This paper considers the impact of new media on freedom of expression and media freedom within the context of the European Convention on Human Rights and European Court of Human Rights jurisprudence. Through comparative analysis of US jurisprudence and scholarship, this paper deals with the following three issues. First, it explores the traditional purpose of the media, and how media freedom, as opposed to freedom of expression, has been subject to privileged protection, within an ECHR context at least. Secondly, it considers the emergence of new media, and how it can be differentiated from the traditional media. Finally, it analyses the philosophical justifications for freedom of expression, and how they enable a workable definition of the media based upon the concept of the media-as-a-constitutional-component.

At the outset of the United Nations Convention on the Rights of the Child, the Committee on the Rights of the Child identified four of its provisions (non-discrimination; best interests of the child as a primary consideration; life, survival and development; and participation) as ‘general principles’. This approach has shaped implementation of, advocacy for and the scholarship on the Convention. The use of general principles has the potential to make a significant contribution in other areas of human rights law provided that the principles are selected carefully and address the distinct issues at the root of potential rights violations for particular rights-holders.

Implementation of human rights is often criticized because it is perceived as being imposed on the rest of the world. In this case, human rights start to be seen as a sole abstraction, an empty word. What are the theoretical arguments of these critics and can we determine any historical grounds for them? In this paper, I will try to point at similar critics after the French Revolution – like that of the Historical School and Hegel – and try to show if some of these critics are still relevant. And I will compare these critics with contemporary arguments of cultural relativists. There are different streams and categorizations of human rights theories in today’s world. What differentiates them is basically the source of the human rights. After the French Revolution, the historical school had criticized the individuation and Hegel had criticized the formal freedom which was, according to him, a consequence of the Revolution. In this context Hegel drew a distinction between real freedom and formal freedom. Besides the theory of sources, the theories of implementation such as human rights as a model of learning, human rights as a result of an historical process are worth attention. The crucial point is about integrating human rights as an inner process and not to use them as a tool for intervention in other countries, which we observe in today’s world. And this is the exact point why I find the discussion of the sources more important. This discussion can help us to show how the inner evaluation of a society makes the realization of human rights possible and how we can avoid the above mentioned abstraction and misuse.

Structured Abstract Purpose: this article systemizes the main historical milestones which led to the current concept of decent work and presents some implications for business. Approach: after presenting the scenario which gives a special meaning and importance to decent work, the historical landmarks are systematized until the definition of the Decent Work Agenda. Findings: Decent work is a concept that has evolved since the ILO Foundation in 1919 and had several important steps throughout its development: Philadelphia Declaration in 1944, ILO constitution update in 1946, Universal Declaration of Human Rights in 1948, Human Development Report, first edition in 1990, World Summit for Social Development in 1995, ILO Declaration on Fundamental Principles and Rights at Work in 1998, World Economic Forum in 1999, Global Compact in 2000, United Nations Millennium Declaration in 2000, ILO Declaration on Social Justice for a Fair Globalization in 2008, Global Jobs Compact in 2009, and inclusion in the 2030 Agenda for Sustainable Development. Throughout this development we can witness the refinement and operationalization of the concept, its institutionalization and its spread at political level, at least as an intention. Practical implications: the business area is a privileged forum to turn policies into practices and some examples are provided. Value: although decent work emerged in a very different social and economic scenario from the present time, it is claimed to be even more topical and relevant for the development of business and society today.

