Quando comparada a outras regiões do mundo e mesmo regionalmente, as tecnologias de geoinformação ainda são pouco utilizadas e difundidas em Angola. Há uma grande carência de profissionais, centros de pesquisa e ensino, desenvolvimento de aplicações e produção técnico-científica. Há carência de uma política nacional de desenvolvimento das TIGs e mecanismos eficazes de gestão e produção de dados, o que se reflete numa fraca difusão da informação, ausência de um quadro normativo e orientações técnicas, entre outros. Há uma grande lacuna no que toca a regulamentação, produção, gestão e disseminação da informação geospacial. A legislação relativa ao domínio da informação geográfica é escassa. É necessário que se consolidem mecanismos legais que visem organizar e regular este setor. Neste contexto, propomos a implementação de uma estratégia sólida e coerente de desenvolvimento, orientada para a gestão, produção e divulgação da informação geográfica que possa integrar a utilização da informação geográfica, implementada no território por organismos que o gerem e cuja missão central é promover o desenvolvimento sustentável.

Currently, Angola portrays a notorious economic growth and due to recent innovative legislations, it has become the major investment attracting pole, especially in Sub-Saharan Africa, having, thus, an extraordinary potentiality for a rapid and sustainable development, likely to place her in outstanding positions in the world economic ranking. Yet, such economic growth entails demanding levels of intensive investment in infrastructure, what has been reported of the Angolan Government to be unable to respond to, save if recurring to very high index of external debt, poisoning, in this way, the future budgeting of the country. Due to these infrastructure investment shortages, the cost of production remains highly onerous and the cost of life extremely unaffordable. On this account, the current study disserts about the contract of Project Finance; an alternative finance resource given as a viable solution for the private financing of infrastructure, aiming to demonstrate that such contractual figure, likewise the experience of several emerging economies and others, is a contract bid framework to take into account in today’s world. It refers to a financing technique – through which the Government may satisfy a common need (for example, the construction of a public domain or public servicing), without having to pay neither offer any collateral – based on a complex legal-financial engineering, arranged throughout a coalition of typical and atypical agreements, whereby it is mandatory to look back at the basic concepts of corporate law. More than just a simple financial study, the dissertation at stake analyses the nature and legal framework of Project Finance, which is a legally atypical and innominate contract, concluding that there is a relevant need for regulating and devoting a special legal regime in the Angolan jurisdiction for this promising legal form in the contemporary corporate finance world.

Along with the food and the comfort, safety has always been one of the human priorities. In pursuit of this objective, man developed self-preservation mechanisms, went to live in society and created rules to control the community life. In the West and in the late eighteenth century, with the creation of states as we know them today, the monopoly of security, among other powers, has been preserved untouched until the last quarter of this century. With the bankruptcy of the welfare state and the rise of the regulatory state, many of the essential tasks for the community have also been carried out by private companies or institutions, including education, health care and security. Although not easy, education and health care have been more opened to be managed by the private sector. Instead, the privatization of the security sector has seen much more resistance. Still, especially in the West, the states have delegated some of the security competences to private companies. Portugal is no exception to the rule and, after a few years of unregulated activity, in 1982 was published the first law regulating the private security. After the initial stages of development (evolution and maturation), which lasted until the early years of the 2000‘s, the private security now seems to have reached maturity. Today, now with a new legal system, composed by Law no. 34/2013, of 16 may, its regulations and complementary legislation, now private security encompasses other activities and competences - becoming, an increasingly complement to public safety. It has also increased the pre-requisites and control mechanisms for private security companies, and strengthened the rules that limit their scope of activity.

