Recognition of "difference" in Shari'a: a feminist scrutiny through the lens of substantive equality

The paper looks at the works of notable Islamic feminists to examine whether Islam can be reconciled with a substantive approach to gender equality. Located within contemporary feminist debates related to gender equality, it considers the Qur’anic verses related to two controversial areas of Shari’a law, namely, duty of obedience and polygamy, to explore how Islamic scriptures perceive ‘difference’ and its implications for substantive equality-based legal reforms in a Muslim society.

The paper seeks to draw attention to some of the recent cases relating to child custody law in Bangladesh where, deviating from orthodox Shari’a rules, courts have looked to ‘the welfare’ of the child in determining which parent shall have custody. In studying the recent ‘welfare of child’ standard that has been advanced by the courts in Bangladesh, the paper aims to explore its implications for Muslim women from a feminist perspective.

Families in market economies worldwide have long been confronted with the demands of participating in paid work and providing care for their dependent members. The social, economic and political contexts within which families do so differ from country to country but an increasing number of governments are being asked to engage, or better engage, with this important area of public policy. What seems like a relatively simple goal – to enable families to better balance care-giving and paid employment – has raised several difficulties and dilemmas for policy makers which have been approached in different ways. This paper aims to identify and critique the nature and development of the means by which legal engagement with work-family reconciliation has, historically, been framed in the European Union. In doing so, and with reference to specific cohorts of workers, we demonstrate how disjointed the strategies are in relation to working carers and argue that the EU is unlikely to provide the legal framework necessary to bring about effective change in this fundamentally important area of social policy.

This article seeks to examine the cross-border legal recognition of same-sex relationships in the EU. Although the Member States maintain an exclusive competence in the field of family law and, thus, it is up to them to determine whether they will provide a legal status to same-sex couples within their territory, they need to exercise their powers in that field in a way that does not violate EU law. This, it is suggested, requires that Member States mutually recognize the legal status of same-sex couples and do not treat same-sex couples worse than opposite-sex couples, if the basis of the differentiation is, merely, the (homosexual) sexual orientation of the two spouses/partners. Nonetheless, the current legal framework does not make it clear that Member States are under such an obligation. The main argument of the article, therefore, is that the EU must adopt a more hands-on approach towards this issue.

My thesis uses legal arguments to demonstrate a requirement for recognition of same-sex marriages and registered partnerships between EU Member States. I draw on the US experience, where arguments for recognition of marriages void in some states previously arose in relation to interracial marriages. I show how there the issue of recognition today depends on conflicts of law and its interface with US constitutional freedoms against discrimination. I introduce the themes of the importance of domicile, the role of the public policy exception, vested rights, and relevant US constitutional freedoms. Recognition in the EU also depends on managing the tension between private international law and freedoms guaranteed by higher norms, in this case the EU Treaties and the European Convention on Human Rights. I set out the inconsistencies between various private international law systems and the problems this creates. Other difficulties are caused by the use of nationality as a connecting factor to determine personal capacity, and the overuse of the public policy exception. I argue that EU Law can constrain the use of conflicts law or public policy by any Member State where these are used to deny effect to same-sex unions validly formed elsewhere. I address the fact that family law falls only partly within Union competence, that existing EU Directives have had limited success at achieving full equality and that powers to implement new measures have not been used to their full potential. However, Treaty provisions outlawing discrimination on grounds of nationality can be interpreted so as to require recognition in many cases. Treaty citizenship rights can also be interpreted favourably to mandate recognition, once private international law is itself recognised as an obstacle to free movement. Finally, evolving interpretations of the European Convention on Human Rights may also support claims for cross-border recognition of existing relationships.

Pedagogues in the borderland of their social task: dealing with family law proceedings, threats and violence Drawing upon an explorative study of family law proceedings from a school perspective, the aim of this paper is to examine the school staff’s strategies for solving or coping with problematic situations in this context. Gendered conflicts between adults and violence are extreme cases for pedagogues in school and preschool. How do the staff cope with their own and the children’s vulnerability? Based upon interviews with 22 informants, the staff’s strategies are outlined and discussed in relation to organizational and professional circumstances and intersecting social relations of power. An analytical construction of six types of proactive and reactive strategies, ranging from distance keeping to normalization of own exposure, is utilized in the analysis. Findings suggest that the staff’s strategies to handle challenging events in this context vary with the parent’s gender, class position and ethnicity. Further, it is argued that creating a sense of safety and promoting learning among the children may be obstructed by lack of support from the school’s organization, demands on staff to perform customer oriented attitudes towards parents and lack of clarity concerning the limits of the social task. Conflicts between the organization and profession on the one hand and the educational and the social task on the other hand, are thus illuminated. In conclusion, a further aim of this article is to contribute to broader discussions on men’s violence against women and children – in families as well as in workplaces and in the intersection between these two areas.

