Charles Larned (1791-1834) was a lawyer and American military officer who served during the War of 1812. He was the son of Simon Larned (1753-1817), who served as a captain in the Revolutionary War and was a member of the United States Congress from Massachusetts from 1804-1805. Charles studied law in the office of Henry Clay in Kentucky, and was dining with a group of prominent citizens when word was received that General William Henry Harrison could soon be overpowered by General Henry Proctor. Colonel Owen, a member of the group, organized a regiment to reinforce Harrison’s troops. Larned became a member and subsequently survived the River Raisin Massacre and was later present at the Battle of the Thames. He was also part of a group of men who learned of General William Hull’s plan to surrender Detroit to the British and planned to overtake him should this occur. However, the plan failed, Hull did surrender and the men became prisoners of the British. After the war, Larned became a lawyer, and served as Attorney General of Michigan Territory during the Black Hawk War. During the cholera epidemic of 1834, he worked tirelessly to assist others, but was stricken with the disease and died. La réforme et l’harmonisation du droit des sûretés mobilières sont à l’ordre du jour de plusieurs organisations internationales, car il est admis qu’un régime de sûretés efficient favorise l’accès au crédit à de faibles coûts. L’harmonisation de ce droit comporte deux volets. D’une part, dans l’Occident industrialisé, les efforts d’harmonisation vont de la réforme des droits internes à l’établissement de régimes spéciaux relativement à des biens spécifiques (principalement les biens mobiles de grande valeur, tels les aéronefs, le matériel ferroviaire roulant et les satellites, et les biens incorporels, comprenant les créances, valeurs mobilières, actifs financiers et titres intermédiés). Ces efforts d’harmonisation démontrent que d’un point de vue systémique, malgré quelques différences notables, les régimes nord-américains et européens sont fondés sur des principes similaires et atteignent des résultats comparables. En résulte l’émergence d’un ordre juridique transnational en droit des sûretés mobilières, fondé sur les principes de la primauté de l’individu et la reconnaissance du droit de propriété de l’individu dans ses biens, mis en œuvre grâce à l’État de droit. D’autre part, les institutions financières internationales encouragent l’établissement de régimes de sûretés dans les pays en voie de développement qui obéissent aux mêmes critères que ceux de l’Occident, en insistant sur les réformes institutionnelles et juridiques visant l’établissement d’une bonne gouvernance et l’État de droit. Cependant, une transposition des régimes occidentaux ne peut se faire sans heurts dans les pays en voie de développement, notamment pour des raisons socio-culturelles et politiques. Lorsque les principes de la primauté de l’individu, de la propriété individuelle et de l’État de droit ne sont pas reconnus dans un pays donné, la réforme et l’harmonisation du droit des sûretés s’en trouvent compromis. La démonstration de l’état d’avancement de la réforme et de l’harmonisation du droit des sûretés dans les pays occidentaux industrialisés est faite grâce à une comparaison du Uniform Commercial Code, du Code civil du Québec, des Personal Property Security Acts des provinces canadiennes de common law, des principes des droits français et anglais, de l’influence du droit communautaire sur les pays membres de l’Union Européenne. Sont analysés, aussi, dans cette optique, les principaux instruments de l’harmonisation du droit émanant des organisations internationales. Par ailleurs, deux études de cas relatifs à la réforme du crédit foncier en Égypte et à la réforme de l’urbanisme et de l’habitat en République démocratique du Congo, viennent étayer les difficultés que rencontrent les institutions internationales, telles la Banque mondiale et l’ACDI, dans le cadre de projets de réformes visant la bonne gouvernance et l’instauration d’un véritable État de droit, en partie à cause d’un pluralisme des ordres juridiques de ces pays.

