The question that I will explore in this research dissertation is whether one can defend the rights of homeland minorities as a progressive extension of the existing norms of human rights. This question calls for several deeper inquiries about the nature, the function and the underlying justifications for both human rights and minority rights. In particular, this research project will examine the following issues: on what normative grounds the available norms of human rights and minority rights are justified; if there is any methodic way to use the normative logic of human rights to support substantial forms of minority claims, such as the right to self-determination; whether human rights can take the form of group rights; and finally, whether there is any non-sectarian basis for justifying the minority norms, which can be acceptable from both liberal and non-liberal perspectives. This research project has some implications for both theories of minority rights and human rights. On the one hand, the research employs the topic of minority rights to shed light on deficiencies of the existing political theories of human rights. On the other hand, it uses the political theory to shed light on how existing theories of minority rights could be improved and amended. The inquiry will ultimately clarify how to judge the merit of the claim that minority rights are or should be a part of human rights norms.

The main purpose of this study is to evaluate the best set of features that automatically enables the identification of argumentative sentences from unstructured text. As corpus, we use case laws from the European Court of Human Rights (ECHR). Three kinds of experiments are conducted: Basic Experiments, Multi Feature Experiments and Tree Kernel Experiments. These experiments are basically categorized according to the type of features available in the corpus. The features are extracted from the corpus and Support Vector Machine (SVM) and Random Forest are the used as Machine learning algorithms. We achieved F1 score of 0.705 for identifying the argumentative sentences which is quite promising result and can be used as the basis for a general argument-mining framework.

La presente tesi affronta l’evoluzione dei rapporti tra costituzionalismo democratico e diritto sovranazionale in Europa. L’ipotesi della ricerca si basa sull’idea che l’aumentare sempre più incessante negli ultimi decenni di conflitti costituzionali tra i due ordinamenti sia dovuto ad una loro differenza di fondo, di cui una parte importante è rappresentata dall’assenza della questione sociale nel diritto sovranazionale. Il primo capitolo si occupa di analizzare le principali teorie giuridiche che hanno fornito l’habitus teorico per leggere il processo di integrazione, giustificando l’adozione di una lettura delle dinamiche ordinamentali attraverso il prisma dei conflitti e della costituzione materiale. Nel secondo capitolo si volge lo sguardo all’analisi del diritto giurisprudenziale, suddiviso in due blocchi: un primo in cui – dopo aver approfondito alcuni capisaldi del diritto sovranazionale – si confrontano i due sistemi, in maniera statica, su alcuni temi (principio di non discriminazione, libertà di impresa e il bilanciamento con interessi collettivi, i diritti di pressione democratica, ecc.) per mettere in luce i diversi approcci; un secondo blocco in cui, invece, si studiano, in maniera più dinamica, le diverse perturbazioni che hanno interessato i rapporti tra ordinamenti, di cui una prima si è sviluppata sul rispetto dei diritti fondamentali da parte del diritto sovranazionale, mentre una seconda, ancora in corso, si concentra sul discorso sull’identità costituzionale. Nel terzo capitolo, in chiusura, si prova a sviluppare – sulla base delle risultanze del dibattito teorico e dell’analisi giurisprudenziale – una proposta finale che cerchi di unire la questione sociale e il discorso sull’identità costituzionale nel diritto pubblico europeo, che abbia alla sua base un nuovo e più centrale ruolo che dovranno svolgere le Corti costituzionali nello sviluppo delle dinamiche ordinamentali, al fine di far emergere alcuni conflitti di valore assenti nello spazio pubblico europeo.

The chapters of the thesis focus on a limited variety of selected themes in EU privacy and data protection law. Chapter 1 sets out the general introduction on the research topic. Chapter 2 touches upon the methodology used in the research. Chapter 3 conceptualises the basic notions from a legal standpoint. Chapter 4 examines the current regulatory regime applicable to digital health technologies, healthcare emergencies, privacy, and data protection. Chapter 5 provides case studies on the application deployed in the Covid-19 scenario, from the perspective of privacy and data protection. Chapter 6 addresses the post-Covid European regulatory initiatives on the subject matter, and its potential effects on privacy and data protection. Chapter 7 is the outcome of a six-month internship with a company in Italy and focuses on the protection of fundamental rights through common standardisation and certification, demonstrating that such standards can serve as supporting tools to guarantee the right to privacy and data protection in digital health technologies. The thesis concludes with the observation that finding and transposing European privacy and data protection standards into scenarios, such as public healthcare emergencies where digital health technologies are deployed, requires rapid coordination between the European Data Protection Authorities and the Member States guarantee that individual privacy and data protection rights are ensured.