Consumer relations, established between the Consumer and the Creditor, which carry a consequent inequality of contractual positioning between the parties, have been pushing the legislator to adopt more rigid regulations with regard to lending for the purchase of goods or services of consum issues. In this sense, the Decree-Law 359/91 was approved, meanwhile repealed by the Decree-Law 133/2009, which regulates the consumer credit agreement’s regime in the portuguese legal system. Through this contract, the financier makes available to the consumer a certain amount of money, which the consumer must repay, plus the respective remuneration (interest) and other charges, according to a refund plan agreed by the parties. The consumer will be in delay if he breaches this stipulation. In case of default, the creditor, notwithstanding, can choose to wait for the performance by the debtor, promote the loss of benefit of the term or the termination of the contract. From the outset it would seem that, in one way or another, the financier, by imposing a forced shortening of the contract duration initially agreed, will lose the right to remuneration for the provision of capital agreed, but not verified. Nevertheless, unlike presently, the previous regime allowed the parties to rule otherwise, being permitted to agree to the payment of interest of outstanding installments. On the other hand, in the consumer credit contract the principle of freedom of contractual provision of the parties is strongly mitigated by the special legislation, which prevents the waiver of rights by the consumer, and by the regime of general contractual terms, which restricts the freedom of the financier to stipulate the contractual content freely and the freedom of the consumer to negotiate. For all these reasons, associated with the growing need of credit resource to satisfy their needs of consumption, it is confirm the relevance of legislative intervention on consumers protection in the context of hiring credit.

The challenge of this work is to assess the importance of the municipal police in improving the safety of citizens, if gauging from this reality through contributions from the Municipal Police Guimarães. The IV Constitutional Review in 1997, enabled the Portuguese municipalities creating administrative police bodies. These services, known as Municipal Police, have gradually come up in several municipalities. Currently the Municipal Police have their fundamental legal regulations of Law No. 19/2004 of 20 May, which, according to the Portuguese Constitution provides that these must be seen as municipal services, which act in a space territorially delimited, which corresponds to the municipality that each belongs. Under Article 237, paragraph 3, of the Constitution, the Municipal Police are municipal services, which shall cooperate in the maintenance of public order and protection of local communities, acting in cooperation with the security forces, public security functions. The safety concept has been taking an increasingly significant importance within the population. Is also no doubt say that, currently, insecurity affects all of society and is a major concern of law enforcement authorities. To find suitable answers we found that there are several studies on these subjects. In order to be able to make our contribution, text looks us on this subject, having had the support of the Municipal Police Guimarães, in the preparation of this work. Thus, based on a survey, they were sounded out, as privileged actors, agents of the Municipal Police Guimarães, in order to know their perceptions with regard to security issues faced in the context of security. We understand ask them to answer in particular the following questions: What are the most facilitators situations of crime? How important is the Municipal Police Guimarães in crime prevention? What are the strategies for prevention of incivilities? What other skills that can be conferred upon the Municipal Police? The results obtained allowed us to conclude that incivilities facilitate the occurrence of crimes and that the Municipal Police may have a more active role in the security of the population. If you were given other duties, in addition to that already have, the Municipal Police could reach another level of effectiveness. However we understand that any change to the tasks of this police need a serious and profound reflection, to find complementary alternatives with the security forces, which does not conflict with current assignments of any of the parties or with the interests of citizens.

Surrogacy is the arrangement made by at least three people, in order for a surrogate or gestational mother to carry a pregnancy for the two intended parents, with the objective of the former party relinquishing all rights to the child, once the child is born. As it has only been in recent years that that same reproductive method has begun to be commonly accepted due to certain modern scientific developments that thus diminished ethical and moral negative stances, there is still an unsettling legal void (both at a national and international level) in regards to such subsidiary form of reproduction. As such, some countries have not only left their citizens with no choice but to travel abroad in order to enter a surrogacy arrangement (leading to private international law issues on establishing parenthood and nationality of the born child) or to resort to surrogacy within black market conditions. Unfortunately, one of those countries is Portugal as it has been considered, both by its political parties and experts in the area, and by its citizens as not dealing adequately with such theme and thus being poorly equipped to deal with surrogacy, at both a legal and social level. The present paper attempts to analyse Portugal’s current legal perspective by looking at the present efforts being made to contradict the current situation, and thus outline altruistic gestational surrogacy’s tangible future within such nation. In order to also become aware of possible improvements specifically regarding to the full protection of human rights and human dignity as a whole, the United Kingdom’s legal standpoint in relation to surrogacy was also studied. Via direct comparison of both social and legal perspectives, a new approach to altruistic surrogacy is thus proposed with view to suggest a harmonious solution for countries that have at least recognized that the present issue deserves to be duly noticed and that altruistic gestational surrogacy may exist in order to grant protection of human dignity and not to place it in check.

