The territory of the European Union is made up of a rich and wide-ranging universe of languages, which is not circumscribed to the «State languages». The existence of multilingualism is one of Europe’s defining characteristics and it should remain so in the constantly evolving model of Europe’s political structure. Nonetheless, until now, the official use of languages has been limited to the «State languages» and has been based on a concept of state monolingualism that has led to a first level of hierarchization among the languages of Europe. This has affected the very concept of European language diversity. The draft of the treaty establishing a European Constitution contains various language-related references that can be grouped in two major categories: on the one hand, those references having to do the constitutional status of languages, and on the other, those regarding the recognition of European language diversity. Both issues are dealt with in this article. In analyzing the legal regime governing languages set forth in the draft of the constitutional treaty, we note that the draft is not based on the concept of the official status of languages. The language regulation contained in the draft of the constitutional treaty is limited in character. The constitutional language regime is based on the concept of Constitutional languages but the official status of languages is not governed by this rule. The European Constitution merely enunciates rights governing language use for European citizens vis-à-vis the languages of the Constitution and refers the regulation of the official status of languages to the Council, which is empowered to set and modify that status by unanimous decision. Because of its broad scope, this constitutes a regulatory reservation. In the final phase of the negotiation process a second level of constitutional recognition of languages would be introduced, linked to those that are official languages in the member states (Catalan, Basque, Galician, etc.). These languages, however, would be excluded from the right to petition; they would constitute a tertium genus, an intermediate category between the lan guages benefiting from the language rights recognized under the Constitution and those other languages for which no status is recognized in the European institutional context. The legal functionality of this second, intermediate category will depend on the development of standards, i.e., it will depend on the entrée provided such languages in future reforms of the institutional language regime. In a later section, the article reflects on European Union language policy with regard to regional or minority languages, concluding that the Union has not acted in accordance with defined language policy guidelines when it has been confronted, in the exercise of its powers, with regional or minority languages (or domestic legislation having to do with language demands). The Court of Justice has endeavoured to resolve on a case by case basis the conflicts raised between community freedoms and the normative measures that protect languages. Thus, using case law, the Court has set certain language boundaries for community freedoms. The article concludes by reflecting on the legal scope of the recognition of European language diversity referred to in Article II-82 of the European Constitution and the possible measures to implement the precept that might constitute the definition of a true European language policy on regional or minority languages. Such a policy has yet to be defined.

This paper analyzes the pensions reforms and changes that have been in Spain to guarantee Welfare State. In fact, pensions are the most important part that we have to control in order to satisfy the necessities of a country: who and what conditions in we have to receive them, what have to be the financial source or sources etcetera. Because of that, this paper summarizes the reforms have been until nowadays, what are the reasons of these changes and what have been the impacts as much on workers as on pensioners. Apart from that, we are going to analyze the factor to cause gender differences. Finally, it suggests some restraints that the state must to impose in the medium term to remove unfair elements that the last reform causes and to guarantee solvency in the long term.

The implementation of the European Commission Services Directive initiated the modernization process of services markets within the European Union. The objective was to guarantee the creation of a single market by ensuring the freedom of establishment and circulation. The transposition of the Directive in Spain triggered an initial wave of reforms in the Spanish legal system. A second package of reforms is currently underway, following recommendations by the EC, IMF and OECD, which highlight the relative lack of competition in Spain’s services as one of the major imbalances in its economy, alongside the public deficit and unemployment. Both the implemented and planned reforms represent a major step forward. Nevertheless, the government has recently announced modifications to the draft bill of the Professional Services and Associations Law, which is expected to soon be submitted for parliamentary debate and approval. Taking into consideration modifications already introduced, together with anticipated further changes, it will be important to maintain the main points of the draft bill and to introduce a deeper review of the legal framework for professional services, of the professional associations themselves, and for the activities that are subject to compulsory membership within a professional association. Spain’s territorial map of professional associations must too be redrawn.

