The dissertation has by objective describe the administrative activity of regulation exercised by independent regulatory agencies, observing that this activity was already done before this structures creation, however, after a really deep administrative reform that had as objective built a Public Administration with more efficiency, it passed to be done with some own peculiarities of these new structures of regulation. The work gave especial attention to what concern the conflicts of normative competency that really often happen between ANP (Agência Nacional do Petróleo, Gás Natural e Biocombustíveis) and the legislatives organs of the Republic Federative of Brazil, because energetic area has unbelievable mater to any country, and the fact of some juridical norm be against the law and be accepted is very dangerous, it affronts the constitutional principle of the legality e may put in risk the democratic Estate of law, them, regulatory dogmatic must be scientifically knows, and developed, thought and especially there are so many doctrinaires divergences about regulation constitutionality. As a theorist point, the investigation got the Logical nocontradiction principle, according Hans Kelsen and Lourival Vilanova thought, doing a philosophical reflection about the system of positive law, in which there are many antinomies, or conflicts of norms, what include the conflicts of the administrative acts expedited by ANP and the legislation of the brazilian regulatory Estate. For a better understanding and exemplify some perplexities treated by the doctrinaire angle, this work did a lucubration about a possibility of a normative conflict between a ANP resolution and the municipal legislation in a specific case, also, brought several jurisprudences for the brazilians courts of justice, that confirm the empiric existence of normative conflicts among ANP s administrative norms and federal legislation. Finally, concludes observing that the regulation is not a legislative competency delegation to regulatory agencies, is just a new exercise of the administrative function, it is a technical specialization of the public administration, that using this know-how can acting with more efficiency, however the normative power of regulatory agencies must respect the empire of law, so in this terms, the dissertation suggests the ponderation of the constitutionals principles of efficiency and legality how form to harmonizing the democratic legitimate inherent to legal norm supremacy, with the perspective of an efficient economic and institutional development

O trabalho aqui desenvolvido tem como objetivos descrever o empreendimento acompanhado durante o estágio, relatar as tarefas realizadas no contexto do estágio e por fim desenvolver um tema adequado ao ramo de Mestrado. Primeiro é apresentado o empreendimento acompanhado durante o estágio. O empreendimento acompanhado foi do Hotel Golden Tulip em Águeda, constituído por um edifício principal e um edifício anexo destinado a spa. São referidas as soluções construtivas, os equipamentos e os serviços que irá proporcionar aos seus utilizadores. Seguidamente são relatadas as tarefas realizadas no contexto do estágio, relacionadas com o acompanhamento da construção do hotel. Estas tarefas foram diversas, desde a direção até à coordenação de segurança em obra. Por último é desenvolvido o tema “Estudo e avaliação de princípios de sustentabilidade de um edifício”, que é aplicado ao edifício principal do hotel. Este tema procura estudar e avaliar soluções aplicadas no edifício, desde soluções construtivas a equipamentos, de forma a propor melhorias ao seu desempenho e a retirada das respetivas conclusões.

The crisis that affected the capitalist states during the last decade of the 20th century, put an end to the period of greatest expansion of the state, demanding alterations that brought, especially in economic terms, the ideals of the liberal state. The main goal of these changes was to optimize the administration of the public service by introducing into it more efficiency, transparency, and morality because the state had shown to be incapable of attending the demands of the society and its way of doing was inefficient and did not reach out to the public interest. In Brazil, like in other part of the world, recent scandals of corruption and misuse of public funds put in doubt the efficiency of the financial control system. Like any other political system Brazil has a complex set of external and internal control, institutions that work to prevent misuse of public funds and identify responsibilities if bad use occurred. All these elements highlight the mechanisms of control of the public administration, which came to be seen as essential instruments for the improvement of the management of the public resources, targeting the collective interest. Therefore, along with the traditional mechanisms of power suppression, such as the system of checks and balances, social control arises. This, when used together with the monitoring exercised by public inspection agencies, is defined as horizontal accountability activated by civil society, in which citizens and institutions gather efforts in order to promote a more effective charge of responsibility from public agents and politicians in case of misconducts. This study aimed to identify the opportunities and limitations of social control exercised by the complaint under the TCE-RJ. The results point to the need to develop measures to guarantee the anonymity of denouncers, to simplify the forms of access the TCE-RJ and to improve information spread to the citizen.

