In the discussion - The Nevada Gaming Debt Collection Experience - by Larry D. Strate, Assistant Professor, College of Business and Economics at the University of Nevada, Las Vegas, Assistant Professor Strate initially outlines the article by saying: “Even though Nevada has had over a century of legalized gaming experience, the evolution of gaming debt collection has been a recent phenomenon. The author traces that history and discusses implications of the current law.” The discussion opens with a comparison between the gaming industries of New Jersey/Atlantic City, and Las Vegas, Nevada. This contrast serves to point out the disparities in debt handling between the two. “There are major differences in the development of legalized gaming for both Nevada and Atlantic City. Nevada has had over a century of legalized gambling; Atlantic City, New Jersey, has completed a decade of its operation,” Strate informs you. “Nevada's gaming industry has been its primary economic base for many years; Atlantic City's entry into gaming served as a possible solution to a social problem. Nevada's processes of legalized gaming, credit play, and the collection of gaming debts were developed over a period of 125 years; Atlantic City's new industry began with gaming, gaming credit, and gaming debt collection simultaneously in 1976 [via the New Jersey Casino Control Act] .” The irony here is that Atlantic City, being the younger venue, had or has a better system for handling debt collection than do the historic and traditional Las Vegas properties. Many of these properties were duplicated in New Jersey, so the dichotomy existed whereby New Jersey casinos could recoup debt while their Nevada counterparts could not. “It would seem logical that a "territory" which permitted gambling in the early 1800’s would have allowed the Nevada industry to collect its debts as any other legal enterprise. But it did not,” Strate says. Of course, this situation could not be allowed to continue and Strate outlines the evolution. New Jersey tactfully benefitted from Nevada’s experience. “The fundamental change in gaming debt collection came through the legislature as the judicial decisions had declared gaming debts uncollectable by either a patron or a casino,” Strate informs you. “Nevada enacted its gaming debt collection act in 1983, six years after New Jersey,” Strate points out. One of the most noteworthy paragraphs in the entire article is this: “The fundamental change in 1983, and probably the most significant change in the history of gaming in Nevada since the enactment of the Open Gaming Law of 1931, was to allow non-restricted gaming licensees* to recover gaming debts evidenced by a credit instrument. The new law incorporated previously litigated terms with a new one, credit instrument.” The term is legally definable and gives Nevada courts an avenue of due process.

Gambling on credit, considered a vice by some, is not judicially collectible based upon the Statute of Anne. This common law statute prevents the collection of gambling losses, unless expected by state statute. This article reviews and updates the findings of an unenforceability of gambling debt study conducted in 1989 just prior to the rapid expansion of gambling in the United States.

Tutkielma sai alkukipinän perinnän merkityksen korostumisesta yritysten välisessä luottokaupassa, tutkijan kiinnostuksesta aihetta kohtaan sekä tutkijan omasta perinnän alan työkokemuksesta. Tutkielma rakentui perinnän sekä luottokaupan käsitteiden ympärille ja sen tarkoituksena oli tutkia perinnän tehokkuuteen vaikuttavia tekijöitä. Tutkielmaa voidaan pitää käsiteanalyyttisena käsikirjamaisena teoksena, jonka empiirinen osio on toteutettu kvantitatiivisena tutkimuksena. Tutkielman teoreettisessa osassa tarkasteltiin ensin yleisellä tasolla perintäprosessiin liittyviä perinnän tehokkuuteen vaikuttavia tekijöitä, jonka jälkeen kvantitatiivisessa empiirisessä osiossa analysoitiin tutkielman kohdeyrityksen baltialaisten ja suomalaisten asiakasyritysten asiakaskohtaisten tekijöiden vaikutuksia perinnän tehokkuuteen. Tutkimuksessa havaittiin, että asiakasyritysten kotimaa sekä omavaraisuusaste vaikuttavat perinnän tehokkuuteen. Perintä oli tehottomampaa baltialaisilta asiakasyrityksiltä sekä asiakasyrityksiltä, joilla oli heikko omavaraisuusaste. Lisäksi havaittiin, että kohdeyrityksen eri toimialojen asiakasyritysten välillä oli eroja perinnän tehokkuudessa.

