This article examines recent research on risk assessment and probation practice in Ireland and relates the findings to the ongoing debate regarding risk management practices in probation. The piece discusses current theoretical arguments on the influence of risk in criminal justice and outlines the impact of risk discourse on probation practice in Ireland and England and Wales. Using a mix of qualitative and quantitative methods, Irish probation officers’ attitudes are examined in order to highlight key issues facing probation officers when making risk decisions. These findings are compared and contrasted to other research results from England and Wales. All the conclusions identify both positive and negative consequences of adopting risk tools and point to the continued salience of clinical judgment over actuarial methods of risk assessment. It is argued that the research highlights the role of ‘resistance’ by criminal justice professionals in mediating the effects of the ‘new penology’ at the level of implementation. The idea of resistance holds particular relevance for probation practice in Ireland where professional discretion is maintained within the National Standards framework. Despite this, to date there has been an uncritical approach taken to risk assessment which may ignore the dangers of risk inflation/deflation and the need to take into account local factors in assessing risk of reoffending

The purpose of this study was to develop knowledge domains and an instrument to assess probation officers’ knowledge levels of offenders with intellectual disabilities by utilizing a synthesis of subject matter analysis technique and a comprehensive review of literature. Results can be used to develop effective training for probation officers.

This article examines the influence of research on social work practice, with special reference to probation, and argues that in order to maintain their well-earned reputation as providers of defensible alternatives to custody, probation officers need to attend more carefully to the findings of research and to review their practice accordingly. Further, it is argued that managers need to consider the content of practice as well as its structure, if they are to meet the challenges of the present decade. These discussions are placed in the context of an applied research project on one probation team's attempt to adopt a more structured and empirically-based approach to the setting up of a new groupwork programme.

L’objectif de ce mémoire est de décrire et expliquer le traitement des jeunes filles traduites devant la Cour des jeunes délinquants de Montréal durant toute la période de son existence, soit de 1912 à 1950. Une analyse statistique a tout d’abord été utilisée sur un échantillon de 1 465 jeunes filles pour lesquelles nous avions des données quantitatives provenant du plumitif de la cour. Une analyse documentaire a ensuite été utilisée sur un sous-échantillon de 126 mineures pour lesquelles nous avions accès aux divers documents contenus dans leur dossier judiciaire. L’analyse met particulièrement en évidence la différence d’application de la loi en fonction du sexe des mineurs traduits devant la cour. Les jeunes filles sont poursuivies pour des motifs différents de ceux pour lesquels on poursuit les garçons : elles sont particulièrement poursuivies pour des infractions spécifiques aux mineurs telles que l’incorrigibilité, les infractions à caractère sexuel, la désertion ou la protection. Les garçons, quant à eux, sont davantage poursuivis pour des infractions prévues au Code criminel (notamment le vol). Les mineures sont plus souvent amenées devant la cour par leurs parents plutôt que par les officiers de la cour et se voient imposer des mesures différentes de celles qu’on impose aux garçons pour une même infraction. Le placement est ainsi plus fréquemment utilisé chez les filles que chez les garçons et la probation plus fréquemment utilisée chez ces derniers. La définition de ce qui pose problème chez ces mineures et les solutions souhaitables pour y remédier varient en fonction des différents acteurs (les agents de probation, les officiers de la cour, les parents et les mineures elles-mêmes).

La thèse délaisse l’étude des biais, des erreurs et des influences externes qui modulent les décisions de justice et formule l’hypothèse que les individus, confrontés à un dilemme normatif (quelle serait la juste peine?), manifestent un souci de justice qu’il est pertinent d’analyser en lui-même. Les résultats de cette thèse indiquent qu’une proportion appréciable des choix et des jugements des citoyens et des acteurs judiciaires interrogés témoignent, en raison de leur cohérence interne et de leur modération, d’un souci manifeste de justice. Les données de la thèse s’appuient sur un sondage sentenciel dans lequel on demandait à des répondants du public (n=297), mais aussi à un échantillon d’acteurs judiciaires (n=235), de prendre des décisions de détermination pénale dans trois histoires de cas bien détaillées. La thèse s’intéresse à la détermination de la juste peine, laquelle incorpore trois prises de décision distinctes. Le premier chapitre de la thèse s’attarde à la qualité des échelles individuelles de sévérité des peines qui peuvent être infligées pour sanctionner un délinquant reconnu coupable d’actes criminels. Les résultats indiquent que les citoyens, tous comme les acteurs judiciaires, n’utilisent pas la même métrique pour statuer sur la sévérité des peines, mais que certains d’entre eux, font usage d’une métrique pénale plus cohérente et plus raisonnable que d’autres. Un test décisif pour jauger de la valeur d’une métrique est son aptitude à établir des équivalences pénales entre les peines de prison, de probation, de travaux communautaires et d’amendes. Le deuxième chapitre s’attarde à la qualité des choix sentenciels des citoyens et des acteurs judiciaires. Deux critères sont utilisés pour distinguer les sentences les plus justes : 1) le critère de proportionnalité ou de cohérence interne (les sentences données sont-elles toujours proportionnelles à la gravité de l’infraction commise ?); 2) le critère de modération ou de cohérence externe (la sentence donnée peut-elle rallier le plus grand nombre de points de vue?). Les deux critères sont importants parce qu’ils contribuent tous deux à réduire la marge d’incertitude du dilemme sentenciel. Le troisième chapitre prend acte que toute sentence fera possiblement l’objet d’un aménagement subséquent. Les formes les plus manifestes d’aménagement pénal sont régies par l’octroi d’une libération conditionnelle qui écourte la durée de peine qui sera purgée en prison. Certains acteurs judiciaires choisiront de tenir compte de cette libération anticipée en gonflant leur sentence, alors que d’autres se refuseront à le faire. Le dernier chapitre s’attarde aux raisons qui motivent leurs choix.