The end of the recent Communist occupation of the many countries bordering Russia marked an end to the tyranny of illegal and forced annexation. Amid these countries are my parents’ homelands, the small Baltic nations of Latvia and Estonia. Their occupation contravenes many of the numerous Articles listed by The Office of the High Commissioner for Human Rights in The Universal Declaration of Human Rights (2008), constituting many acts of violation. As a filmmaker, I was unusually incognizant of these events, despite my relationship to them. My parents never discussed the war, while during the ensuing Communist era, information was conspicuously absent. However, this lack of knowledge provided the incentive that compelled a journey of discovery that resulted in the making of Regimes and Rebels. This Masters project is presented is two parts. The film equates to 70% of the project (52 minutes in length), whilst the exegesis represents the remaining 30%. The film is a ‘human rights’, ‘video diary’ styled documentary film about the Communist occupation of my parents’ homelands, Latvia and Estonia, and the resonating effect of the occupation on our family living in Australia and family still living in the homelands. The production of the video diary is contextualised by this exegesis, which concurrently discusses the burgeoning video diary format as the basis for making a ‘human rights’ documentary film. A discussion about the latter genre of documentary film ensues, encompassing modes of representation, followed by various issues related to production including: issues of aesthetics, styles, digital media, lack of evidence and subjectivity analogous with both filmmaker and audience. Next, work by other filmmakers in the ‘human rights’ genre, linked to the proliferation of Communism in Europe, is discussed and analysed in terms of production and modes of representation. The exegesis ends with my experience as filmmaker and an analysis of factors that arose in making Regimes and Rebels.

O art. 6 da Constituição Federal estabelece que o lazer é um direito social. A referida proteção constitucional conquistada com a Carta Cidadã de 1988, somada a previsão internacional da Declaração Universal dos Direitos Humanos por si só ensejam a elaboração de estudo detalhado do tema. Além disso, a ascensão de uma nova classe média com maior poder de consumo, a efervescência da terceira revolução industrial e a eleição do Brasil, e especificamente da cidade do Rio de Janeiro, como sede de diversos eventos de entretenimento internacional, são os argumentos que introduzem o estudo a cidade e a satisfação do direito ao (do) entretenimento. Assim, a partir da conceituação de entretenimento à luz da comparação com as outras ciências humanas e o direito alienígena, enseja-se a propositura de um conceito próprio para o ordenamento jurídico pátrio, que delimita os deveres do Estado na satisfação deste direito, e na regulação e fomento da atividade econômica que circundam o lazer, denominada indústria do entretenimento. O estudo aborda ainda a compreensão de que a cidade pode ser concebida como oikos do entretenimento, permitindo uma análise das formas como as cidades devem comportar conteúdo mínimo que viabilize a satisfação do lazer. Ao final, tendo por paradigma a cidade do Rio de Janeiro, se analisa como determinadas cidade podem possuir características geográficas, históricas e culturais próprias que permitem que sua vocação econômica seja a satisfação do entretenimento em nível internacional.

Eleanor Roosevelt, as a renowned humanitarian, portrayed an inconsistency by supporting Zionist ambitions for a national homeland in Palestine while simultaneously ignoring the rights of the indigenous Palestinians. Because of this dichotomy, this dissertation explores her attitudes, her disposition and her position in light of the conflict in the region. It conveys how her particular character traits interplayed with the cultural influences prevalent in mid-century America and encouraged her empathy with the plight of European Jews after the Holocaust. As she evolved politically, initially under the tutelage of Franklin Roosevelt and latterly as a UN delegate, she outgrew the anti-Semitism of the period to become a committed Zionist. Judging the Palestinians as ‘primitives’ incapable of self-government and heartened by Jewish development, she supported the partition of Palestine in November 1947. After the 1948 Arab-Israeli war the 800,000 Palestinian refugees encamped in neighbouring Arab states threatened to destabilise the region. Her solution was to discourage repatriation and to re-settle them in Iraq – a plan that directly contravened the principles of the December 1948 Universal Declaration of Human Rights proclaimed by the UN committee she had chaired. No detailed work has been conducted on these aspects of Eleanor Roosevelt’s life; this dissertation reveals a complex person rather than a model ofhumanitarianism’, and one whose activities cannot be so simply categorised. In the eight chapters that follow, her own thoughts are disclosed through her ‘My Day’ newspaper column, through letters to friends and to members of the public that petitioned her, through a scrutiny of her articles, books and autobiography. This information was attained as a result of archival research in the US and in The Netherlands and was considered against an extensive range of secondary literature. During the Cold War, to offset Soviet incursion, Eleanor Roosevelt promoted Jewish usurpation of Palestinian lands with equanimity in order that an industrious Western-style democracy would bring stability to the region. These events facilitated the exposure of a latent Orientalism and an imperialistic lien that fostered paternalism in a woman new to the nuances of international diplomacy.

