O modelo de polícia dos postos da guarda

A GNR é uma força de segurança única em Portugal, de natureza militar, constituída essencialmente por militares organizados num corpo especial de tropas, dotada de autonomia administrativa e integrada no Ministério da Administração Interna. A lei da sua orgânica, promulgada em 2007 e concretizada em 2009, tem por objecto o exercício de funções de soberania na qual a vertente de força de segurança assenta em muito na capilaridade dos postos territoriais que desenvolvem a sua missão fundamentalmente na área policial assegurando a legalidade democrática e garantindo a segurança interna e os direitos dos cidadãos. Definiu-se como objecto da dissertação o actual dispositivo dos postos territoriais da Guarda, no território continental português, visando caracterizá-lo relativamente à sua envolvente externa tendo, para o efeito, sido seleccionados os indicadores da população, da área, da relação administrativa e judicial, da localização específica e das distâncias mais próximas entre eles. Ao longo do trabalho foi utilizado o método indutivo com recurso a diversas técnicas (pesquisa bibliográfica, análise documental, estatística e observação participativa) e, em especial, a um inquérito que permitiu arrolar informação sobre 92,69 % dos postos da Guarda num universo de quatrocentos e sessenta e cinco. O modelo secular do dispositivo dos postos territoriais é uma competência distintiva da GNR que se caracteriza por ser uma malha sistemática de ocupação do território, composta por unidades elementares polivalentes, intermitentes, multiformes e muito desiguais. Independentemente da existência de um posto da Guarda constituir um símbolo da soberania nacional interessa que não seja apenas isso pois trata-se de um escalão fundamentalmente operacional com profundas responsabilidades pelo cumprimento da missão policial da GNR. Em jeito prospectivo consideramos que os postos territoriais devem ostentar uma autonomia operacional necessária e, sem excepção, dispor de uma envolvente externa coerente e provida da adequada envergadura, legitimando materialmente a sua existência, fomentando-se o equilíbrio relativo da mais pequena unidade orgânica da Guarda, sem prejuízo da proximidade às populações, do conhecimento actual e permanente do espaço social, de se assegurarem tempos de intervenção aceitáveis e da salvaguarda de constrangimentos geográficos, sociais e económicos.

Da caça de Mondragón à guarda do Estreito de Gibraltar (1508-1513) : os guardiões da memória de Duarte Pacheco Pereira e a economia da mercê nos séculos XVI-XVII

O artigo apresenta nova documentação relativa ao episódio do primeiro ataque a uma nau da Carreira da Índia, a nau de Job Queimado, e o papel desempenhado por Duarte Pacheco Pereira na perseguição do pirata Mondragón. Primeiramente, mostraremos como o pirata não chegou a ser capturado pelos portugueses. Duarte Pacheco Pereira tornou-se capitão-mor de várias armadas enviadas ao Estreito de Gibraltar. O seu desempenho no estreito nos anos de 1509, 1510, 1511 e 1513 vem complementar a lacuna documental sobre as suas actividades após a redacção do Esmeraldo de Situ Orbis. Em seguida, mostraremos como a documentação régia enviada por D. Manuel I a Duarte Pacheco Pereira foi preservada pelos seus descendentes e utilizada para obter da Coroa mercês adicionais, baseadas no seu serviço, durante mais de um século. O artigo é complementado por um apêndice documental onde se apresentam as transcrições da documentação existente no Arquivo Almada Lencastre Basto, na Biblioteca Nacional de Portugal.

O dever de obediência a ordens ilegais na Guarda Nacional Republicana

The Republican National Guard (GNR) is a military structure and hierarchical force where discipline and obedience is a serious matter, but at the same time, the scope of its activity relates to the protection of the rights, freedoms and guarantees of citizens and the primacy of public interest. While security force, GNR ensures democratic law, guarantee the internal security and the rights of citizens. The controversial issue that lies at the heart of this work its related with the balance between the hierarchy and the written law. The hierarchy, also established by law, with given powers, exist to apply the law. However, the rule of law has exceptions. Which institute to prioritize, hierarchy or the law. And within the law, its rules or the exceptions. Who decides? The GNR's officers have to obey the laws and regulations and comply with the accuracy and timeliness determinations, orders and instructions issued by a superior, given in terms of service, as long as does not involve the practice of crime. The GNR´s officer with command tasks exercises power of authority inherent in these functions, and the corresponding disciplinary authority, being responsible for acts by himself or by his order are practiced. Identify situations of exception to law enforcement, the situations in which one must obey illegal orders, is difficult and thankless, it requires conferred authority and raises the weight of responsibility for decisions and orders issued.

