Social work in the United Kingdom remains embroiled in concerns about child protection error. The serious injury or death of vulnerable children continues to evince much consternation in the public and private spheres. Governmental responses to these concerns invariably draw on technocratic solutions involving more procedures, case management systems, information technology and bureaucratic regulation. Such solutions flow from an implicit use of instrumental rationality based on a ‘means-end’ logic. While bringing an important perspective to the problem of child protection error, instrumental rationality has been overused limiting discretion and other modes of rational inquiry. This paper argues that the social work profession should apply an enlarged form of rationality comprising not only the instrumental-rational mode but also the critical-rational, affective-rational and communicative-rational forms. It is suggested that this combined, conceptual arsenal of rational inquiry leads to a gestalt which has been termed the holistic-rational perspective. It is also argued that embracing a more rounded perspective such as this might offer greater opportunities for reducing child protection error.

The term sports law is fourfold in nature and encompasses: (a) traditional areas of law, such as contract, tort, criminal, administrative and EU law, as applied to disputes of a sporting origin; (b) the particular impact that a range of statutory provisions might have on sport; for example, legislation governing discriminatory and unsafe practices in a workplace or monopolistic or fraudulent behaviour in an industry; (c) issues of public and social policy otherwise influencing the legislature and the courts, from the allocation of resources to the allocation of risk; and (d) lex sportiva, where that term is taken to reflect the various internal administrative regulations and awards by dispute-resolving mechanisms in sport. As a matter of practice, sports law tends to be concerned with the application of contract and commercial law principles to professional sport - and namely the application of such branches of law to disputes relating to the following "three pillars" of modern, professional sport i.e., disputes relating to the payment, sponsorship or endorsement of those who play sport for a living; disputes arising from decisions made by sports governing bodies; and disputes arising from the application of law to the holding of sports events.

