The work presented here is about aspects of the constitutional extension in which is the public civil action with the objective of verifying its aptitute in tutelaging subjective situations derived from fundamental rights, especially right to health assistance. Thus, it offers a clear analysis of the practical functioning of most aspects of the public civil action (lawsuit), with philosophical foundation and necessary doctrinaire to your comphehension. How it once was (history), how it could be (reform suggestion), how it is (current interpretation of the law) and how it should be (critic analysis of the microsystem of collective tutelaging of rights, its perspectives, as well as the efficacy of the public cilvil action about accomplishment of the right to health as supraindividual right). The objective is to analyse the main version of the theme (for instance: the impacts caused to the dissociation of the Procurations theory), so that it can be extracted the philosophy and the general theory, of the public civil action and collective tutelaging in general, pragmatically applicable to study purposes. With this theorical fountain, the reader will be in a more solid position, not only being able to understand the subtilities of the public civil action, but mainly being able to recognize its faults and present solid reform proposals and improvement. It is know that the Juridical Power (Procuration) does not allow any more inactivity about negating accession to health in its collective dimension (lato sensu: spread, collective stricto sensu and homogeneous individuals), being imputed to it novel usage that consolidates in the assumption of the role instrument set aside to be used by all with organized instancy of solution to collective conflicts in large sense. Verifica-se, na atualidade, grande multiplicação dos conflitos envolvendo a Previdência Social e seus segurados. Embora sejam vários os motivos que levam ao ajuizamento de ações previdenciárias, identifica-se em grande parte dos casos uma linha condutora que unifica os diversos litigantes (segurados e dependentes) em torno de uma questão comum. Olhando-se de longe, o que se vê é uma série de ações individuais, cada uma com suas peculiaridades, que buscam as mesmas reparações e ajustes. Há, nesses casos, o ajuizamento em massa de ações com conteúdo semelhante, o que irá gerar sentenças, recursos e execuções múltiplos e, em vários casos, apresentando soluções divergentes. Desse modo, ainda que se tratem de direitos que podem ser tutelados individualmente, há que se buscar a tutela por um prisma coletivo, de modo a se trazer efetividade e segurança na área previdenciária. E uma dessas formas consiste no uso da ação civil pública em questões previdenciárias. Mecanismo relativamente recente em nosso ordenamento, introduzido em 1985, a ação civil pública encontra-se hoje plenamente integrada àquilo que se chama de microssistema de tutela coletiva, admitindo tanto a defesa de direitos difusos, quanto de coletivos stricto sensu e mesmo de direitos individuais homogêneos. O esforço que merece atenção, portanto, consiste na caracterização do Direito Previdenciário numa dessas três categorias de direitos coletivos lato sensu, vez que a tutela no plano coletivo molda-se de acordo com o tipo de direito que se está a tutelar. Ademais, é necessário também que se afaste a interpretação restritiva já superada pela jurisprudência mais atual que exclui os Direitos Previdenciários da esfera de objetos da ação civil pública.

Reliable, comparable information about the main causes of disease and injury in populations, and how these are changing, is a critical input for debates about priorities in the health sector. Traditional sources of information about the descriptive epidemiology of diseases, injuries and risk factors are generally incomplete, fragmented and of uncertain reliability and comparability. Lack of a standardized measurement framework to permit comparisons across diseases and injuries, as well as risk factors, and failure to systematically evaluate data quality have impeded comparative analyses of the true public health importance of various conditions and risk factors. As a consequence the impact of major conditions and hazards on population health has been poorly appreciated, often leading to a lack of public health investment. Global disease and risk factor quantification improved dramatically in the early 1990s with the completion of the first Global Burden of Disease Study. For the first time, the comparative importance of over 100 diseases and injuries, and ten major risk factors, for global and regional health status could be assessed using a common metric (Disability-Adjusted Life Years) which simultaneously accounted for both premature mortality and the prevalence, duration and severity of the non-fatal consequences of disease and injury. As a consequence, mental health conditions and injuries, for which non-fatal outcomes are of particular significance, were identified as being among the leading causes of disease/injury burden worldwide, with clear implications for policy, particularly prevention. A major achievement of the Study was the complete global descriptive epidemiology, including incidence, prevalence and mortality, by age, sex and Region, of over 100 diseases and injuries. National applications, further methodological research and an increase in data availability have led to improved national, regional and global estimates for 2000, but substantial uncertainty around the disease burden caused by major conditions, including, HIV, remains. The rapid implementation of cost-effective data collection systems in developing countries is a key priority if global public policy to promote health is to be more effectively informed.

O Brasil possui uma rigorosa legislação no que consiste ao controle das relações de consumo. No entanto, ainda não parece possível perceber que a vulnerabilidade natural do consumidor, em relação ao fornecedor, conseguiu ser efetivamente minimizada. No entanto, alguns instrumentos, como a Ação Civil Pública, o Inquérito Civil e o Compromisso de Ajustamente de Conduta, da forma como foram constituídos, teoricamente, podem contribuir significativamente para o alcance de uma maior eficácia jurídica da legislação consumerista e, consequentemente, para a efetividade social dos direitos dos consumidores, ainda que, na prática, alguns desafios precisem ser enfrentados.

