN as an economic integrated area, and the way the ASEAN might follow the footsteps set by the European Union in its integration process.

The World Trade Organization’s (WTO) forthcoming Ninth Ministerial Conference in Bali comes at a critical juncture for the multilateral trade body, long mired in the Doha Round stalemate. Beyond offering a critical first test at consensus-building and institutional renewal, the Bali Ministerial affords a unique opportunity to gauge contrasting perceptions across ASEAN and East Asian countries of the continued relevance of the WTO to trade and economic governance within the region and beyond. Resulting from the collaborative efforts of the Economic Research Institute for ASEAN and East Asia (ERIA), the Universitas Pelita Harapan (UPH) and the World Trade Institute at the University of Bern (WTI), this policy research initiative offers comparative scholarship on some of the key questions arising from the forthcoming WTO Ministerial gathering from an East Asian perspective. Specifically, it explores what scholars in the region expect the Bali Ministerial to produce by way of tangible outcomes and whether the Ministerial will restore the momentum needed to bring the Doha Round to a successful conclusion. Contributors also investigate how relevant the WTO remains to the multiple processes of deepening economic integration in ASEAN and East Asia (e.g. AEC, TPP, RCEP) and, importantly, what lessons in rule-design and market opening WTO Members could usefully draw from the ongoing march towards the establishment of an ASEAN Economic Community.

Nariño y Cauca son dos de los departamentos de Colombia más afectados por la violencia. La reciente firma de un acuerdo de un cese bilateral de hostilidades con las Fuerzas Armadas Revolucionarias de Colombia (FARC) y los diálogos de La Habana son apenas el comienzo de la Construcción de Paz (CP) que implica el esfuerzo continuo de diferentes actores (gubernamentales, sector privado, sociedad civil y organismos multilaterales) para lograr no solo una paz negativa sino una paz positiva. El apoyo al emprendimiento es una estrategia implementada por el Gobierno y por los stakeholders que participan en el proceso del posconflicto, que tiene como finalidad respaldar el proceso de integración económica de las víctimas y desmovilizados. El presente documento es un estudio exploratorio elaborado por medio de una investigación cualitativa en la temática de emprendimiento, instituciones y CP en los departamentos de Nariño y Cauca. Se utilizó una estrategia metodológica denominada Matrices de Stakeholders para representar gráficamente la influencia institucional sobre la toma decisiones e implementación de los stakeholders sobre las reformas o políticas de emprendimiento y CP en estos dos departamentos. En esta investigación se encontró que i) en general, las instituciones del gobierno de los de Nariño y Cauca son extractivas y limitan la participación de la sociedad; ii) los stakeholders de la sociedad civil a pesar de tener cierta organización y voz no están en capacidad de generar influencia más que a nivel local o comunitario; iii) los vacíos dejados por las instituciones extractivas del gobierno tienden a ser llenados por instituciones inclusivas de stakeholders del sector privado y de organismos multilaterales.

Este documento indaga sobre los determinantes que hicieron posible la creación de la Alianza del Pacífico. Para ello, se describen elementos del contexto internacional y regional dentro del cual se gestó la Alianza, y que permitió la convergencia de unos intereses afines entre Chile, Colombia, Perú y México que, determinados por identidades similares, desembocaron en un proyecto colectivo: La Alianza del Pacífico. El argumento principal es que los intereses, las características y las identidades comunes configuraron unas preferencias nacionales que fueron materializadas en la creación de un proyecto de integración económica con características particulares, que sirve de plataforma para la coordinación, la articulación, la inserción y el desarrollo económico de sus miembros.

La conformación de grandes organizaciones de comercio de bienes de consumo como resultado de una integración de empresas comercializadoras, entre ellas la del Grupo Casino, han adquirido participaciones mayoritarias en empresas nacionales. Este nuevo modelo de negocios corporativo ha generado algunos beneficios al consumidor en aspectos de precio, variedad y calidad a la luz de compradores, investigadores y de los propios dueños. Sin embargo, son más los daños y perjuicios que ha ocasionado estos procesos de internacionalización que los beneficios a primera luz, pues vienen acompañados de prácticas desleales que han atentado con los intereses de empresas productoras y proveedoras eliminando de tajo la libre competencia y desapareciendo reglas y conductas sanas que han caracterizado a la economía de mercado. Se examinará las teorías y conductas que se aplican a estas negociaciones, así como las prácticas que ejecutan en el comercio en la defensa de la competencia y su impacto competitivo en sector comercio de Colombia.

The goal of this thesis has been to find out whether ISDS and international investment law exert a chilling effect on more stringent environmental standards at the domestic level. Due to the lack of consistent empirical and statistical evidence uncovered during the analysis, this thesis largely dismisses the regulatory chill hypothesis. However, two exceptions are identified: first, there is evidence of the efforts made by domestic industrial groups and trade unions to prevent the implementation of stricter environmental standards; second, it has become apparent that unfounded beliefs, e.g. about ISDS, held by lawmakers and regulators can play an important role in chilling stricter environmental standards. For these reasons, a new and narrower definition of the regulatory chill phenomenon has been proposed, one that only encompasses those instances in which lawmakers, governments and government agencies refrain from adopting the laws and regulations that they deem the most appropriate because they believe that doing so would lead to adverse consequences at the international trade and investment level, despite a lack of consistent and robust evidence supporting their concerns. The second part of this thesis focusses on what could be done in international economic law to promote environmentally friendly FDI, while preventing the few instances in which regulatory chill may take place due to ill-founded beliefs held by lawmakers and regulators. Following an analysis that highlights the paramount role played by public participation and responsive institutions to achieve an appropriate level of environmental protection, this study ends with a proposal that recommends the adoption of a clause within IIAs that makes pre-investment environmental screening mandatory and free from ISDS oversight.

This paper examines the hysteresis hypothesis in the Brazilian industrialized exports using a time series analysis. This hypothesis finds an empirical representation into the nonlinear adjustments of the exported quantity to relative price changes. Thus, the threshold cointegration analysis proposed by Balke and Fomby [Balke, N.S. and Fomby, T.B. Threshold Cointegration. International Economic Review, 1997; 38; 627-645.] was used for estimating models with asymmetric adjustment of the error correction term. Amongst sixteen industrial sectors selected, there was evidence of nonlinearities in the residuals of long-run relationships of supply or demand for exports in nine of them. These nonlinearities represent asymmetric and/or discontinuous responses of exports to different representative measures of real exchange rates, in addition to other components of long-run demand or supply equations. Textile and tourism sectors are two important industries in the Portuguese economy. However, its high exposure to both internal and international economic volatility make the companies operating in these economic sectors particularly vulnerable to economic crises, such as the ones which have been impacting Portugal and the European Union. The objective of this paper is to evaluate and understand the impact of size and age on the financial health of textile and tourism companies, measured by economic indices. An empirical based model is proposed. Its implications are derived and tested on a sample of 4061 Portuguese companies from textile and tourism sectors, during the period 2005-2009. The findings suggest that age has a major impact on the risk of failure, rather than size. Whereas the effect of age is generally positive regarding the financial health of the company, the effect of size is less clear and ultimately depends on the age of the company.
