The thriving and well-established field of Law and Society (also referred to as Socio-legal Studies) has diverse methodological influences; it draws on social-scientific and arts-based methods. The approach of scholars researching and teaching in the field often crosses disciplinary borders, but, broadly speaking, Law and Society scholarship goes behind formalism to investigate how and why law operates, or does not operate as intended, in society. By exploring law’s connections with broader social and political forces—both domestic and international—scholars gain valuable perspectives on ideology, culture, identity, and social life. Law and Society scholarship considers both the law in contexts, as well as contexts in law.
Law and Society flourishes today, perhaps as never before. Este trabajo pretende ser una reflexión sobre cómo dos profesiones que, a pesar de compartir una base común, en el mundo académico aparecen a menudo separadas por determidas competencias bien definidas y divergentes entre sí. No obstante, ambas pueden converger en la figura del llamado traductor e intérprete jurado. Esta realidad es absolutamente tangible en la provincia de Málaga, donde nuestro mercado local cuenta con una amplia presencia de extranjeros que no tiene demasiados problemas para comunicarse en ciertos contextos, pero sí cuando hay trámites legales o administrativos, en los que interviene el traductor jurado, que cumple las funciones simultáneas de traductor e intérprete. Por último, el trabajo finaliza con una revisión de qué respuesta damos a nivel local a esta heterogeneidad.

In recent years, the high percentage of lawyers in Portugal became a controversial issue. As a large number of law graduates have been competing for admission at the Bar, this trend is creating new challenges to the profession, with important resonances in the Bar admission policy. The purpose of this presentation is to illustrate the progress made by women in legal professions, in Portugal, over the last decades. In order to contextualize our analysis, we begin with an overview of the position of women in the labor market and then focus on the legal professions. Firstly, the increasing presence of women in different segments of the legal field is analyzed by means of a statistical approach. Afterwards, we draw a critical analysis highlighting the bearing of these developments and deconstructing their meaning in terms of career patterns, remuneration and professional status. Our analysis of contemporary official data on legal professions reveals that even though women are occupying a growing number of positions in private practice, they earn lower salaries, have lower job satisfaction and have a more critical reasoning towards the public image of lawyers. Concerning magistrates, women working in superior courts continue to be underrepresented. Overall, we conclude that the increasing integration of women in legal professions is not straightforward, and there are still many aspects that need to be addressed the private and public sector.

This article discusses the role of EU anti-discrimination law in challenging EU anti-crisis measures from a critical legal studies perspective. Critical legal scholarship is defined through its challenge of ‘lex’ through the vision of ‘ius’ and its critical links with social movements. EU anti-discrimination law attracts critique for constituting a compartmentalised socio-legal field, which prevents justice for those at intersections of inequalities. By defining as the aim of anti-discrimination law the combat of disadvantage resulting from ascribed otherness around the nodes sex/gender, race/ethnicity, and disability, the article suggests a convincing normative vision suitable to de-compartmentalise the field and adequately address intersectionality. This critical legal perspective on intersectionality differs from its sociological counterparts by omitting class as a category. The article demonstrates that this distinction is necessary for EU anti-discrimination law to maintain its critical edge.