O presente estudo tem como objetivo compreender a valoração de uma mensagem de correio eletrónico em ambiente corporativo, e respetiva integração no arquivo empresarial. Objetivamos, nos primeiros capítulos, descrever o modelo metodológico aplicado. Seguidamente, apresentamos uma revisão bibliográfica assente em literatura inerente à temática dos circuitos informacionais na empresa, e documentação eletrónica resultante dos mesmos, com ênfase nas mensagens de correio eletrónico. A investigação empírica teve por base a aplicação de um inquérito por questionário, tendo por amostra um grupo profissional pré-selecionado, com acesso regular a um sistema de correio eletrónico. Os resultados obtidos através da análise do material empírico permitem-nos observar uma utilização preferencial do correio eletrónico face a outros suportes comunicacionais, constituindo-se as mensagens eletrónicas no documento produzido em maior escala, em ambiente profissional. Foram igualmente verificados casos de ausência de regulamentação para criação, gestão ou arquivo de mensagens, ou mesmo de um sistema de gestão documental que permita integração das mesmas. Com base na análise empírica, e em associação com a revisão bibliográfica explanada, concluímos que estas, e outras questões enunciadas ao longo do estudo, poderão constituir-se num sério obstáculo à gestão, preservação, recuperação e integridade da informação registada por meio de mensagens de correio eletrónico, caso não sejam criados e aplicados procedimentos e sistemas de gestão orientados para a documentação eletrónica, de forma a garantir o acesso a informação de fulcral importância para empresa, enquanto evidência e memória dos processos e atividades organizacionais.

O setor farmacêutico apresenta um elevado grau de complexidade, dada a regulamentação a que está sujeito. Atualmente, um dos principais problemas deste setor prende-se com o acentuado aumento (142,6% entre dezembro de 2012 e julho de 2014) do número de farmácias insolventes, sendo impacto da crise económica e consequentes medidas regulamentares aplicadas com o Memorando de Entendimento da Troika. Dada a importância que as farmácias têm na dispensa do medicamento assim como o papel do farmacêutico no aconselhamento diário aos utentes, a redução do número de farmácias levanta problemas no acesso ao medicamento por parte da população. Assim, é necessário dotar as farmácias de ferramentas que lhes permitam gerir o seu negócio, criando bases sólidas de forma a terem uma maior capacidade de reagir em tempos de crise. Desta forma, o objetivo principal do trabalho é fornecer às farmácias uma dessas ferramentas, através da criação de um modelo preditivo de insolvência que permita estimar uma probabilidade de uma farmácia entrar em insolvência. Para o efeito, desenvolveu-se um modelo teórico, com base na revisão de literatura científica e na análise do setor farmacêutico em Portugal, que foi depois testado recorrendo a métodos de estimação com recurso ao modelo logit através do método da Máxima Verosimilhança. O modelo empírico foi estimado com dados de uma amostra de 97 farmácias, selecionadas a partir de uma base de dados da ANF. Esta amostra é composta por todas as farmácias insolventes e por uma seleção aleatória de farmácias solventes, para as quais foi possível utilizar informação proveniente do IES, mantendo a total confidencialidade, nomeadamente dados relativos às dimensões consideradas no modelo teórico: Autonomia Financeira, Endividamento, Gestão de Inventários, Gestão de Funcionários, Liquidez, Prazo Médio de Pagamentos do Estado, Prazo Médio Pagamentos a Fornecedores, Rendibilidade, Solvabilidade, Tesouraria, Dimensão e Localização. As dimensões referidas foram selecionadas após uma análise extensiva da bibliografia sobre esta temática. Estas dimensões foram incluídas na estimação através de variáveis proxy (com exceção da Tesouraria), para as quais foi também levada a cabo uma análise de sensibilidade. Depois de validados os pressupostos da estimação e de uma análise crítica sobre os resultados, foi possível selecionar um modelo em que mais de 90% das observações foram classificadas corretamente. O modelo preditivo selecionado inclui as variáveis proxy das dimensões: Autonomia Financeira, Prazo Médio Pagamentos a Fornecedores, Endividamento, Rendibilidade, Dimensão e Localização. Em testes posteriores, validou-se a capacidade preditiva do modelo com recurso a uma amostra de teste.