Pikavippi on nykykäsityksen mukaan vakuudeton, lyhytaikainen, euromääräisesti pienehkö luotto, joka hankitaan yleensä joko tekstiviestillä tai Internetissä täytettävällä hakemuksella. Luotto maksetaan hakijan tilille asiakkaan suostuttua luotontarjoajan ehtoihin luottotietojen tarkistuksen jälkeen. Tutkielmassa on selvitetty millainen oli lainsäädännöllinen lähtötilanne, kun pikavipit tulivat markkinoille. Lisäksi halusin selvittää lainsäätäjän toimia alaa kohtaan, sekä selvittää ovatko pikaluotot koronkiskontaa tai ovatko ne sitä joskus olleet. Tutkielma toteutettiin lainopillista ja de lege ferenda – menetelmiä käyttäen. Lainsäätäjä on tehnyt kaksi merkittävää lainmuutospakettia pikaluottoja kohtaan erityisesti kuluttajansuojan parantamiseksi. Pikaluotot eivät ole täyttäneet missään vaiheessa koronkiskonnan tunnusmerkistöä. Jos maksamattomat luotot päätyvät oikeuteen perittäviksi niin perintäkulut muodostuvat lain asettamien taulukkohintojen mukaisesti, vaikka kuluttajasta saattaa tuntua kohtuuttomalta maksaa suuria perintäkuluja. Mikäli pikaluotot kielletään, siirtynevät lyhytaikaisten pienluottojen markkinat ainakin osittain pimeille markkinoille tai tarjolle tulee lakia kiertäviä korvaavia lainatuotteita.

One of the most important measures to prevent wild forest fires is the use of prescribed and controlled burning actions as it reduce the fuel mass availability. The impact of these management activities on soil physical and chemical properties varies according to the type of both soil and vegetation. Decisions in forest management plans are often based on the results obtained from soil-monitoring campaigns. Those campaigns are often man-labor intensive and expensive. In this paper we have successfully used the multivariate statistical technique Robust Principal Analysis Compounds (ROBPCA) to investigate on the sampling procedure effectiveness for two different methodologies, in order to reflect on the possibility of simplifying and reduce the sampling collection process and its auxiliary laboratory analysis work towards a cost-effective and competent forest soil characterization.

The following report aims to present the internship developed under the Master in Legal Sciences Business in the Legal Affairs management of Caixa Geral de Depósitos S.A. Activities were developed in the field of Banking Law, focusing on the Special Revitalization Process. The aim of these activities was to promote the construction of a study that, apart from its doctrinal and jurisprudential research, also excels in the practical adequacy of the regime lectured. The revitalizing effectiveness of the Special Revitalization Process is erected in the Article 17-E, nº 1, which establishes a series of procedural – stand still effects - which aim to allow the debtor "breathing space", ie, a period during which creditors are prevented from setting up "actions for debt collection" against him, suspending the pending actions with identical purposes. Therefore, this report essentially studies these effects, considering "actions in debt collection" executive actions that are intended to recover a debt of any kind, including anticipatory precautionary procedures of an action of this nature. In addition, it is necessary to set boundaries temporally and subjectively to the standstill period, understanding that this period should be extended beyond the legally established period, in order to preserve the ratio of the process, concretely, until the recovery plan effects. In turn, we understand that the standstill effects only apply to the established material in connection with the debtor, remaining the rights of creditors unaffected over the ones of the guarantors and debtors.

The selective collection of municipal solid waste for recycling is a very complex and expensive process, where a major issue is to perform cost-efficient waste collection routes. Despite the abundance of commercially available software for fleet management, they often lack the capability to deal properly with sequencing problems and dynamic revision of plans and schedules during process execution. Our approach to achieve better solutions for the waste collection process is to model it as a vehicle routing problem, more specifically as a team orienteering problem where capacity constraints on the vehicles are considered, as well as time windows for the waste collection points and for the vehicles. The final model is called capacitated team orienteering problem with double time windows (CTOPdTW).We developed a genetic algorithm to solve routing problems in waste collection modelled as a CTOPdTW. The results achieved suggest possible reductions of logistic costs in selective waste collection.

Comprehensive approach study aimed understanding the reflections and contrasts between personal time and medical therapy protocol time in the life of a young woman with breast cancer. Addressed as a situational study and grounded in Beth’s life story about getting sick and dying of cancer at age 34, the study’s data collection process employed interviews, observation and medical record analysis. The construction of the analytic-synthetic box based on the chronology of Beth’s clinical progression, treatment phases and temporal perception of occurrences enabled us to point out a linear medical therapy protocol time identified by the diagnosis and treatment sequencing process. On the other hand, Beth’s experienced time was marked by simultaneous and non-linear events that generated suffering resulting from the disease. Such comprehension highlights the need for healthcare professionals to take into account the time experienced by the patient, thus providing an indispensable cancer therapeutic protocol with a personal character.
