This thesis explains why immigration detention persists as part of Australia's immigration policy. It argues that this form of incarceration has a long history in Australia, and that it fulfils specific social and political functions. The thesis also demonstrates that immigration detention is punitive and therefore breaches Australia's constitution.

The Australian Institute of Criminology’s (AIC’s) national Juveniles in Detention Monitoring Program was established to contribute to the evidence base on juvenile detention in Australia, with a particular focus on Indigenous juveniles. Findings date back to 1981 and have been reported annually. This report provides an overview of the numbers and rates of juveniles in detention in Australia since 1981 and juveniles in detention for the financial year 2007–08. As with the AIC’s previous report on juveniles in detention (Taylor 2009), it also provides contextual information on young people sentenced in the children’s courts. The collation of data for these reports is supported by statutory juvenile justice agencies in each of Australia’s jurisdictions, as well as the NSW Department of Corrective Services. As described in more detail in this report, the Australian Institute of Health and Welfare (AIHW) administers the Juvenile Justice National Minimum Data Set and also reports annually on juveniles in detention. Given this development, the AIC is conducting a review of the Juveniles in Detention Monitoring Report in 2010–11, to ensure that AIC’s research and monitoring does not duplicate the AIHW’s work and that it makes a useful contribution to the field and enables more in-depth analysis of key issues.

This paper provides an overview of key trends in juvenile detention in Australia, based on data contained in the Australian Institute of Criminology’s (AIC’s) Juveniles in Detention in Australia Monitoring Program database and then provides a discussion of two key trends in juvenile detention—the national increase in the proportion of juvenile detainees that is remanded (rather than sentenced) and the increase in the over-representation of Indigenous juveniles in detention.

The chapter provides a synthesis of theory and research in relation to relationships between babies, toddlers and their caregivers in child care centres. The themes addressed include attachment theory and how this is taken account of by caregivers, the importance of secure relationships that recognize and build on the first transition from home to child care centres. In addition, the use of primary caregiving gropus is investigated whereby the caregivers establish close reciprocal relationships with babire, toddlers and their families.

The present investigation aims to identify the factors which differentiate violent from non-violent juvenile offenders, with a particular emphasis on the association between internalizing psychiatric morbidity (i.e. anxiety and depression), impulsivity, substance misuse, and violence. A total of 323 incarcerated male juvenile offenders from one of three Youth Detention Centers (YDCs) in China were recruited between August 2007 and November 2008. Interviews were conducted by trained psychiatrists using the Barratt Impulsivity Scale (BIS-11), the Screen for Child Anxiety Related Emotional Disorders (SCARED), and the Birleson Depression Self-Rating Scale (DSRS) to assess impulsivity, anxiety and depression, respectively. The Schedule for Affective Disorder and Schizophrenia for School-Age Children Present and Lifetime (K-SADS-PL) was also used to assess psychiatric diagnoses. Violent offenders had significantly higher BIS-11 total scores, and attention and nonplanning subscale scores (p<0.05). In the multiple logistic regression model, substance use disorders (SUD) and BIS-11 total scores independently predicted violence. Prison-based treatment services designed to reduce impulsivity and substance misuse in juvenile detention facilities should be prioritized.

The studies in the thesis were derived from a program of research focused on centre-based child care in Australia. The studies constituted an ecological analysis as they examined proximal and distal factors which have the potential to affect children's developmental opportunities (Bronfenbrenner, 1979). The project was conducted in thirty-two child care centres located in south-east Queensland. Participants in the research included staff members at the centres, families using the centres and their children. The first study described the personal and professional characteristics of one hundred and forty-four child care workers, as well as their job satisfaction and job commitment. Factors impinging on the stability of care afforded to children were examined, specifically child care workers' intentions to leave their current position and actual staff turnover at a twelve month follow-up. This is an ecosystem analysis (Bronfenbrenner & Crouter, 1983), as it examined the world of work for carers; a setting not directly involving the developing child, but which has implications for children's experiences. Staff job satisfaction was focused on working with children and other adults, including parents and colleagues. Involvement with children was reported as being the most rewarding aspect of the work. This intrinsic satisfaction was enough to sustain caregivers' efforts to maintain their employment in child care programs. It was found that, while improving working conditions may help to reduce turnover, it is likely that moderate turnover rates will remain as child care staff work in relatively small centres and they leave in order to improve career prospects. Departure from a child care job appeared to be as much about improving career opportunities or changing personal circumstances, as it was about poor wages and working conditions. In the second study, factors that influence maternal satisfaction with child care arrangements were examined. The focus included examination of the nature and qualities of parental interaction with staff. This was a mesosystem analysis (Bronfenbrenner & Crouter, 1983), as it considered the links between family and child care settings. Two hundred and twenty-two questionnaires were returned from mothers whose children were enrolled in the participating centres. It was found that maternal satisfaction with child care encompassed the domains of child-centred and parent-centred satisfaction. The nature and range of responses in the quantitative and qualitative data indicated that these parents were genuinely satisfied with their children's care. In the prediction of maternal satisfaction with child care, single parents, mothers with high role satisfaction, and mothers who were satisfied with the frequency of staff contact and degree of supportive communication had higher levels of satisfaction with their child care arrangements. The third study described the structural and process variations within child care programs and examined program differences for compliance with regulations and differences by profit status of the centre, as a microsystem analysis (Bronfenbrenner, 1979). Observations were made in eighty-three programs which served children from two to five years. The results of the study affirmed beliefs that nonprofit centres are superior in the quality of care provided, although this was not to a level which meant that the care in for-profit centres was inadequate. Regulation of structural features of child care programs, per se, did not guarantee higher quality child care as measured by global or process indicators. The final study represented an integration of a range of influences in child care and family settings which may impact on development. Features of child care programs which predict children's social and cognitive development, while taking into account child and family characteristics, were identified. Results were consistent with other research findings which show that child and family characteristics and child care quality predict children's development. Child care quality was more important to the prediction of social development, while family factors appeared to be more predictive of cognitive/language development. An influential variable predictive of development was the period of time which the child had been in the centre. This highlighted the importance of the stability of child care arrangements. Child care quality features which had most influence were global ratings of the qualities of the program environment. However, results need to be interpreted cautiously as the explained variance in the predictive models developed was low. The results of these studies are discussed in terms of the implications for practice and future research. Considerations for an expanded view of ecological approaches to child care research are outlined. Issues discussed include the need to generate child care research which is relevant to social policy development, the implications of market driven policies for child care services, professionalism and professionalisation of child care work, and the need to reconceptualise child care research when the goal is to develop greater theoretical understanding about child care environments and developmental processes.

