The topic is white collar crime in its organizational form. The research question is why otherwise law-abiding people engage in wrongful behavior within legitimate organizations and what kinds of dynamics are involved in wrongful organizational processes. This is a theoretical inquiry the method of which is to bring together relevant literature on organizational behavior regardless of the branch of science. In addition to criminological and sociolegal writings, I mostly refer to works of social psychology and organization theory. At first, I discuss the terminological multiplicity related to organizational white collar crime. In conclusion from a critical analysis of the dominant terms and definitions, I argue for the concept of organizational wrongdoing. The approach of organizational wrongdoing captures unethical, illegal and criminal organizational behavior. Thus, it is not retricted by legislative categories but ethical reasoning. The approach aims at grasping a behavioral entity, and state law crimes do not constitute an ontology of behavior. In order to understand organizational wrongdoing, the dominant criminological theories applied to white collar crime are discussed. To a surprisingly large extent, they lack a sophisticated organizational perspective and do not offer viable frameworks for building a plausible theory of organizational white collar crime. In order to fill the gap, I incorporate the social psychological dynamics of organizational behavior and present several findings on collective behavior that criminological theorization must come to terms with. ------ This publication has been first presented and accepted as a master's thesis at the Faculty of Law, University of Turku. "IT'S THE ECONOMY STUPID", BUT CHARISMA MATTERS TOO: A DUAL PROCESS MODEL OF PRESIDENTIAL ELECTION OUTCOMES. ABSTRACT Because charisma is assumed to be an important determinant of effective leadership, the extent to which a presidential nominee is more charismatic than his opponent should be an important determinant of voter choices. We computed a composite measure of the rhetorical richness of acceptances speeches given by U.S. presidential candidates at their national party convention. We added this marker of charisma to Ray C. Fair's presidential vote-share equation (1978; 2009). We theorized that voters decide using psychological attribution (i.e., due to macroeconomics and incumbency) as well as inferential processes (i.e., due to leader charismatic behavior) when voting. Controlling for the macro-level variables and incumbency in the Fair model, our results indicated that difference between nominees' charisma is a significant determinant of electoral success, particularly in close elections. This extended model significantly improves the precision of the Fair model and correctly predicts 23 out of the last 24 U.S. presidential elections. Paper 2: IT CEO LEADERSHIP, CORPORATE SOCIAL AND FINANCIAL PERFORMANCE. ABSTRACT We investigated whether CEO leadership predicted corporate financial performance (CFP) and corporate social performance (CSP). Using longitudinal data on 258 CEOs from 117 firms across 19 countries and 10 industry sectors, we found that determinants of CEO leadership (i.e., implicit motives) significantly predicted both CFP and CSP. As expected, the most consistent positive predictor was Responsibility Disposition when interacting with n (need for) Power. n Achievement and n Affiliation were generally negatively related or unrelated to outcomes. CSP was positively related to accounting measures of CFP. Our findings suggest that executive leader characteristics have important consequences for corporate level outcomes. Paper 3. PUNISHING THE POWERFUL: ATTRIBUTIONS OF BLAME AND LEADERSHIP ABSTRACT We propose that individuals are more lenient in attributing blame to leaders than to nonleaders. We advance a motivational explanation building on the perspective of punishment and on system justification theory. We conducted two scenario experiments which supported our proposition. In study 1, wrongdoer leader status was negatively related to blame and the perceived seriousness of the wrongdoing. In study 2, controlling for the Big-Five personality factor and individual differences in moral evaluation (i.e., moral foundations), wrongdoer leader status was negatively related with desired severity of punishment, and fair punishments were perceived as more just for non-leaders than for leaders.

