Con el fin de la unipolaridad no sólo se fortalecieron mecanismos de gobernanza global como los Regímenes Internacionales, sino también se fortalecieron actores no estatales. A pesar de la importancia que tomaron estos dos elementos aún no existe una teoría que explique exhaustivamente la relación que existe entre ellos. Es por lo anterior que, la investigación busca responder de qué manera el rol de las Redes de Apoyo Transnacional ha incidido en la evolución del régimen de tráfico de personas en la Región del Mekong. Asimismo tiene como objetivo comprender las relación entre el Régimen y las Redes de Apoyo Transnacional a través de la formulación de un caso de estudio basado en metodologías cualitativas, específicamente, en el análisis teórico-constructivista y el análisis de contenido de documentos producidos por actores estatales y no estatales.

El presente estudio de caso tiene como principal objetivo el de analizar la manera como las características sociopolíticas de los Estados del Mekong, específicamente en el caso de Camboya y Myanmar, dificultan la implementación de las normas enunciadas en el Protocolo de las Naciones Unidas para Prevenir, Reprimir y Sancionar la Trata de Personas, Especialmente Mujeres y Niños, también conocido como el Protocolo de Palermo. En este sentido, se parte de las características principales del Protocolo y de la manera como el tráfico de personas se presenta en el Mekong para posteriormente analizar la forma como la corrupción, la impunidad y la desigualdad de género representan retos sociopolíticos que obstruyen la implementación de los mandatos internacionales enmarcados en este instrumento

Introducción: Los Desórdenes Musculo-Esqueléticos (DME) tienen origen multifactorial. En Colombia corresponden al principal grupo diagnóstico en procesos relacionados con la determinación de origen y pérdida de capacidad laboral. Objetivo: Determinar la relación entre síntomas musculo-esqueléticos y factores relacionados con la carga física en trabajadores de una empresa dedicada a la venta y distribución de medicamentos y equipos médicos, Bogotá (Colombia), en el año 2015. Materiales y Métodos: Estudio de corte transversal en 235 trabajadores. Se incluyeron variables sociodemográficas, ocupacionales y las relacionadas con los síntomas musculoesqueléticos y carga física. Se utilizó en cuestionario ERGOPAR. Para el análisis se utilizó la Prueba Exacta de Fisher, el Odds Ratio (OR) con el Intervalo de Confianza (IC) del 95%. Se realizó el análisis Multivariado con Regresión Logística Binaria. Resultados: La prevalencia de síntomas relacionados con DME fue de 79,2%, siendo más prevalente en cuello, hombros y columna dorsal (48,1%), seguido por columna lumbar (35,3%). Se encontró una asociación entre síntomas en cuello, hombros y/o columna dorsal con el sexo femenino (p=0,005, OR=2,33, 95%IC: 1,2-4,2); adoptar postura bípeda menos de 30 minutos (p=0,004, OR=3,34, 95%IC: 1,4-7,6); adoptar postura cabeza/cuello inclinado hacia delante entre 30 minutos y 2 horas (p=0,007, OR=3,25, 95%IC :1,3-7,7) y en columna lumbar con adoptar postura espalda/tronco hacia delante entre 30 minutos y 2 horas (p=0,001, OR=4,27, 95%IC: 1,7-10,3); y la antigüedad en el cargo entre 1 y 5 años (p=0,009, OR=3,47, 95%IC: 1,3-8,8). Conclusión: Las posturas bípedas con y sin desplazamiento, inclinaciones de tronco y cabeza, transporte manual de cargas, sexo femenino, antigüedad en el cargo y edad están asociadas conjuntamente al riesgo para presentar DME.

This research aimed to develop a questionnaire measure of workers’ perceptions of decent work. The initial pool of 72 items covered the substantive elements used by the International Labour Organization to characterize decent work. It was administered to workers from Portugal (N = 636) and Brazil (N = 1039) and submitted to exploratory and confirmatory factor analysis. The final 31-item version yields seven factor scores in addition to the global decent work score. With good reliability, convergent and discriminant validity indices, the DWQ could open new avenues for empirical studies of the decent work concept.