O presente trabalho tem como objetivo apresentar o fenômeno da Guerra Fiscal relativa ao ICMS em razão da concessão de benefícios fiscais sem amparo em Convênio. Ao longo dos últimos anos, os Estados têm concedido cada vez mais tais benefícios, o que levou a um grande número de ações judiciais no Supremo Tribunal Federal questionando sua constitucionalidade. Para pacificar o entendimento no sentido de que tais benefícios quando não aprovados pela unanimidade dos membros no CONFAZ seriam inconstitucionais, o STF editou a Proposta de Súmula Vinculante nº 69. São apresentados os efeitos que esta Súmula Vinculante causará caso venha a ser aprovada e se seria possível a modulação de seus efeitos como forma de garantir uma maior segurança jurídica. Em seguida, é feita uma abordagem acerca da Lei nº 3.394/2000 e do Decreto 26.273/2000 do Estado do Rio de Janeiro, normas que concederam remissão de juros e multa os débitos referentes aos benefícios acumulados pelas empresas durante a vigência da Lei nº 2.273/1994, que foi posteriormente declarada inconstitucional pelo STF. O presente trabalho trata também da legitimidade do Ministério Público para ajuizar ações civis públicas em face de TAREs concessivos de benefícios fiscais. Por fim, apresenta-se o Convênio ICMS 70/2014 na sua tentativa de minimizar os impactos da declaração de inconstitucionalidade dos benefícios sobre os contribuintes e os obstáculos que existem para o alcance deste objetivo.

The journalists, as occupants of a enlarged spectrum concerning of right of the inform, have responsibility for the information they disseminate, devoir that puts on the basis of the constitutional right to be informed. This duty is divided with journalistic companies, when them realized. In the research, examined the existence of constitutional guarantees the right to be informed. To answer the question, realized research to support bibliographical and documentary. The guaranty is a empirical preoccupation coated with legality, since lends itself effect concretize a right. Traced so a panel of guarantees of institutional imprint, substantive and procedural. The concern with issues related to consumer protection has emerged in North America and then spread throughout the world. In Brazil, consumer‟s rights and interests only gained greater importance after their consolidation in the Constitution of 1988 and the enactment of the 8078/90 Law (Consumer‟s Protection and Defense Code), which established the consumerist microsystem. The understanding of the legal relationship of consumption concept is necessarily connected to knowledge of the elements that compose it. Among these, we can find the consumer and the provider (subjective elements), the product or service (objective elements), and the consumer‟s condition as final receiver of the consumption object (finalistic element). In order to elucidate the configuration of consumer protection before advertising communication, this work will analyze the advertising through the prism of consumerist laws, conceptualizing it and presenting a differentiation of it in relation to practices such as marketing, offer and commercial communication as well as examining its several kinds of manifestation, focusing mainly the ones categorized as misleading or unfair advertising. All kinds of advertising communication against the consumerist microsystem are subject to judicial control exercised by the State. Besides individual protection possibilities, this state-owned control can be collectively exercised as a result of the utilization of public civil action and popular action. Some specific categories of advertising (smoking products, alcoholic beverages, pesticides, medicines and therapies) are still subject to a set of particular restraints provided by the 9294/96 Law, which enables the performance of a special control in relation to them. In addition to state control, there is also a system of advertising communication self-regulation, which develops itself through the actions of the National Council of Advertising Self-Regulation that are based mainly on the laws established by the Brazilian Code of Advertising Self-Regulation and its annexes. However, this system of advertising self-regulation still has some deficiencies that hinder its effectiveness

Este trabalho se propõe a desvendar os contornos principiológicos e instrumentais daquilo que doravante iremos chamar Justo Processo Coletivo Laboral, ramo especialíssimo do processo dedicado à resolução de lides trabalhistas metaindividuais. O foco de nossas atenções é a tutela que é prestada em favor e não contra a coletividade. A falta de disposições específicas na CLT a respeito da tutela de direitos difusos, coletivos e individuais homogêneos próprios à realidade do trabalho torna imperiosa a inserção do Processo Trabalhista no circuito normativo de tutela coletiva, no chamado microssistema coletivo de tutela, composto, dentre outros diplomas, pelo Código de Defesa do Consumidor e pela Lei da Ação Civil Pública. A acomodação do Processo do Trabalho no ambiente coletivista será feita à luz da constelação de princípios constitucionais do processo e sob influxo do paradigma processual instrumental. A partir da identificação das principais barreiras que repelem o trabalhador do Poder Judiciário, procura-se demonstrar de que modo podem as ações coletivas contribuir para sua superação e assim para alavancar e universalizar o acesso à justiça, meta síntese para a qual convergem todos os esforços da processualística contemporânea. Apresentadas suas nuanças principiológicas, parte-se para a análise de seus principais institutos e do modo como deverá ser operacionalizado no dia-a-dia, isto é, de como irá funcionar. A crise de efetividade do processo de bases individualistas, especialmente para o trabalhador hipossuficiente, acentua a importância do devido processo legal coletivo do trabalho, instrumentalmente vocacionado a tornar justo o embate Capital X Trabalho e a conduzir grupos de trabalhadores de uma só vez à justa ordem jurídico-social.

PURPOSE OF REVIEW: The assumption that fructose may be toxic and involved in the pathogenesis of noncommunicable diseases such as obesity, diabetes mellitus, dyslipidemia, and even cancer has resulted in the call for public health action, such as introducing taxes on sweetened beverages. This review evaluates the scientific basis for such action. RECENT FINDINGS: Although some studies hint towards some potential adverse effects of excessive fructose consumption especially when combined with excess energy intake, the results from clinical trials do not support a significant detrimental effect of fructose on metabolic health when consumed as part of a weight-maintaining diet in amounts consistent with the average-estimated fructose consumption in Western countries. However, definitive studies are missing. SUMMARY: Public health policies to eliminate or limit fructose in the diet should be considered premature. Instead, efforts should be made to promote a healthy lifestyle that includes physical activity and nutritious foods while avoiding intake of excess calories until solid evidence to support action against fructose is available. Public health is almost certainly to benefit more from policies that are aimed at promoting what is known to be good than from policies that are prohibiting what is not (yet) known to be bad.
