The colonial census was a bureaucratic device which provided an essential abstraction from social reality, a ‘statistical fix’ designed to map individual social groups in space. This paper considers the contradictions associated with colonial knowledge systems as reflected in the census grafted onto Burmese society in the nineteenth and early twentieth centuries. It attempts to chart the general adoption and adaptation, in the Burmese context, of a classificatory scheme which categorised labour as either productive or unproductive. Colonialism introduced new attitudes towards work and labour which reinforced patriarchal values which contrasted with more egalitarian Burmese socio-economic systems. The paper suggests that a simple classification of women workers as either productive or unproductive in the Burmese census between 1872 and 1931 resulted in the devaluation of their status as workers. This devaluation was a function of both real economic transformation taking place in the empire and changes in census classification, reflecting a gendering of occupations that undermined the cultural norms of Burmese society. The material result was that women became statistically less visible as economically productive workers. Such ascriptions of value to women workers were largely informed by moral considerations originating in England.

Since 1991 with the advent of globalization and economic liberalisation, basic conceptual and discursive changes are taking place in housing sector in India. The new changes suggest how housing affordability, quality and lifestyles reality is shifting for various segments of the population. Such shift not only reflects structural patterns but also stimulates an ongoing transition process. The paper highlights a twin impetus that continue to shape the ongoing transition: expanding middle class and their wealth - a category with distinctive lifestyles, desires and habits and corresponding ‘market defining’ of affordable housing standards - to articulate function of housing as a conceptualization of social reality in modern India. The paper highlights the contradictions and paradoxes, and the manner in which the concept of affordability, quality and lifestyles are embedded in both discourse and practice in India. The housing ‘dream’ currently being packaged and fed through to the middle class population has an upper middle class bias and is set to alienate those at the lower end of the middle-and low-income population. In the context of growing agreement and inevitability of market provision of ‘affordable housing’, the unbridled ‘market-defining’ of housing quality and lifestyles must be checked.

This chapter provides an analysis of the European Court of Justice's Fundamental Rights Jurisprudence, focused on the potential of Member States to maintain any positive regulatory role in supporting citizens' autonomy on the one hand, and on the impact of the Court's case law on citizens' opportunities to actually enjoy human rights within societies (substantive autonomy). It first sketches the notion of autonomy which is proposed as base of fundamental rights protection and promotion within a social reality characterized by not democratically legitimated dominance based on wealth and economic power. It proceeds to contextualize ECJ case law on fundamental rights. This section starts with a quantitative appetizer, which will formalize some assumptions and test them on a total of 150 cases before the European judiciary. The paper then offers a more conceptual recount around fundamental rights to equality and non-discrimination on the one hand and around fundamental rights of workers to actively shape employment and labor relations on the other hand. In conclusion some suggestions are made of how ECJ fundamental rights doctrine could develop more positively in order to moderate diverging interests of different parts of the citizenry in protecting fundamental rights.

O presente documento enobrece a experiência da construção do desenho e do desenvolvimento de um projeto de Educação e Intervenção Social num Centro Social com várias respostas sociais de apoio à população idosa. Seguindo a metodologia de Investigação-Ação Participativa, o projeto partiu da auscultação dos sentires, perceções e vivências dos sujeitosque integram esta realidade social (idosos, direção e colaboradores) com o intuito da identificação de problemas, necessidades, recursos e potencialidades. Edificou-se através de um conhecimento coconstruído, valorizando, especialmente, a necessidade contínua de uma relação com os demais e com o meio ambiente no seu desenvolvimento. O projeto, fruto de um trabalho conjunto entre o investigador e os sujeitos, possibilitou uma melhoria na qualidade de vida e do bem-estar global dos mesmos, que passou pela promoção da participação ativa e o desenvolvimento das relações afetivas e comunitárias no quotidiano dos idosos

