The human right to water is nowadays more broadly recognised, mainly due to the essential societal function that this resource plays; likewise, because of the present water scarcity is generating conflicts between its different uses. Thus, this right aims at protecting human beings by guaranteeing access to clean water that is essential to satisfy vital human needs. Similarly, access to clean water is an important element to guarantee other rights including the right to life and health. The recognition of the right to water is mainly achieved in two ways: as a new and independent right and as a subordinate or derivative right. Concerning the latter, the right to water can emanate from civil and political rights, such as the right to life; or can be derived from economic, social and cultural rights, including the right to health, the right to an adequate standard of living, and the right to housing. This contribution explores the position of the Inter-American Court of Human Rights regarding the right to water, and analyses whether the Court has recognised the right to water and, if so, in which manner.

Water, considered as an environmental resource and as an economic and social good, should be part of the Colombian public agenda, not only not only in terms of the use and preservation of hydro resources, but also in terms of the social implications of its possession and use. The world wide preoccupation with the diminution of natural resources, species extinction and water shortage has its origins in the seventies. One of the results was the establishment of international conventions and agreements to achieve responsible management of natural resources. Regarding water as a resource, it is intrinsically bound to the Earth’s natural processes and ecosystems. As regards the Colombian case, the “right to water in Colombia” is analyzed taking into account: water as an integral part of sustainable development, the right to water as a global debate and, finally, the right to water in the Colombian context within the explanatory framework of the Water Referendum.

This article explores the medical care standard required by law for terminally illpatients and the possibility of limiting therapeutic efforts while respecting the duediligence expected from doctors. To this end, circumstances are identified in whichthe doctor is forced to choose between two possible actions: to guarantee the right tolife by continuing treatment, or to limit the right to healthcare by limiting therapeuticefforts. Two cases taken from English Common Law were reviewed that decided onthe factual problem at hand. In our country, the Constitutional Court established aline of jurisprudence on the role of the doctor in deciding whether or not to continuetreatment for a terminally ill person. Lastly, jurisprudence precedents are presentedalong with a comparative analysis of the solutions given in Great Britain andin Colombia.

Conscientious objection is defined as the ability to depart from statutory mandates because of intimate convictions based on ethical or religious convictions. A discussion of this issue presents the conflict between the idea of a State concerned with the promotion of individual rights or the protection of general interests and an idea of law based on the maintenance of order and against a view of the law as a means to claim the protection of minimum conditions of the person. From this conflict is drawn the possibility to argue whether conscientious objection should be guaranteed as a fundamental right of freedom of conscience or as a statutory authority legislatively conferred upon persons. This paper sets out a discussion around the two views so as to develop a position that is more consistent with the context of social and constitutional law.

The aim of this work is to recover Henri Lefèbvre's methodological contributions for (re)thinking the right to the city, based on the need to know the appropriation of space´s dialectical triad. Empirically, it refers to the urban genesis of Mar del Plata (Argentina), an intermediate Latin American city, and its heterogeneous socio-territorial forms of appropriating inhabitance, or different forms of appropriating goods of use, that lead to think about opening to the transformation of the capitalist social order, and of its urban order, naturalized after the fetischism of private property.

In this work we analyze the reforms carried out by the Mexican state in the nineties of the 20th century, in the items concerning the policies of housing and urban land, based on an exhaustive review of the main actions, programs and changes in the legal and institutional frame that applies for each of these fields. The nineties represent a "breaking point" in the way the State considers the satisfaction of the right to the housing and attends the offer of urbanized land for a tidy and sustainable urban development. In this period of time, the approach of direct intervention in developing and financing housing and creation of land reserves has changed into another one, ruled by the logic of the market. The balance to the first decade of the 21st century is ambiguous, as neither the housing policy has solved the housing shortage for low-income population, nor the land policy has eliminated the illegal urban growth.

The current housing problems in the city of Buenos Aires revolves around two phenomena, the precariousness and the evictions, in a context that is conceived like housing emergency. In response to this situation, some institutional organisms and certain social organizations with territorial roots in the south of the city, began to take forward actions of resilience opposing to the massive evictions, which take place as consequence of the real-estate pressure, and were concerning to the hotels, pensions, tenancies, and usurped houses of this zone of the city. It will be analyzed the actions of resilience displayed by them in their individual and collective dimensions and their relation to housing policies.