[EU] Gradu amaierako lan honetan, XXI.mendeko Lan Erreforma adierazgarrienak kronologikoki erakusten dira, hauetako bakoitzean, hurrengo lau aldagai hauen analisiaren bitartez, hain zuzen, kontratazioak eta enplegua, langabezia, pentsioak eta negoziazio kolektiboa. Gainera, ELA, LAB, CCOO eta UGT sindikatuei elkarrizketa bat burutu zaie, erreformei buruzko iritzia jaso eta kolektibo bakoitzaren ezinegonak eta parekotasunak ezagutzeko helburuarekin. Era honetan, analisi zehatz honen bidez, XXI.mendean zehar enpleguan eta lan harremanetan emandako aldaketak islatzea da funtsezko xedea.

In this End of Degree Dissertation I built a basic economic model, where two perfectly competitive markets interact, as a tool to understand, illustrate and evaluate environmentalfiscal reforms that have already been implemented or have been announced in many developed countries. Thus, in this dissertation I try to explain as simply as possible the theorical aspects of the “double dividend” hyphotesis and provide a numerical example with illustrative purpose.

[Pentsio-sistema honela antolatzen da: lehen maila, kotizaziopeko pentsioak jasotzen ez dituztenei pentsioak ordaintzera bideratzen da; bigarren maila, Gizarte Segurantza edo kotizaziopeko pentsioena da; hirugarren maila, borondatezko gizarte-aurreikuspen osagarriari dagokio Euskal Autonomia Erkidegoan eta pentsio-planei Espainian. Bigarren mailan, Gizarte Segurantza banaketa-sisteman oinarritzen da. 2050ean erretiro-pentsioak finantzatzeko arazoak egotea espero da. Etorkizuneko egoerari aurre egiteko, 27/2011 Legearen eta 5/2013 Errege Lege Dekretuaren bitartez, erreformak burutu dira. Hirugarren mailan, Euskal Autonomia Erkidegoan gizarte-aurreikuspen osagarria Eusko Jaurlaritzaren esku dago eta Borondatezko Aurreikuspen Sozialeko Erakundeen (BASE) aurreikuspen-planak bertako pentsio-plan propioak dira. Lan honetan, batez ere, pentsio-sistemaren bigarren eta hirugarren mailak aztertuko ditut. [ES] Tras una primera visión del concepto de precariedad y acotación del término en el ámbito europeo, este trabajo trata, por un lado, de exponer los factores y el marco social en el que se crea dicha precariedad laboral y, por otro lado, de analizar mediante diversos indicadores de calidad del empleo la incidencia en el caso de la Unión Europea y España. Se exponen la flexibilidad laboral y otros cambios empresariales, reformas legales o transformaciones en el contexto del mercado del trabajo como causantes del aumento de empleos atípicos, los cuales tiendes a ser de peor calidad. En cuanto a los indicadores de calidad utilizados destacan las tasas de actividad, la temporalidad, la estructura de la renta y el salario mínimo, el porcentaje del trabajo a tiempo parcial con respecto al total o las malas condiciones de trabajo, entre otros. Además se hace referencia a la crisis comenzada en 2007 y al efecto agravatorio de esta en la situación, especialmente en el caso de los jóvenes. Por último, se mencionan ciertas propuestas y políticas laborales.

In the middle of the so-called pension crisis, the ageing of population and the sharp decrease in affiliations to Social Security are threatening the well-functioning of the Spanish public pension system. The purpose of this paper is to present the main challenges to be faced by the Spanish pension system, as well as to shed light on the main determinants that will condition the evolution of pension expenditure over GDP along the following decades. This quantitative analysis, which considers the 2011 and 2013 pension reforms, uses the latest data on the Spanish demographic, labor market and institutional factors in order to project the evolution of the system from the expenditure side up to 2060. For the purpose of analyzing the dynamics and the underlying drivers of pension expenditure, the so-called aggregate accounting approach will be utilized. The alternative scenarios proposed allow for exploring the robustness of the results within the baseline scenario, which constitutes the reference point of projections in the exercise. The analysis concludes that, by the end of the projected period, Spain will count on a similar public pension expenditure ratio as the current one.