A diversidade, complexidade e imprevisibilidade que caracterizam a sociedade actual exigem da Escola uma articulação eficaz entre as aprendizagens e a realidade sociocultural dos alunos, de modo a promover a formação de cidadãos instruídos, competentes, críticos e aptos para aprender a aprender ao longo da vida. Neste sentido, é crucial contextualizar e gerir o currículo, adequando-o à multiplicidade e idiossincrasias dos alunos e seus contextos, assegurando-lhes aprendizagens funcionais e de qualidade. A implementação do processo de Reorganização Curricular do Ensino Básico, consubstanciado através da promulgação do Decreto-Lei n.º 6/2001, de 18 de Janeiro, ambiciona(va) melhorar a eficácia de resposta da escola ao seu mandato social, atribuindo a esta a centralidade na reconceptualização do currículo nacional em função dos contextos com que trabalha. Para tal, a auto-implicação, a negociação e a colaboração são pressupostos indispensáveis a um processo de gestão curricular centrado na escola e operacionalizado no contexto das suas diferentes estruturas. Nesta perspectiva, estruturas de gestão curricular intermédia como o conselho de turma e o departamento curricular, assumem particular ênfase na promoção e desenvolvimento de práticas de colaboração docente fulcrais a processos de gestão curricular. Assim, analisar e aprofundar conhecimento sobre condições facilitadoras, bem como factores de dificultação, do desenvolvimento de práticas de colaboração docente no contexto das referidas estruturas, identificadas na sequência da implementação da orientação de política curricular traduzida no referido decreto-lei constituiu o principal objectivo subjacente a este estudo. Procurou-se relacionar esta análise com dimensões de cultura profissional e organizacional, que a literatura e a investigação revistas documentam como factores relevantes na transformação de práticas curriculares. O presente estudo decorreu em dois momentos: o primeiro, no ano lectivo de 2006/2007, assumiu uma natureza predominantemente quantitativa, privilegiando-se como técnica de recolha de dados o inquérito por questionário aplicado 2718 professores que se encontravam a leccionar Ciências da Natureza, Ciências Naturais ou Ciências Físico-Químicas na rede de escolas públicas com 2º e 3º Ciclos da Direcção Regional de Educação do Norte (DREN) e do Centro de Área Educativa (CAE) de Aveiro, o qual foi complementado com a realização de uma entrevista semi-estruturada a seis professores de Ciências Físicas e Naturais; o segundo momento, realizado no ano lectivo de 2007/2008, adoptou uma metodologia de investigação, essencialmente, qualitativa – estudo de caso – desenvolvido numa escola básica com 2º e 3º ciclos com doze professores pertencentes a um conselho de turma e com oito professores de Ciências Físicas e Naturais afectos ao departamento curricular de Matemática e Ciências Experimentais. Este momento caracterizou-se pela: i) realização de dois percursos formativos, um com professores do conselho de turma e outro com os professores de Ciências Físicas e Naturais; ii) observação de reuniões de trabalho em contexto das estruturas supramencionadas; iii) planificação, implementação e avaliação de uma aula em regime de co-docência, abordando uma temática na perspectiva Ciência, Tecnologia e Sociedade e iv) realização de entrevistas a todos os professores participantes, aos Presidentes do Conselho Executivo e do Conselho Pedagógico e à Coordenadora do Departamento Curricular de Matemática e Ciências Experimentais. O sistema de análise de dados utilizado visou a compreensão das dinâmicas de trabalho docente desenvolvidas no processo de gestão curricular no contexto das estruturas de gestão intermédia em análise. Neste sentido, privilegiaram-se a análise estatística e de conteúdo como técnicas de tratamento dos dados. Os resultados deste estudo apontam para a prevalência de uma cultura docente fortemente individualizada, balcanizada e burocratizada, facto que restringe o desenvolvimento de práticas de gestão curricular e de dinâmicas de trabalho docente sustentadas e adequadas ao contexto e necessidades específicas dos alunos. Sugerem, igualmente, que o desenvolvimento de práticas de colaboração docente não é consequência directa da decisão espontânea e voluntarismo dos professores ou de uma imposição externa não assumida pelos mesmos, mas sim de uma convergência de factores de responsabilização, reconhecimento da utilidade e eficácia da colaboração, e incentivo organizacional que se revelaram pouco significativos no estudo em causa. Por outro lado, indiciam que uma efectiva colaboração docente implica transformações no plano das culturas, que não decorrem dos normativos, e é potenciada por processos de negociação, onde os diferentes actores educativos partilham responsabilidades e uma autonomia cimentada numa visão colectiva e integradora do projecto educativo e curricular da escola. No sentido de contribuir para a consolidação do conhecimento no domínio em estudo, consideramos necessária a realização de outras investigações centradas no mesmo objecto de estudo, mas desenvolvidas em outros contextos escolares.

RESUMO - 1. INTRODUÇÃO: Ao longo dos tempos, assistiu-se a um aumento da importância da Saúde Pública na Comunidade Europeia, mas só há relativamente pouco tempo teve o merecido lugar de destaque à luz da legislação comunitária. Neste contexto e com a adopção do Programa Europeu de Saúde Pública, surge a necessidade de actualizar o pensamento nesta área. Assim, é identificada uma oportunidade para formular uma estratégia, que seja passível de reduzir desigualdades e que também em compreenda as necessidades de saúde. Com o expandir da questão e com o propósito de reduzir as desigualdades, surge a Directiva 2011/24/UE, que visa regulamentar os direitos dos doentes em matéria de cuidados transfronteiriços. 2. OBJETIVO: Este trabalho apresenta como objetivo primordial analisar a Directiva 2011/24/UE, bem como a Lei n.º 52/2014, de 25 de Agosto, e identificar as principais barreiras, ao exercício do direito de acesso aos cuidados de saúde transfronteiriços, pelos beneficiários do SNS em Portugal, derivadas da aplicação de tais instrumentos legais. 3. METODOLOGIA: Foi utilizada uma abordagem analítica e documental, baseada na metodologia qualitativa. 4. CONCLUSÕES: As principais barreiras ao direito de acesso aos cuidados de saúde transfronteiriços, para os beneficiários do SNS em Portugal, são de ordem financeira, linguística e cultural, informacional, de mobilidade física, de proximidade geográfica, de carácter administrativo e de continuidade dos cuidados. A transposição da Directiva 2011/24/UE para o quadro jurídico português resulta essencialmente em iniquidades no âmbito do acesso aos cuidados de saúde transfronteiriços.

