RESUMO - A sobrelotação das urgências resultante da utilização inadequada tem como consequências a diminuição na qualidade dos cuidados. As causas da utilização inadequada são várias. Entre elas, a utilização dos Cuidados de saúde Primários merece uma atenção particular. De facto, as barreiras no acesso aos cuidados de saúde primários estão associadas com uma maior inadequação. Assim, ter um prestador regular, acessível, que presta cuidados contínuos e regulares está associado com uma menor utilização inadequada dos csp. Contudo, é necessário ter em conta as características dos utilizadores de forma a desenvolver estratégias que permitam a prestação de cuidados acessíveis. Em Portugal, foi implementada em 2006 uma Reforma dos CSP cuja face mais visíveis são as USF, que deverão prestar cuidados personalizados, garantido a acessibilidade, globalidade e continuidade dos mesmos. Assim, da revisão da literatura e existindo uma associação entre a utilização inadequada das urgências observou-se a variação das urgências hospitalares entre 2005 (ano anterior à implementação das USF) e 2008 (últimos dados disponibilizados) e o nº de USF implementadas. Ao contrário do expectável, verificou-se haver uma associação positiva entre o nº de USF e o nº de urgências hospitalares. Os hospitais com maior nº de USF tiveram um aumento da utilização das urgências hospitalares, enquanto nos hospitais sem nenhuma USF associada, houve uma diminuição das urgências hospitalares. Contudo, existiram factores que não considerados, como criação da Linha Saúde 24, encerramento dos SAP, dimensão dos hospitais, etc., que poderão ter influenciado os resultados. Os resultados em saúde resultantes da implementação das USF não foram considerados. Assim sugere- se futura investigação. ------------------------------ABSTRACT - Crowded emergency department resulting from inappropriate use may compromise the quality of care . Several causes explain the inadequate use of emergency care. Among them, the association between primary care and inappropriate use of emergency departments is of particular interest. Indeed, studies show that fact, barriers in access to Primary Health Care ( PHC) are associated with more inappropriate use. Therefore having a regular, accessible, continuous, source of care is associated with a decrease in inappropriate use of Emergency department. Though, patient’s preferences have to be considered in order to develop strategies that allow accessible care. In Portugal, a reform of primary care has been launched in 2006, through the implementation of Family Health Units ( FHU) that are responsible for giving personalized, accessible, global and continuous care. A vast literature shows an association between inappropriate use of emergency departments and primary health care access. In the present work we observed the variation in emergency department use between 2005 (previous year to Family Health Units implementation) and 2008 (last available data) and the number of Family Health Units implemented. Contrary to our expectations, results showed a positive association between the number of Health Family Units and emergency department use. The Hospitals with more Health Family Units experienced an increase of emergency department use while hospitals with none Health Family units experienced a decrease of emergency department use. RESUMO - O excesso de peso (EP) é um dos mais graves problemas de Saúde Pública deste século XXI, dada a sua elevada e crescente prevalência a nível mundial, afectando um elevado número de adultos, adolescentes e crianças, com graves consequências na saúde, sendo responsável pelo aumento das doenças crónicas e pela diminuição da duração e qualidade de vida dos indivíduos. Em Portugal, a prevalência do EP afecta mais de metade da população adulta portuguesa. No meio militar, este problema é reflexo da prevalência do EP na população em geral e, para além das consequências económicas e na saúde, prejudica a aparência militar e pode comprometer a aptidão física. Pretende-se com realizar um estudo exploratório, com vista a realizar uma primeira abordagem do conhecimento do perfil e tendências do índice de massa corporal (IMC), bem como da prevalência do EP e, ainda, de possíveis associações entre o EP e a aptidão física, numa amostra representativa de militares no activo da Marinha Portuguesa (MP). Com os resultados deste estudo pretende-se alertar, pela primeira vez, para a problemática do EP no meio militar, contribuindo também para ampliar o conhecimento da prevalência do EP em subgrupos da população nacional. Os resultados obtidos poderão servir de base para a constituição de um sistema de vigilância, para um correcto entendimento da evolução da tendência do IMC e da prevalência de EP dos militares da MP, bem como disponibilizar uma base de partida para outros estudos, focando os determinantes do EP associados a estilos de vida. ------------ABSTRACT - Overweight and obesity severe Public Health problems of the XXI Century due to its high and increasing worldwide prevalence, including Portugal, and it afects a high number of adults, adolescents and children, with serious health consequences, being responsible for the increase of chronic diseases and for lower life quality and lower life expectancy. In Portugal, overweight prevalence affects more than half of adult’s population. Among the Navy, overweight problem reflects population’s tendency, and, besides it’s economic and health consequences, can affect military image and can jeopardize physical fitness with consequences in the Navy response and performance. This study carries out an exploratory first approach of body’s mass index profile and trends, as well the prevalence of overweight in a representative sample of on duty Portuguese Navy staff, and the potential links between overweight and physical fitness among this population. It outcome seeks, for the first time, to draw attention to the overweight problematic among Navy staff, being also a way to enhance the knowledge of overweight prevalence among population sub-groups. The Republican National Guard (GNR) is a military structure and hierarchical force where discipline and obedience is a serious matter, but at the same time, the scope of its activity relates to the protection of the rights, freedoms and guarantees of citizens and the primacy of public interest. While security force, GNR ensures democratic law, guarantee the internal security and the rights of citizens. The controversial issue that lies at the heart of this work its related with the balance between the hierarchy and the written law. The hierarchy, also established by law, with given powers, exist to apply the law. However, the rule of law has exceptions. Which institute to prioritize, hierarchy or the law. And within the law, its rules or the exceptions. Who decides? The GNR's officers have to obey the laws and regulations and comply with the accuracy and timeliness determinations, orders and instructions issued by a superior, given in terms of service, as long as does not involve the practice of crime. The GNR´s officer with command tasks exercises power of authority inherent in these functions, and the corresponding disciplinary authority, being responsible for acts by himself or by his order are practiced. Identify situations of exception to law enforcement, the situations in which one must obey illegal orders, is difficult and thankless, it requires conferred authority and raises the weight of responsibility for decisions and orders issued.

