Resumo:
Modern ‘nonscripted’ theatre (NST) clearly owes much to improvisation. Perhaps less obviously, and more surprisingly, so too does modern law. In this article I will contend that, despite all the rules of evidence and procedure, statutes and legal precedents that fundamentally govern the decisions and actions of a judge, it is only through ‘spontaneity’ that judgment can take place. This claim may appear strange to those well-versed in the common law tradition which proceeds on the basis of past legal decisions, or reason where no precedent exists. NST, on the other hand, is assumed to rely heavily on the unprecedented and unreasoned. Therefore, when the public watches a NST production, it places its faith in the belief that what is being observed is entirely new and is being produced ‘on the spur of the moment’.

This article offers a typology of so-called blocking legislation and analyses its development, functions and legality under international law. It also presents and discusses the new Russian blocking Order, issued in September 2012, focusing on its possible effects on the European Commission's investigation of Gazprom's business practices (in light of EU competition law) as well as, more broadly, on foreign operations of Russian strategic enterprises.

RESUMO - O decisor hospitalar tem como função decidir os recursos de uma organização de saúde, sejam estes financeiros, materiais ou humanos, sendo decisivo o conhecimento e informação que o apoiem na aplicabilidade nas tomadas de decisão e na solução dos problemas. As tomadas de decisão suportam-se em modelos reproduzidos pelos decisores, em processos, modelos, e em princípios, que podem ou não assumir intuição, objetividade, racionalidade e ética, bem como de técnicas várias que podem ser limitativas ou condicionadas, por força de fatores vários, como: a falta de informação inerente de uma multidisciplinaridade do processo; de condicionalismos organizacionais, internos ou externos, associados à envolvente e cultura organizacional e influências políticas e macroeconómicas; ao fator tempo; a tecnologia; a estrutura e desenho organizacional; a autoridade/poder e a autonomia para decidir; a liderança, e do estatuto jurídico que o hospital possui. Este último ponto será esmiuçado, mais profundamente, neste estudo. Iremos, através do estudo, compreender se os elementos componentes das decisões tomadas nos hospitais, são ou não adaptadas em consonância com diferentes políticas de governação hospitalar, em contextos e dinâmicas organizacionais diferenciadas, por diferentes Estatutos Jurídicos Hospitalares - EPE, SPA, PPP e Privados. Foi realizado um estudo de caráter exploratório, descritivo-correlacional e transversal, baseou-se num questionário aplicado a decisores hospitalares, incidindo nos dois vetores centrais do estudo, na tomada de decisão e no estatuto jurídico hospitalar. A decisão é então, um valiosíssimo veículo na persecução das estratégias e planos formulados pelo hospital, esperando-se destes produzir consequentes resultados eficientes, eficazes e efetivos na sua aplicação.

The main purpose of this report is to inform about the work developed throughout the curricular training period, which took place in the Legal Department of The Portuguese Football Federation. Firstly, and in general terms, issues such as the evolution of football in Portugal and Sports Federations will be dealt with in this study. In addition, a characterization of the welcoming entity will be done as well, focusing not only on its legal context, but also on its organic structure and operating dynamics. Also, the work developed during the training period will be made known, namely the activities undertaken as part of the project. Besides all the above-mentioned, a study has been carried out essentially on the Regional District Football Associations, in what concerns the statutes of the various associations ( object of study ), including the statutes of FPF- since the main goal of this work is to understand whether the various District and Regional Football Associations, as regular partners of the Portuguese Football Federation, do or do not comply with the Duty of Statutory Adjustment imposed by it, regarding the amendment to the Sports Federation legal regime.