BACKGROUND: Little is known about the health status of prisoners in Switzerland. The aim of this study was to provide a detailed description of the health problems presented by detainees in Switzerland's largest remand prison. METHODS: In this retrospective cross-sectional study we reviewed the health records of all detainees leaving Switzerland's largest remand prison in 2007. The health problems were coded using the International Classification for Primary Care (ICPC-2). Analyses were descriptive, stratified by gender. RESULTS: A total of 2195 health records were reviewed. Mean age was 29.5 years (SD 9.5); 95% were male; 87.8% were migrants. Mean length of stay was 80 days (SD 160). Illicit drug use (40.2%) and mental health problems (32.6%) were frequent, but most of these detainees (57.6%) had more generic primary care problems, such as skin (27.0%), infectious diseases (23.5%), musculoskeletal (19.2%), injury related (18.3%), digestive (15.0%) or respiratory problems (14.0%). Furthermore, 7.9% reported exposure to violence during arrest by the police. CONCLUSION: Morbidity is high in this young, predominantly male population of detainees, in particular in relation to substance abuse. Other health problems more commonly seen in general practice are also frequent. These findings support the further development of coordinated primary care and mental health services within detention centers.

En el presente texto, los autores se aproximan a los estándares del Sistema Internacional de los Derechos Humanos, en especial el Sistema Interamericano de Derechos Humanos (en adelante el “sidh”), en relación con el deber de custodia frente a las personas privadas de la libertad. De esta manera, se aproximan a la naturaleza particular de la responsabilidad internacional del Estado en la materia, al alcance de las obligaciones estatales en cuanto a determinadas poblaciones vulnerables dentro de centros carcelarios y penitenciarios, así como a las exigencias hechas al Estado de adecuar el sistema carcelario en general, con el fin de garantizar los derechos de los internos.

El interés de esta investigación es analizar los cambios en las políticas migratorias de Italia y Libia a partir del Tratado de amistad y cooperación firmado en 2008. Utilizando el concepto de securitización de Barry Buzan, se explican cuáles fueron las principales motivaciones para que ambos Estados tomaran la decisión de endurecer sus políticas migratorias para hacerle frente a la migración irregular. La securitización del tema de la migración se convirtió en el mecanismo principal del gobierno italiano para justificar el incumplimiento de acuerdos internacionales, dejando en un segundo plano la protecciónde los Derechos Humanos. Esta situación trae consigo altos costos humanitarios y pone en evidencia cómo Italia y Libia están tratando las nuevas amenazas como lo es la migración irregular en esta región.

El propósito de este trabajo es investigar los motivos, anhelos, sueños, deseos que llevan a un grupo de entre 20 y 25 ex presos políticos a reunirse semanalmente en el local del sindicato Luz y Fuerza, Córdoba. Optamos por entrevistar a quienes daban la sensación de ser más participativos o más explícitos, en la elección procuramos que hubiesen casi por igual miembros de las dos organizaciones mayoritarias en el pasado: Montoneros y Partido Revolucionario de los Trabajadores. El celo a la hora de elegir se entronca con las subculturas que emergieron de las organizaciones. Otro aspecto observado es la cuestión de género, mujeres y hombres, equitativamente incorporados, se constituyeron en narradores.2 En la ciudad mediterránea hubo alrededor de dos mil detenidos por causas políticas a partir de la dictadura que iniciara Jorge Rafael Videla. La curiosidad social es acicateada por el número exiguo de ex-represaliados que constituyen la comisión de presos políticos, que entre otras tareas peticiona ante las autoridades solicitando reivindicaciones a raíz de su condición de ex detenidos, organizan eventos sociales y políticos, gestionan los ex centros de detención convertidos en "museos de la memoria", impulsan los juicios contra los ex represores, editan publicaciones. Concurrimos a las reuniones semanales, a asados, "locreadas"; empleamos en las investigaciones la observación participante. La participación se dio en eventos, en compartir ruedas de mate en la casa de los entrevistados, íntimas ruedas de café, por un fenómeno de indexicalidad en relación con el discurso ideológico pudimos avanzar en la profundidad de la conversación. Además, de las entrevistas en profundidad, analizamos material periodístico y material escrito por los detenidos; cuando la emoción del entrevistado dificultaba la conversación, en algunos casos nos remitieron a elaboraciones suyas sobre la situación planteada.. Nos favoreció, en el trabajo, el hecho de haber participado en la vida política, y el tener familiares que lucharon junto a los ex-represaliados. A pesar de ello no fue fácil llegar a subjetividades que hacía largo tiempo se hallaban abroqueladas.