Cette thèse est une recherche pluridisciplinaire sur le concept du pardon interpersonnel. Elle cherche à circonscrire la portée et la dynamique du pardon, entre autres en répondant à la question Pourquoi pardonner ? Jusqu’à récemment on trouvait peu d’écrits sur le pardon. Mais les deux dernières décennies ont vu un foisonnement de travaux de recherche sur le sujet de la part de psychologues éveillés à ses bienfaits thérapeutiques. Parallèlement, des philosophes et des théologiens se sont aussi intéressés à la question et ont commencé à publier leurs réflexions. Deux hypothèses marquent le parcours de notre recherche. La première porte sur la signification de la deuxième partie de l’énoncé biblique en Luc 23, 34 « Père, pardonne-leur car ils ne savent pas ce qu’ils font ». Elle avance que le « motif de l’ignorance » que cette parole affirme a une portée universelle et soutient que l’offenseur est en état d’ignorance inconsciente lorsqu’il fait le mal. Le pardon des offenses serait donc le pardon de cette ignorance inconsciente. La seconde hypothèse conjecture que le pardon interpersonnel s’inscrit dans une dynamique spirituelle même s’il a quitté ses amarres religieuses. Nous avançons que la relation pardon-spiritualité est significative et que sa compréhension peut aider à mieux saisir l’essence d’un pardon devenu séculier et à en permettre l’éclosion. Pour établir la valeur de cette hypothèse, nous devons étudier la dynamique d’une démarche de pardon de même qu’à déterminer le statut actuel de la spiritualité. La thèse se divise en trois parties. La première partie expose la pensée d’auteurs significatifs dans chacune des principales disciplines concernées par le pardon : philosophie, théologie, psychologie et spiritualité. Il y est question d’offense pardonnable ou impardonnable, de pardon conditionnel ou inconditionnel, de corrélats du pardon comme l’oubli, la colère, la culpabilité, le repentir et des résultats d’études empiriques psychothérapeutiques sur le pardon. Cette première partie se termine par une réflexion sur la spiritualité de façon à voir dans quelle mesure le pardon devient une dynamique spirituelle. La deuxième partie est consacrée à l’examen de l’hypothèse concernant le sens et la portée du « car ils ne savent pas ce qu’ils font ». Dans un premier temps on fait appel à l’expertise exégétique pour situer l’authenticité et la portée de ce passage. Nous explorons ensuite la pensée philosophique à travers l’histoire pour comprendre le véritable sens du libre-arbitre et son impact sur la conception de la faute. La remise en cause philosophique du libre-arbitre nous ramènera à la thèse socratique selon laquelle « Nul n’est méchant volontairement ». La théorie mimétique de René Girard vient démontrer que les persécuteurs sont fondamentalement inconscients de ce qu’ils font et la théologienne Lytta Basset identifie le fantasme de la connaissance du bien et du mal comme accroissant cette ignorance qui s’ignore. La troisième partie de la thèse intègre les réflexions et découvertes des deux premières parties, et les situent dans un parcours qui va de l’impardonnable à la guérison, tout en les conceptualisant avec une matrice de verticalité et d’horizontalité qui schématise leurs interactions. Nous découvrons que si « car ils ne savent pas ce qu’ils font » fournit la réponse logique à la question Pourquoi pardonner ?, il existe aussi une deuxième voie qui conduit au pardon, l’amour. L’amour est la clé du pardon basé sur le message évangélique, alors que l’empathie est celle de l’approche psychothérapeutique. Enfin, la comparaison entre le « pardon psychothérapeutique » et le « pardon évangélique » nous fait conclure qu’il y a deux modes d’accès majeurs au pardon : la raison et l’amour.

It is in a way easier to imagine evil actions than we often suppose, but what it is thus relatively easy to do is not what we want to understand about evil. To argue for this conclusion I distinguish between imagining why someone did something and imagining how they could have done it, and I try to grasp partial understanding, in part by distinguishing different imaginative perspectives we can have on an act. When we do this we see an often unnoticed asymmetry: we do not put the same demands on our understanding of wrongdoing as on that of most everyday, morally acceptable, actions. Il est relativement facile d’imaginer des actes maléfiques, plus facile que ce que nous sommes prêts à supposer. Mais ce qui est ainsi facile à imaginer n’est pas ce que nous souhaitons comprendre à propos des actes maléfiques. Pour étayer cette conclusion, je distingue entre comprendre pourquoi quelqu'un fait ce qu'il fait et imaginer comment cette personne aurait fait une telle chose; j'essaie aussi de saisir ce qu'est la compréhension partielle, du moins en partie, en distinguant entre elles les différentes perspectives imaginaires d’un même acte. C’est ainsi qu’apparaît une asymétrie qui passe souvent inaperçue: nous n'imposons pas les mêmes exigences à l'égard de notre compréhension d’actes répréhensibles qu'à l’égard d’actions quotidiennes moralement acceptables.