Colapso do sistema informático da Justiça, Citius?! É que, a ser verdade, então seria o kaos da justiça e teria que haver consequências imediatas na tutela, pois poderia estar em causa a aplicação prática dos Direitos Fundamentais dos cidadãos e das organizações legais, tendo que ser declarado, ouvido o Conselho de Estado, o “estado de emergência”, de acordo com o art. 19º da Constituição. § Mas mais incrível ainda é o facto de estar por cumprir desde 2011 (dois mil e onze!), a Lei-Quadro de Política Criminal! Abstract: Collapse of the computer system of justice, Citius ?! Is that to be true, then it would be the kaos justice and would have to be immediate consequences in the protection, it could be because the practical application of fundamental rights of citizens and legal organizations, having to be declared, after hearing the Council of State the "state of emergency", according to art. 19 of the Constitution. § But more amazing is the fact of being unfulfilled since 2011 (two thousand and eleven!), The Framework Law for Criminal Policy!

o Acórdão do Tribunal Constitucional português n.º 353/2012, de 5 de Julho de 2012, ao declarar a respectiva inconstitucionalidade com força obrigatória geral, colocou em evidência a existência de bens jurídicos individuais e bens jurídicos colectivos, bens jurídicos supra-individuais, bens jurídicos comunitários. Bens jurídicos estes que devem e têm que ser tutelados e protegidos. A legítima defesa pode existir quer em relação à agressão actual e ilícita de bens jurídicos individuais, quer em relação à agressão actual e ilícita de bens jurídicos colectivos, bens jurídicos supra-individuais e/ou bens jurídicos comunitários? Parte muito substancial e importante da Doutrina indica que sim. Mas, então, como reagir, no contexto da hipotética legítima defesa, face à eventual agressão actual e ilícita dos bens jurídicos tutelados, agora com valor reforçado, pelo próprio Tribunal Constitucional? E qual o papel do direito constitucional de resistência? Este artigo pretende fornecer um muito breve contributo para a solução das correspondentes questões. A questão dos Direitos Fundamentais, o Desenvolvimento e a modernidade. § the Sentence of the (Portuguese) Constitutional Court n. 353/2012 of July 5, 2012, declaring its generally binding unconstitutionality, has highlighted the existence of individual legal goods and collective legal goods, supra-individual legal goods, community legal goods. These legal goods, that should and must be defended and protected. Legitimate defense can be either relative to the current and illicit aggression to individual legal goods, whether in relation to the current and illicit aggression to collective legal goods, supra-individual legal goods or community legal goods? Very substantial and important part of the Doctrine would appear so. But then how to respond, in the context of hypothetical self-defense, in the face of possible current and illicit aggression of the protected legal goods, now with enhanced value, by the Constitutional Court? And what is the role of the constitutional right of resistance? This article is intended to provide a very brief contribution to the solution of the corresponding questions. Estamos desde logo a falar de Direitos Fundamentais. De direitos, liberdades e garantias, também, mas não apenas, nos termos do art. 18º da CRP. Numa altura em que o ex-agente da CIA-Central Intelligence Agency e da NSA-National Security Agency, Sr. Snowden, revelou que é possível existir, e que existiu em efectivo, acesso a toda a correspondência privada em vários países do mundo, senão mesmo em todos, nomeadamente aquela que é feita por via electrónica e informática, cumpre recordar algumas notas do ponto de vista dos Direitos Fundamentais e do Direito Constitucional. § We are immediately talking about fundamental rights. Rights, freedoms and guarantees, too, but not only, in accordance with art. 18 of CRP. At a time when former CIA agent-Central Intelligence Agency and the NSA-National Security Agency, Mr. Snowden has revealed that it is possible to exist, and has existed in effective, access to all private correspondence in countries around the world, if not in all, including one that is made by electronic and computerized means, it is recalled some notes from the point of view of fundamental rights and constitutional law.