“One cannot analyse a legal concept outside the economic and socio-cultural context in which it was applied” – such is the longstanding thesis of António Manuel Hespanha. I argue that Hespanha’s line of argument relative to legal concepts is also applicable, mutatis mutandis, to legal agents: the magistrates, advocates, notaries, solicitors and clerks who lived and exercised their professions in a given time and place. The question, then, is how to understand the actions of these individuals in particular contexts – more specifically in late 18th century and 19th century Goa. The main goal of the present thesis was to comprehend how westernized and Catholic Goan elite of Brahman and Chardó origin who provided the majority of Goan legal agents used Portuguese law to their own advantage. It can be divided into five key points. The first one is the importance of the Constitutional liberalism regime (with all the juridical, judicial, administrative and political changes that it has brought, namely the parliamentary representation) and its relations with the perismo – a local political and ideological tendency nurtured by Goan native Catholic elite. It was explored in the chapter 2 of this thesis. The second key point is the repeated attempts made by Goan native Catholic elite to implement the jury system in local courts. It was studied in the chapter 3. Chapter 4 aims to understand the participation of the native Catholic elite in the codification process of the uses and traditions of the indigenous peoples in New Conquests territory. The fourth key point is the involvement of those elites not only in the conflict of civil and ecclesiastical jurisdictions but also in the succession of the Royal House of Sunda. It was analyzed in the chapter 5. The functions of an advocate could be delegated to someone who, though lacking a law degree, possessed sufficient knowledge to perform this role satisfactorily. Those who held a special licence to practice law were known as provisionários (from provisão, or licence, as opposed to the letrados, or lettered). In the Goa of the second half of the 18th century and the 19th century, such provisionários were abundant, the vast majority coming from the native Catholic elite. The characteristics of those provisionários, the role played by the Portuguese letrados in Goa and the difficult relations between both groups were studied in the chapter 6.

Os aquivos municipais preservam a documentação definida legalmente como de conservação permanente, a memória e a experiência da Administração Local e, como tal, são agentes imprescindíveis à preservação dos direitos municipais. A preocupação com a preservação da documentação deve constituir um dos pilares principais do arquivo desde o início da sua criação. E não somente quando a documentação é transferida para o Arquivo Histórico, deve estar presente durante todo o ciclo de vida da documentação. Com a criação do PARAM (Programa de Apoio à Rede de Arquivos Municipais), os arquivos municipais ganham um novo incremento, não só a nível técnico como a nível financeiro, sendo-lhe reconhecido o seu devido valor e importância, na sua dupla dimensão, administrativa e cultural. Uma das funções do arquivo é disponibilizar a documentação que têm à sua guarda e que se encontra armazenada nos depósitos. Para tal é fundamental criar condições a curto, a médio e a longo prazo, implementando toda uma política integrada de preservação, envolvendo os demais serviços da instituição, fazendo-se o controlo do estado de conservação da documentação, aplicando uma metodologia da manipulação de documentos para disponibilizá-los tanto aos clientes internos como externos. O Arquivo Intermédio da Câmara Municipal de Sintra não possui plano de preservação documental, nem ações de preservação extensíveis aos objetos digitais, daí que a presente tese de mestrado pretenda ser um proposta de um contributo de um plano de preservação, que tenha em consideração os demais aspetos desde a localização e construção ou manutenção do edifício onde se encontra o arquivo, questões de segurança, de controlo ambiental, de luz/fotodegradação, o controlo integrado de pragas, danos causados por água, os desastres naturais, a poluição, a limpeza e vigilância na zona de depósitos e armazenamento e manuseamento dos documentos.

The last several decades have been marked by tremendous changes in education - technological, pedagogical, administrative, and social. These changes have led to considerable increments in the budgets devoted to professional development for teachers ~ with the express purpose of helping them accommodate their practices to the new realities oftheir classrooms. However, research has suggested that, in spite of the emphasis placed on encouraging sustained change in teaching practices, little has been accomplished. This begs the question of what ought to be done to not only reverse this outcome, but contribute to transformational change. The literature suggests some possibilities including: a) considering teachers as learners and applying what, is known about cognition and learning; b) modifying the location and nature ofprofessional development so that it is authentic, based in the classroom and focusing on tasks meaningful to the teacher; c) attending to the infrastructure underlying professional development; and d) ensuring opportunities for reflective practice. This dissertation looks at the impact of each ofthese variables through an analysis ofthe learning journeys of a group ofteachers engaged in a program called GrassRoots in one midsized school board in Ontario. Action research was conducted by the researcher in his role as consultant facilitating teacher professional growth around the use of Web sites as culminating performance tasks by students. Research focused on the pedagogical approach to the learning of the teachers involved and the infrastructure underlying their learning. Using grounded theory, a model for professional development was developed that can be used in the future to inform practices and, hopefully, lead to sustained transformational school change.

