El artículo explora el surgimiento de la figura del extranjero indeseable en las legislaciones nacionales latinoamericanas, desde la Independencia hasta finales de la década de 1930, aproximadamente, de forma paralela a la política de inmigración en los Estados Unidos. Las restricciones sobre la entrada libre de extranjeros que establecieron las repúblicas, durante las primeras décadas de la Independencia, estaban relacionadas con el modelo del ciudadano idealizado. El análisis de los impedimentos para la entrada de extranjeros muestra cómo, durante el siglo XIX, el extranjero “deseado” fue definido cada vez más en contraste con los rasgos negativos de los “indeseables”, bajo el supuesto objetivo de “defender la nación”.

Causing civilian casualties during military operations has become a much politicised topic in international relations since the Second World War. Since the last decade of the 20th century, different scholars and political analysts have claimed that human life is valued more and more among the general international community. This argument has led many researchers to assume that democratic culture and traditions, modern ethical and moral issues have created a desire for a world without war or, at least, a demand that contemporary armed conflicts, if unavoidable, at least have to be far less lethal forcing the military to seek new technologies that can minimise civilian casualties and collateral damage. Non-Lethal Weapons (NLW) – weapons that are intended to minimise civilian casualties and collateral damage – are based on the technology that, during the 1990s, was expected to revolutionise the conduct of warfare making it significantly less deadly. The rapid rise of interest in NLW, ignited by the American military twenty five years ago, sparked off an entirely new military, as well as an academic, discourse concerning their potential contribution to military success on the 21st century battlefields. It seems, however, that except for this debate, very little has been done within the military forces themselves. This research suggests that the roots of this situation are much deeper than the simple professional misconduct of the military establishment, or the poor political behaviour of political leaders, who had sent them to fight. Following the story of NLW in the U.S., Russia and Israel this research focuses on the political and cultural aspects that have been supposed to force the military organisations of these countries to adopt new technologies and operational and organisational concepts regarding NLW in an attempt to minimise enemy civilian casualties during their military operations. This research finds that while American, Russian and Israeli national characters are, undoubtedly, products of the unique historical experience of each one of these nations, all of three pay very little regard to foreigners’ lives. Moreover, while it is generally argued that the international political pressure is a crucial factor that leads to the significant reduction of harmed civilians and destroyed civilian infrastructure, the findings of this research suggest that the American, Russian and Israeli governments are well prepared and politically equipped to fend off international criticism. As the analyses of the American, Russian and Israeli cases reveal, the political-military leaderships of these countries have very little external or domestic reasons to minimise enemy civilian casualties through fundamental-revolutionary change in their conduct of war. In other words, this research finds that employment of NLW have failed because the political leadership asks the militaries to reduce the enemy civilian casualties to a politically acceptable level, rather than to the technologically possible minimum; as in the socio-cultural-political context of each country, support for the former appears to be significantly higher than for the latter.

A richer language when painting before speaking? – What is a rich language and can painting stimulate towards a richer language?In this work I seek to answer two questions. What may a “richer” language mean and does it become richer when the informants, as a preparation, paint what they are going to talk about in front of the class, than when they do not paint? This I try to do by studying earlyer research about how to measure the richness in languages and by analysing video recordings of speeches when the students in an sfi-class (Swedish for foreigners) painted or did not paint before the speech, and by analysing the richness in their language. The result is my own definition of what rich language is in this context, and a conclusion that painting stimulates the students to use more words and to use specific words that they need to bring the audience their message.

The unemployment crisis of 1926-7 focused attention onto the question of immigration. Historians of this period have generally focused on the crisis of public policy and popular antipathies towards foreigners; more recently historians have become attuned to voices of racism. Less attention has been paid to attempts to redress the policy weaknesses through a new legislative regime on immigration. This paper reviews one such proposal, made by Charles Lambert, a deputy from the Rhone, in 1931. Instrumental in a revision of the naturalization law in 1927 to encourage the assimilation of foreigners through the acquisition of French citizenship, Lambert proposed a comprehensive statute on immigration to select “desirable” foreigners and exclude the “undesirables” to promote the assimilation of the “better” elements. The paper argues that his rationale betrays a profound fear of mounting French weakness in the face of economic and demographic decline, and grave anxieties for the future health of the French nation.