The conflicts currently taking place around the world demand that the international intervention fits the intensity and extent of the threat. This is particularly important in post-conflict scenarios, leading to a greater participation of the Security Forces in those scenarios, in order to foster lasting peace, enforce the order and improve law enforcement services in those regions. The transition from armed conflict to peacekeeping may entail high risk situations and greater instability periods, so-called “intermediate situations”. Accordingly, in the face of persisting high volatility, a robust response is still required post-conflict. Therefore, it is appropriate to deploy Security Forces with military nature and status, the gendarmeries, which have training and response capabilities similar to Armed Forces in peacekeeping operations. Their double facet as police and military forces enables them to perform police duties in high risk and unsafe environments. In light of these features, the Portuguese gendarmerie, Guarda Nacional Republicana (GNR), is able to carry out tasks in these scenarios, which it has been doing through individual operatives or larger units. This dissertation focuses on the use of Security Forces of military nature in peacekeeping missions, in particular the Portuguese GNR, relying mostly on the inductive approach and using literature research, document analysis, interviews and statistics. After a brief description of international peacekeeping missions, we describe the contribution of Security Forces of a military nature in such operations. Then we introduce and analyse the GNR, focusing on its deployment in different kinds of peacekeeping operations, from its first participation in 1995 until today. We also report some reactions to the performance of GNR. Finally, we discuss whether there is indeed a unique role for this type of forces in international peacekeeping missions.

Following orders, hierarchical obedience and military discipline are essential values for the survival of the armed forces. Without them, it is not possible to conceive the armed forces as an essential pillar of a democratic state of law and a guarantor of national independence. As issuing orders as well as receiving and following them are inextricably linked to military discipline, and as such injunctions entail the workings of a particular obedience regime within the specific kind of organized power framework which is the Armed Forces, only by analysing the importance of such orders within this microcosm – with its strict hierarchical structure – will it be possible to understand which criminal judicial qualification to ascribe to the individual at the rear by reference to the role of the front line individual (i.e. the one who issues an order vs the one who executes it). That is, of course, when we are faced with the practice of unlawful acts, keeping in mind the organizational framework and its influence over the will of the executor. One thing we take as read, if the orders can be described as unlawful, the boundary line of the duty of obedience, which cannot be overstepped, both because of a legal as well as a constitutional imperative, will have been crossed. And the military have sworn an oath of obedience to the fundamental law. The topic of hierarchical obedience cannot be separated from the analysis of current legislation which pertains to the topic within military institutions. With that in mind, it appeared relevant to address the major norms which regulate the matter within the Portuguese military legal system, and, whenever necessary and required by the reality under analysis, to relate that to civilian law or legal doctrine.