Los esfuerzos de la presente investigación se concentran en el cumplimiento del objetivo principal, el cual consiste en analizar el arrendamiento como un programa que puede ser incorporado en la política de vivienda en Colombia, para dar respuesta de forma transitoria y/o temporal de alojamiento a los hogares con ingresos iguales o inferiores a dos salarios mínimos, ya que actualmente la política sectorial no incorpora esta forma tenencia de la vivienda para ofertar soluciones habitacionales. El arrendamiento tiene rasgos interesantes e importantes de destacar, tales como que él mismo constituye una forma de tenencia de vivienda eminentemente urbana. Además, es un mercado al que acuden todos los estratos socioeconómicos, por lo cual no es un mercado segregado. Igualmente, al relacionar ésta tenencia con el territorio y por ende con la economía espacial, se puede decir que no existe segregación socio-espacial muy pronunciada frente a la distribución urbana de la tenencia de la vivienda en arrendamiento. En este sentido, la tenencia de la vivienda en forma de arrendamiento se presenta en todo el territorio urbano de Cali, Medellín y Bogotá.

Right to Audience and Right to a Lawful Judge are presumed to be two of the most important guaranties for the rule of law. Both liberties are established in the Spanish Constitution of 1978 as “fundamental rights”, and they are included as a part of a most generic right: the right to due process of law. Along this text, I will try to show its content and significance, according to the sentences of the Spanish “Tribunal Constitucional”, passed through more than 25 years.

We undertake a first step to investigating a reform that has been applied in numerous universities across Europe: the right to select students. We ask to what extent this right will increase the efficiency of the university. While it seems evident that giving universities the right to select students that match best with the human capital of professors should increase efficiency measures in the productivities of students in the labor market, we point to a potentially negative efect. We argue that allowing universities to select the students they prefer can reduce the incentives of the universities to improve the human capital of their professors.

La educación está definida por la Constitución Política como derecho y como servicio público con función social. A su vez, para lograr este cometido se la ha definido como política pública, es decir, de máximo interés para el Estado. No obstante, lo plasmado en norma y programas no corresponde con la realidad. Aún hay actuaciones de la administración que vulneran el derecho a la educación por deficiencias en la prestación del servicio público educativo. De ahí el interés legítimo que tiene la colectividad para exigir de la administración, mediante las acciones populares, que se garantice la prestación del servicio público de la educación en las mejores condiciones posibles. La educación como servicio público es un derecho colectivo, y la comunidad puede exigir que se garantice su prestación adecuadamente, pues en la medida en que haya más personas bien educadas, ello redunda en beneficio de la sociedad y del Estado.

Los países que salen de conflictos armados internos deben afrontar el reto de lograr el equilibrio entre los acuerdos para establecer la paz de un lado y la búsqueda de la justicia y la reconciliación de otro. En realidad, los procesos de justicia y reconciliación están bajo la influencia de numerosos factores entre los cuales se cuentan el impacto del conflicto, los recursos disponibles, el grado de voluntad política, la capacidad institucional, las normas legales, entre otros. En este contexto, la justicia transicional, la reparación, las reformas institucionales, la cooperación con la comunidad internacional y la búsqueda de una paz sostenible son temas importantes. Esta monografía se centra en el dilema entre el derecho de las víctimas a la justicia y el derecho a vivir en paz en un régimen democrático con base en el proceso que adelanta el Gobierno con grupos paramilitares.

A dos años de la declaración unilateral de Independencia de Kosovo, 65 Estados han reconocido el autoproclamado Estado, de los 193 Estados reconocidos por la ONU. Serbia, gobernada por demócratas europeístas, ha asegurado que no aceptará ninguna solución unilateral para el problema de Kosovo. El presente trabajo no pretende hacer una defensa desde el punto de vista identitario del derecho de Serbia a poseer Kosovo, sino que intenta alertar de los peligros que conlleva realizar acciones unilaterales con trasfondos etnicistas. Esta monografía constituye una defensa del multilateralismo regional y la defensa de los ciudadanos per se, sin distinciones de etnia o religión.

En esta tesis se investigó lo relativo al cumplimiento de los fallos dictados en primera instancia por los tribunales administrativos y en segunda instancia por el Consejo de Estado de las acciones populares en materia de aguas, desde el año 1998 hasta el año 2007 aproximadamente de acuerdo con la disponibilidad de los expedientes que reposan en la entidad encargada legalmente de llevar el registro de dichas acciones. Dentro de la investigación se encontró que del porcentaje total de las acciones presentadas, únicamente el 22% es favorable en las dos instancias para los actores y de ese porcentaje se desprendieron los demás ítems analizados, tales como: seguimiento, forma de cumplimiento, tiempo de cumplimiento entre otros. Así mismo se estudiaron los aspectos relevantes del derecho humano al agua y su incidencia en las políticas públicas actuales. Finalmente se presentan unas conclusiones enfocadas al cumplimiento de las acciones populares en materia de aguas y al seguimiento que deben hacer los actores de las mismas, con el fin de que se retome el carácter esencial de éstas y no sean acciones netamente pecuniarias.