Abstract This research takes the lens of social reproduction as a starting point for an examination of the effects of recent social welfare reforms on the lives o.fsingle mothers. As the cumulative effects o.f diminishing state provided benefits take hold, tensions are heightened as single mothers internalize the insecurity of earning an income in 11 capitalist labour market, while trying to carry out all that is involved in social reproduction with inadequate means of survival. Through interviewing single mothers who are the recipients of mUltiple state provided benefits (social assistance, student loans, subsidized housing and subsidized childcare), this thesis illuminates the cOl1linued regulation of women in an effort to assure that social reproduction is occurring at the lowest cost possible. State provided benefits are set lip in such a way that it is near impossible for single mothers to make ends meet without entering the labour force or entering into co-residential relationships. This push towards the labour force and/or marriage via punitive welfare policies illuminates the devaluation of the labour that is done at home. Through interviewing 5 single mothers, I will demonstrate the extensive labour that goes into maintaining their households. In addition .J case managers are interviewed. The employees of social assistance, subsidized hOllsing, subsidized childcare and student loans, have much agency in deeming who is worthy of receiving benefits. The employees of these agencies have the ability to make these women's lives easier or more complicated by how the workers interpret the policy regulations. Social policies are of paramount importance in the quest for women's equality and thus have consequences for how women's daily lives are organized. The rules and regulations that govern the individual policies are complex and bureaucratic and have implications for the ways in which women must organize their lives in order to survive. The shifts in social policy have been guided by neo-liberal assumptions with a focus on individual responsibility and a market-modeled welfare state. The caring work that is involved in raising children to be productive in a capitalist society is ignored or devalued in current policies. The emphasis in each polic.:v is on getting women who receive benefits into the paid work force, with little facilitation or investment into the caring work these women do on a daily basis that in turn supports capitalism. Policies, such as social assistance, subsidized housing, subsidized childcare and student loans, are set up in such a way that ignores the reality of women's day-to-day lives and devalues the necessary work done at home. It takes an abundance of labour and strategizing for women to seek out necessary means of survival, labour that is amplified when a woman is dealing with mUltiple slate provided benefits.

