Incentivados pelos debates de reforma de gestão, foi criado o Conselho Nacional de Justiça (CNJ) incumbido, dentre outras funções, de realizar a modernização do Poder Judiciário Brasileiro. Dentre diversos projetos foram realizados projetos referentes a modernização administrativa do judiciário, destacando-se os Indicadores e Justiça em Números, o Planejamento Estratégico, as metas de nivelamento e a modernização do Processo Judicial Eletrônico. O magistrado é o principal gestor do Poder Judiciário e cabem a ele as definições político-institucionais de seu tribunal. A reforma realizada pelo CNJ impactou diretamente no Tribunal. O estudo de caso analisa as implicação para a reforma de gestão do Poder Judiciário do Rio de Janeiro, a partir da interpretação do magistrado sobre a reforma de gestão implementada pelo CNJ no PJERJ.

The domination of the violence for the Rule of law awakened a tension between the practice of the punitive power and the right to counsel. However, throughout the recent history of the Criminal law, this shock of forces has been determined for the punitive power. In this perspective, the present work intends to submit the guarantee of defense to a critical judgment, in search to conciliate its content to the Constitutional State of Right. For in such a way, it will be necessary to recognize the disequilibrium of the situation, but without considering the superiority of any of these elements. The State in such a way must fulfill the function to punish the culprits as to acquit the innocents. Despite the law is far from obtaining a harmonious speech, it is necessary that the defense guarantee coexists the punitive power as part of an only public interest, which is, to make criminal justice. In such a way, the existence of a sustainable balance between the punitive power and the guarantee of defense depend on the minimum interference of Criminal law and, also, of the judicial position in the concrete case. The present work faces, therefore, the moment of crisis of the Criminal law, consolidated with the advent of a new way of thinking according to the procedural guarantees, that will demand the overcoming of the old concepts. The Constitutional State of Right not only constitutes an efectiveness of the regime of the right to counsel, but in a similar way it searchs to accomplish the right of action and criminal justice as a whole. Knowing that the philosophy of the language raises doubts on the certainty, the truth and the judgement, it is imposed to understand that the defense guarantee is no more about a simple idea, but, in the crooked ways of the communication, we intend to find what the judge s function is when he faces this new reality

The judicial intervention in limited liability company goes through several issues of legislative and hermeneutics origin, based considerably on the small importance given to freedom of economic initiative by the participants in the process of formation and application of the law. In addition, Brazilian law, due to incompleteness, inconsistency or lack of valid grounds, put the judge in a procedural delicate situation. Being forced to judge, the judiciary faces severe uncomfortable interpretive situations, of which derive solutions of dubious constitutionality and affecting, significantly, the dynamics of business activity. In this context, and considering the limited liability company as an expression of free enterprise, corresponding to a lawful association of people in order to undertake economically, in exercise of his freedom of contracting and professional action, intended to be offered safe parameters of constitutionality for judicial intervention in limited liability company in the hypothesis of (i) transfer of corporate shares, (ii) attachment of corporate shares, (iii) dismissal of directors, (iv) appointment of judicial stakeholders, (v) exclusion of shareholders and (vi ) trespass. The hypothetical-deductive approach was adopted, building hypotheses to overcome the gaps and unconstitutionality of the law and subjecting them to tests, reviews, and comparisons with hypothetical facts and case law in order to determine the constitutional validity of the proposed solutions. The procedure aimed to reconcile the historical, comparative, dialectical and scientific methods. The roots of temporal institutes were researched as well as current solutions provided by national and compared law. From problematizations point, addressed by the constitutional interpretation of the law and jurisprudence, responses that bring out the unconstitutionality of certain conceptions were headed

