In today’s world heritage worldwide are at the risk not only because of natural process of decay and destruction but also by social change like urbanization, globalization and homogenization of cultures. With these emerging problems, the heritage conservation discourse also has reached to a new dimension including broader range of concepts like tangible heritage, intangible heritage, community participation, indigenous knowledge and many more. Even with the changing scenario in the international context about the heritage conservation, Nepal’s heritage conservation still focus on monuments, sites and buildings. In add to that the conservation practices are still top-down approach and community involvements are limited only in plans. While numerous intangible heritages like masking dances chariot processions, festivals and rituals, which form an integral part of the daily social life of people are still being continued and managed by the community and its people, without with out serious attention form the government. In Kathmandu Valley these heritages has been maintained with the traditional social association of people known as “Guthi” which has been continuing since 5th Century. Most of the tangible and intangible heritages have survived for centuries because of this unique association of people. Among the numerous festivals of the Kathmandu Valley, the festival Yenya Punhi was chosen as a case for this study, which is also a major festival of Kathmandu. This festival is the perfect example for the study as its celebrated in the city that is the most urbanized city of Nepal with the challenges of the every modern city like social changes and urbanization. Despite modern challenges Guthi still plays a major role in the heritage conservation in Kathmandu Valley. Now there are some interventions of the various formal institutions. So this study will be focusing on the management, continuity and problems of the festival along with Nepal’s position in terms of intangible heritage conservation. The problem of Kathmandu and Yenya Punhi festival is the problem of every country in the similar situation so with this case study it can be a good example for finding solutions of the similar problem not only the other festivals within Nepal but also elsewhere in the world; Resumo: Conexão de Património: Festival Yenya Punhi um caminho de fortalecimento de identidade: A experiência de Catmandu Nos dias de hoje, os patrimónios mundiais encontram-se em risco, não só devido ao processo natural de degradação e destruição, mas também pelas mudanças sociais, tais como a urbanização, globalização e homogeneização de culturas. Com o emergir destes problemas, o discurso de conservação de Património atingiu também uma nova dimensão, incluíndo uma área mais abrangente de conceitos, como por exemplo, património material, património imaterial, participação da comunidade, conhecimento indígena, entre outros. Mesmo com este cenário de mudança no contexto mundial de conservação do património, a preservação do património do Nepal continua a focar-se em monumentos, sítios e edíficios. A acrescentar a isso, as práticas de conservação ainda têm uma abordagem descendente e os envolvimentos da comunidade são limitados por planificações. Enquanto que os numerosos patrimónios imateriais como danças com máscaras, procissões, festivais e rituais, os quais formam uma parte integral da vida diária social das pessoas que as continuam e as gerem em comunidade, sem uma atenção séria por parte do governo. No Vale de Catmandu, este património tem sido mantido pela associação tradicional de pessoas conhecidas como ''Guthi'' desde o século V. A maior parte destes patrimónios materiais e imateriais tem sobrevivido durante séculos graças a esta associação única de pessoas. Entre os numerosos festivais do Vale de Catmandu, o festival Yenya Puhni foi escolhido para este estudo, pois é também um grande festival em Catmandu. Este festival é o exemplo perfeito para este estudo, pois é celebrado na cidade mais urbanizada do Nepal, com os desafios das cidades modernas tais como mudanças sociais e urbanização. Apesar dos desafios da modernização, os ''Guthi'' ainda desempenham um papel importante na preservação do património do Vale de Catmandu. Agora, existem algumas intervenções de várias instituições formais Então, este estudo irá focar-se na gestão, continuidade e problemas do festival, juntamente com a posição do Nepal em termos de conservação de património imaterial. O problema de Catmandu e do festival Yenya Punhi é o problema de todos os países em situação semelhante então, este estudo pode ser um bom exemplo para encontrar soluções de problemas parecidos, não só em outros festivais no Nepal mas também para qualquer parte do mundo.

This work started from an investigation concerning the process of education, moralization and disciplining of the poor in the backlands of the Brazilian Northeast region, in the second half of the 19th century, through the incorporation of the values of productive work. In order to do so, we took as our field of investigation the missions of Father José Antônio Pereira Ibiapina (1806-1883), in which an extensive work was developed, including the construction of twenty two (22) charity houses in the States of Rio Grande do Norte, Paraíba, Pernambuco, Ceará e Piauí, but also of weirs, churches, graveyards, hospitals and so forth. Given the socio-historical character of the research, we adopted qualitative methods of analysis and the following procedures: survey and analysis of documents, statute and internal rules that ordered the workings of the charity houses; biographies on Father Ibiapina and the missions‟ reports, as well as various sorts of publications on the missionary. Our study comprises his 27 year-period of missionary-religious activity (1856-1883), and undertakes an analysis on the topic of poverty, since the medieval Christian take on it until modernity, when it stops representing a value and becomes a problem to be solved through work. The socio-political context in which Ibiapina lived in the Northeast was marked by the consequence of droughts and economic crises in the region. The analysis of the documents indicates that, in the circumstances of political weakness and lack of interest for regional demands by the national political agenda, his missionary actions produced strong effects. Starting from an ethics of valorization of work, which combined modern and traditional elements, his actions set up disciplinary, moralizing and civil educational practices of the poor, founding, simultaneously, a pragmatic religious experience directed at the resolution of the problems caused by poverty. In that sense, we observe that such actions are connected to the broader process of moralization and education of the poor, but the analysis also suggests that their inscription into the social order articulated both forward as well as conservative aspects of the established system