Esta obra tem como tema central a conciliação como método contemporâneo de solução dos conflitos, notadamente nas Varas de Família de Porto Velho/RO. Os métodos alternativos de solução de controvérsias surgem como opção eficaz ao jurisdicionado, em atenção ao clamor da sociedade por uma prestação jurisdicional mais célere. A utilização deste método visa oferecer e assegurar uma melhor e efetiva solução de conflitos à população, fugindo assim dos modelos tradicionais de resoluções de conflitos. O objetivo é procurar demonstrar que, além da jurisdição estatal, existem outros meios de pacificação social, os quais também colocam fim às controvérsias e realizam a justiça. Destaque-se que mecanismos alternativos objetivam não somente oferecer uma prestação jurisdicional mais célere à sociedade, mas também verdadeira pacificação social; além do que, oportunizam também a resolução do conflito antes que seja instaurada qualquer demanda judicial, desafogando assim o Judiciário. Enfatiza-se a importância da conciliação nas matérias concernentes ao direito de família, já que nesta área há preocupação fundamental com a preservação emocional das partes. E dada a carga emocional que circundam as ações dessa natureza, muitas vezes ao juiz é impossível encontrar uma resposta adequada e definitiva para os problemas que lhes são apresentados pelas partes. Os resultados demonstram que a conciliação nas Varas de Família de Porto Velho/RO têm se revelado um mecanismo célere e eficaz, na busca da resolução de conflitos e pacificação social. Os profissionais e operadores do direito têm consciência da importância de sua aplicação.

O objetivo desta monografia é a análise do direito de família, mais especificamente do instituto da paternidade socioafeitva e seu reflexo em situações atuais como a adoção à brasileira. A metodologia deste trabalho foi baseada na revisão de pesquisas bibliográficas, doutrinárias, legislativas e jurisprudenciais. A análise discorre, primeiramente, acerca do conceito da paternidade socioafetiva e da maneira como que os vínculos sociais e afetivos têm sido avaliados como predominante em relação ao vínculo de consanguinidade, considerando o melhor interesse do menor. Posteriormente foi abordado o tema adoção, a “adoção à brasileira”, e como a mesma, tipificada como crime no Código Penal Brasileiro, pode ser solucionada pelo instituto da filiação socioafetiva. Por fim foram revisadas as apreciações de como os tribunais brasileiros adéquam o procedimento de adoção na nova realidade familiar brasileira, tendo em vista a falta de previsão legal, o que leva para os juízes a decisão acerca deste tema. Paralelamente são apresentados exemplos das decisões tomadas caracterizando jurisprudências no tema.

O objetivo desse trabalho é analisar a gestão municipal sobre o Benefício de Prestação Continuada (BPC), programa assistencial previsto pela Constituição Federal de 1988 e que consiste no pagamento de 01 (um) salário mínimo mensal à pessoas com 65 anos ou mais de idade e à pessoas com deficiência incapacitante para a vida independente e para o trabalho, em que a renda per capita familiar deve ser inferior a ¼ do salário mínimo. A pesquisa empírica teve como lócus o município de Castanhal. A motivação para realização deste trabalho surgiu do fato do BPC estar inscrito na CF/ 1988 e por demandar um grande volume de recursos financeiros, mas ainda assim ser desconhecido de grande parte da população e pouco divulgado por parte do Poder Executivo. A partir de pesquisa bibliográfica, pesquisa documental e pesquisa de campo. Desta forma, o trabalho parte da discussão sobre a Política de Assistência Social no Brasil, seguido do debate sobre o Benefício de Prestação Continuada, para por fim, apresentar como o município organiza sua política de assistência social, como é realizada a gestão do BPC pelo Poder Executivo e a atuação do Conselho Municipal de Assistência Social. Ao longo deste trabalho é possível observar o baixo nível de acompanhamento dos beneficiários do BPC pela rede de Proteção Social Básica e a ausência de controle social.

This paper presents some research on the choice of a course of study as related to a certain social, family and labor context. The methodology used included the definition of the theoretical basis and a series of empirical investigations which comprised different kinds of sur- veys, records, observations, participants as well as other fieldwork. The results obtained shed some light on the issue and raise new questions. This study was especially carried out to analyze the choice of the following courses of study: Law, Psychology and the different Teaching Courses.