O corpo da Guarda prisional como Órgão de Polícia Criminal e a sua importância na Segurança Interna

The study now presented a research study aimed at the exercise of security activity of the prison guard corps (CGP) in the specific context of the prison system (SP). The study also focused on the phenomenon of globalization and its influence on the current panorama of world crime and their relationship with the prison security object of study was the security activity of the CGP on the current inmate population, as well as the typology of crimes inherent to it and that requires the interpretation of the amendment to the correctional paradigm. In the preparation of the study we have tried to identify the legal framework of the profession based on the main laws and decree-laws governing the institution DGRSP and CGP's career. The difficulties and constraints were analyzed the performance of the security function of the CGP, resulting from the infrastructure, the interaction with the inmates and the need of assigning the status of Criminal Police (OPC). Really connected the relevant importance of OPC so the Corporation can establish a cooperation interaction and sharing of information with different security forces. We noted the importance of the CGP being OPC status before the framework for its action in work situations, specifically, on gatehouses, prison wings, area, and high-complexity operations such as escorts and riot control interventions.The explanation of this study enabled us to assess the importance of the actions of a police officer of the elements of the CGP for maintaining internal security. The analyses and studies were complemented by twenty years of career and exercise of the activity of the master's degree, during which time he served as guard and head of the CGP, the intervention Group and Prison Security, the Lisbon Prison, Prison, Prison of Caxias, Sintra and Monsanto.

Guarda prisional: força de segurança ou agente responsabilizador?

A permanently changing occidental society framework, simultaneously, to a world Globalization and a market liberalization, requires to know how important and which role the agents plays, in Estates representation, to guarantee their own intern security. Portugal is an example of that since has been integrated in European and world politics that allowed the borders opening, with all the negative consequences of that kind of measures. In way to struggle with those debilities emerge, in our Juridical Order, several security forces such as Prison Guards Corporation, whose contribute to intern security seems undefined and confuse, being urgent legislation in way to describe and clearly define their goals and functions. We begin with a brief history view to understand the evolution, focusing on the present moment, correlate several laws in way to clarify their juridical situation. Using a own critical sense, it draws attention to legislation lack problem in opposition to the conclusion that, Prison Guards Corporation is a security force with specialized expertise in matter and territory fields. Their activity occurs, generally, in penitentiaries where people see themselves without their freedom, legally determinated and confined to places as other individuals with deviant behaviors that deserve society refutation, establishing a separation period having rehabilitation as a goal – it is called general and special prevention. Penitentiaries specificities requires specially police force because penitentiaries are places where tensions are often, both between inmates and against employees, above all prison guards, the first to struggle inmates daily frustrations. In way that institutions achieve their purpose, it is necessary that citizens respect all the rules, although, to their efficacy is necessary to inflict punishment to those who did not respect the rules. Furthermore, it will be indispensable to act immediately in situations as impeding runaway helping, illegally standing in jail and to avoid violent acts against personal and patrimonial belongings. Juridical Order has a few security tools that are available to administration, in which is included coercive methods, that as damaging to citizens in whom they are use, are restricted, unavoidably, to inflexible control rules. Concluding, Prison Guards and Penitentiaries General Direction last goal is to give back recovered inmates to society, in a way to conduct their lives responsibly, without committing crimes.

Georeferencing Road Accidents with Google Earth: Transforming Information into Knowledge for Decision Support

Over the last fifty years mobility practices have changed dramatically, improving the way travel takes place, the time it takes but also on matters like road safety and prevention. High mortality caused by high accident levels has reached untenable levels. But the research into road mortality stayed limited to comparative statistical exercises which go no further than defining accident types. In terms of sharing information and mapping accidents, little progress has been mad, aside from the normal publication of figures, either through simplistic tables or web pages. With considerable technological advances on geographical information technologies, research and development stayed rather static with only a few good examples on dynamic mapping. The use of Global Positioning System (GPS) devices as normal equipments on automobile industry resulted in a more dynamic mobility patterns but also with higher degrees of uncertainty on road traffic. This paper describes a road accident georeferencing project for the Lisbon District involving fatalities and serious injuries during 2007. In the initial phase, individual information summaries were compiled giving information on accidents and its majour characteristics, collected by the security forces: the Public Safety Police Force (Polícia de Segurança Pública - PSP) and the National Guard (Guarda Nacional Republicana - GNR). The Google Earth platform was used to georeference the information in order to inform the public and the authorities of the accident locations, the nature of the location, and the causes and consequences of the accidents. This paper also gives future insights about augmented reality technologies, considered crucial to advances to road safety and prevention studies. At the end, this exercise could be considered a success because of numerous consequences, as for stakeholders who decide what to do but also for the public awareness to the problem of road mortality.