The conceptions of the judicial function, the process and the factors of legitimacy of the norm of decision are changed according to the model of State (liberal, social democratic and constitutional). The right of access to justice, likewise, follows the ideals present in constitutional movements experienced in different historical moments. The deficit of legitimacy of the judiciary is recurring subject of study in the doctrine, especially in the face of democratic standards that permeate the current paradigm of state. Under the process law, the essential element for the distinction of the states based on the rule of law (formal and material) and the democratic constitutional state lies in the democratic guarantee of participation to the litigants in the process of elaborating the norm of decision. The concern about the participatory democracy and the concretion of fundamental rights has as presupposition the conception of popular sovereignty. Keeping this effort in mind, the civil procedure cannot be oblivious to such considerations, especially when it justifies its constitutional conformation from the institutionalization of discourse within the procedural field (democratic principle) and of the democratization of access to justice, leading to the necessary contestation of the theory of instrumentality of the process. The democratic prospects of civil procedure and the concern about the legitimacy of the rule of decision cannot be moved away from the analysis of the judicial function and the elements that influence the legal suit s progress. The computerization of the judicial process entails extensive modification in the way the judicial function is developed, in view of automation of activities held, of the eliminating of bureaucratic tasks, manual and repetitive, and of streamlining the procedure. The objective of this study is to analyze the dogmatic changes and resulting practices from the implementation of the Judicial Electronic Process (JEP), prepared by the National Council of Justice, under the parameters of procedural discourse and democratic access to justice. Two hypotheses are raised, which, based on a bibliographic-documentary, applied and exploratory research, are contested dialectically. The expansion of publicity of procedural acts and the facilitating of communication and practice of such acts are elements that contribute to the effective participation of the recipients of the norm of decision in its making process and, therefore, the democratic principle in the procedural field. Ensuring access (to the parts) to the case files and reasonable duration of the process along with the preservation of its founding principles (contradictory, legal defense and isonomy) are essential to ensure democratic access to justice within the virtual system

During the ninth century, owing to the process of industrialization, new social conflicts were showed, forcing the Government not to remain inert. The necessity of answer to these new demands requires from the State some actions that assure the new economic, cultural and social rights, able to exceed the formal equality, according to the principles of redistributive equality and well-being. Among the social rights, the right to health is showed up, which is placed at the Universal Declaration of Human Rights and the International Treaty for the Economic, Social and Cultural Rights, as a necessary term to promote the dignity and the free development of the human personality. Under the Constitutional Law, it is clear that the implementation of the right to health, placed at the 6th article of the Brazilian Constitution, demands a government activity, which usually requires a provision of material goods, depending on budgetary resources. The Legislative and Executive Branches have a very important role in compliance with the constitutional regulations about the satisfactory offer of health care services, besides the correct use of the resources at this area. The adoption of public policies is the way of Government action to the planning and realization of this right. Though, some public policies are usually made apart from the social compromises, to the detriment of the basic social rights. The government has a discretionary competence to manage the health services. That is the reason it is necessary the control of the political choices, through the popular control, the extrajudicial control by the Account Courts, or the judicial review. Owed to the constitutionalization of social rights, the constitutional justice has a very relevant role, concerning to the constitutional jurisdiction, in a way the Judiciary Branch assume your position as a player that transforms the society. On the control of the public health policies, there is a cast of official instruments, judicial or not, to the guarantee of the collective right to the public health services, and to allow the citizens to reach the real implementation of the right to health

The present study aimed to evaluate the inclusion of the principles of the National Medicines Policy - PNM and the Pharmaceutical assistance - PNAF in the prosecution of lawsuits involving medicines. To fulfill this necessity , data collection was performed on the website by the Tribunal Rio Grande do Norte - TJ RN ( Rio Grande do Norte Court) , in 2012 . It was obtained 115 judgments, which were analyzed in order to generate Monitoring Indicators from lawsuits and conduct content analysis proposed by Bardin (2006). The results showed that : a) 100 % of the decisions were favorable to the author , b) 76 % of decisions were requests by the trade name of the drug , c) only one drug (eculizumabe) had not granted by ANVISA , d) 36 % of drugs were present in the list of standard medicines in SUS , 16 % of primary care block and 20 % of specialized component , e) 76 % of the decisions presented the request of at least 01 non-standard medicine. With regard to decentralization of PNM and PNAF we observed a commitment to this principle at judicial decisions, to see that municipalities and states are often forced to buy medicines of responsibility from another federal entity or other tertiary units as CACONs and UNACONS. The content analysis revealed that the argument from the judges used when you utter their decisions was that the right to health is recognized by Brazilian law as a fundamental right and should be guaranteed by the State for all its citizens. So, health is more than budgetary constraints of federal entities, which are severally liable for lawsuits , regardless the medication requested belongs or not to a particular block of a pharmaceutical assistance funding. Given these data, it is observed that there are gaps in the judgment when it comes to the insertion of the words and principles of PNM and PNAF, creating then the need for greater dialogue between the executive and judicial, so that they may consider relevant the effectiveness and application of such principles to minimize the negative consequences of the phenomenon of health judicialisation. A pesquisa tem como finalidade a análise do Poder Judiciário em um contexto de ampliação de sua dimensão política, o que traz como conseqüência um tipo inédito e peculiar de espaço público de participação democrática. Essa alteração no quadro político institucional possibilitou uma maior inserção do Poder Judiciário em questões essencialmente políticas, o que se convencionou denominar de judicialização da política - expressa na ampliação da importância e da participação do Poder Judiciário na vida social, política e econômica. Tal fenômeno, característico de democracias consolidadas, decorreu de condicionantes e peculiaridades vivenciadas na ordem política, econômica e social e gerou efeitos visíveis na democracia brasileira. As conseqüências desse processo de judicialização da política sobre o espaço democrático variam de acordo com o enfoque analítico estabelecido como referencial teórico: o substancialista, defensor de um Judiciário mais participativo; e o procedimentalista, eixo que enfatiza os processos majoritários de formação da vontade política em detrimento das vias judiciais. A presente pesquisa situa-se no marco conceitual procedimentalista que defende a primazia do procedimento que torne possível o diálogo democrático, ressaltando, assim, a dificuldade contra-majoritária da judicialização da política, os perigos da crescente tendência de valorização do ativismo político exercido pelo Poder Judiciário e a conseqüente necessidade de se estabelecer limites institucionais à atuação dos tribunais em demandas políticas.