The site of present-day St. Catharines was settled by 3000 United Empire Loyalists at the end of the 18th century. From 1790, the settlement (then known as "The Twelve") grew as an agricultural community. St. Catharines was once referred to Shipman's Corners after Paul Shipman, owner of a tavern that was an important stagecoach transfer point. In 1815, leading businessman William Hamilton Merritt abandoned his wharf at Queenston and set up another at Shipman's Corners. He became involved in the construction and operation of several lumber and gristmills along Twelve Mile Creek. Shipman's Corners soon became the principal milling site of the eastern Niagara Peninsula. At about the same time, Merritt began to develop the salt springs that were discovered along the river which subsequently gave the village a reputation as a health resort. By this time St. Catharines was the official name of the village; the origin of the name remains obscure, but is thought to be named after Catharine Askin Robertson Hamilton, wife of the Hon. Robert Hamilton, a prominent businessman. Merritt devised a canal scheme from Lake Erie to Lake Ontario that would provide a more reliable water supply for the mills while at the same time function as a canal. He formed the Welland Canal Company, and construction took place from 1824 to 1829. The canal and the mills made St. Catharines the most important industrial centre in Niagara. By 1845, St. Catharines was incorporated as a town, with the town limits extending in 1854. Administrative and political functions were added to St. Catharines in 1862 when it became the county seat of Lincoln. In 1871, construction began on the third Welland Canal, which attracted additional population to the town. As a consequence of continual growth, the town limits were again extended. St. Catharines attained city status in 1876 with its larger population and area. Manufacturing became increasingly important in St. Catharines in the early 1900s with the abundance of hydro-electric power, and its location on important land and water routes. The large increase in population after the 1900s was mainly due to the continued industrialization and urbanization of the northern part of the city and the related expansion of business activity. The fourth Welland Canal was opened in 1932 as the third canal could no longer accommodate the larger ships. The post war years and the automobile brought great change to the urban form of St. Catharines. St. Catharines began to spread its boundaries in all directions with land being added five times during the 1950s. The Town of Merritton, Village of Port Dalhousie and Grantham Township were all incorporated as part of St. Catharines in 1961. In 1970 the Province of Ontario implemented a regional approach to deal with such issues as planning, pollution, transportation and services. As a result, Louth Township on the west side of the city was amalgamated, extending the city's boundary to Fifteen Mile Creek. With its current population of 131,989, St. Catharines has become the dominant centre of the Niagara region. The purpose of this study was to explore the strategies that elementary school teachers use to be engaged in their work. Participation was solicited from a random sample of schools stratified by location (i.e., urban, inner city, and rural) of a large school board. The study used an anonymous quantitative/qualitative questionnaire. The survey tool was based upon Kahn's (1990) psychological engagement framework, which presents the foundation of availability of self, meaningfulness of work, and safety while at work. Forty-one surveys were analyzed descriptively including a subgroup of self-rated highly engaged teachers. Teachers tended to favour physical and emotional strategies compared to cognitive type strategies, with the exception of the highly engaged subgroup. The theme of preferred strategies reflected a setting outside the school/workplace, that is, a preference for horne based strategies. The study's main contribution highlights the teachers' sense of importance for physical and emotional health in a profession that is heavily focused in the cognitive domain. This may influence administrative and teacher discourse regarding workplace engagement with strategies to help reduce stress and to maintain and increase teacher engagement.

Depuis la dernière décennie, les outils technologiques et informatiques ont connu un essor considérable dans plusieurs sphères d’activité de la société. L’éducation n’y a pas échappé, et le ministère de l’Éducation, du Loisir et du Sport (MELS) en a d’ailleurs fait une compétence transversale dans le cadre du Programme de formation de l’école québécoise. L’intégration des TIC s’est faite à travers différents moyens, à commencer par les laboratoires informatiques, les ordinateurs à même la salle de classe et, plus récemment, par l’introduction de projets portables où chaque élève et l’enseignant disposent de leur propre ordinateur. Afin d’être mené à terme, ce projet de recherche a été inscrit dans un projet à plus grande échelle, soit celui d’une recherche financée par le Conseil de recherches en sciences humaines du Canada (CRSH), qui a pour objectif d'analyser les obstacles auxquels font face les enseignants dans l'intégration des technologies à l'école. Le présent projet s'est quant à lui attardé plus spécifiquement aux défis technologiques et pédagogiques inhérents aux projets portables. L’étude s'est déroulée en milieu défavorisé, dans une école primaire montréalaise. Une telle intégration demande une planification rigoureuse et un suivi continu afin d’assurer le succès du projet. De plus, il est évident que ce type de projet pose aussi des défis technologiques et pédagogiques particuliers pour les enseignants. À ce sujet, trois catégories de facteurs qui peuvent avoir un impact sur la réussite des projets portables ont été relevées, soit : les facteurs personnels (internes à l’enseignant), les facteurs relatifs au travail (contexte d'enseignement, pratiques pédagogiques, etc.), ainsi que les facteurs relatifs au matériel et à l’infrastructure. À l’intérieur de ce mémoire, différents concepts, dimensions et indicateurs sont donc explicités et mis en relation afin de mieux comprendre les défis technologiques et pédagogiques qui peuvent survenir dans le cadre de la mise en oeuvre de projets portables. Trois enseignantes rattachées à autant de groupes d’élèves ont accepté de participer à une entrevue individuelle et de répondre à un questionnaire. Les échanges par courriel ont aussi été analysés. L'ensemble des données recueillies ont fait l'objet d'analyses qualitatives. Les analyses ont montré que la catégorie de facteurs citée la plus fréquemment était celle des facteurs relatifs au travail avec une forte majorité. Des défis ont toutefois été identifiés pour toutes les dimensions.