David Hull et Philip Kitcher présentent tous deux une description des sciences qui tient compte autant de l'articulation logique des théories que de leur dynamique sociale. Hull (1988a, 2001) tente de rendre compte du progrès scientifique par le biais d'une analyse sélectionniste, en s'appuyant sur les contingences sociales et les biais individuels en tant que pressions de sélections. Pour lui, un processus de sélection darwinien filtre les théories supérieures des théories inadéquates. Kitcher (1993) présente plutôt le progrès scientifique comme un changement de consensus résultant de processus sociaux et psychologiques qui mènent de manière fiable à la vérité. Les théories sont ainsi filtrées par une dynamique sociale qui sélectionne les théories selon la qualité de leur articulation logique. Kitcher (1988) exprime un doute à l'idée qu'un processus de sélection darwinien du type suggéré par Hull puisse ajouter quoi que ce soit à une explication du processus d'avancement des sciences. Ce mémoire tentera d'établir si cette critique de Kitcher est fondée. Dans cette optique, une analyse détaillée de l’approche de Hull sera nécessaire afin d’examiner comment il justifie le lien qu’il établit entre la pratique scientifique et un processus de sélection. Un contraste sera ensuite fait avec l’approche de Kitcher pour tester la force et la nécessité de ce lien et pour expliquer le désaccord de Kitcher. Cette analyse comparative permettra de préciser les avantages et les désavantages uniques à chacune des approches pour déterminer si une analyse sélectionniste est plus prometteuse qu’une analyse non-sélectionniste pour rendre compte du progrès scientifique.

Chicha (2009) constate un « trou noir » dans la littérature en ce qui a trait au processus qui engendre une plus forte déqualification à l’endroit des immigrantes universitaires. Ce « trou noir » est considéré comme problématique. D’une part, le gouvernement québécois tente de mettre en place des politiques d’immigration qui recrutent des immigrants ayant un capital humain élevé dans l’espoir qu’ils s’insèrent facilement sur marché de l’emploi. D’autre part, la présence plus marquée de déqualification de ce bassin de main d’œuvre démontre un écart entre la volonté politique et la situation réelle en emploi de ces immigrants. Il semble donc exister un problème de discrimination systémique lorsqu’il est question de déqualification des travailleuses immigrantes. Par souci d’équité et dans l’espoir d’avoir une meilleure compréhension du processus menant à la déqualification des immigrantes les objectifs de cette thèse sont de 1- mieux saisir le concept de discrimination en emploi et 2- mettre en place des mesures mieux adaptées pour s’attaquer à cette discrimination. Pour expliquer ce « trou noir », nous considérons que l’approche systémique est pertinente à cause de sa une vision holistique. Nous avons rencontré 52 immigrantes universitaires qui ont partagé leur parcours professionnel pré et post-migratoire. Les thématiques abordées touchaient à de nombreux sujets telles que leur formation, leur expérience professionnelle, leur stratégie d’unité familiale immigrante, leurs démarches concernant tant le processus de reconnaissance de leurs diplômes étrangers que leur insertion sur le marché de l’emploi, le climat de travail, etc. Les résultats de cette recherche indiquent que la discrimination en emploi est toujours présente sur le marché de l’emploi au Québec. De plus, l’origine ethnique, tel que la couleur de la peau, affecte les attitudes, comportements et propos des acteurs du milieu du travail à l’endroit des xiii immigrantes universitaires. L’application des typologies de Van Laer et Janssens (2011) et de Bonilla-Silva (2006) contribue à l’identification des attitudes, des comportements et des propos pouvant être considérés comme étant du racisme subtil. L’un des avancements de cette thèse est l’amélioration du cadre d’analyse systémique afin de mieux comprendre les difficultés à l’emploi des immigrantes universitaires. Les différentes théories empruntées de la psychologie sociale telles que les théories de similarité attraction, de catégorisation sociale et de qualité d’échanges entre subordonné et supérieur (Roberson et Block, 2001) permettent de peaufiner ce cadre d’analyse systémique, puisqu’il permet de mieux saisir les relations, parfois complexes, qui peuvent s’établir entre les différents acteurs et résulter en de la discrimination flagrante ou subtile.