O presente documento reflete o desenvolvimento de um projeto de Educação e Intervenção Social num agrupamento de Escolas TEIP. Ancorado na metodologia de Investigação-ação participativa, o projeto partiu da auscultação dos sentires, perceções e vivências dos sujeitos que integram esta realidade social e desenvolveu-se passando pela reflexão sobre a relação pedagógica entre a escola, professores e a família e do seu contributo para o sucesso educativo dos jovens. A utilização de vários métodos e técnicas permitiu recolher e analisar a informação de onde emergiram vários problemas e perceber as necessidades subjacentes a esses problemas, para as quais foi delineado um projeto de intervenção social e educativa. No âmbito deste projeto, enquadrado pela Educação Social, procurou-se que os diferentes agentes educativos refletissem sobre os seus problemas e pela via da participação procurassem dar resposta a esses mesmos problemas. O projeto, “A participação: Uma âncora para o sucesso educativo”, fruto de um trabalho conjunto dos vários participantes, possibilitou a melhoria das relações entre os intervenientes educativos (jovens, famílias desses jovens, professores, assistentes operacionais e administrativos e diretor) e a transformação da escola num espaço especialmente mais rico em relações e ações com carácter inovador.

Technologic and socio-economic mutations have always determined challenges not only to lawyers, but to law itself. These phenomena have occurred specially when trying to deal with the hard task of finding solutions for the current increasing mismatch of social interests, for example, bank secrecy and money laundering. Usually occurring simultaneously, they are typical examples of outcomes generated by technological and socio-economic innovations that have become fashionable and captured international attention. At the same time, bank secrecy and money laundering support interests belonging to different dimensions, deserving to be balanced in the light of the heterogeneous mechanisms provided by the law to its practitioners and society as a hole. In order to achieve an outcome in accordance with the Rule of Law´s principles, lawyers´ tools are consequently subordinated to constitutional and social justice. Guided by this purpose, we performed the present study, aiming to analyse bank secrecy and money laundering in the light of the current stablished juridical procedures. We intended to develop a prudent point of view that is also in accordance with social reality. In sum, we demonstrate that bank secrecy should adopt a flexible character, embedding new settings and following the socio-economic path in a globalized world with constant innovations.

If quality of life is an important recreation outcome, then municipal parks and recreation management's efforts have to change because:· Over one-third of all the little kids in schools will be diabetic in their lifetime if the trends we are looking at continue. The average loss of life is about 15 years, and there is an average reduction in quality oflife by about 20 years (Jackson, 2007). This thesis is about municipal parks and recreation, an agency that controls and limits physical activity opportunity. It is also about active living; from an ecological perspective, a multi-disciplinary approach to incorporate physical activity into more 111 people's daily lives. In particular, this thesis examines one case --'. the Donutville Case - . with the intent of providing an explanation of how municipal parks and recreation can advance its management efforts to improve health outcomes of people suffering from daily physical activity deficits. More specifically, how can the tension between external and internal environments to municipal parks and recreation be better balanced to affect the change needed? Given that changing the current social reality is through making decisions, decision-making functions connected with systems theory helps identify how recreation authorities can more effectively influence environmental physical activity determinants. , Sallis et al.' (2006) ·social ecological model provides the a priori focus on active living decision-making. An integrated analogous emerging logic model is developed and presented as an efficacious strategy for how municipal parks and recreation decisionmakers can affect change. Attendue, débattue, décriée … l’impulsion française de ces dernières années tendant à faire du salarié un acteur à part entière de l’entreprise interpelle. En effet, le microcosme de la firme s’en trouve bouleversé et l’évidence d’une réalité sociale condamnée à évoluer pose la nécessité de rechercher un nouvel équilibre. Reste à disséquer les implications de cette tendance récente, à en comprendre les fondements et à en mesurer les enjeux. Le dispositif juridique français est animé d’une préoccupation qui ne cesse de prendre de l’ampleur depuis la fin des années 2000 : faire du salarié un partenaire impliqué dans la vie de l’entreprise. L’étude de cette perception innovante d’une gouvernance axée sur la collaboration des salariés ne peut être menée sans appréhender les travaux de l’OCDE qui, dans ses Principes de gouvernement d’entreprise, fournit une grille d’analyse complète. En conséquence, le droit s’inscrit en droite ligne des nombreux écrits d’autres disciplines prônant une implication croissante des employés. Toutefois, l’accélération de la prise en compte des salariés dont témoignent les textes récemment adoptés en France rend complexe la synthèse de ce phénomène.

