Dentro de la economía Colombiana, la agricultura es considerada uno de los sectores económicos más sólidos y rentables; y se encuentra en este la oportunidad de desarrollar nuevos cam pos de explotación. La práctica de la helicicultura se desarrolla bajo este sector económico, actividad que se define como la cría de caracoles con fines productivos. El constante crecimiento de la demanda por parte de países europeos es uno de los motivos por los cuales se encuentra atractivo desarrollar esta actividad en Colombia, sumado a esto las ventajas competitivas del país dadas por su posición geográfica y clima. A partir de la Ley 1011 de 2006, el gobierno colombiano decide apoyar la explotación de esta actividad, por medio de la cual se autoriza y reglamenta, generando así la oportunidad de formalizar el sector e incentivar a los productores a realizar inversiones en productos no tradicionales. Actualmente la producción se encuentra en niveles bajos debido a los inconvenientes presentados durante la aprobación del decreto que autoriza la exportación. En este proceso juegan un papel fundamental el Ministerio de Agricultura, el Ministerio de Ambiente, Vivienda y Desarrollo social y el Ministerio de Protección Social, quienes deben trabajar con base en sus políticas y objetivos y son los encargados de autorizar la aprobación del respectivo decreto. Como consecuencia a esta situación, en el país no existen registros de exportaciones, ni experiencias comerciales de la práctica de la helicicultura con el mercado europeo por parte de los productores. Sin embargo, la experiencia en América Latina principalmente en Argentina y Chile muestra los sobresalientes resultados de las exportacion es de caracoles con destino a Europa, generando grandes expectativas para los productores Colombianos. Dentro de la Unión Europea, España ha tenido un crecimiento importante en sus importaciones del caracol y sus derivados en los últimos años, razón por la cual se ha decidido enfocar esta investigación a este país. Colombia cuenta con acuerdos comerciales con la comunidad Europea que le permiten mayor facilidad en el acceso de mercancías y preferencias arancelarias. Con relación a la partida arancelaria que hace referencia al caracol vivo, Colombia cuenta con la ventaja de ingresar al mercado Español con 0% de arancel, lo cual es un incentivo más para llevar a cabo planes exportadores.

In trademark systems such as the Andean Community, a state authority verifiesthat the marks are distinctive, lawful and do not affect third parties, and after that,given their ownership. In this context, particular interest has sparked the possibilityof individuals by agreements or statements of co-existence, are who ensure that theirsigns meet the conditions for simultaneous registrations.Such agreements for the coexistence of marks are problematic if one thinks thatthe holders of interests that would be available also seem to matter to consumers,competitors and the market. Therefore, define the scope of contractual freedom inthe field of trademark law, whose rules are considered imperative, acquire practicaland theoretical importance because its realization i) recognizes the risks that maybe relevant to evaluating trade agreements and ii) contributes to debates on the roleof private autonomy in areas reserved for non-derogable norms. Thus, this researchputs the declarations of consent for the coexistence of registrations in Colombia, ina larger scope of the limits of freedom of contract.

Water, considered as an environmental resource and as an economic and social good, should be part of the Colombian public agenda, not only not only in terms of the use and preservation of hydro resources, but also in terms of the social implications of its possession and use. The world wide preoccupation with the diminution of natural resources, species extinction and water shortage has its origins in the seventies. One of the results was the establishment of international conventions and agreements to achieve responsible management of natural resources. Regarding water as a resource, it is intrinsically bound to the Earth’s natural processes and ecosystems. As regards the Colombian case, the “right to water in Colombia” is analyzed taking into account: water as an integral part of sustainable development, the right to water as a global debate and, finally, the right to water in the Colombian context within the explanatory framework of the Water Referendum.

The work aims to demonstrate that an indirect expropriation of rights occurs when mining concession agreements are made for subsoil exploitation. The article looks at examples such as when administrative divesture for public utilities or for social interest is decreed to implement projects or environmental works; when any regulation or administrative action is taken determining protected areas or environment control of type; and when environmental control plans are implemented. The indirect expropriation occurs because a conflict exists between general interests and equality principles of the burdens, the contractual right of adherence to agreed upon provisions and the legality of prior legal regulations for the carrying out of such expropriation.

The Inter-American system for the protection of human rights provides that disputesbetween States and victims of human rights violations or their representatives can beresolved through a friendly settlement. In this arrangement, conducted before the regionalorgans of protection of human rights, the State accepts its international responsibility,commits itself to investigate and judge the responsible and makes commitmentson compensation to the offended, the victims, on his part, renounce to take the caseto the Inter-American Court of Human Rights, and the Inter-American Commissionmonitors the legal consistency of the agreement and holds the role of independentobserver. What are these agreements, what possibilities and limitations provide to theopposing parties and, above all, what kind of reparation offer to victims of humanrights violations are issues to resolve in this article.