Ce mémoire a pour objectif de comprendre l’expérience de travail des agents œuvrant en réinsertion sociale auprès de condamnés provinciaux en collectivité au Québec. Plus précisément, cette recherche souhaite saisir le rôle exercé par ces agents, dans un contexte où ils exercent un double mandat de sécurité publique et de réinsertion sociale. L’étude tente aussi de mettre en lumière leurs pratiques de travail, inscrites dans une logique de gestion efficace des risques. Enfin, ce mémoire vise à comprendre la place qu’occupe la réinsertion sociale dans le cadre de leur travail. Pour ce faire, l’approche qualitative a permis de mener quinze (15) entretiens auprès d’agents de probation et d’intervenants issus du secteur communautaire responsables de la surveillance de justiciables provinciaux en collectivité. Deux (2) thèmes principaux émergent de ces entrevues. D’une part, Le travail est décrit par les participants en regard du double rôle exercé, des responsabilités légales et cliniques qui leur incombent, et de l’intervention centrée sur le risque et la réinsertion sociale auprès des contrevenants. D’autre part, Le contexte de travail réfère au partenariat établi entre les intervenants, au recours aux outils actuariels, ainsi qu’aux instances modulant leurs pratiques de travail : les médias, la Commission québécoise des libérations conditionnelles et les Services correctionnels du Québec. Il ressort de nos analyses que la sécurité publique par la gestion efficace des risques se manifeste par une forme de rationalisation des pratiques de travail et par l’intégration d’un rôle de contrôle. Il appert cependant que ces deux (2) aspects sont motivés avant tout par le désir de venir en aide à la population contrevenante. Il résulte finalement de l’étude que la réinsertion sociale ne constitue qu’un objectif de l’intervention parmi d’autres. Les participants doivent jongler avec ces diverses finalités afin de s’ajuster à l’acteur principal de leur travail : le contrevenant.

Introdução: Os trabalhos sobre correlatos psicológicos em Técnicos Superiores de Reinserção Social (TSRS) no nosso país são inexistentes. São nossos objetivos analisar os níveis de sintomas depressivos e ansiosos, stresse, coping e resiliência numa amostra de TSRS; explorar diferenças nestas variáveis por sexo, estado civil, Delegação regional e tipo de competências das equipas de reinserção social; explorar associações entre todas as variáveis referidas nesta amostra (entre si e com a variável sociodemográfica idade e as variáveis profissionais tempo de serviço e horas de trabalho semanal). Metodologia: 89 TSRS (sexo feminino, n = 67; 75,3%), com idades entre os 27 e os 61 anos (M = 47,4; DP = 7,10) preencheram um protocolo composto por questões sociodemográficas e profissionais, a Depression, Anxiety and Stress Scale, o Brief COPE e a Escala para avaliar as competências na área da Resiliência. Resultados: As mulheres apresentaram níveis maiores de Suporte Emocional e Instrumental comparativamente aos homens. Os profissionais da Delegação do Centro apresentaram pontuação mais elevada de Resiliência vs. da Delegação do Norte e os da Delegação do Norte maiores níveis de Stresse vs. os da Delegação do Sul e Ilhas. Os profissionais com competência mista apresentaram maiores níveis de Ansiedade vs. com competência específica. Encontrámos associações significativas (na amostra total) entre a Depressão e a Negação e o Uso de Substâncias. No sexo masculino o uso de Suporte Emocional e Instrumental associaram-se à Depressão e à Ansiedade. De uma forma geral, em todas as Delegações (consideradas separadamente), maiores níveis de Resiliência associaram-se a estratégias mais positivas de coping (e.g. Coping ativo) e maiores níveis de Depressão, Ansiedade e Stresse a níveis menores de estratégias positivas de coping (e.g. Aceitação) e a níveis maiores de estratégias negativas de coping (e.g. Uso de substâncias). Os técnicos quer de equipas com competência mista quer de equipas com competência específica, com níveis maiores de Ansiedade, apresentaram níveis maiores de estratégias de coping negativas (e.g. Negação). Discussão: Este estudo revelou existirem algumas diferenças por sexo nos TSRS e apresentou dados importantes sobre os construtos psicológicos dos TSRS de diferentes Delegações e de equipas com diferentes competências, apontando possíveis aspetos a considerar num trabalho de intervenção com estes profissionais. Tal como esperado, no geral, maiores níveis de resiliência associaram-se, como noutros profissionais, a estratégias mais positivas de coping e maiores níveis de sintomas a estratégias mais negativas de coping. / Introduction: Studies on psychological correlates on Probation Officers (TSRS) in our country are nonexistent. Our purposes are to analyze the levels of depressive and anxiety symptoms, stress, coping and resilience in a sample of TSRS; to explore differences in these variables by gender, marital status, Regional Delegation and type of responsibility of local organic units; to explore associations between all variables mentioned in this sample (among themselves and with the sociodemographic variable age and the professional variables years of service and weekly hours of work"). Methodology: 89 TSRS (females, n = 67, 75.3 %), aged between 27 and 61 years (M = 47.4, SD = 7.10) completed a protocol consisting of sociodemographic and professional questions, the Depression, Anxiety and Stress Scale, the Brief COPE Scale and the Scale to assess resilience skills. Results: Women had higher levels on Use of Instrumental and Emotional Social Support compared to men. The professionals of the Delegation of the Centre had higher scores on Resilience vs. professionals of the Delegation of the North and the North Delegation had higher levels of Stress vs. the Delegation of the South and Islands. The professionals with mixed competence had higher levels of Anxiety vs. those with specific competence. We found significant associations (in the total sample) between Depression, Denial and Substances Use. In males, the use of Emotional Social Support and Instrumental Support was associated with Depression and Anxiety. Overall, in all Delegations (considered separately), higher levels of Resilience were associated with more positive coping strategies (e.g., Active Coping) and higher levels of Depression, Anxiety and Stress with lower levels of positive coping strategies ( e.g. Acceptance) and higher levels of negative coping strategies (e.g. Substances Use). TSRS with higher levels of Anxiety, either in teams of mixed and specific competence, had higher levels of negative coping strategies (e.g. Denial). Discussion: This study revealed that there were some gender differences in TSRS and provided important data on the psychological constructs of TSRS of different Delegations and different types of organic units, pointing to possible issues to be addressed in an intervention work with these professionals. As expected, in general, higher levels of Resilience were associated, as in other professionals, with more positive coping strategies and higher levels of symptoms with more negative coping strategies.