Résumé La démonstration qui est ici à l’œuvre s’apparente, dans une certaine mesure, à celle qu’élabore Amartya Kumar Sen dans 'The Argumentative Indian'. Dans cet ouvrage, Sen discute de l’héritage intellectuel et politique de l’Inde et de la manière dont cette tradition est essentielle pour le succès de la démocratie et des politiques séculières de l’État indien. Pour notre part, nous ne nous intéressons point à l’Inde, mais à la Chine, notamment à l’héritage intellectuel, politique et moral des lettrés confucéens de l’Antiquité chinoise et à la pertinence de revisiter, aujourd’hui, la réflexion confucéenne classique pour mieux penser et fonder les droits humains en Chine. Plus précisément, notre réflexion s’inscrit au sein du débat contemporain, qui a lieu à l’échelle internationale, entourant les soi-disant valeurs asiatiques et les droits humains. Pour les partisans de la thèse des valeurs asiatiques, les valeurs asiatiques seraient associées au modèle de développement dit asiatique, lequel se distinguerait du modèle « occidental » en étant en outre réfractaire aux droits humains. Ces droits ayant une origine occidentale et étant, à maints égards, en rupture avec les valeurs asiatiques, ils ne seraient ni souhaitables en Asie (notamment en Chine) ni compatibles avec les valeurs asiatiques (spécialement avec les valeurs confucéennes). Dans notre thèse, nous réfutons ce point de vue. Par l’entremise d’une analyse de la 'Déclaration universelle des droits de l’homme' de 1948 et d’un examen des quatre textes fondateurs du confucianisme classique que sont : les 'Entretiens' (Lunyu), le 'Mencius' (Mengzi), la 'Grande Étude' (Daxue) et la 'Pratique du Milieu' (Zhongyong), nous démontrons que cette compréhension des choses s’avère injustifiée. Les droits humains ne sont pas incompatibles avec les valeurs confucéennes et leur adoption est souhaitable en Asie (notamment en Chine), tout comme elle l’est en Occident. De fait, la philosophie des droits humains et la pensée confucéenne classique ont de nombreuses affinités conceptuelles, axiologiques et normatives. Loin d’être en rupture, ces univers théoriques convergent, car ils ont tous deux à cœur l’être humain, ses besoins vitaux et son épanouissement au sein de la communauté. Notre démonstration s’appuie, pour une large part, sur l’analyse d’un concept phare de la pensée éthique et politique confucéenne, soit la notion d’humanité ou du sens de l’humain (ren) ainsi que d’une autre notion qui lui est étroitement liée, soit celle de l’homme de bien ou de la personne moralement noble (junzi).