The principal objective of this paper is to identify the relationship between the results of the Canadian policies implemented to protect female workers against the impact of globalization on the garment industry and the institutional setting in which this labour market is immersed in Winnipeg. This research paper begins with a brief summary of the institutional theory approach that sheds light on the analysis of the effects of institutions on the policy options to protect female workers of the Winnipeg garment industry. Next, this paper identifies the set of beliefs, formal procedures, routines, norms and conventions that characterize the institutional environment of the female workers of Winnipeg’s garment industry. Subsequently, this paper describes the impact of free trade policies on the garment industry of Winnipeg. Afterward, this paper presents an analysis of the barriers that the institutional features of the garment sector in Winnipeg can set to the successful achievement of policy options addressed to protect the female workforce of this sector. Three policy options are considered: ethical purchasing; training/retraining programs and social engagement support for garment workers; and protection of migrated workers through promoting and facilitating bonds between Canada’s trade unions and trade unions of the labour sending countries. Finally, this paper concludes that the formation of isolated cultural groups inside of factories; the belief that there is gender and race discrimination on the part of the garment industry management against workers; the powerless social conditions of immigrant women; the economic rationality of garment factories’ managers; and the lack of political will on the part of Canada and the labour sending countries to set effective bilateral agreements to protect migrate workers, are the principal barriers that divide the actors involved in the garment industry in Winnipeg. This division among the principal actors of Winnipeg’s garment industry impedes the change toward more efficient institutions and, hence, the successful achievement of policy options addressed to protect women workers.

This paper presents the supply of postdegree programs in the cardiopulmonary area in Colombia in orden to show its state and sufficiency. Plans of formation, objectives, curricular approach, methodology and profile of performance are analyzed in terms of costs, duration, supply, location and research capabilities. Our results show problems in regard to supply as well as unanimous criteria and strategic alliances. There are no Gremial associations that favor both discussion and analysis about epidemiologist aspects of respiratory and cardiovascular diseases in Colombia there is necessity of professionals in this area with experience. Knowledge and appropiated skills in management, administration, laws, agreements and public policies that cover the affected population. Also, it is exposed that the Universities whit this programs require support and pursuit for professionals positioning both in national and international context.Methodology A descriptive study was carried out with a data collection made in a period between April-December of 2006. Cards were done and they allowed to review different aspects such as costs, occupational profile, duration, modality, methodology, practical component and evaluation in the offering universities of programs of postdegree in the cardiopulmonary area for physiotherapists. Later an analysis was made on curriculum, profiles, objectives, contents, professional competitions the areas of research.

Today we are talking about the international integration processes and the objectives that the companies have to keep in mind in order to enter in international markets. Agreements like the FTA (Free Trade Agreement) with the United States and the CAN – MERCOSUR are important in this development. But actually, too many companies are not prepared to compete in new markets. There is only one idea in the national business and this is staying in the national market and do not try to expand the company’s scope to other countries where probably exist many possibilities to sell its products, because of the fear about entering new markets, with new strategies. In this article, I pretend to show what the alternatives to compete in external markets are and how not committing mistakes planning the strategy in the new international sector. Today we do not only think in terms of local market but also in international markets, because due to the internationalization processes we are going in the open way and the search of the free trade. We can’t turn around and go back according to the necessities of the enterprise. We have to assume risks and alternatives. Following the steps and the examples which are shown in this document, you can identify easily if your business is or is not prepared to compete in external markets.

The strategic equilibrium of an N-person cooperative game with transferable utility is a system composed of a cover collection of subsets of N and a set of extended imputations attainable through such equilibrium cover. The system describes a state of coalitional bargaining stability where every player has a bargaining alternative against any other player to support his corresponding equilibrium claim. Any coalition in the sable system may form and divide the characteristic value function of the coalition as prescribed by the equilibrium payoffs. If syndicates are allowed to form, a formed coalition may become a syndicate using the equilibrium payoffs as disagreement values in bargaining for a part of the complementary coalition incremental value to the grand coalition when formed. The emergent well known-constant sum derived game in partition function is described in terms of parameters that result from incumbent binding agreements. The strategic-equilibrium corresponding to the derived game gives an equal value claim to all players. This surprising result is alternatively explained in terms of strategic-equilibrium based possible outcomes by a sequence of bargaining stages that when the binding agreements are in the right sequential order, von Neumann and Morgenstern (vN-M) non-discriminatory solutions emerge. In these solutions a preferred branch by a sufficient number of players is identified: the weaker players syndicate against the stronger player. This condition is referred to as the stronger player paradox. A strategic alternative available to the stronger players to overcome the anticipated not desirable results is to voluntarily lower his bargaining equilibrium claim. In doing the original strategic equilibrium is modified and vN-M discriminatory solutions may occur, but also a different stronger player may emerge that has eventually will have to lower his equilibrium claim. A sequence of such measures converges to the equal opportunity for all vN-M solution anticipated by the strategic equilibrium of partition function derived game. [298-words]