This paper discusses the growing attention that, over the last decades, has been given to the administrative procedure in Administrative Law, as it also highlights the procedures which are in tune with the new trappings of this legal field. It focuses on the sanctioning competence of regulatory agencies, notably what concerns the procedural guide that conditions its exercise. It aims at gathering varied elements, many times dispersed over the legal system, so it is possible to list, with a satisfactory degree of detail, the procedural constitutional guidelines which are indispensable to the sanctioning of private entities through punitive action by regulatory agencies. It highlights the due legal process clause, for the abundance of the protective set there is around it, as a guiding constitutional principle for the application of sanctions by regulatory agencies. It examines the repercussion of the constitutional principle of the due legal process on Administrative Law, focusing on the most relevant principles on which the first unfolds itself. It analyzes, in light of the due legal process principle, the sanctioning administrative procedure developed in regulatory agencies. In conclusion, it is asserted that there is no room, in the Brazilian legal system as a whole, for sanctions to be applied summarily; that there reigns, in our system, an absolute presumption, dictated by the Constitution, that only through regular procedures can the best and fairest decision, concerning cases in which the rights of private parties could be affected, be taken by the public administration; that, respecting the principle of the right to a fair hearing, it is indispensable that there be motivation of a decision that imposes a sanction; that there should be, in homage to the principle of full defense and for the need to preserve the autonomy of the regulatory party, an appeal court in every agency; that the principles listed in the federal law No. 9.784/1999 should be mandatorily monitored by the agencies, for this is the only alternative consistent with the Constitution

Esta dissertação, ao tomar como objeto de pesquisa a Sociedade Brasileira de Direito Aeronáutico (SBDA), tendo por recorte cronológico os anos entre 1950 e 1965, pretende trazer para a análise histórica mais um elemento no auxílio à compreensão do processo de formação do Estado brasileiro no cerne de um projeto de desenvolvimento capitalista de matizes nacionalistas envolvendo infraestrutura, industrialização, ciência e tecnologia, inclusive a modernização das Forças Armadas, no qual a reorganização das incumbências das esferas pública e privada transpassada pela expansão tanto das atividades de regulamentação quanto dos órgãos e agências estatais conduziu a uma ampla institucionalização dos setores econômicos por parte do governo, no caso específico deste estudo o ramo Aeronáutico. A SBDA funcionou como articuladora de interesses entre a sociedade política (Ministério da Aeronáutica) e a sociedade civil (empresas e sindicatos), exercendo desta maneira no parelho estatal um papel que a insere na aplicação do conceito de Estado gramsciano. A formulação de um campo jurídico no Brasil, mediante a perspectiva de análise de Pierre Bourdieu relativa ao campo intelectual, integra a trajetória de luta da SBDA pela autonomia do Direito Aeronáutico, agindo como organizadora das demandas provenientes deste setor específico de atividades.

Breast region measurements are important for research, but they may also become significant in the legal field as a quantitative tool for preoperative and postoperative evaluation. Direct anthropometric measurements can be taken in clinical practice. the aim of this study was to compare direct breast anthropometric measurements taken with a tape measure and a compass.Forty women, aged 18-60 years, were evaluated. They had 14 anatomical landmarks marked on the breast region and arms. the union of these points formed eight linear segments and one angle for each side of the body. the volunteers were evaluated by direct anthropometry in a standardized way, using a tape measure and a compass.Differences were found between the tape measure and the compass measurements for all segments analyzed (p > 0.05).Measurements obtained by tape measure and compass are not identical. Euthanasia, especially the active one, has always been an extremely discussed subject, which goes further pure dogmatics and transcends the strictly legal field. A reflection about such issue makes us re-think on what it implies for all the involved without ever loosing sight of the fact that admitting a legalization is, in a legal system as ours, to admit the lack of punishment of an homicide act or an assistance to suicide. However, burying in mind the foreign experiences, isn’t there a possibility of working on a path that respects both the basis of our legal system and the rest of the interests involved? And what interests would those be? How to admit such a path? Based on what assumptions? The present study proposes a discovery of paths and not the search for dead ends, creating definitive answers. The purpose of this dissertation is to explore the existing structure of the Portuguese legal system on these matters, in a path that is until now mostly in favour of punishment, based on homicide or assisted suicide crimes. Along with the Portuguese dynamic, we want to analyse legal systems that opted by decriminalization and, based on those experiences, shared with our legal culture, scan the viability of a decriminalization procedure. What paths would be viable for such a decriminalization in Portuguese criminal territory? The scope is only to open the eyes of who always wanted to keep them shut, or to who just never tried to open them, because at the end of the day it will always be a discussion that we want to keep light up, since that what we are here discussing is life. We want discussion, not imposition.