Currently, Portugal assumes itself as a democratic rule of substantive law State, sustained by a legal system seeking the right balance between the guarantee of fundamental rights and freedoms constitutional foreseen in Portugal’s Fundamental Law and criminal persecution. The architecture of the penal code lies with, roughly speaking, a accusatory basic structure, “deliberately attached to one of the most remarkable achievements of the civilizational democratic progress, and by obedience to the constitutional commandment”, in balance with the official investigation principle, valid both for the purpose of prosecution and trial. Regarding the principle of non self-incrimination - nemo tenetur se ipsum accusare, briefly defined as the defendant’s right of not being obliged to contribute to the self-incrimination, it should be stressed that there isn’t an explicit consecration in the Portuguese Constitution, being commonly accepted in an implicit constitutional prediction and deriving from other constitutional rights and principles, first and foremost, the meaning and scope of the concept of democratic rule of Law State, embedded in the Fundamental Law, and in the guidelines of the constitutional principles of human person dignity, freedom of action and the presumption of innocence. In any case, about the (in) applicability of the principle of the prohibition of self-incrimination to the Criminal Police Bodies in the trial hearing in Court, and sharing an idea of Guedes Valente, the truth is that the exercise of criminal action must tread a transparent path and non-compliant with methods to obtain evidence that violate the law, the public order or in violation of democratic principles and loyalty (Guedes Valente, 2013, p. 484). Within the framework of the penal process relating to the trial, which is assumed as the true phase of the process, the witness represents a relevant figure for the administration of criminal justice, for the testimonial proof is, in the idea of Othmar Jauernig, the worst proof of evidence, but also being the most frequent (Jauernig, 1998, p. 289). As coadjutant of the Public Prosecutor and, in specific cases, the investigating judge, the Criminal Police Bodies are invested with high responsibility, being "the arms and eyes of Judicial Authorities in pursuing the criminal investigation..." which has as ultimate goal the fulfillment of the Law pursuing the defense of society" (Guedes Valente, 2013, p. 485). It is in this context and as a witness that, throughout operational career, the Criminal Police Bodies are required to be at the trial hearing and clarify the Court with its view about the facts relating to occurrences of criminal context, thus contributing very significantly and, in some cases, decisively for the proper administration of the portuguese criminal justice. With regards to the intervention of Criminal Police Bodies in the trial hearing in Court, it’s important that they pay attention to a set of standards concerning the preparation of the testimony, the very provision of the testimony and, also, to its conclusion. Be emphasized that these guidelines may become crucial for the quality of the police testimony at the trial hearing, thus leading to an improvement of the enforcement of justice system. In this vein, while preparing the testimony, the Criminal Police Bodies must present itself in court with proper clothing, to read before and carefully the case files, to debate the facts being judged with other Criminal Police Bodies and prepare potential questions. Later, while giving his testimony during the trial, the Criminal Police Bodies must, summing up, to take the oath in a convincing manner, to feel comfortable, to start well by convincingly answering the first question, keep an attitude of serenity, to adopt an attitude of collaboration, to avoid the reading of documents, to demonstrate deference and seriousness before the judicial operators, to use simple and objective language, to adopt a fluent speech, to use nonverbal language correctly, to avoid spontaneity responding only to what is asked, to report only the truth, to avoid hesitations and contradictions, to be impartial and to maintain eye contact with the judge. Finally, at the conclusion of the testimony, the Criminal Police Bodies should rise in a smooth manner, avoiding to show relief, resentment or satisfaction, leaving a credible and professional image and, without much formality, requesting the judge permission to leave the courtroom. As final note, it’s important to stress that "The intervention of the Police Criminal Bodies in the trial hearing in Court” encloses itself on a theme of crucial importance not only for members of the Police and Security Forces, who must welcome this subject with the utmost seriousness and professionalism, but also for the proper administration of the criminal justice system in Portugal.

On 21 January 2011, the Grand Chamber of the European Court of Human Rights delivered its judgment in the case of MSS v. Belgium and Greece. This judgment puts into question the practices followed by many national authorities in the implementation of the Dublin system. Particularly noteworthy are the effects on the "safety presumption" that Member States accord to each other in the field of asylum. The authors explore the implications of the MSS decision, first, in regard of the evidentiary requirements imposed on asylum seekers to rebut the safety presumption. They come to the conclusion that through the decision, a real paradigm-shift has taken place - from the theoretical to the actual supremacy of the non-refoulement principle in Dublin matters. This is also true in light of the increased requirements imposed by the Court as regards the scope and depth of judicial review on transfer decisions. Moreover, the MSS judgment could give new impetus to the stalled reform process concerning the Dublin Regulation. Indeed, the Court's decision seems to enshrine in positive ECHR law the most progressive elements of the Commission's proposal, including procedural guarantees and, de facto, the mechanism for the temporary suspension of transfers to member states not offering adequate protection.