Euripides’ Medea has been reinvented several times in the twentieth century. While some modern Medeas reiterate conservative tropes of the monstrous feminine or the evil of the cultural Other, the infanticidal figure of Medea is also open to more politically progressive usages. Indeed, several modern versions of Medea are overt in their politicisation of the problems of colonialism and/or institutionalised gender dissymmetry: the Medeas of Pier Paolo Pasolini, Heiner Müller, Christa Wolf, and more recently the indigenous Australian version by Wesley Enoch, for example, enact resistance to the interpretative closures that construct Medea as a caricature of the evil Other. But what lends the Euripidean narrative to such politicisations? And what role does the infanticide have in modern politicisations of the narrative?

To answer these questions, the paper examines Pier Paolo Pasolini’s 1969 film Medea from his Trilogy of Life series. Focussing on Pasolini’s representation of Medea’s signature act, maternal infanticide, the paper outlines the complex ways in which this motif is integral to the film’s contestation of imperialist ideologies, values and practices, and its affiliations with Marxist and feminist criticism. Drawing upon theories of subjectivity and postcolonial discourse, the paper argues that the infanticide motif is politically enabling precisely because it exalts the politics of the ways in which subjectivity is defined. That is, the apparent blessing of the sun god over Medea’s murderous act speaks to the ways in which subjectivity is formed by the symbolic order: a point recalling Medea’s earlier articulation that society systematically demonises and oppresses foreigners and women. The films representation of infanticide, then, can be read in the light of the narratives politicisation of the discourses that define subjectivity and the hegemonic practices that subjugate and dominate the subaltern. So, while Medea’s infanticide is sometimes dismissed as a demonising representation of the cultural and sexual Other, it can also be read as the key to understanding Medea’s political radicality, drawing attention to the discourses of rights-bearing subjectivity in both its ancient and modern incarnations.

Pasolini’s project of anti-colonialism, however, is fraught with certain paradoxes. To politicise the predicament of imperial subjugation, Pasolini’s Medea places the burden of authenticity on the cultural and sexual Other, on Medea - and on Medea’s culture of origin, Colchis. In this way, Pasolini’s Medea mobilises the problematic discourses of ‘First World’ modernity that define the ‘Third World’ as the carrier of the symbolic burden of authenticity as well as of ‘the sacred.’ Pasolini’s Medea thus offers an overly schematic and abstract representation of the relationship between coloniser and colonised. However, Pasolini’s Medea is not simply or finally a reification of these discourses; rather it strategically mobilises them – just as it strategically mobilises the monstrous act of infanticide – to make its political point.

Examines and evaluates the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs) in the development of China's innovative research capacity and the Convention for the Protection of New Plant Varieties (UPOV) criteria in protecting new plant varieties in encouraging China's creativeness. Argues that whilst UPOV sets up principles and standards that condone uncompensated extraction of plant genetic resources from China to developed countries, TRIPs gives foreigners preferential patent protection in China.

In advanced capitalist societies, intellectual property laws protecting such subject matter as copyright and patents are justified by a combination of theories, which include the provision of economic incentives to foster creativity and innovation and the prevention of unfair competition. IP academics and policy makers have differing views about the appropriate balance between these objectives and public interest considerations such as health, education and the protection of the environment. These different views entered the policy debate in Asian developing countries in connection with an unprecedented introduction and expansion of IP laws over the last 25 years. This paper will use case studies of law reform from Asia, in particular Southeast Asia, to show that the policy considerations of governments in reforming their laws were often quite different from the standard rationale mentioned above. As much of the IP was, at least initially, held by foreigners and introduced to attract foreign investment, national development considerations were joined with the more commonly quoted objectives to promote the rights, creativity and innovation of individuals. Such national development objectives at times coincided and at other times collided with official explanations and received wisdom about the effects of stronger IP rights.

Especially in the early postcolonial period, copyright laws and other IP laws were frequently restricted or simply not implemented, if they conflicted with development policies in areas such as education or public health. Such policies were slowly changing in the wake of WTO-TRIPS and other international agreements. Nevertheless, the implementation and enforcement of the IP laws has been uneven. Specialised institutions such as courts and IP administering agencies compete with other branches of government and administration for limited funding and a rich repertoire of informal dispute settlement procedures has kept the number of court cases relatively low. In some countries, censorship laws have influenced freedom of expression and led to quite idiosyncratic interpretations of intellectual property laws. Governments often also retain a role in the assessment of licensing and technology transfer contracts. And while there are many programs to foster individual creativity, in most cases R & D activities are still largely taking place in government institutions and this has influenced the thinking about intellectual property rights and creativity in the context of employment.