A presente dissertação analisará a persistente dinâmica da Petróleo Brasileiro S.A. – Petrobras – no arranjo institucional brasileiro. O objetivo é identificar se essa permanência foi acompanhada de mudanças na estrutura macro e microjurídica da empresa estatal que promoveram a sua adaptação às alterações da relação Estado e mercado promovidas por reformas institucionais. O trabalho parte do pressuposto de que, na recente evolução histórica brasileira, quatro correlações de forças promoveram reformas jurídicas que alteraram a relação Estado e mercado em quatro diferentes períodos: (i) da Era Vargas ao governo Juscelino Kubitschek; (ii) do golpe militar ao processo de redemocratização; (iii) do governo Fernando Collor ao término do governo Fernando Henrique Cardoso; e (iv) do início do governo Lula até o momento da elaboração deste trabalho. Para desenvolver esse precedente, o primeiro capítulo analisará o modo e a intensidade da intervenção direta do Estado no setor produtivo para identificar as características da relação Estado e mercado nos períodos. Os capítulos subsequentes se deterão à análise da estrutura da Petrobras na esfera microjurídica – organização societária – e macrojurídica – articulação da empresa estatal com outros agentes públicos e privados – em cada um dos quatro períodos delimitados no capítulo anterior. O segundo capítulo descreverá institucionalmente a Petrobras durante seus primeiros dez anos. O terceiro capítulo identificará as mudanças institucionais promovidas na empresa estatal durante o regime militar. O quarto capítulo disporá sobre as alterações jurídicas na Petrobras promovidas pela Reforma do Estado. Por fim, o quinto capítulo tratará das mais recentes mudanças institucionais da empresa estatal decorrente da descoberta da vasta reserva de petróleo denominada pré-sal.

Este ensaio tem por objetivo apresentar as necessidades jurídicas diferenciadas que florescem da realidade socioambiental brasileira, enfocando especialmente o cenário relativo às populações tradicionais amazônicas. Utiliza como base argumentativa as reflexões de Bourdieu, usando especialmente o conceito de campo e capital simbólico desenvolvidos pelo autor. Através de uma literatura originária da região Amazônica descreve, de forma crítica, o contexto socioambiental dessa região, detalhado pelo olhar proveniente da experiência em coleta de dados para pesquisa. Evidencia, em particular, o descompasso entre a construção da norma no campo jurídico e a realidade vivenciada pelas populações tradicionais. Aponta o fetichismo jurídico como responsável pelo invisibilização das práticas jurídicas nativas que regulamentam, de uma maneira informal, o tecido socioambiental do cenário amazônico.

This dissertation discusses the professional figure of interpreters working for the International Criminal Tribunal for Rwanda (ICTR). The objective is to investigate specific job-related stress factors, particularly the psychological consequences interpreters may have to face, the so-called vicarious trauma. People working for the ICTR are exposed to genocide victims’ violent and shocking testimonies, a situation that could have negative psychological impacts. Online interviews with some interpreters working for the ICTR were carried out in order to arrive at a more thorough understanding of this topic. The study is divided into four chapters. Chapter I outlines the historical aspects of the simultaneous interpreting service in the legal field at the International Military Tribunal, in the trials of the Nazi leaders, and then it analyses a modern international criminal jurisdiction, the ICTR. Chapter II firstly discusses the differences between conference interpreting and court interpreting and in the second part it investigates job-related stress factors for interpreters, focusing on the legal field. Chapter III contains a detailed analysis of vicarious trauma: the main goal is to understand what psychological consequences interpreters have to cope with as a result of translating abused people’s accounts. Chapter IV examines the answers given by ICTR interpreters to the online interviews. The data collected from the interview was compared with the literature survey and the information derived from their comparison was used to put forward some suggestions for studies to be carried out in the future.