Esta investigación se centra en la Fédération Internationale de Football Association (FIFA) como organización política. Intenta responder dos interrogantes primordiales: 1) ¿cómo la FIFA ha constituido el poder que tiene actualmente y, así, hacerse del monopolio indiscutido del fútbol? Y 2) ¿cómo ha cambiado en el tiempo la política interna de FIFA y su vínculo con la política internacional? Para lograr esto, se realiza un estudio histórico, basado principalmente en documentos, que intenta caracterizar y analizar los cambios de la organización en el tiempo. Se enfatizan las últimas dos presidencias de FIFA, de João Havelange y Joseph Blatter, como casos de estudio.

At criminal trial, we demand that those accused of criminal wrongdoing be presumed innocent until proven guilty beyond any reasonable doubt. What are the moral and/or political grounds of this demand? One popular and natural answer to this question focuses on the moral badness or wrongness of convicting and punishing innocent persons, which I call the direct moral grounding. In this essay, I suggest that this direct moral grounding, if accepted, may well have important ramifications for other areas of the criminal justice process, and in particular those parts in which we (through our legislatures and judges) decide how much punishment to distribute to guilty persons. If, as the direct moral grounding suggests, we should prefer under-punishment to over-punishment under conditions of uncertainty, due to the moral seriousness of errors which inappropriately punish persons, then we should also prefer erring on the side of under-punishment when considering how much to punish those who may justly be punished. Some objections to this line of thinking are considered.

Though many of those who decided to report wrongdoings in their organizations were able to tell their stories (e.g. Bamford, 2014, Armenakis 2004), it is fair to say that there is still much left to uncover. The paper aims to contribute to the literature in three ways. First, it provides preliminary evidence that the wrongdoing linked with individual financial loss leads to higher whistleblowing rate. Secondly, it shows how the experience of anger is related to the higher likelihood to report the wrongdoer but only if the wrongful act is perceived as a cause of one’s financial loss. Finally, the paper establishes first steps for the future development of an experimental procedure that would enable to predict, and measure whistleblowing behavior in the lab environment.

Information and communication technology have contributed to the realization of the ideals of citizen participation in public decisions, as well as to help in fighting corruption and wrongdoing in government. After all, democracy entails the right to information. The government, in many spheres, has encouraged the responsible use of the internet. Conduct manuals and standards have been published for public segments to direct the responsible use of these tools by their agents. This article aims to determine whether the manuals comply with the principles of digital democracy. Conduct manuals were analyzed in digital media from four Brazilian public organizations: Embrapa; Department of Communication of the Federal Government; Judiciary and Health Department of the Federal District. As a methodology, content analysis, based on criteria focused on transparency and encouraging civic engagement was used.

This study examines the effects of the source of whistle-blowing allegations and potential for allegations to trigger concerns about reputation threats on Chief Audit Executives’ handling of whistle-blowing allegations. The participants for this study, 79 Chief Audit Executives (CAEs) and deputy CAEs, evaluated whistle-blowing reports related to financial reporting malfeasance that were received from either an anonymous or a non-anonymous source. The whistle-blowing reports alleged that the wrongdoing resulted from either the exploitation of substantial weaknesses in internal controls (suggesting higher responsibility of the CAE and internal audit) or the circumvention of internal controls (suggesting lower responsibility of the CAE or internal audit). Findings indicate that CAEs believe anonymous whistle-blowing reports to be significantly less credible than non-anonymous reports. Although CAEs assessed lower credibility ratings for the reports alleging wrongdoing by the exploitation of substantial weaknesses in internal controls, they allocated more resources to investigating these allegations.
