While essential to human nature, health and life have been protected since ancient times by various areas of knowledge, particularly by the Law, given its dynamics within the regulation of social interactions. In Brazil, health has been granted major importance by the Federal Constitution of 1988, which, disrupting the dictatorial authoritarianism, inaugurating a Social State and focusing on the values of freedom and human dignity, raises health to the condition of a social right, marked predominantly by an obligational bias directed, primarily, to the State, through the enforcement of public policies. Although, given the limitation of the State action to the reserve for contingencies, it turns clear that an universalizing access to public health is impossible, seen that the high cost of medical provisions hinders the State to meet all the health needs of the rightholders. As a result of the inefficiency of the State, the effort of the Constituent Assembly of 1988 in creating a hybrid health system becomes nuclear, which, marked by the possibility of exploration of healthcare by the private initiative, assigns to the private enterprise a key role in supplementing the public health system, especially through the offer of health insurance plans. At this point, however, it becomes clear that health provisions rendered by the private agents are not unlimited, which involves discussions about services and procedures that should be excluded from the contractual coverage, for purposes of sectoral balance, situation which draws the indispensability of deliberations between Fundamental Rights on one hand, related to the protection of health and life, and contractual principles on the other hand, connected to the primacy of private autonomy. At this point, the importance of the regulation undertaken by the ANS, Brazilian National Health Agency, appears primordial, which, by means of its seized broad functions, considerable autonomy and technical discretion, has conditions to implement an effective control towards the harmonization of the regulatory triangle, the stability and development of the supplementary health system and, consequently, towards the universalization of the right to health, within constitutional contours. According to this, the present essay, resorting to a broad legislative, doctrinal and jurisprudential study, concludes that economic regulation over the private healthcare sector, when legitimately undertaken, provides progress and stability to the intervening segment and, besides, turns healthcare universalization feasible, in a way that it can not be replaced efficiently by any other State function.

This study aims to analyze citizen participation in state policy decisions, as an essential element of legitimacy in the branches of government, especially in the sphere of the Executive, in the context of deliberative democracy. But, this study still has the desideratum to understand the citizen's role in public life, especially in the sphere of the Executive Branch, in order to effect the Fundamental Right to Public Administration proba, efficient and honest. Thus, to achieve this mister, the proposal is to expose the pesamento the classic contractualist, Thomas Hobbes, John Locke and Rousseau about the legitimacy of governments, through the statutes, and the question of the general will and majority rule as well how to present the comments of Thomas Jefferson on popular sovereignty and dialogical citizen participation in matters of local interest. After, it will be studied the theories of Fundamental Rights in order to demonstrate the need for the Civil Service should be veiled in a more specific custody rights, given the deep crisis in the Public Administrative practice due, especially, corruption. On the other side, the fundamentality of management also covers the aspect of the development of cities, which decisively affects the development of man, which, to join a deliberative governance program needs to be politicized, adopting full participation, dialogue, as duty citizen. On the other hand, the fundamentality of management also covers the aspect of the development of cities, which decisively affects the development of man, who, to join a deliberative governance program, needs to be politicized, adopting full participation and dialogue as a citizen responsibility. Furthermore, taking as the major heart, it will be presented the doctrine of Jürgen Habermas whose Discourse Theory element is to be followed for the implementation of a broad deliberative and emancipatory democracy, with effective citizen participation. It will also be considered the Condorcet Constitution Project as a comparative link in the linking of the public deliberative will, and the Central Power, in the face of the Theory of “Sluice” Habermas. The proposal, based on communicative action, must allow a continuous flux and influx process of social interests towards the exercise of administrative power. The dialogical deal, brought to the center of the decisions, will allow discussions in the public scope, and may contribute to the legitimacy of government actions, inasmuch as it creates the feeling of politicization demanded by the man in a democratic state.

This master thesis aims to research the tension established between the judicial review and democratic theory which was always present in the constitutional doctrine of separation of powers. In this regard, the expansion of the Brazilian constitutional jurisdiction checked after the occurrence of the Federal Constitution of 1988 and the inertia of the Legislature in disciplinary relevant legal aspects of Brazilian society contributed to a hyperactivity of the Supreme Court. However, in a complex society of context, as is the Brazilian society, there are contained demands and political controversies that hardly would be well represented or resolved through the action of the Court of ministers at the expense of other government bodies. Among the supremacy of Parliament and the legitimacy deficit of these magistrates, is the constitutional text and the social fabric that makes this legal status of the political. Participatory democracy established by the guidelines of the Federal Constitution requires this perspective when the Supreme Court acting in place of concentrated constitutionality control. In a plural society, there is no reason to get rid of state decision moments popular participation. Lack the Supreme Court, this time, the democratizing perception that the institute brings to the interior of the Court, as state determination of space in which to come together and meet the aspirations of society and state claims. The dissertation investigates thus the possibility of amicus curiae Institute serve as a mediator of the democratic debate, to assist the Supreme Court in the preparation of the decision is, historically, that which is of greater legitimacy, from the perspective of a theory participatory democracy. Analyzes, likewise, the unfolding of abstract judicial review in the context of Brazilian law. Proposes, incidentally, a rereading of the separation of powers, with the call for the Judiciary be careful not to become the protagonist of national political decisions. It maintains, finally, that procedural opening the interpreters of the constitution, through the amicus curiae Institute, shows up as able to decrease the legitimacy deficit in the performance of the Brazilian Supreme Court.

