This article examines the particular experiences of female ‘cause lawyers’ in conflicted and transitional societies. Drawn from an ongoing comparative project which involved fieldwork in Cambodia, Chile, Israel, Palestine, Tunisia and South Africa, the paper looks at opportunities, obstacles and the obduracy required from such lawyers to ‘make a difference’ in these challenging contexts. Drawing upon the theoretical literature on the sociology of the legal profession, cause-lawyers, gender and transitional justice, and the structure/agency nexus, the article considers in turn the conflict\cause-lawyering intersection and the work of cause-lawyers in transitional contexts. It concludes by arguing that the case-study of cause-lawyers offers a rebuttal to the charge that transitional justice is just like ‘ordinary justice’. It also contends that, notwithstanding the durability of patriarchal power in transitional contexts, law remains a site of struggle, not acquiescence, and many of these cause-lawyers have and continue to exercise both agency and responsibility in ‘taking on’ that power.

Focusing on post-apartheid South Africa, the report explores the role of lawyers in truth recovery mechanisms.
The report was prepared by Dr Rachel Killean and draws on a series of interviews conducted in South Africa (with legal academics, ‘struggle’ lawyers, state lawyers, judges and human rights activists) as part of the wider Lawyers, Conflict and Transition project.
Dr Killean begins with an overview of the various roles the legal profession has played in South Africa, both during the apartheid era and post-transition.
The first half of the report then explores the role of lawyers as professional participants – firstly at the South African Truth and Reconciliation Commission and secondly in the Marikana Commission of Inquiry.
The report then considers the notion of lawyers as subjects of truth recovery, looking in particular at the Special Legal Hearing on the legal profession as part of the South African Truth and Reconciliation Commission.
In the concluding section Killean reflects on the extent to which lawyers influence the procedures and outcomes of truth recovery mechanisms and offers some concrete suggestions as to how the involvement of lawyers in such processes might be more effectively managed.
With regard to lawyers as subjects of truth recovery, she acknowledges the limitations of the South African model but posits that the endeavour must be applauded, not least because it demonstrated that it is possible to scrutinise the role of the legal profession in past conflict, and that it is worth wrestling with the associated challenges.

INTRODUÇÃO: a responsabilidade do cirurgião-dentista pode ser entendida como obrigações de ordem penal, civil, ética e administrativa, às quais está sujeito no exercício de sua atividade. Assim, se comprovado um resultado lesivo ao paciente - por imprudência, imperícia ou negligência -, o cirurgião-dentista estará sujeito às penalidades previstas no Código Civil, sendo obrigado a satisfazer o dano e indenizar segundo a consequência provocada. Em processos cíveis, as partes poderão contratar um assistente técnico para fornecer, aos respectivos advogados, conhecimentos técnicos e científicos inerentes ao tema. OBJETIVO: informar sobre a importância da atuação de assistentes técnicos em processos cíveis, propiciando às partes uma maior compreensão dos aspectos técnicos, éticos e legais. CONCLUSÃO: há a necessidade de um maior conhecimento, por parte dos profissionais em Odontologia, sobre os aspectos éticos e legais que norteiam a profissão.

Significance of the decision in McCabe v British American Tobacco Australia Services Ltd - ramifications for the possibilities for success of future litigation of this nature in Australia and overseas - ethical and public policy issues regarding the duties of lawyers to the courts and to their clients - whilst a lawyer's implication in the destruction of documents to prevent a fair trial ultimately involves stricter duties, it exposes a need for vigilance against the possibilities for corporations to act outside the public interest, if not the justice system.

This paper uses three films adapted from the novels of John Grisham, The Firm, The Rainmaker and A Time To Kill, as well as associated television series like Ed to map a vernacular theory of what I have termed the 'postmaterial' lawyer. Grisham's work has been the focus of much critique by legal scholars who suggests he hates lawyers, is critical of the concept of law, and provides 'outlandishly' happy endings. I will challenge these critiques and, in tracing the history of legal thrillers and trial movies, suggest that Grisham and the related texts' explorations of how a just practitioner can operate in an unjust system constitute a powerful interrogation of what law can be.