Mediante este proyecto, se hace un análisis de la industria automotriz en Colombia, cómo se puede ver afectada y cuáles serán los pros y contras ante la puesta en ejecución del Tratado de Libre Comercio con la República de Corea, tomando como base diferentes agentes que incursionan directamente en la industria mencionada, como lo son sus consumidores, los comerciantes, productores (ensambladoras) y el gobierno nacional. Igualmente, la globalización como aspecto fundamental para las economías mundiales, genera la apertura de estas y afianza a su vez la firma de diferentes tratados que permitan mejorar el comercio y bajar los precios de bienes y servicios entre países; pero en este caso dicha apertura, puede no ser beneficiosa para la industria automotriz colombiana debido a las grandes diferencias en capacidad de producción y tecnología entre ambos países. Por lo anterior, se realizan comparaciones entre las dos economías y sus industrias (la automotriz), para encontrar los puntos en los cuales Colombia es más débil y buscar estrategias que permitan contrarrestar los efectos negativos que puede traer consigo el Tratado de Libre Comercio, así mismo, buscar oportunidades para mejorar el desarrollo tecnológico y de esta manera incentivar la inversión para consolidar dicha industria en el mercado.

El presente artículo señala los principales aspectos que involucran la negociación de servicios financieros en el contexto de los tratados internacionales de libre comercio. Para esto, ilustra los principios que sobre el particular ha mencionado la Organización Mundial del Comercio. Posteriormente, hace una revisión de algunos tratados internacionales que han negociado los servicios financieros. Finalmente, elabora una breve revisión de la posición negociadora de Colombia en el marco del TLC con los Estados Unidos.-----This article points out the main aspects involved in the negotiation of financial services in the context of international free trade agreements. The principles established by the World Trade Organization are illustrated first. Then, some international agreements involving the negotiation of financial services are discussed, and finally, the position adopted by Colombia concerning the FTA with the United States is briefly reviewed.

La autora identifica las principales características e implicaciones de la negociación del Tratado de Libre Comercio con los Estados Unidos, determinando como argumentos esenciales de este proceso la relación e importancia histórica de este país en materia comercial y política, la necesidad de continuar con las preferencias arancelarias, ATPDEA,** a largo plazo y especialmente enfrentar la competencia de otros países que han negociado acuerdos con Estados Unidos previamente. Sin embargo, destaca como principal requisito para abordar este acuerdo, que se retome la política de productividad y competitividad como elemento indispensable para diversificar las exportaciones y aprovechar las ventajas competitivas de nuestro país frente a este acuerdo y de cara a la internacionalización de la economía nacional.** Andean Trade Promotion and Drug Eradication Act.-----The author discusses the main characteristics and implications of the Free Trade Agreement with the United States by pointing out, as the most outstanding arguments of this process, the following: the relation with and the historical importance of the US in terms of trade and politics, the need to maintain tariff preferences and a long-term ATPDEA* *, and particularly the need to face the competitiveness of other countries that have reached agreements with that country before. Nevertheless, the author suggests to consider productivity and competitiveness policies as an essential factor to diversify exportations and to make good use of Colombia’s competitive advantages concerning this agreement, vis-à-vis the internationalization of its economy.

Este artículo tiene como objetivo analizar, la incidencia que tienen actualmente las ONG s internacionales sobre la toma de decisiones de los gobiernos de diferentes Estados. Con el fin de hacer más específico dicho análisis, el trabajo se centra en el estudio del caso de la firma del Tratado de Libre Comercio entre Estados Unidos cuyo proceso, según se explica a lo largo del texto, se vio afectado de manera significativa por la acción de Human Rights Watch. El artículo presenta una exposición de la mecánica política requerida para la aprobación de este tipo de tratados en ambos países involucrados, así como la forma en que las asimetrías de poder entre ellos abrieron el campo a la acción de Human Rights Watch.

En los últimos años Colombia ha demostrado un cambio y apertura en su política comercial, aumentando su interés por expandir sus relaciones comerciales con otros países y otros continentes. Como resultado de estas políticas comerciales y la constante evolución y cambio en las tendencias comerciales en el mundo. Colombia le apuesta a diversificar sus exportaciones por medio de la realización de Tratados de Libre Comercio con países de continentes como el Asiático. Y su primera aproximación para establecer una relación comercial con el continente Asiático es la firma del TLC con la República de Corea. Como consecuencia de la firma del TLC, es necesario que tanto el Estado junto con sus instituciones, el sector real y la academia unan esfuerzos para que se le saque el mayor provecho y se identifiquen las mejores oportunidades a este tipo de tratados. Por lo tanto el objetivo del proyecto como parte de una contribución al Laboratorio de Tratados de Libre Comercio de la Universidad del Rosario es determinar la evolución de las relaciones comerciales entre Colombia y Corea por medio de herramientas cuantitativas y cualitativas, con el fin de a partir del entendimiento de la evolución en la relación comercial establecer un marco de oportunidades para los diferentes sectores y empresas colombianas. Esta relación se determinara estudiando la evolución en forma cuantitativa de las importaciones realizadas por Colombia y cada uno de sus departamentos desde Corea del Sur. Analizando la evolución en las importaciones de los diez principales productos importados por cada departamento desde Corea del Sur en los últimos años.