The European Union has taken in recent years an increasingly important role in ensuring peace and stability in the international community, and the security and defence policy of the Union has become synonymous with crisis management. The Union has addressed the issue of crisis management through two sources: the military side and the civilian side, which consists in carrying out numerous crisis management operations and missions. This study discusses the role of the European Union in conducting crisis management operations and missions and how the gendarmerie forces contribute to the success of the same. It will discuss the evolution of the European Union's security policy and the concept of crisis management, and seek to demonstrate the added value of the commitment of gendarmerie forces in operations and missions of crisis management, particularly with regard to employment of the European Gendarmerie Force. On the other hand, it will study the planning process for crisis management of the European Union, featuring the entities and agencies involved in it, and presenting the products that result from this same process. The use of Gendarmerie forces in crisis management operations and missions has significant advantages. Its use is recommended to post - conflict scenarios, in complementarity with the armed forces, in order to overcome the "security gap" that mediates the transition from the state of conflict for the period of peace and reconstruction. Gendarmerie forces can also be engaged both in military crisis management operations and civilian crisis management missions.

The present work offers a brief historical and evolutionary introduction to the legal basis of the Portuguese Republic Intelligence System (SIRP) which comprises two services – the Security Intelligence Service (SIS) and the Defence Strategic Intelligence Service (SIED) – and two entities responsible for its oversight – the Supervisory Body (CFSIRP) and the Data Monitoring Committee (CFD), also responsible for supervising the Military Intelligence and Security Centre (CISMIL) of the General Staff of the Armed Forces (EMGFA). The initial narrative subsequently leads us to a detailed analysis of the Portuguese Intelligence services' current model of monitoring, as well as of the legislator’s options, namely in the legal drafting field, used within the construction and definition of the legal structure that currently regulates the Portuguese Republic Intelligence System. For the purposes of this study we have broadly examined different models of the European Union, in particular those of Belgium, the Netherlands and Croatia. We have also transposed to the text the valuable contributions collected during the research phase, more precisely the replies to questionnaires and interviews conducted with certain individuals selected according to their knowledge and affinity with the subject of this study, including members and former members of the Supervisory Body and former directors of the three portuguese intelligence services. The present dissertation intends to contribute to the development of this subject, promoting critical analysis, within and beyond the academia, with the aim that some of its reflections might be useful towards the intelligence system’s future reform, particularly in what concerns intelligence services monitoring.

A presente dissertação é circunscrita no espaço e no tempo, tendo como objecto de estudo fundamental o concelho de Setúbal durante a I Guerra Mundial (1914-1918). Enquadrando historicamente os impactos do conflito no contexto nacional, Setúbal é revisitada entre os finais de oitocentos e os primórdios do século XX a fim de retratar política, económica, social e culturalmente um dos maiores centros urbanos portugueses dos finais da Monarquia Constitucional e do início da I República. Numa lógica de impactos políticos e económico-sociais, esta investigação promove o redescobrir das vivências quotidianas de Setúbal durante um dos períodos mais negros da História da Humanidade. Através do estudo dos mecanismos de acção e intervenção municipais, bem como dos resultados eleitorais e dinâmicas políticopartidárias locais, transmite-se como foram vividos acontecimentos marcantes da vida pública de Portugal, nomeadamente o 14 de Maio de 1915 e o coup d’état sidonista, realçando como dimensões operárias anárquicas e sindicalistas conviviam com grupos conservadores, católicos e monárquicos. Num plano de economia de guerra, o mundo agrícola é abordado em diferentes sectores, nomeadamente na laranja, na cortiça e nos vinhos, dando maior atenção às questões relacionadas com a decadência da fruta e à abertura de novos mercados exportadores, como o Brasil, pela Casa José Maria da Fonseca. A indústria de conservas de peixe, que viveu um boom neste período como resultado da intensa procura externa dos países aliados que tinham nas latas de conserva o alimento das tropas nas trincheiras, representa outro foco de análise deste trabalho. Consequentemente aborda-se o papel da estrutura portuária local na resposta às necessidades de consumo britânicas, francesas e italianas. Por fim, os impactos sociais do conflito em Setúbal constituem um dos enunciados desta investigação, compreendendo como o estudo de uma imprensa dividida na questão intervencionismo versus anti-intervencionismo reflectiu um concelho que viveu como poucos a crise de abastecimentos e a carestia de vida. A proliferação de greves, manifestações contra a guerra, as deserções militares e os assaltos colectivos representam o culminar de um vulcão que entrou em erupção e que ainda sofreu as agruras da epidemia da gripe pneumónica até ao final do ano de 1918.