Centrée sur une réflexion des droits de l’homme à partir de l’expérience historique de la Shoah, la thèse porte sur l’enjeu fondamental du statut du religieux en modernité. Trois parties la composent, correspondant au génocide, à la modernité politique et à l’histoire du Salut : la première propose une interprétation de l’Holocauste en ayant recours aux catégories empruntées à l’historiographie, à la réflexion philosophique et à la tradition théologique. Elle rend compte de deux lectures concurrentes des Lumières, du renversement de la théologie chrétienne du judaïsme au XXe siècle, de la généalogie idéologique du nazisme ainsi que du contexte explosif de l’entre-deux-guerres. La seconde partie de la thèse avance une théorie des trois modernités, selon laquelle les États-Unis, la France et Vatican II représenteraient des interprétations divergentes et rivales des droits. Enfin, la troisième partie reprend les deux précédentes thématiques de la Shoah et de la modernité, mais à la lumière de la Révélation, notamment de l’Incarnation et de la Croix. La Révélation est présentée comme un double dévoilement simultané de l’identité de Dieu et de la dignité humaine – comme un jeu de miroir où la définition de l’homme est indissociable de celle de la divinité. En provoquant l’effondrement de la Chrétienté, la sécularisation aurait créé un vide existentiel dans lequel se serait engouffré le nazisme comme religion politique et idéologie néo-païenne de substitution. Négation de l'élection d'Israël, du Décalogue et de l’anthropologie biblique, l’entreprise nazie d’anéantissement est comprise comme la volonté d’éradication de la Transcendance et du patrimoine spirituel judéo-chrétien, la liquidation du Dieu juif par l’élimination du peuple juif. Le judéocide pourrait dès lors être qualifié de «moment dans l’histoire du Salut» en ce sens qu’il serait porteur d’un message moral en lien avec le contenu de la Révélation qui interpellerait avec force et urgence la conscience moderne. L’Holocauste constituerait ainsi un kairos, une occasion à saisir pour une critique lucide des apories de la modernité issue des Lumières et pour un renouvellement de la pensée théologico-politique, une invitation à une refondation transcendante des droits fondamentaux, dont la liberté religieuse ferait figure de matrice fondationnelle. La Shoah apporterait alors une réponse au rôle que la Transcendance pourrait jouer dans les sociétés modernes. Mémorial de Sang refondateur des droits de la personne, l'Holocauste rendrait témoignage, il lancerait une mise en garde et poserait les conditions nécessaires d'un enracinement biblique à la préservation de la dignité de l’être humain. Aux Six Millions de Défigurés correspondrait la Création de l'Homme du Sixième Jour. En conclusion, un triangle synergique nourricier est soutenu par l’extermination hitlérienne (1941-1945), la Déclaration universelle des droits de l’homme (1948) et le Concile Vatican II (1962-1965) comme les trois piliers d’une nouvelle modernité, située au-delà des paradigmes américain (1776) et français (1789). La Shoah inaugurerait et poserait ainsi les fondements d'un nouvel horizon civilisationnel; elle pointerait vers un nouveau départ possible pour le projet de la modernité. L'expérience génocidaire n'invaliderait pas la modernité, elle ne la discréditerait pas, mais la relancerait sur des bases spirituelles nouvelles. Cette refondation des droits fondamentaux offrirait alors une voie de sortie et de conciliation à la crise historique qui opposait depuis près de deux siècles en Europe les droits de l'homme et la Transcendance, Dieu et la liberté – modèle susceptible d’inspirer des civilisations non occidentales en quête d’une modernité respectueuse de leur altérité culturelle et compatible avec la foi religieuse.

El terrorismo en la actualidad es considerado como uno de los conceptos más controversiales en los campos social, académico y político. El término se empieza a utilizar después de la Revolución Francesa, pero recientemente, a raíz de los atentados del 11 de septiembre de 2001, ha tomado suma relevancia y ha motivado numerosas investigaciones para tratar de entender qué es terrorismo. Aunque a la fecha existen varias revisiones sistemáticas, este trabajo tiene como propósito revisar, agrupar y concretar diferentes teorías y conceptos formulados por los autores que han trabajado sobre el concepto de “terrorismo” con el fin de entender las implicaciones de su utilización en el discurso, y cómo esto afecta la dinámica interna de las sociedades en relación con la violencia, las creencias, los estereotipos entre otros elementos. Para lograrlo, se revisaron 56 artículos, publicados entre los años 1985 y 2013; 10 fuentes secundarias entre noticias y artículos de periódicos correspondientes a los años 1995-2013 y 10 estudios estadísticos cuyos resultados nos aportan a la comprensión del tema en cuestión. La búsqueda se limitó al desarrollo histórico del terrorismo, sus diferentes dimensiones y el concepto social de la realidad de terrorismo. Los hallazgos demuestran que la palabra “terrorismo” constituye un concepto que como tal es un vehículo lingüístico que puede ser utilizado con fines, estratégicos movilizando al público conforme a través del discurso e intereses políticos, destacando la necesidad de estudiar las implicaciones psicológicas y sociales de su uso.