RESUMO - Este artigo descreve a evolução do estatuto jurídico do hospital público português, com o intuito de o caracterizar, em especial do ponto de vista da sua autonomia. Considera-se que, pelo menos em parte, o estatuto jurídico do hospital público português é responsável pela limitada autonomia de que estas instituições gozaram nos últimos sessenta anos, com as consequentes ineficiências na produção e produtividade, fraca equidade no acesso e aumento de custos com a prestação de cuidados, de discutível qualidade. Nessa medida, várias reformas foram implementadas com o intuito de conferir ao hospital maior autonomia: ao nível da gestão, do financiamento e também reformas organizacionais. De um sistema regionalizado, estabelecido em 1946, até ao Serviço Nacional de Saúde e ao hospital dos nossos dias foram adoptados diversos modelos estatutários. A reforma de 2002 pretende estabelecer uma clara fronteira entre o hospital público, administrativo, burocratizado e aquele que assume natureza empresarial, numa clara viragem — demasiado precoce? — com as «experiências inovadoras » subsequentes à Lei de Bases da Saúde, que permitiram concluir que à maior autonomia correspondiam atitudes e resultados pró-activos e positivos. Por outro lado, ultima-se a preparação da construção de dez novos hospitais com recurso a parcerias público-privadas (PPP), sem ainda estarem definidos quais os estatutos, grau de autonomia e forma de gestão destas entidades. Ainda é cedo para avaliar esta última reforma; não deverá, no entanto, perder-se de vista que a implementação de um novo estatuto jurídico para os hospitais terá necessariamente de permitir a sua renovação sem descurar a sua secular missão de solidariedade.

This report will describe the activities undertaken during my internship at the Personnel Department (DPE-UPE4.1) in Caixa Geral de Depósitos (CGD), Lisbon, between September 22, 2014, and February 28, 2015. I consider that it is important to note from the outset i) that the subject of my training was suggested by my supervisor in the DPE and accepted by me; and ii) that the internship consisted essentially of carrying out research and information gathering into the different social systems that coexist within the bank and the application of each legal system in solving concrete situations of the CGD employees. The research and analysis of information was important not only for my study but for the CGD itself, as it enables the department to have such an important matter, full of specific characteristics, condensed into a single document, i.e. this report. This is a complex reality. The various welfare systems differ according to the contractual agreement linking the employee to the employer at the date when the labour contract is signed, and also the unique/singular characteristics of the CGD. In the early stage I started by trying to understand the financial institution and its organization and role and the department where I worked. So I analyzed the CGD Statutes and the legal measures that crystallized the scheme for its employees and I also researched its domestic and international operations. The first month was devoted to the research and analysis of such legislation to understand the creation of the CGD and its path to date. In the second and third months I studied the legal social systems that are applied to different groups of CGD workers. This period was quite important to identify and understand the differences between those regimes of CGD employees as well as the procedure inherent in each case. I highlighted the non-implementation of “the social protection regime of convergence” to the workers of this institution; the differences regarding the allocation of sickness subsidies paid to workers who belong to Social Security and CGA contributors, as well as the enforcement of internal rules to all the workers when a work-related accident happens.Then I focused on to assessing and examining external legislation and several internal regulations in order to obtain solutions to questions raised and situations involving by the workers, in order to understand how the DPE solves these situations. Over the last three months of internship, after this more theoretical work, I began the analysis of concrete situations involving employees carrying out their duties in Portugal and abroad. Some of these situations had been received by the department before the beginning of my internship and others over this period. When I was “working” in the DPE I analyzed “cases” that had been solved and some others without a final solution because they were still in courts. As for the last ones (new cases) I was able to follow their assessment and sometimes their outcome. Some of them became study cases for me. Over these five months of my internship, several cases were analyzed and discussed by legal experts of DPE in which I could participate. I always worked hard. I know that this action contributed to elucidate me about the treatment of the issues, and allowed me to have a direct contact with some workers and be part of a dynamic work team. For these reasons, my internship report is not merely descriptive of activities. It consists of an analysis of rules (legislation) and a regulatory framework of activities and it is also a description of several specific situations solved or in a solution process. Through this work I intend to make known the particular reality of a modern Portuguese financial institution not only because of its importance in our country but also such a large number of employees work here (in Portugal and abroad). I should add that throughout my internship I was allowed to attend conferences, within the scope of the bank in order to get a broader view of some issues related to the daily life of the DPE and the CGD. So, I participated in I Jornadas Bancárias and the Conferência Internacional do Contrato a Termo, given that the CGD is a bank and the DPE deals with legal and labour relations.