Submarine hull structure is a watertight envelope, under hydrostatic pressure when in operation. Stiffened cylindrical shells constitute the major portion of these submarine hulls and these thin shells under compression are susceptible to buckling failure. Normally loss of stability occurs at the limit point rather than at the bifurcation point and the stability analysis has to consider the change in geometry at each load step. Hence geometric nonlinear analysis of the shell forms becomes. a necessity. External hydrostatic pressure will follow the deformed configuration of the shell and hence follower force effect has to be accounted for. Computer codes have been developed based on all-cubic axisymmetric cylindrical shell finite element and discrete ring stiffener element for linear elastic, linear buckling and geometric nonIinear analysis of stiffened cylindrical shells. These analysis programs have the capability to treat hydrostatic pressure as a radial load and as a follower force. Analytical investigations are carried out on two attack submarine cylindrical hull models besides standard benchmark problems. In each case, the analysis has been carried out for interstiffener, interdeepframe and interbulkhead configurations. The shell stiffener attachment in each of this configuration has been represented by the simply supported-simply supported, clamped-clamped and fixed-fixed boundary conditions in this study. The results of the analytical investigations have been discussed and the observations and conclusions are described. Rotation restraint at the ends is influential for interstiffener and interbulkhead configurations and the significance of axial restraint becomes predominant in the interbulkhead configuration. The follower force effect of hydrostatic pressure is not significant in interstiffener and interdeepframe configurations where as it has very high detrimental effect on buckling pressure on interbulkhead configuration. The geometric nonlinear interbulkhead analysis incorporating follower force effect gives the critical value of buckling pressure and this analysis is recommended for the determination of collapse pressure of stiffened cylindrical submarine shells.

The present investigation has looked exclusively into the aspect of the biological phenomenon of settling behaviour by two serious fouling offenders encountered in the tropical seas mainly on the hulls of ships and stationary structures in the harbours. The cue to study the behaviour was adopted from the observations so far made by scientists on the epizoic growth of these organisms on the surfaces of algal fronds of variegated shape, texture, size etc. The results do indicate that there are sufficient qualities of bioactive substances produced by plants occupying the lowest categories in organic evolution and curiously enough these substances have withstood the test of time.

El trabajo se enmarca en las discusiones relacionadas con segregación espacial, segregación social y construcción de barrios mezclados. Específicamente, selecciona el caso de La Felicidad: ciudad parque en Bogotá como un ejemplo que sirve para analizar las políticas públicas enfocadas en disminuir la segregación residencial en la ciudad a partir de la construcción de un vecindario que está compuesto por vivienda de interés social y vivienda regular. A partir de métodos cuantitativos y cualitativos se analiza cómo esta funcionando esta propuesta urbana.

El autor se interroga acerca de si el Consejo Nacional de Planeación, al igual que los consejos territoriales, son escenarios para el ejercicio de la democracia y si su participación, en la construcción de los planes de desarrollo, constituye un instrumento eficaz para su fortalecimiento o son, por el contrario, un espejismo en la praxis de la democracia en Colombia. En la primera parte se mencionan algunas versiones de democracia desde Lincoln, pasando por las versiones de Tocqueville, Shumpeter, Dahl, Bryce, Borón y Sartori. Se identifican en cada caso los elementos fundamentales para tenerlos como referente y soporte de análisis para dar cuenta, en la segunda parte, cuál o cuáles formas de esas democracias describen el modus operandi en el seno de los consejos de planeación en los niveles nacional o territorial. Igualmente se analiza el rol de los consejos de planeación, su legitimidad, la calidad y trascendencia de las intervenciones de sus miembros, así como la capacidad de incidir en el proyecto de ley del Plan Nacional de Desarrollo, para lo cual se recurre a entrevistar a miembros y ex miembros de los consejos Nacional y Distrital de planeación. El autor, además de responder algunos interrogantes que se plantea sobre el tema objeto de esta reflexión, deja planteados otros para la consideración de los lectores.

Este proyecto busca determinar que utilización se hace de los conceptos de caos y complejidad en las empresas del sector financiero colombiano, para así encontrar la relación entre estos conceptos y la ocurrencia de eventos en la economía actual. Se adoptó un método descriptivo, donde se tomará como unidad de análisis una empresa representativa del sector financiero de Colombia. La compañía escogida para el análisis fue Bancolombia, la cual debido a su larga trayectoria dentro de la economía colombiana, ha demostrado un buen desempeño y el logro de sus objetivos a nivel nacional e internacional. El análisis realizado permitió tener una visión amplia y representativa del significado que el caos y la complejidad tienen para el sector financiero; y como sus respectivos conceptos se aplican a la hora de enfrentar condiciones extremas en la industria o la economía. Pero también como el comportamiento de variables pertenecientes a otras industrias, tienen la capacidad de afectar e influir en el normal comportamiento de la compañía. Se concluyó además que Bancolombia en épocas de crisis logra ser mucho más realista al afrontar los momentos. Las crisis se muestran como caos dentro de un sistema simple y organizado que afecta a sus diferentes variables no lineales, y que puede llegar a una interacción entre otros sistemas, produciendo así comportamientos críticos y complicados. Se muestra también que la complejidad dentro de un sistema financiero es una creación de interacciones simples que muestran un parámetro claro, casi deducible, que al interactuar entre todas se convierte en complejidad para las organizaciones como Bancolombia.