Structured Abstract Purpose: this article systemizes the main historical milestones which led to the current concept of decent work and presents some implications for business. Approach: after presenting the scenario which gives a special meaning and importance to decent work, the historical landmarks are systematized until the definition of the Decent Work Agenda. Findings: Decent work is a concept that has evolved since the ILO Foundation in 1919 and had several important steps throughout its development: Philadelphia Declaration in 1944, ILO constitution update in 1946, Universal Declaration of Human Rights in 1948, Human Development Report, first edition in 1990, World Summit for Social Development in 1995, ILO Declaration on Fundamental Principles and Rights at Work in 1998, World Economic Forum in 1999, Global Compact in 2000, United Nations Millennium Declaration in 2000, ILO Declaration on Social Justice for a Fair Globalization in 2008, Global Jobs Compact in 2009, and inclusion in the 2030 Agenda for Sustainable Development. Throughout this development we can witness the refinement and operationalization of the concept, its institutionalization and its spread at political level, at least as an intention. Practical implications: the business area is a privileged forum to turn policies into practices and some examples are provided. Value: although decent work emerged in a very different social and economic scenario from the present time, it is claimed to be even more topical and relevant for the development of business and society today.

ResumenEste trabajo pretende abordar desde un enfoque deductivo, el fenómeno del relativismo cultural. Es así como se parten de las premisas teóricas y conceptuales de lo que se entiende por este tipo de relativismo, su contraste con los derechos humanos de alcance universal, hasta llegar a su implementación a través de diferentes normas internacionales. Se analizarán las principales fuentes, consistentes en tratados, conferencias y declaraciones, en las que se visualiza la tutela y defensa del relativismo cultural. Finalmente, se reflexionará en torno a la efectividad de la salvaguarda de esta modalidad de relativismo y las particularidades propias de cada una de las fuentes jurídicas y políticas invocadas. It analyzed the major sources,consisting of treaties, conferences and declarations, which displays the protection and defenseof cultural relativism. Employment-related policies are sensitive by any standard, and they remain basically national despite international labour standards (ILS) being even older than the United Nations. Globalization is changing this situation where countries may have to choose between ‘more’ or ‘better’ jobs. The multilateral framework of the World Trade Organization (WTO) can only have an indirect impact. But Regional Trade Agreements (RTA) and International Investment Agreements (IIA) are emerging as a new way of gradually enhancing the impact of certain labour standards. In addition, unilateral measures both by governments and importers driven by social and environmental consumer preferences and pressure groups increasingly shape the international regulatory framework for national employment policies. Even small, locally operating enterprises risk marginalization and market exclusion by ignoring these developments. The long-term influence of this new ‘network approach’ on employment-related policies, including job location, gender issues, social coherence and migration remains to be seen. Nonetheless, the still flimsy evidence gathered here seems to indicate that this new, international framework might increase sustainable employment where and when supporting measures, including through unilateral preferences and even sanctions, form a ‘cocktail’ which export-oriented industries and their suppliers will find palatable.

Research on the relationship between reproductive work and women´s life trajectories including the experience of labour migration has mainly focused on the case of relatively young mothers who leave behind, or later re-join, their children. While it is true that most women migrate at a younger age, there are a significant number of cases of men and women who move abroad for labour purposes at a more advanced stage, undertaking a late-career migration. This is still an under-estimated and under-researched sub-field that uncovers a varied range of issues, including the global organization of reproductive work and the employment of migrant women as domestic workers late in their lives. By pooling the findings of two qualitative studies, this article focuses on Peruvian and Ukrainian women who seek employment in Spain and Italy when they are well into their forties, or older. A commonality the two groups of women share is that, independently of their level of education and professional experience, more often than not they end up as domestic and care workers. The article initially discusses the reasons for late-career female migration, taking into consideration the structural and personal determinants that have affected Peruvian and Ukrainian women’s careers in their countries of origin and settlement. After this, the focus is set on the characteristics of domestic employment at later life, on the impact on their current lives, including the transnational family organization, and on future labour and retirement prospects. Apart from an evaluation of objective working and living conditions, we discuss women’s personal impressions of being domestic workers in the context of their occupational experiences and family commitments. In this regard, women report varying levels of personal and professional satisfaction, as well as different patterns of continuity-discontinuity in their work and family lives, and of optimism towards the future. Divergences could be, to some extent, explained by the effect of migrants´ transnational social practices and policies of states.