This report is the outcome of an internship that took place in Centro de Arbitragem Comercial da Câmara de Comércio e Indústria Portuguesa and its completion is an essential part of the path towards obtaining the Master’s Degree in Faculdade de Direito da Universidade Nova de Lisboa. This report has been structured in two stages – firstly, the presentation of the Centro de Arbitragem Comercial, focusing on its field of expertise, organic structure, principles and advantages. Then, the description of the activities developed within the Secretariat over the several stages of the arbitration procedure – since the reception of the arbitration requirement in institutional proceedings, terms of reference in ad hoc procedures, through the monitoring of the arbitral tribunal sessions (preliminary hearings, submission of evidence and final allegations) and the notification of the arbitration award. The second stage of this report is related to the description of the functions and powers of the President of Centro de Arbitragem Comercial. Firstly, it defines those powers by analyzing the statutes and rules of proceedings of the Centro de Arbitragem, drawing comparisons between the above mention and the rules of proceedings of others arbitral institutional centres, some of them are international references. The report assesses and describes the presidential powers, such as: configuration and composition of the arbitral tribunal (including arbitrator’s replacements, excuses and refusals); deadline extensions; determination of procedural rules and decision-making on any procedural incidents which arise before the constitution of the arbitral tribunal; definition of arbitration costs and fees; joinder of parties and consolidation of proceedings admission; and appointment of an emergency arbitrator. Lastly, this report analyzes some decisions delivered by the President in the respective institutional procedures which took place in the Centre.

This study applies a Marxist theoretical paradigm to examine the working conditions of greenhouse workers in the Niagara Region, and the range of factors that bear upon the formation of their class-consciousness. The Niagara greenhouse industry represents one of the most developed horticultural regions in Canada and plays a prominent role in the local economy. The industry generates substantial revenues and employs a significant number of people, yet the greenhouse workers are paid one of the lowest rates in the region. Being classified as agricultural workers, the greenhouse employees are exempted from many provisions of federal and provincial labour regulations. Under the current provincial statutes, agricultural workers in Ontario are denied the right to organize and bargain collectively. Except for a few technical and managerial positions, the greenhouse industry employs mostly low-skilled workers who are subjected to poor working conditions that stem from the employer's attempts to adapt to larger structural imperatives of the capitalist economy. While subjected to these poor working conditions, the greenhouse workers are also affected by objectively alienated social relations and by ruling class ideological domination and hegemony. These two sets of factors arise from the inherent conflict of interests between wage-labour and capital but also militate against the development of class-consciousness. Semi-structured interviews were conducted with 12 greenhouse workers to examine the role played by their material circumstances in the formulation of their social and political views as well as the extent to which they are aware of their class location and class interests. The hegemonic notions of 'common sense' acted as impediments to formation of classconsciousness. The greenhouse workers have virtually no opportunities to access alternative perspectives that would address the issues associated with exploitation in production and offer solutions leading to 'social justice'. Fonnidable challenges confront any organized political body seeking to improve the conditions of the working people.

Richard Leonard was a member of the 104th Regiment of the British Army. He fought during the War of 1812 at Sackett’s Harbour, Lundy’s Lane and Fort Erie. After the war he settled at Lundy’s Lane and was appointed lieutenant colonel of the 1st Lincoln Militia. He later became the Sheriff of Niagara. He died in 1833 and is buried in the Drummond Hill Cemetery.

Cette étude est consacrée au droit privé fédéral et à l'interaction entre la législation fédérale et le droit privé des provinces. Elle porte plus précisément sur le rôle des tribunaux dans le cadre de cette interaction. Elle a pour objectif de vérifier comment les juges procèdent à l'unification du droit privé fédéral en évitant de recourir formellement au droit provincial à titre supplétif. Dans un premier temps, elle établit le cadre juridique gouvernant l'interprétation du droit privé fédéral, de même que l'exercice du pouvoir judiciaire dans ce contexte. Dans un deuxième temps, elle analyse à travers un ensemble de jugements les procédés employés par les juges pour réaliser l'unification du droit privé fédéral. Elle conclut que ces procédés peuvent effectivement permettre de réaliser, au plan pratique, une telle unification. Cependant, ces interventions judiciaires sont ponctuelles et sont limitées à certains aspects de la conception ou de l'application des normes de droit privé. Dans les cas plus problématiques, elles peuvent avoir pour effet soit de nier le vide normatif rendant nécessaire le recours aux sources supplétives provinciales, soit de nier la pluralité formelle de ces sources dans le contexte fédéral.