Com os avanços da tecnologia as crianças e jovens passam demasiado tempo sem realizar atividade física (Rodrigues, 2000), exceto a que é proporcionada na escola. É nas aulas de Educação Física que se notam as dificuldades sentidas pelos alunos na realização de exercícios devido à sua fraca aptidão física, sendo a força uma das capacidades motoras com maior défice. O presente trabalho pretende analisar as possibilidades de melhorias da força através da realização de exercícios específicos nas aulas de Educação Física. Para tal, realizámos um estudo experimental com dois grupos: GE (grupo experimental), onde foi aplicado um programa de treino de desenvolvimento da força superior e média, durante seis semanas, em três sessões semanais e GC (grupo de controlo) onde não foi aplicado o programa de treino. A amostra foi constituída por trinta e quatro alunos, de ambos os géneros, pertencentes a três turmas do 9º ano de escolaridade, com idades compreendidas entre os catorze e os dezasseis anos, da Escola EB 2,3 António Gedeão em Odivelas. Após a análise estatística (Teste T-Pares) constatámos que existiram melhorias nos dois testes, nos dois géneros, em ambos os grupos, com as seguintes exceções: extensões de braços nas raparigas do GC (decréscimo não significativo); abdominais das raparigas do GC (valor manteve-se); extensões de braços das raparigas no GE (melhoria significativa). Concluímos que a aplicação de alguns exercícios específicos, devidamente integrados no normal funcionamento das aulas, provocou melhorias na força. O estudo sugere a possibilidade de alcançar melhores resultados ao nível da aptidão física mediante a inclusão de exercícios específicos no plano de aulas.

Seeds of Avicennia alba BI. matured at high moisture content and were sensitive to desiccation: no seeds survived desiccation below 35% moisture content. The effect on survival of a factorial combination of five moist storage treatments (fresh seeds in a polyethylene bag, open with water sprayed over regularly, mixed with sand at 10% moisture content, mixed with moist paddy hulls, or naked seeds mixed with sand at 10% moisture content) and three temperatures (28-30degreesC, 17degreesC and 8-10degreesC) was investigated. In addition, seeds were mixed with sand at 5% moisture content and stored at 17degreesC in order to determine the effect of sand moisture content on seed moisture content and viability during storage. Avicennia alba showed recalcitrant seed storage behaviour, but 75% of the seeds remained viable after four months' moist (45-47% moisture content) storage in 10% moisture content sand at 17degreesC.

Dry and mature tree fruits are a potential source of protein for goats in the semi-arid areas of southern Africa, but their chemical composition and feeding value is largely unknown. This study presents the chemical composition and in vitro fermentation of indehiscent whole fruits and separated seed and hull fractions from Acacia nilotica, Acacia erubescens, Acacia sieberiana, Acacia erioloba, Piliostigma thonningii and Dichrostachys cinerea trees. Results indicate that the N contents of whole fruits ranged between 13.5 g/kg DM (A. nilotica) and 27.1 g/kg DM (A. erubescens). Seeds had a higher N content than hulls for all tree species. A. nilotica, D. cinerea and P thonningii fruits had high levels of extractable phenolics (758, 458 and 299 g/kg DM, respectively). Soluble phenolics (SPh) and ytterbium precipitable phenolics (YbPh) levels were negatively correlated to in vitro gas production but positively correlated to in vitro organic matter degradability (iOMD). Partition factors for whole fruits at 48 h ranged between 3.6 mg/ml for A. erioloba and 7.8 mg/ml for A. nilotica. Seeds of A. erioloba, A. erubescens and P thonningii were consistently fermented more efficiently throughout the incubation period compared to their whole fruits or hulls. Estimating in vitro degradability of phenolic-rich substrates through filtration procedures can give erroneous results due to the loss of soluble phenolics, which are not necessarily degradable. The feeding value of fruits from D. cinerea and A. nilotica tree species may be reduced due to the presence of high levels of phenolics. (C) 2007 Elsevier B.V. All rights reserved.