En cuanto que las minorías étnicas son reconocidas constitucionalmente, se encuentra un ambiente propicio para lograr con éxito la necesidad de reconocer a los pueblos indígenas como una cultura diferenciada, razón por la cual, constitucionalmente se otorgó status constitucional a su propio sistema de impartir justicia, es decir, su sistema judicial, al punto que es el artículo 246 de la Constitución Política así lo consagra, siendo de ésta manera como se hizo improrrogable hacer efectivo un mecanismo que permita el funcionamiento armónico de la jurisdicción especial indígena y Sistema Jurídico Nacional. Por ésta razón el presente trabajo investigativo, se desarrollará con base en los resultados arrojados por el proyecto Extensión de la coordinación del Sistema Judicial Nacional (SJN) y la Jurisdicción Especial Indígena (JEI), exponiendo una serie de componentes y elementos jurídicos que pretenden analizar la problemática de coexistencia de culturas jurídicas diferentes, en el marco del Estado Social de Derecho, con base en el pluralismo jurídico, diversidad cultural e interculturalismo.

Los pueblos indígenas han logrado mantener costumbres propias que los diferencian del resto de poblaciones. El Estado debe reconocer estas diferencias e incorporarlas a las políticas estatales, sin absorberlos y hacerlos parte de la etnia dominante en el país. Su autonomía se evidencia en sistemas consolidados como el de justicia indígena que opera actualmente, una realidad que necesita ser compatibilizada con el sistema mestizo.

Este artículo estudia el Proyecto de Declaración Americana sobre los Derechos de los Pueblos Indígenas como un intento de comprensión del fenómeno indígena en el contexto latinoamericano, imbuido de los caracteres de universalidad e individualidad de los derechos humanos, en el que se refleja la predisposición de los órganos del Sistema Interamericano para incentivar un diálogo intercultural, en el que, los derechos individuales convivan con los colectivos, procurando que en esta simultaneidad, los conflictos entre ambas filosofías se reduzcan. Este trabajo trata fundamentalmente cuatro temas: 1) la eventual obligatoriedad de este Proyecto, 2) la futura personalidad jurídica de los pueblos indígenas, 3) el tratamiento jurídico de la interacción entre derechos individuales y colectivos en el contexto indígena cuando el Proyecto sea aprobado como Declaración definitiva, y 4) el ejercicio grupal o individual del derecho de petición internacional de los pueblos indígenas. La referencia a la actual jurisprudencia de la Comisión y la Corte Interamericana de Derechos Humanos brindará luces para anticiparnos, por así decirlo, a la inauguración de este próximo instrumento internacional.

Infrastructure works are included in strategic areas for the social development. For that matter that all of the investments are very important for the social development. When the population has enough water and an acceptable quality, and it includes a wastewater gathering and its treatment, the whole society became less susceptible to the water diseases. Even the Water Supply and the Sewage depend for its perfect operation of reservoirs, or of the accumulation of water to provide the popular necessity, either due to retention or for the treatment wastewarer. These structures present very specific environmental conditions, because the microclimate created around them, like high environmental humidity and for the existence of many harmful substances for the concrete, such as chloride ions presents in water. The reservoir that compose the System of Water Supply of Natal were built between 1970s and 1980s, a period whom the technical and scientific community did not have in-depth studies about the reinforced concrete mechanism of deterioration. Therefore, these reservoirs have been suffered accelerated deterioration progress, and they have been shown many pathological manifestations strikingly visible. In front of all these problems this academic work aims to identify the generally conditions of conservation of all the reservoirs components of the Water Supply System of Natal. This academic work objectives to develop a recuperation plan for use in these reservoirs, in this academic work it was achieved all the survey of pathological manifestation existing in each reservoir. It was made with local visits, photographic recorders of all manifestations viii and realization of in loco tests. The other step consisted in a application of GDE/UnB metodolgy reformulated by Fonseca (2007). In the step of local visits in each reservoir it was evaluated carbonation depth, by spreading a phenolphthalein solution with 1% of concentration; evaluation of contamination of chlorides, by spreading silver nitrate solution with 1% of concentration, and evaluation of width cracks. After the conclusion of all the testings, it was established that all reservoir, studied in this academic work, have showed an advanced deteriorating condition. It´s presents prevalent pathological manifestations as unacceptable cracks, spots, efflorescence and reinforcement corrosion, and in some cases, chlorides contamination. After the conclusion of the testings and its concatenation it was able to implementing, using GDE/UnB methodology, the order of the restoration its service life and initial safety conditions