Theodor W. Adorno (1903-1969) propose une philosophie dont les problèmes centraux concernent la réalité sociale. Depuis cette perspective, nous démontrerons, à travers la présentation de quelques modèles théoriques, comment les problèmes traités sont déterminés historiquement et comment la quête de leur résolution engage la philosophie à entrer dans un rapport critique avec elle-même. Cette critique a pour but de corriger les excès de la théorie de la vérité comme adéquation dont la philosophie s’est montrée responsable, tant vis-à-vis d’elle-même que vis-à-vis de l’histoire. À travers ce parcours, nous défendons la thèse que le modèle adornien effectue une « négation déterminée » du concept de totalité sociale en vue d’orienter le penser vers la conscience et la connaissance des éléments hétérogènes de la réalité. Selon nous, une telle réorientation permettrait de rouvrir la conscience à l’expérience de ce qu’elle a de plus précieux : la possibilité de rendre compte de ses erreurs et de les corriger.

Ce présent mémoire est animé par une forte conviction : les frontières disciplinaires entre les sociologues et les écrivains ne doivent pas se transmuer en barbelés obstruant un éclairage de sens renouvelé sur la réalité sociale. Alors qu’au tournant du siècle dernier, le roman réaliste et la sociologie allemande se sont mutuellement inspirés, au fil du temps les canaux de communication se sont progressivement brouillés. Notre démarche consiste donc à renouer avec la tradition du monde germanophone à l’orée du 20e siècle, période au cours de laquelle la sociologie émerge comme discipline propre. Plus précisément, nous chercherons à faire converser les deux régimes d’écriture afin d’une part, d’explorer les vertus cognitives de la littérature pour la sociologie et d’autre part de mieux comprendre comment les hommes contemporains aux premiers sociologues entrevoyaient l’époque des temps modernes. Pour ce faire, nous nous appuierons sur la sociologie de Max Weber (1864-1920), un des pères fondateurs de la discipline, ainsi que sur l’analyse de trois romans réalistes, signés par deux romanciers germanophones du début du 20e siècle, c’est-à-dire Joseph Roth (1894-1939) et Thomas Mann (1875-1955).

This is an empirical study with theoretical interpretation and elaboration simultaneously on the migration process and the related spatial development in contemporary China. In so doing, there is always a combination of series of studies of the modernization of the migrants themselves with accumulation of forms of capital and changes of lebenswelt (life world) as well as the regions of their origins by the effective use of the gained resources from outgoing migration and remigration. With great efforts made to put the issues together for analysis, the author has taken three approaches to the study based on the political and economic institutional arrangements, the field work data and the elaboration of respective findings. First, as the analytical parts of the institutional changes, which have gone through the whole research, many of the policies from state level to townships involved in the migration, remigration and spatial development have been interpreted with Chinese political and cultural insight. The making of these, as the means of understanding the contexts of macro level and micro level cases is served as key linkages between scholarly imagination and social reality. Indeed most of the discussions made to explain the phenomena such as the sudden upsurge of migration flows, the emergence of three generations, the strong and weak trends of remigration as well as the related spatial development planning, etc are mainly due to the domination, at least the impact of governments decision-making in spite of growing market functioning in often operative manners. Secondly, case studies of the effects of migration and remigration are carried out between the years of 1995 and 2005 in the costal urban regions as designations and the interior rural regions as origins. Conducted mainly by the author, the cases drawn in the research focus on the process of migration with an accumulation of forms of capital away from home and the effective use of the resources flowing back to home areas. As a result, ways of accumulation and utilization of the economic, social and cultural capital are described and interpreted in terms of the development and modernization of both the migrants themselves and the regions where they come out from or move to in the future. Thirdly, in accordance with the findings generated from the cases, the author proposes in the final chapter an important argumentation as conclusion that the duel social-economic structure will inevitably be broken up and reformulated with flows of migrants and forms of capital they possess as types of future spatial development that will be put into practice. With scenarios and all the other conclusions worked out in the end, the research concludes that the pluralistic spatial development in the condition of constant space flows between regions can be a decisive line of thinking in the process of urbanization, industrialization and modernization in the long run in the future. Since this is an exploratory study of the past and present, the author has left some space open for academic debates and put forward suggestions on the inclusion of future research before implementing policies necessary for migration associated spatial practice and development.