A study was conducted to estimate variation among laboratories and between manual and automated techniques of measuring pressure on the resulting gas production profiles (GPP). Eight feeds (molassed sugarbeet feed, grass silage, maize silage, soyabean hulls, maize gluten feed, whole crop wheat silage, wheat, glucose) were milled to pass a I mm screen and sent to three laboratories (ADAS Nutritional Sciences Research Unit, UK; Institute of Grassland and Environmental Research (IGER), UK; Wageningen University, The Netherlands). Each laboratory measured GPP over 144 h using standardised procedures with manual pressure transducers (MPT) and automated pressure systems (APS). The APS at ADAS used a pressure transducer and bottles in a shaking water bath, while the APS at Wageningen and IGER used a pressure sensor and bottles held in a stationary rack. Apparent dry matter degradability (ADDM) was estimated at the end of the incubation. GPP were fitted to a modified Michaelis-Menten model assuming a single phase of gas production, and GPP were described in terms of the asymptotic volume of gas produced (A), the time to half A (B), the time of maximum gas production rate (t(RM) (gas)) and maximum gas production rate (R-M (gas)). There were effects (P<0.001) of substrate on all parameters. However, MPT produced more (P<0.001) gas, but with longer (P<0.001) B and t(RM gas) (P<0.05) and lower (P<0.001) R-M gas compared to APS. There was no difference between apparatus in ADDM estimates. Interactions occurred between substrate and apparatus, substrate and laboratory, and laboratory and apparatus. However, when mean values for MPT were regressed from the individual laboratories, relationships were good (i.e., adjusted R-2 = 0.827 or higher). Good relationships were also observed with APS, although they were weaker than for MPT (i.e., adjusted R-2 = 0.723 or higher). The relationships between mean MPT and mean APS data were also good (i.e., adjusted R 2 = 0. 844 or higher). Data suggest that, although laboratory and method of measuring pressure are sources of variation in GPP estimation, it should be possible using appropriate mathematical models to standardise data among laboratories so that data from one laboratory could be extrapolated to others. Background: Aggressive periodontitis is a specific form of periodontal disease that is characterized by rapid attachment loss and bone destruction. Cytokine profiles are of considerable value when studying disease course during treatment. The aim of this trial was to investigate cytokine levels in the gingival crevicular fluid (GCF) of patients with aggressive periodontitis, after treatment with photodynamic therapy (PDT) or scaling and root planing (SRP), in a split-mouth design on -7, 0, +1, +7, +30, and +90 days. Methods: Ten patients were randomly treated with PDT using a laser source associated with a photosensitizer or SRP with hand instruments. GCF samples were collected, and the concentrations of tumor necrosis factor-alpha (TNF-alpha) and receptor activator of nuclear factor-kappa B ligand (RANKL) were determined by enzyme-linked immunosorbent assays. The data were analyzed using generalized estimating equations to test the associations among treatments, evaluated parameters, and experimental times (alpha = 0.05). Results: Non-surgical periodontal treatment with PDT or SRP led to statistically significant reductions in TNF-alpha level 30 days following treatment. There were similar levels of TNF-alpha and RANKL at the different time points in both groups, with no statistically significant differences. Conclusion: SRP and PDT had similar effects on crevicular TNF-alpha and RANKL levels in patients with aggressive periodontitis. J Periodontol 2009;80:98-105.

The objective of the present study was to evaluate the mycoflora and occurrence of aflatoxins in stored peanut samples (hulls and kernels) from Tupa, State of Sao Paulo, Brazil. The samples were analyzed monthly over a period of one year. The results showed a predominance of Fusarium spp. (67.7% in hulls and 25.8% in kernels) and Aspergillus spp. (10.3% in hulls and 21.8% in kernels), and the presence of five other genera. The growth of Aspergillus flavus was mainly influenced by temperature and relative humidity. Analysis of hulls showed that 6.7% of the samples were contaminated with AFB(1) (mean levels 15-23.9 mu g/kg) and AFB(2) (mean levels = 3.3-5.6 mu g/kg); in kernels, 33.3% of the samples were contaminated with AFB(1) (mean levels 7.0-116 mu g/kg) and 28.3% were contaminated with AFB(2) (mean levels = 3.3-45.5 mu g/kg).