The international shipping sector is a major contributor to global greenhouse gas (GHG) emissions. The International Maritime Organisation (IMO) has adopted some technical and operational measures to reduce GHG emissions from international shipping. However, these measures may not be enough to reduce the amount of GHG emissions from international shipping to an acceptable level. Therefore, the IMO Member States are currently considering a number of proposals for the introduction of market-based measures (MBMs). During the negotiation process, some leading developing countries raised questions about the probable confl ict of the proposed MBMs with the rules of the World Trade Organisation (WTO). This article comprehensively examines this issue and argues that none of the MBM proposals currently under consideration by the IMO has any confl ict with the WTO rules.

The IMO, a United Nations specialized agency, has been entrusted with the duty to provide machinery for cooperation among governments for the prevention and control of pollution of the marine environment from vessels. The organization is responsible for drafting legal instruments as well as for facilitating technical cooperation for the protection of the marine environment. Although IMO legal instruments are mainly targeted at the prevention of pollution of the marine environment from vessels, there is a trend towards a liberal interpretation of this, and the organization has expanded its work to areas like shipbreaking, which is essentially a land-based industry.

Le Québec reçoit chaque année un nombre croissant de travailleurs agricoles temporaires, à travers deux programmes : le Programme des travailleurs agricoles saisonniers (principalement Mexicains) et le Programme des travailleurs peu qualifiés (pour l’instant Guatémaltèques). Une de leurs caractéristiques communes est le lien fixe à l’employeur imposé aux travailleurs. Cette recherche analyse la conformité de cette disposition avec l’article 46 de la Charte québécoise qui garantit le droit à des conditions de travail justes et raisonnables. Un examen des effets du lien fixe démontre que celui-ci établit une dépendance forte des travailleurs envers leur employeur, aux niveaux légal (du fait de la possibilité du rapatriement anticipé en cas de problèmes liés au travail ou au comportement), financier (dû à la nomination des travailleurs année après année et au dépôt de sécurité imposé aux travailleurs guatémaltèques) et psychologique (soumission, crainte). L’interprétation de l’article 46 à la lumière du droit international des droits de la personne met en évidence la non conformité du lien fixe avec cette disposition. Or si l’objectif de cette mesure est de retenir la main-d’oeuvre dans le secteur agricole, il serait plus juste et raisonnable d’améliorer les conditions de travail de cette main-d’oeuvre plutôt que de l’asservir.

Cette étude traite des difficultés que rencontrent les travailleurs agricoles salariés dans l’exercice de leur droit à la liberté d’association et à la négociation collective. Ils sont souvent exclus des régimes législatifs nationaux de protection des droits syndicaux ou restreints dans leur capacité de les exercer en dépit du fait qu’ils sont parmi les plus pauvres et mal nourris de la planète et donc requerraient une protection accrue. Quelles sont les causes historiques de ce traitement discriminatoire (première partie) ? Comment le droit international du travail contribue-t-il à remédier à cette situation (deuxième partie) ? En quoi est-ce que le droit international du travail a-t-il influencé le droit interne canadien pour la protection des travailleurs agricoles salariés (troisième partie) ? Les causes du traitement singulier accordé à ces travailleurs remontent aux origines mêmes de l’agriculture. Consciente des caractéristiques particulières de cette activité, l’Organisation internationale du travail affirmera dès le début du 20e siècle qu’il est injustifié d’empêcher les travailleurs agricoles salariés de se syndiquer. Elle insiste sur la valeur fondamentale des droits syndicaux devant différents forums onusiens et favorise leur promotion à travers l’élaboration de normes du travail mais également d’instruments de soft law, considérés mieux adaptés dans un contexte contemporain de mondialisation. Ce droit international du travail influencera ensuite l’interprétation de la Charte canadienne des droits et libertés par les tribunaux canadiens dans leur analyse de la constitutionnalité de l’exclusion totale ou partielle des travailleurs agricoles salariés des régimes législatifs de protection des droits syndicaux.