A falta, de concretização de alguns direitos fundamentais, como os sociais de saúde e educação, que demandam certos custos para o Estado, ainda representa um desafio ao constitucionalismo brasileiro. Em decorrência, os tribunais vêm se deparando com demandas relacionadas a materialização dos referidos direitos, tais como pedidos de fornecimento de medicamentos não fornecidos pela rede pública de saúde ou a garantia de matrícula de estudante no sistema público de educação. Tratam-se assim de pedidos de ordens judiciais para que a administração pública cumpra seu dever constitucional, através de prestações positivas. Tal fenômeno, incluído por boa parte da doutrina dentro do que se convencionou chamar de "judicialização da política" não está isento à criticas. Em seu desfavor, argumenta-se que (1) o Judiciário está agredindo o princípio da separação de poderes, haja vista que a função administrativa, com sua discricionariedade, deve ser preservada com o Executivo não devendo na mesma se imiscuírem os magistrados, sendo-lhes defeso interferir em políticas publicas; (II) não há legitimidade democrática dos juízes, pois os mesmos não foram eleitos pelo povo; (III) o Judiciário não está preparado e tecnicamente capacitado para tal tipo de demanda; (IV) por envolver prestações positivas e assim necessidade de recursos públicos para a sua concretização, uma, determinação judicial nesse sentido contrariaria o princípio da legalidade e anterioridade orçamentária e encontraria sérios óbices em sua concretização pela reserva do possível. O presente estudo se propõe não só a analisar os referidos argumentos, como também examinar as fronteiras do sistema jurídico e do político, para concluir pela legitimidade ou não de tal conduta judicial, bem como a análise da natureza, do alegado caráter programático e da difícil delimitação dos direitos sociais e sua proteção judicial, ou seja, se procura, em síntese, examinar o papel do judiciário brasileiro no problema da efetivação dos direitos sociais, como garantidor do mínimo existencial.

Este estudo trata da realidade da prisão provisória dentro do contexto processual brasileiro e da consagração do direito fundamental à razoável duração do processo. A morosidade judicial faz parte do cotidiano de quem lida com o poder judiciário no Brasil. Uma questão, porém, sobressai-se no momento atual: o que fazer com os milhares de presos que dependem de uma resposta jurisdicional, os chamados presos provisórios “permanentes”? E o que fazer quando as prisões provisórias estão sendo aplicadas de uma forma completamente arbitrária, sem respeitar nenhum critério a não ser o de um termo vago e impreciso denominado “ordem pública”? Processos arrastam-se por anos, às vezes décadas, enquanto isso sujeitos ficam esquecidos dentro de estabelecimentos prisionais, tendo violados direitos constitucionais como a presunção de inocência, o devido processo legal, a razoável duração do processo e a liberdade de ir e vir. Foi feita uma análise do estigma que esses presos carregam, mais especificamente as presas, bem como dos prejuízos que advêm desse tipo de prisão. Atualmente, condena-se, antes mesmo de julgar, segregando de todas as formas essas mulheres do convívio familiar e social.