The paper uses a few case studies to examine the implementation of IP laws in selected Asian developing countries to point to the quite different institutional setting for IP law reform in comparison to European or American models. It reaches some tentative conclusions as to the likely effects on creativity and innovation under these different circumstances.

An attempt to limit the rights of domiciled foreigners in the Alsatian department of the Haut-Rhin in 1821 provides an opportunity to examine the impact of immigration on early-industrial society and shifting perceptions of the place of foreigners in French society in a period often omitted from histories of immigration. New conceptions of belonging become evident, which demonstrate a turn away from local and subjective bonds to community, towards bonds regulated nationally through nationality law. Imposed in an emerging urban, industrial context, the limitations of rights—on access to the biens communaux and the droit d’affouage—were traditional restrictions of rural society and modes of distinguishing the included from the excluded and were imposed on long-settled foreigners who failed to become naturalized as French citizens. The article reflects on the question why, if the concerns about immigration and industrialization turned on recently arrived foreign workers, these traditional exclusions were imposed on established resident foreigners.

This academic work describes the interfirm technological learning processes behavior at a thermo plant throughout the years 2001 till 2007. Its former ownership structure was composed by two foreigners companies. This structure was changed by the acquisition of the company control by a Brazilian state owned company on April 2006. The company is a Natural Gas Fired Power Plant placed at Macaé City, at Rio de Janeiro State, Brazil generating electric power right to National Integrated System (SIN). The goal of this research is verify how the technological knowledge had been acquired by the firm and how it had been spread out throughout the organization before and after the change of the ownership structure. The taxonomy applied to determining of ownership structure take in account three parameters: type, specific characteristic and the ownership structure itself. Technological Learning Interfirm Processes have been examined from a model of systemic approach that establishes four key characteristics: ¿variety, intensity, functioning and interaction¿. During 2001 until 2006, till the change of owner structure, the firm developed its own learning processes in its own operational routines. The main learning processes have been identified from empirical evidences. It has been adopted the cut line at year of 2006 for the comparison among the technological learning processes behavior, when the change of ownership structure took place. The data capture occurred within April and August 2007 covering since 2001. Verified the behavior of these learning processes before and after the ownership structure changed from private property to state owned property. The conclusion of this case study suggests that interfirm processes of technological learning identified by the research had their dynamical behavior promptly affected by a change from private to ownerstate ownership structure, exposing the company to a poor performance in its industry, due to the lack of 51% of the technological intrafirm learning processes and reduction of the acquisition of new technical knowledge and its conversion throughout the organization.

Trata do problema do descompasso das empresas industriais de menor porte, do Setor de Autopeças, abordadas dentro do período de 1915 até 1990. Apresenta o Brasil em expansão, recessão e o sistema automotivo nacional em mutação, neste período, conseqüência da modernização neste ramo, provocado pela inserção no mercado mundial das montadoras nipônicas com suas novas técnicas industriais. Caracteriza-se a década de 80, apontando os problemas que afetaram os produtores menores frente a seus clientes (montadoras, autopeças) e usuários finais. Indica também os eventos ocorridos nesta década com efeitos negativos, no mercado de comercialização de sobressalentes.

With the constant decrease of the wine consumption in traditional winemaking countries, more and more Brazil is seen as an appealing market. But the country also pretends to become an international player of winemaking in its own right. Both the participants of the Brazilian wine industry and the foreigners trying to get advantage of this promising market are facing new challenges to develop the consumption of wine in the world’s fifth largest country. Among all the possible actions to be taken in that sense, it also is worth taking time for a collective thought on the place of wine in the country, as well as the factors that shape it. What are these factors, which ones really make the difference, and what is their respective impact on the evolution of the place of wine in the country? After drawing the big picture of the wine market situation, this thesis tries to identify the levers of the evolution of the place of wine in Brazil. Using the tools of prospective, it aims at putting into perspective the different driving forces that influence its development, and in particular the relative influence of the political drivers. This paper also intends to be a first step of a prospective study as it constitutes a solid base for scenario planning. This paper is divided in five chapters starting with “introduction”, followed by chapter 2 “Theoretical framework”. Chapter 3 is “Methodology”, followed by chapter 4 “Description and analysis of the results”. Finally the results are discussed and concluded in the last part “Conclusions and implications for future studies”.

