Open Access zu öffentlich geförderten wissenschaftlichen Publikationen ist unter dem Vorzeichen der „Openness“ Teil einer zunehmend bedeutsamen globalen Entwicklung mit strukturellen Folgen für Wissenschaft, Forschung und Bildung. Dabei bedingen die jeweiligen fachkulturellen Ausgangslagen und ökonomischen Interessenskonstellationen sehr stark, in welcher Weise, mit welcher Reichweite und Akzeptanz sich das Open-Access-Paradigma konkret materialisiert. Die vorliegende Arbeit geht dieser Frage am Beispiel des inter- bzw. pluridisziplinären Feldes der Erziehungswissenschaft/Bildungsforschung nach. Zum einen werden die fachlichen und soziokulturellen Konstellationen des Publizierens im disziplinären Feld, die verlagswirtschaftlichen Marktkonstellationen sowie die informationsinfrastrukturellen Bedingungen des Fachgebietes analysiert und ein differenziertes Gesamtbild erstellt. Gestützt auf eine Online-Befragung der Fachcommunity Erziehungswissenschaft/Bildungsforschung werden weitergehende Erkenntnisse über vorhandene Open-Access-Erfahrungen im Fachgebiet und Hemmnisse bzw. Anforderungen an das neue Publikationsmodell aus der Sicht der Wissenschaftler/innen selbst – sowie explorativ aus Sicht der Studierenden und der Bildungspraxis - ermittelt. Wesentliche Faktoren bei der Betrachtung der Potenziale und Effekte von Open Access im Fachgebiet bilden die Faktoren akademischer Status und Funktion, Interdisziplinarität und fachliche Provenienz sowie das Verhältnis von Bildungspraxis und akademischem Sektor. This chapter discusses the consequences of open-access (OA) publishing and dissemination for libraries in higher education institutions (HEIs). Key questions (which are addressed in this chapter) include: 1. How might OA help information provision? 2. What changes to library services will arise from OA developments (particularly if OA becomes widespread)? 3. How do these changes fit in with wider changes affecting the future role of libraries? 4. How can libraries and librarians help to address key practical issues associated with the implementation of OA (particularly transition issues)? This chapter will look at OA from the perspective of HE libraries and will make four key points: 1. Open access has the potential to bring benefits to the research community in particular and society in general by improving information provision. 2. If there is widespread open access to research content, there will be less need for library-based activity at the institution level, and more need for information management activity at the supra-institutional or national level. 3. Institutional libraries will, however, continue to have an important role to play in areas such as managing purchased or licensed content, curating institutional digital assets, and providing support in the use of content for teaching and research. 4. Libraries are well-placed to work with stakeholders within their institutions and beyond to help resolve current challenges associated with the implementation of OA policies and practices.

El presente proyecto se propone investigar la legislación de derechos de autor en relación con la universidad pública, su historia en el contexto nacional y educativo. Indagamos en torno de la normativa vigente, los aspectos facilitadores u obstaculizadores en la educación y las excepciones a las leyes con material de uso educativo en universidades públicas y las modalidades de implementación en el acceso al conocimiento libre. Asimismo, nos interesa conocer la diferencia entre bienes materiales e inmateriales, el estatuto del conocimiento humano como bien inmaterial y los impactos en el tratamiento de los bienes culturales y el conocimiento como bienes económicos susceptibles de apropiación privada.

[From the Introduction]. Information gives knowledge and knowledge gives power. Though in all EC Member States, the task to protect the environment is given to the administration, it is obvious that the administration is not the owner of the environment. The environment is everybody's. It is for this reason that administrative decisions which affect the environment must be transparent, open and must strike a balance between the general interest to preserve, protect and improve the quality of the environment on the one hand, the satisfying of specific private or public interests on the other hand. In order to allow at least a certain control of whether the administration strikes the right balance between the need to protect the environment and other legitimate or less legitimate needs, it appears normal and self-evident that information on the environment which is in the hands of public authorities, be also made available to the public and to citizens.

At the Berlin7 conference in Paris on 3 December 2009 Knowledge Exchange provided a workshop on the practical challenges to be addressed in moving to Open Access. Presentations where provided by John Houghton and Alma Swan discussing the outcomes of studies on the costs and benefits of Open Access for institutions and the society as a whole. These were followed by presentations by two funding agencies on the results of financing publication costs both at an institutional and national level in Germany. Also the results of the Springer deal in the Netherlands where presented. The third section was focused on the results of implementing mandates both by funding bodies and institutions.

Saltwater recreational fishing (SRF) in Portugal was for a long time an open-access activity, without restrictions of any kind. Restrictions to control the recreational harvest were first implemented in 2006 and were highly criticized by the angler community, for being highly restrictive and lacking scientific support. The present study aimed to obtain socio-economic data on the recreational shore anglers and gauge their perceptions about recreational fishing regulations and the newly implemented restrictions in Portugal. Roving creel surveys were conducted along the south and south-west coasts of Portugal, during pre and post regulation periods (2006-2007). A total of 1298 valid face-to-face interviews were conducted. Logit models were fitted to identify which characteristics influence anglers' perceptions about recreational fishing regulations. The majority of the interviewed anglers was aware and agreed with the existence of recreational fishing regulations. However, most were against the recreational fishing regulations currently in place. The logit models estimates revealed that Portuguese anglers with a higher level of formal education and income are more likely to agree with the existence of recreational fishing regulations. In contrast, anglers who perceive that more limitations and a better enforcement of commercial fishing would improve fishing in the area are less likely to agree with the existence of SRF regulations. The findings from this study will contribute to inform decision-makers about anglers' potential behaviour towards the new and future regulations. Although the existence of fishing regulations is a good starting point for effective management, the lack of acceptance and detailed knowledge of the regulations in place by fishers may result in lack of compliance, and ultimately hinder the success of recreational fishing regulations in Portugal. According to the Bethesda Statement on Open Access Policy for libraries and the recommendations of the BOAI10, libraries and librarians have an important role to fulfil in the encouragement of open access. Taking into account the Competencies for Information Professionals of the 21st Century, elaborated by the Special Libraries Association, and the Librarians’ Competencies Profile for Scholarly Publishing and Open Access, we shall identify the competencies and new areas of knowledge and expertise that have been involved in the process of the development and upkeep of our institutional repository (Repositorio SSPA).

The presentation provides an overview of the copyright issues related to the implementation of Open Access policies. It focuses on the need to obtain permission to reproduce and disseminate a copy of any published paper taking into account any copyright transfer signed by authors. This permission is needed to implement Green Open Access policies through repositories. Moreover it explores the use of open content licenses in repositories and journals to move to the Gold Open Access model that offers not only free access to full text but full reuse of contributions.

This article discusses the relationship between digital humanities and disciplinary boundaries in the last decade, primarily in the context of the national project Synergies. It offers first an overview of Synergies as a concrete example of the way technological change impacts the very notion of disciplines by trying to create a platform that was interdisciplinary by nature, then discusses the creation of a new Digital Humanities centre in Québec—Le Centre de recherche interuniversitaire sur les humanités numériques – and the ways it was conceived as encompassing a range of disciplinary approach.