Essa pesquisa tem como objeto a comunicação política com foco na propaganda eleitoral, no contexto da democracia midiática. Partindo deste princípio, delineia-se o problema de pesquisa: estudar como a propaganda eleitoral tem se apropriado do contexto da democracia midiática para expor suas mensagens, o uso entre a razão e a emoção, a venda de sonhos ao eleitor entre outros assuntos como as críticas ao adversário e as promessas que realizam. O objetivo da pesquisa é destacar os tipos de conteúdos elaborados para serem transmitidos aos eleitores que assistem ao horário eleitoral gratuito, analisar os argumentos, a qualidade e o teor de tais veiculações, assim como destacar as distinções entre eles, avaliando assim sua efetividade, suas principais características, o que os diferenciava e quais os recursos que usavam para atrair a atenção e o voto dos eleitores. A metodologia adotada foi a análise de conteúdo, uma vez que se deseja compreender quais são os principais sinais e características definidos pelos partidos e pelos candidatos no momento de serem divulgados. Foram definidas seis categorias para a análise de dez vídeos do horário eleitoral gratuito na televisão dos três principais candidatos, tanto do primeiro, quanto do segundo turno. Conclui-se que a candidata Dilma Rousseff foi a que mais aproveitou de todos os artifícios estratégicos da comunicação política, da propaganda eleitoral, apropriada da democracia midiática, com forte apelo emotivo nas categorias analisadas, resultando em uma vitória apertada, a mais disputada até hoje, porém, de resultado positivo para a campanha de reeleição da presidente

En el marco de la exclusión y desigualdad social surgen los educadores populares como nuevos actores sociales, reinterpretando y cuestionando la realidad. Según Carlos Falaci "siembran bombas de construcción masiva" para reverberar el tejido social resignificando espacios con el otro mediante la comunicación. El presente trabajo aborda la práctica social de la Universidad Transhumante -una iniciativa de educación popular basada en los fundamentos de la pedagogía crítica de Paulo Freire- y en particular el accionar del Grupo Malabares, de Rosario -Santa Fe, miembro de esta red. La unidad de análisis se acota a la experiencia de un taller de formación.En primera instancia, se exponen las herramientas ideológicas, metodológicas y políticas para la praxis pedagógica postuladas por P. Freire. Luego, se analizan las prácticas del Grupo Malabares basadas en estas herramientas. Finalmente, se indagan las posibilidades de la educación popular -a la luz de este Grupo que sintetiza teoría y práctica- de ser una propuesta superadora

El presente trabajo focaliza su interés en los aportes que la educación del cuerpo puede hacerle a las teorías críticas en educación. La Educación Física institucionalizada, como una disciplina curricular de la escuela, reproduce las condiciones materiales y simbólicas de explotación que se encuentran naturalizadas en el entramado social, como se evidencia en las prácticas corporales que predominan y constituyen su identidad. La escuela reproduce los valores de competitividad e individualismo inherente al sistema capitalista en el seno de cada relación social establecida en cada rincón de la institución escolar, siendo que las clases de Educación Física no exceden la puesta en escena de esta microfísica del poder. La escuela reproduce estas lógicas capitalistas y la Educación Física a través del juego y el deporte es funcional a estos sentimientos de competencia e individualismo.Nos proponemos analizar la educación física actual en términos emancipa torios, desnaturalizar las miradas tradicionales sobre el cuerpo, educación y escuela enmarcadas en la sociedad capitalista actual para pensar la educación del cuerpo desde un punto de vista crítico abordando las temáticas generales del deporte, juego y prácticas corporales olvidadas

La heterogeneidad de las estrategias para influir en el espacio público y sobre los actores legalmente autorizados a tomar decisiones vinculantes, puede representar un obstáculo para señalar la existencia de un fenómeno único llamado movimiento "piquetero". La hipótesis que guía a la presente ponencia es que la unidad está dada por el tipo de conflicto que plantean, a pesar de la competencia y fragmentación entre las diversas organizaciones. Para explicar cuál es el alcance y el tipo de conflicto se analizarán tres dimensiones, en primer lugar, la relación entre demandas discretas y el exceso metafórico de las mismas que dan paso a la construcción de un sentido compartido de "injusticia social". En segundo lugar, la elaboración de la identidad a partir de un posicionamiento antagónico con el "modelo neoliberal". Finalmente, el intento de institución de un público que se constituye en objeto de disputa y que se lo interpela a través de la categoría de "pueblo". La apelación a un sujeto que aún siendo inhallable (las diferencias sociales hacen impensable la unidad orgánica, subjetiva y objetiva) e indeseable (por las consecuencias totalitarias que puede tener que alguien se atribuya la soberanía popular), produce efectos sobre el espacio público, abriendo una brecha que se denominará "el espectro del pueblo". Estas tres dimensiones señalan la existencia de un movimiento social que, a través del tratamiento de la exclusión social como injusticia realizada al pueblo, dislocó ciertos sentidos sedimentados en el sistema político argentino y revivió la tensión constitutiva de la democracia entre la dimensión redentora y la dimensión pragmática. La metodología aplicada fue el análisis de discurso basado en entrevistas en profundidad administradas a militantes, adherentes y dirigentes de diferentes organizaciones piqueteras, documentos elaborados por las mismas, diarios y revistas