A chamada Lei do Branqueamento de Capitais - Lei 25/2008, de 5/6 e alterações -, considera que estão sujeitas a especiais obrigações os “Notários, conservadores de registos, advogados, solicitadores e outros profissionais independentes, constituídos em sociedade ou em prática individual, que intervenham ou assistam, por conta de um cliente ou noutras circunstâncias, em operações: § vi) De alienação e aquisição de direitos sobre praticantes de actividades desportivas profissionais;”. Estamos a pensar, como é óbvio, nas transferências de jogadores de futebol, nomeadamente na Europa, as quais atingem somas astronómicas e muitas vezes ocultas. Muitas outras medidas poderiam ser alvitradas, mas estas são algumas das ideias fundamentais para um programa de Governo que visa uma Justiça humanista, na qual o Ser Humano, organizado ou individual, é o centro da questão. A Justiça portuguesa também não pode ser uma competição entre a cor-de-laranja e o rosa, vermelho, azul ou qualquer outra cor, como amarelo, cinzento, castanho, entre outras. A Justiça portuguesa deve fazer-se sentir e respeitar. Não é mentira se dissermos que temos entre os melhores Magistrados do mundo, entre os melhores Advogados e Solicitadores do mundo, entre os melhores Funcionários Judiciais, Conservadores, Notários e outros Auxiliares de Justiça, entre os melhores polícias e investigadores do mundo. Bem hajas, Portugal, pois és capaz de muito mais e melhor. § There is the fact there are lies and there are statistics. Many other measures could be tell, but these are some of the key ideas for a government program aimed at a humanistic Justice, in which the human being organized or individual, is the heart of the matter. The Portuguese Justice can not be a competition between the pink-orange and pink, red, blue or any other color, such as yellow, gray, brown, and others. The Portuguese Justice must be felt and respect. It's not a lie if we say we have among the best Magistrates of the world, among the best Lawyers and Solicitors of the world, among the best Judicial Officers, Conservatives, notaries and other auxiliaries of Justice, police and among the best researchers in the world. In Permanent Transit: Discourses and Maps of the Intercultural Experience builds interdisciplinary approaches to the study of migrations, traffics, globalization, communication, regulations, arts, literature, and other intercultural processes, in the context of past and present times. The book offers a convergence of perspectives, combining conceptual and empirical work by sociologists, anthropologists, historians, linguists, educators, lawyers, media, specialists, and literary studies writers, in their shared attempt to understand the many routes of the intercultural experience. OBJECTIVE To analyze the access and utilization profile of biological medications for psoriasis provided by the judicial system in Brazil.METHODSThis is a cross-sectional study. We interviewed a total of 203 patients with psoriasis who were on biological medications obtained by the judicial system of the State of Sao Paulo, from 2004 to 2010. Sociodemographics, medical, and political-administrative characteristics were complemented with data obtained from dispensation orders that included biological medications to treat psoriasis and the legal actions involved. The data was analyzed using an electronic data base and shown as simple variable frequencies. The prescriptions contained in the lawsuits were analyzed according to legal provisions.RESULTS A total of 190 lawsuits requesting several biological drugs (adalimumab, efalizumab, etanercept, and infliximab) were analyzed. Patients obtained these medications as a result of injunctions (59.5%) or without having ever demanded biological medication from any health institution (86.2%), i.e., public or private health services. They used the prerogative of free legal aid (72.6%), even though they were represented by private lawyers (91.1%) and treated in private facilities (69.5%). Most of the patients used a biological medication for more than 13 months (66.0%), and some patients were undergoing treatment with this medication when interviewed (44.9%). Approximately one third of the patients discontinued treatment due to worsening of their illness (26.6%), adverse drug reactions (20.5%), lack of efficacy, or because the doctor discontinued this medication (13.8%). None of the analyzed medical prescriptions matched the legal prescribing requirements. Clinical monitoring results showed that 70.3% of the patients had not undergone laboratory examinations (blood work, liver and kidney function tests) for treatment control purposes.CONCLUSIONS The plaintiffs resorted to legal action to get access to biological medications because they were either unaware or had difficulty in accessing them through institutional public health system procedures. Access by means of legal action facilitated long-term use of this type of medication through irregular prescriptions and led to a high rate of adverse drug reactions as well as inappropriate clinical monitoring.

O presente relatório visa cumprir os requisitos da unidade curricular Dissertação, Projeto ou Estágio (DIPRE) do mestrado em Engenharia Civil do Instituto Superior de Engenharia do Porto (ISEP). O estágio curricular decorreu na empresa VPM - Vaz Pinto Mendes - Unipessoal Lda, sob o tema: “A avaliação imobiliária e a sua relação com o investimento”. A avaliação imobiliária visa determinar o valor associado aos bens imóveis. Pode ser aplicada a todo o tipo de bens imóveis, tais como: apartamentos e moradias uni e multifamiliares, espaços comerciais e de serviços, quintas, unidades hoteleiras e industriais, complexos desportivos, entre outros. A avaliação imobiliária poderá ser solicitada por parte de proprietários ou arrendatários dos imóveis, por empresas, tribunais, advogados e solicitadores. Apresenta diversos fins, tais como a determinação do valor de indemnização devido a expropriações, o financiamento hipotecário para compra ou construção de imóveis, partilhas, estudo de um investimento financeiro, intenção de venda ou arrendamento, efeitos fiscais ou apenas o simples conhecimento do valor aproximado das propriedades que se possui. O presente estudo visa abordar o atual mercado imobiliário nacional, o procedimento de realização de uma avaliação imobiliária e principalmente os métodos de avaliação tradicionais.

This paper summarises the results of the first systematic, detailed prosopographic study of the MPs – the deputados of the Lower Chamber - of the First Portuguese Republic (1910-1926). Data are presented both by legislature and for the overall period. Two kinds of background variables are explored: sociodemographic (birthplace, age, education and profession) and political (previous experience in other elite positions). Regime change in 1910 resulted in the replacement of the former political elite by homines novi. Most MPs of the Republican regime were born in small towns and communities, had carried out higher educational studies (with prevalence for law training), were mainly drawn from the professions (practising lawyers and doctors) and the Army, and were elected for the first-time at relatively young ages. Parliamentary turnover was high (two-thirds of the representatives held just one mandate) and a large proportion of MPs had a consistent connection (birth, family ties, occupation) to the constituencies to which they had been elected.