O escopo teórico de Gestão Internacional atualmente atinge tantos locais quanto pessoas ao redor do planeta e pode se expandir para atender também a um conjunto mais amplo de empresas que somente as multinacionais. Com o objetivo de analisar os desafios cross-culturais e os conflitos que permearam o Comitê Organizador dos XV Jogos Pan-americanos Rio 2007, este estudo equipara Comitês Organizadores de Jogos a subsidiárias com mandato global. A partir de uma metodologia de inspiração interpretativista cultural defendendo o papel do contexto local por uma abordagem crítica, analisa o sistema de ação cultural brasileiro e contrapõe teorias clássicas da abordagem cross-cultural com uma visão qualitativa de base sócio-antropológica. Foram realizadas entrevistas semiestruturadas com ex-funcionários do Comitê Rio 2007 tanto brasileiros quanto estrangeiros e consultores que apoiaram a realização dos Jogos. Várias questões foram levantadas que apóiam a influência de características comportamentais culturais brasileiras como o paternalismo, a lealdade às pessoas, a flexibilidade, e evitar conflitos nas relações pessoais e organizacionais. Ao mesmo tempo, foi possível identificar três possíveis causas de conflitos entre os atores principais das narrativas (os consultores, o Comitê Organizador Rio2007 e o governo): (1) a diferença no nível de experiência /conhecimento explícito e tácito, (2) a desconfiança, e (3) o orgulho; e o esforço de comunicação foi identificado como possível solução. Por fim, foi possível visualizar traços das teorias clássicas cross-culturais dentro do estudo, mas foi reforçada a crítica de que é impossível isolar a cultura e o contexto local como variáveis contingenciais, muito menos ignorá-los.

O objetivo deste estudo explano-exploratório é determinar os fatores chave de sucesso para a operação de PMOs (Project Management Office) nas organizações. Como meio de alcançar o objetivo traçado, realizou-se o levantamento bibliográfico para: (a) conceituar gerenciamento de projetos e PMOs; (b) identificar as diferentes formas de atuação de PMO; (c) identificar os fatores chave de sucesso na operação de PMOs; (d) identificar os fatores que influenciam o sucesso na operação de PMOs; (e) elaborar um meta-modelo contendo os fatores que influenciam e definem o sucesso na operação de PMOs; (f) desenvolver questionário estruturado como instrumento de coleta de dados e (g) levantar metodologia aplicável para o uso de equações estruturais. Durante o período de aplicação do instrumento de coleta de dados, foram obtidas 553 respostas válidas, preenchidas por especialistas em gerenciamento de projetos, sendo 489 do Brasil e 64 de diversos países no mundo. A partir dos dados obtidos, a pesquisa valeu-se das técnicas de Análise Fatorial Exploratória (AFE), Análise Fatorial Confirmatória (AFC) e Modelagem de Equações Estruturais (SEM) para confirmar o meta-modelo teórico proposto. Verificou-se que o meta-modelo inicial não foi confirmado sendo, portanto, necessário a realização de ajustes, os quais foram implementados com justificativas teóricas adequadas. Ainda assim, o meta-modelo final, obtido após as alterações realizadas, explica cerca de 7% da variância dos fatores de sucesso na operação de PMOs.

Trabalhar embarcado no mesmo navio, pode representar um desafio para os tripulantes estrangeiros e brasileiros da empresa Alfa Navegações, devido às diferenças de valores e crenças dessas culturas manifestas no dia a dia desta tripulação marítima. O principal objetivo nesta dissertação é sinalizar impactos na socialização do convívio a bordo entre tripulação mista. Esta pesquisa investigou a construção de um cotidiano intercultural a partir da convivência entre brasileiros e estrangeiros na filial brasileira da empresa Alfa Navegações. O marco teórico foi construído por meio de fundamentos sobre cultura organizacional, relações interculturais e cultura brasileira para compreensão e análise do cotidiano. A metodologia de pesquisa adotada neste trabalho foi o estudo de caso, com ênfase qualitativa. Foi utilizada a entrevista semiestruturada como instrumento principal de coleta de dados. Concluiu-se que as barreiras culturais na comunicação e na adaptação dos tripulantes no convívio intercultural recaem no idioma. Isto reforça os conceitos expostos no marco teórico sobre a necessidade do treinamento intercultural e aprendizagem de outro idioma para auxiliar o convívio entre culturas diferentes. Com isso, notou-se a necessidade de aprender a lidar com outras culturas, tendo em vista o novo cenário internacional, devido ao aumento do trânsito de pessoas e de ideias de fontes culturais diferentes, e que nas relações sociais a questão intercultural tornou-se crucial. Isto ocorre não somente com aqueles que aceitam o desafio de viver ou trabalhar no exterior, mas também com aqueles que recebem estes profissionais e com eles convivem no cotidiano.