Le thème de ce mémoire de Maîtrise en droit est « La dignité humaine: limite à la brevetabilité du corps humain». Dans ce travail, nous avons tenté d'apporter une contribution à un débat des plus importants de ce début du 21 e siècle. Deux parties composent ce mémoire. La première partie vise à présenter la thématique de la brevetabilité du corps humain. Elle fait l'analyse non seulement des normes juridiques interdisant la brevetabilité du corps humain, mais aussi elle se penche sur le corps humain comme source d'inventions brevetables. Dans la première sous-section, notre analyse porte sur l'étude des documents normatifs d'intérêt international, régional et national. Le modèle et les normes de la Communauté européenne ont largement retenu notre attention alors que le cas des États-Unis, du Canada et surtout de la France nous servait de guide de réflexion pour mieux comprendre l'état du droit au Canada. Par une argumentation serrée nous avons conclu cette partie en affirmant que le corps humain n'est pas brevetable. La prohibition de la brevetabilité du corps humain s'impose comme universelle. La dignité humaine a constitué un élément déterminant de cette prohibition. Ce qui nous a permis, dans la deuxième sous-section de considérer le brevetage de l'ADN. Après avoir présenté les trois critères juridiques de la brevetabilité, à savoir la nouveauté, l'utilité et l'inventivité, nous avons appliqué ces critères à l'ADN. Il s'est avéré que c'est à bon droit que la plupart des pays accordent le brevet sur l'ADN. Mais cet état de droit pose des problèmes sur le plan des valeurs éthiques. Il a notamment comme conséquence de relativiser la dignité humaine. Ces dernières considérations éthiques nous ont conduits à étendre à l'ADN les critères juridiques de la brevetabilité vus dans la première partie. Pour nous prononcer adéquatement sur ce sujet combien délicat, il a fallu considérer la question de la brevetabilité de l'ADN chez les vivants, depuis l'affaire Chakrabarty en 1980, aux États-Unis, en passant par la Directive européenne de 1998, l'affaire Harvard College au Canada jusqu'à Myriad Genetics Inc. En droit, la brevetabilité de l'ADN ne fait plus de doute. Mais elle continue de soulever des « gènes» sur le plan éthique. L'inquiétude que suscite la pente glissante nous a amenés, dans la deuxième partie, à nous pencher sur la brevetabilité dans son rapport avec la dignité humaine. La première sous-section se voulait une analyse permettant de montrer que la dignité humaine est une valeur absolue et inconditionnelle. Si nous considérons cette valeur comme absolue, il devient impossible de breveter le corps humain dans son ensemble. Par contre, en brevetant l'ADN humain, nos institutions se trouvent à relativiser la dignité humaine. C'est ce que la deuxième sous-section tendait à montrer. Soulignons que cette deuxième sous-section a été conçue également comme une conclusion. Elle s'articule autour notamment de la dignité humaine comme principe de précaution.

Ce mémoire porte sur les perceptions de l’université et des diplômes (universitaires) chez les lycéens guinéens du privé et du public en classe de terminale. L’atteinte de cet objectif exigeait une exploration de l’expérience scolaire et extrascolaire des élèves. La démarche privilégiée est qualitative et a consisté en des entrevues semi-dirigées auprès de 23 jeunes de deux lycées de la capitale, différents de par leur statut (privé/public) et l’origine sociale de leurs élèves. Les résultats de la recherche montrent que l’expérience scolaire et extrascolaire varie considérablement selon le type de lycée fréquenté. Si le parcours scolaire au privé s’est déroulé sans grands heurts, il est nettement plus chaotique parmi les élèves du public. Les premiers bénéficient d’un cadre d’apprentissage -tant au niveau infrastructurel que professoral- et d’un soutien familial clairement plus propices aux études que les seconds. Hors de l’école, si le temps est consacré aux loisirs pour les lycéens privés, il est marqué par une forte implication dans les activités économiques de survie pour les lycéens et lycéennes du public qui doivent tous se « battre » pour rester aux études. Les données révèlent en outre que la poursuite des études au-delà de la classe de terminale est perçue par les deux groupes de lycéens comme une suite logique de leur parcours scolaire. L’université attire et exerce une forme de « fascination » notamment pour le «bout de papier » qu’elle octroie. Le diplôme universitaire demeure perçu comme une marque distinctive et un symbole de prestige et, surtout dans des milieux populaires, comme un gage d’employabilité. Enfin, pour les jeunes filles du lycée privé, la poursuite des études est présentée comme un moyen d’acquérir une certaine indépendance même si, comme leurs homologues du public, la poursuite des études doit « coexister » avec le projet matrimonial.