We had as the problem of analysis in this research: what are the assumptions, principles and general content that based the Sistema Nacional de Avaliação da Educação Superior (SINAES). We started from the hypothesis that the general content of SINAES is essentially based on the assumptions and principles of a control/regulatory perspective of evaluation and a summative epistemology, objectivist and quantitativist, constituted by members who prioritize testing and classification of courses and institutions based on market values. The overall goal was to make a political evaluation of SINAES and the specific objectives were: a) apply the concepts of politics evaluation and meta-evaluation, b) identify the role of international organizations in education reform in the 1990s and its impact on superior education in Brazil c) redeem the concept of evaluation, especially in the field of studies in education; and d) investigate the evaluation policies of Brazilian superior education leading to SINAES. As for the technical procedures for collecting and analyzing data, the research was made with bibliography and documents, considering that it was developed by bibliographic sources and official publications. It was developed by crossing sources: texts or documents remitted to others; it was also concentrated: on the role of international organizations in educational and State reforms (in the 1990s); on the policies of evaluation of the Brazilian superior education (1980s and 1990s); on the proposal of the Comissão Especial de Avaliação (CEA); on the Law No. 10.861/2004; on the documents of CONAES; on the Decree No. 5.773/2006, and the MEC Regulatory Ordinances No. 4/2008 and No. 12/2008. It did not stop in the so called purely technical aspects, but in the ideological field itself. The research found that international organizations, notably the World Bank, played a political, intellectual and financial role determinant to the field of education, a fact that reflects in the legal framework. It was also found that the politics of evaluation of the superior education is historically marked by conflict, represented by two distinct perspectives of different natures and emphases. On one hand, the focus is on control / regulation, favoring efficiency, productivity and competitiveness benchmarking and prioritizing the punctual performance and measurement. On the other, it seeks to transform academic perspective in primarily formative / emancipatory, in order to support more institutional improvement. It was concluded that the CEA presented a conception evaluation predominantly formative and emancipatory, which emphasized the idea of system, centered around the institution and repudiated the rankings practices. In the post-formulation period, however, some of its principles were fragmenting and, gradually, the institution was giving way to the courses and the Exame Nacional de Desempenho de Estudantes (ENADE) grew in prominence. With the creation of the Conceito Preliminar de Cursos superiores (CPC) and of the Índice Geral de Cursos da Instituição de Educação Superior (IGC), it was redemeed the practice of evaluation as measurement and control, under the principles of efficiency and productivity. So, SINAES that seemed like a progressive evaluation method has assumed a setting that close resembles the Exame Nacional de Cursos (ENC-Provão). PETROBRAS, a Brazilian oil company, follows principles of public administration and from the Constitutional Amendment 9/95 in Brazil began to compete with other companies with the flexibility of the oil monopoly. In this new model started to use the simplified procedure for bidding so that could compete on equal terms. The ordinance that adopted a simplified procedure for bidding has been the subject of some criticism and lawsuits especially under the Court of Audit and the Supreme Court in Brazil. The analysis of their constitutionality, and the possibility of their use by other group companies is the theme of this work, and for this purpose, permeates through the notions of judicial review in the Brazilian law on the stage of law and economics analysis of the norm, and the principles applicable to PETROBRAS and the devices most frequently asked about the implementation of 2745/98 Decree. For this, the basic issue that should be investigated further is the regulatory power of the Federal Executive and the delegation of powers within the legislature and its conformation to the constitutional regency

Esta pesquisa objetiva buscar parâmetros que permitam avaliar a eficiência relativa de uma instituição, assim considerada a administração pública direta, de forma a subsidiar as decisões do gestor atendendo ao princípio da eficiência insculpido no artigo 37, caput, da Constituição Federal, considerado o tema oportuno, haja vista a tramitação do projeto de reforma do Judiciário, reforma esta que não pode desconsiderar os princípios que regem a atuação do gestor público, entre eles o da eficiência. O objetivo central da pesquisa, então, foi a estruturação de um modelo de avaliação da eficiência relativa das Varas do Trabalho no Paraná, desdobrado em objetivos específicos. Para alcance de tais objetivos foi adotado o método de pesquisa operacional e, na busca da solução, optou-se pelo modelo matemático oferecido pela DEA – Análise Envoltória de Dados, mais as técnicas como a TGN – Técnica Grupo Nominal, combinada com a de brainstorming e o Método de Análise Hierárquica, para refinamento dos dados obtidos, num total de 14h de reunião, divididas em sete encontros, um a cada semana, com o Corregedor e ex-corregedores da Justiça do Trabalho no Paraná. Os resultados finais foram confirmados, ainda que tenham surpreendido aos profissionais da instituição onde se validou o modelo, através de entrevista semi-estruturada, ficando patente, entre outras situações, a de que o gestor público não se socorre de técnicas de gestão e, em muitas situações, em face do princípio da estrita legalidade, vê -se constrangido na ação em busca de melhor eficiência.

No presente trabalho apresenta-se um conceito de habitação, aplicado a uma casa do tipo Bungalow que alia a arquitetura, clima, e energias renováveis (Produção fotovoltaica e eólica), denominado Green Bungalow, para um agregado familiar de 3 pessoas. Para o efeito foram analisados e estudados princípios de arquitetura bioclimática, considerando e potencializando as condições climáticas existentes no local onde o conceito foi aplicado. Foram igualmente otimizados os respetivos consumos energéticos e construídos os respetivos diagramas de carga. São propostas soluções técnicas para a alimentação da carga dimensionada para o Green Bungalow para funcionamento em sistema isolado e ligado à rede elétrica de energia. Para averiguar a racionalidade económica do investimento teve-se em consideração os aspetos legislativos, tarifas e taxas em vigor (2011) respeitantes à microprodução. Efetuou-se uma análise de sensibilidade que, tendo por base uma solução técnica dimensionada para o consumo de 1890 kWh/ano, considerou os seguintes cenários: • Sensibilidade a diferentes níveis de consumo – 4000 kWh/ano e 6000 kWh/ano; • Sensibilidade a diferentes níveis de geração; • Sensibilidade a valores de custo do equipamento considerado para cada solução técnica exequível. Conclui-se que o conceito Green Bungalow é uma boa escolha do ponto de vista técnico e em termos ambientais. Da simulação da microprodução do caso de estudo comprovou-se que, para o atual enquadramento tarifário e custo de equipamento não existe viabilidade económica, sendo viável apenas para cenários de consumo muito elevados. Nesse cenário a tecnologia fotovoltaica de produção de energia apresentou-se a mais rentável em todas as simulações.