The conflict in Northern Ireland known as the Troubles presented numerous challenges for the administration of traditional forms of criminal justice and has led to a variety of adaptations that have been widely discussed in the literature in criminology and transitional justice. The role of Northern Ireland's probation service is often forgotten or ignored in such analyses. This brief article is intended to begin to fill this gap by exploring how the Troubles impacted on probation practice during the Conflict and beyond. In particular, we argue that the 'neutrality stance' taken by probation in the mid-1970s, when officers decided to cease mandated work with individuals charged with 'politically-motivated' offences, has had a lasting impact on the identity and role of probation in the region. The deep immersion into, and engagement with, marginalised communities during this time, facilitated by this neutrality stance, has overlooked implications for probation practice more widely in the United Kingdom and abroad.

The relationship between job characteristics (e.g., job demands, social support) and work-related outcomes (e.g., turnover intentions, job performance) is assumed to be mediated by strains (e.g., work-related well-being, psychological strain). However, evidence suggests this association will be stronger for work-related strains than broader measures of overall psychological well-being. The primary aim of this study was to identify whether work and non-work related strains differ significantly in their ability to mediate between job characteristics and work-related outcomes. Perceptions of job characteristics, strain, turnover intentions and job performance were collected via a self-report survey from 2,588 Australian police officers. All job characteristics (job demands, job control, supervisor support and colleague support) were significant predictors of both job performance and turnover intentions, with the exception of job demands, which was not a significant predictor of turnover intentions. Both work and non-work related strains were significant predictors of turnover intentions and job performance. Strains were collectively significant in mediating between job characteristics and work-related outcomes, except in the case of job demands and job performance. The indirect effects of job characteristics on work-related outcomes were primarily through officers’ work-related enthusiasm. The relative importance of work-related enthusiasm in mediating between job characteristics and work-related outcomes offers some support for previous research suggesting stronger associations between work-related constructs. Future research should examine whether there are substantial differences in the explanatory power of work-related enthusiasm and a popular related construct, work engagement.

With the growth of service industry occupations, managing emotions at work has increased as a topic of interest among scholars and practitioners in organisational behaviour and human resource management(Grandey, 2000). Emotional dissonance occurs when there is discrepancy between organisational sanctioned emotions and actual emotions of employees(Zapf, Vogt, Seifert, Mertini, & Isic, 1999). This discrepancy can be associated with significant levels of psychological ill-health (Zapf, Seifert, Schmutte, Mertini, & Holz, 2001). Policing is consistently ranked among the top five stressful/high-risk occupations (e.g. Coman, Evans, Stanley, & Burrows, 1991). Police officers act as the front-line contact when dealing directly with community members; they are expected to be social workers, teachers, role models, and counsellors. Operational police officers are often required to suppress their actual emotions during their work, in order to perform their job to formally designated procedures and standards.