During the ninth century, owing to the process of industrialization, new social conflicts were showed, forcing the Government not to remain inert. The necessity of answer to these new demands requires from the State some actions that assure the new economic, cultural and social rights, able to exceed the formal equality, according to the principles of redistributive equality and well-being. Among the social rights, the right to health is showed up, which is placed at the Universal Declaration of Human Rights and the International Treaty for the Economic, Social and Cultural Rights, as a necessary term to promote the dignity and the free development of the human personality. Under the Constitutional Law, it is clear that the implementation of the right to health, placed at the 6th article of the Brazilian Constitution, demands a government activity, which usually requires a provision of material goods, depending on budgetary resources. The Legislative and Executive Branches have a very important role in compliance with the constitutional regulations about the satisfactory offer of health care services, besides the correct use of the resources at this area. The adoption of public policies is the way of Government action to the planning and realization of this right. Though, some public policies are usually made apart from the social compromises, to the detriment of the basic social rights. The government has a discretionary competence to manage the health services. That is the reason it is necessary the control of the political choices, through the popular control, the extrajudicial control by the Account Courts, or the judicial review. Owed to the constitutionalization of social rights, the constitutional justice has a very relevant role, concerning to the constitutional jurisdiction, in a way the Judiciary Branch assume your position as a player that transforms the society. On the control of the public health policies, there is a cast of official instruments, judicial or not, to the guarantee of the collective right to the public health services, and to allow the citizens to reach the real implementation of the right to health

The work presented here is the result of research on the issue of human rights in the face of conflicting issues such as the incorporation of international treaties, the sovereignty of states, globalization and multuculturalism. Specifically, we will investigate the origin of human rights, alongside his growing recognition, from the Revolutions until its completion in the Universal Declaration of Human Rights in 1948. The question, however, has become broader, when analyzed from the perspective of the internationalization of these rights as conditions and limits of democracy. Given the convergence on the reception of international treaties on human rights, we analyze a series of positions, including recent placements of the Supreme Court, and Constitutional Amendment n.45/2004. The study aims to review the classical concept of sovereignty, now within a new perspective based on the appearance of certain limitations of the state and a crisis in the face of the protection of human rights. We analyze the phenomenon of globalization in light of its complexity and its relation to sovereignty and human rights in pursuit of an expansion of democracy. The theme is consistent also with the line of contemporary constitutionalism, since their approach has a close connection with the issues of sovereignty and globalization, as well as a current relationship with the protection of human rights. The research aims to analyze the formation of a new society within a global vision of the constitutionalization of international law. It seeks to glimpse the invocacion model of foreign precedents and the possibility of dialogue betweem States as a way of protecting and enforcing the protection of human rights

Nessa pesquisa investigo no discurso biológico moderno, teorias e proposições que legitimam as igualdades e desigualdades sociais a partir de argumentos considerados científicos, a fim de relacioná-las à Educação em Direitos Humanos. Minha motivação inicial para tal estudo decorreu da identificação de concepções contrárias a valores humanísticos entre estudantes da educação básica. Concepções essas mantidas e defendidas a partir de argumentos tidos como científicos por esses sujeitos, que ao serem indagados sobre temas relacionados à raça, etnia, sexualidade e organização social manifestaram preconceitos usando elementos do discurso biológico como forma de justificar suas idéias. Com o propósito de estabelecer relações entre Discurso Biológico e Educação em Direitos Humanos, recorro aos valores presentes na Declaração Universal dos Direitos Humanos que integram um projeto global de ensino das prerrogativas estabelecidas pela Organização das Nações Unidas e à análise de três obras de referência da Biologia Moderna A Origem do Homem e a Seleção Sexual, de Charles Darwin (1809-1882); O Gene Egoísta, de Richard Dawkins (1941 -) e A Origem da Espécie Humana, de Richard Leakey (1944 -). O material empírico selecionado foi organizado e investigado com a utilização de princípios metodológicos da análise de conteúdo, inclusive a construção do corpo textual que recebe inferências em seu desenvolvimento, proporcionando a visualização de discursos que refutam ou corroboram valores próximos às concepções humanísticas presentes nos Direitos Humanos. A diversidade dos discursos biológicos analisados partindo de razões diferentes, indicam a necessidade do ensino de valores altruístas e cooperativos, quer por trazerem argumentos reveladores de nossa natureza egoísta quer por defenderem nossa tendência ao altruísmo inato que precisa ser mantido e reforçado pelos meios culturais. Os temas desenvolvidos no trabalho promovem múltiplas discussões que podem ser aproveitadas por educadores em ciências biológicas para, ao ensinar biologia, divulgar, educar e refletir sobre Direitos Humanos.
