A presente dissertação parte do problema sobe a possibilidade de compreender uma racionalidade não instrumental, em relação à dominação técnica e científica da natureza para pensar a Educação Ambiental. A pesquisa teve como principais objetivos compreender e interpretar a Natureza e a Educação Ambiental para alem do sentido historicamente produzido pela ciência sobre a relação homem e natureza em confronto com outras interpretações oriundas de uma visão ampliada de racionalidade. Propõe-se a desconstrução por meio de um exercício hermenêutico da concepção de natureza e forma de agir proposta pela ciência moderna como propósito de desvendar o caráter ideológico da ciência e dos múltiplos usos que carrega o conceito. A investigação permitiu identificar aspectos críticos da racionalidade que se desenvolveu no mundo ocidental e tem causado inúmeros problemas ao meio ambiente e à sobrevivência da natureza e da espécie humana. A presente Dissertação foi pensada na proposta de radicalização da ideia de compreensão como interpretação, de modo a apresentar como método de produção de conhecimento a interpretação narrativo-interpretativa proposta pela hermenêutica.

The report on the findings of extensive empirical research on equality of educational opportunities carried out in the US on a very large sample of public schools by Coleman and his colleagues has had a major impact on education policy and has given rise to a large amount of research and various interpretations. However, as some interpreters have highlighted, even more important than the findings of the survey themselves has been Coleman’s redefinition of equality of opportunity, abandoning the then prevailing conception of equality of educational opportunities as equality of starting points and replacing it with the concept of equality of educational opportunities as equality of educational outcomes. The question is, therefore, whether equality of outcomes really is one of the two types of equality of opportunity. The purpose of the present article is to show that equality of opportunity and equality of outcomes are two different types of equality. If they are different, the interpretation that Coleman has redefined the concept of “equality of educational opportunity” turns out to be incorrect. (DIPF/Orig.)

The present paper examines some of the tensions, problems and challenges associated with claims for equality of opportunity (the fairness argument). The introductory part identifies three separate forms of justification for public education, including the argument associated with equality of opportunity. Part II examines in detail two questions that reveal part of the anatomy of equality of opportunity: (1) what an opportunity is, and (2) when individuals’ opportunities are equal. This is followed by a presentation of the two basic principles of equality of opportunity: (1) the principle of non-discrimination, and (2) the “levelling the playing field” principle. The next part takes up the multiculturalist hypothesis advanced by minority groups for the accommodation and recognition of cultural diversity. This is followed by the identification of a set of claims comprising the “fairness argument”. The last section focuses on the “currency problem” associated with cultural diversity as a form of “unfair disadvantage”. Part V examines two of the major shortcomings associated with the multicultural conception of equality of opportunity, while the concluding part discusses some of the questions that must be answered by any conception of equal opportunities. Este ensayo teoriza la relaciones fuertes que toda praxis política tiene de forma consciente o inconsciente con alguna concepción concreta de la moral y del derecho. Trata así de explicitar esos vínculos en el marco de una filosofía crítica de la política, bajo la denominación de ‘poli(é)tica’ e ‘iuspoli(é)tica’ general. Para ello analiza la presencia de la actitud moral y la norma jurídica en la acción política. Estas relaciones se considera que pueden ser representadas de una forma «romboidal» más que «triangular», en virtud de la duplicidad de rasgos constituyentes / instituyentes y constituidos / instituidos de toda política respecto a las diversas concepciones de la moral y el derecho. En relación a ‘lo peor fáctico’ y ‘lo mejor posible’, construidos desde la interpretación de lo real como modelos de validez y viabilidad ejemplar negativa y positiva, finalmente se reformula la categoría de ‘autonomía’ en sus versiones iuspoli(é)ticas autodeterminista, pluriversalista y finalista y sus vertientes individual y societal. Emerge de esta manera una propuesta de filosofía iuspoli(é)tica equitativista particular que pivota sobre las categorías de legitimidad, dignidad, autonomía y equidad.

Social innovation is a critical factor for the conception of new strategies to deal with increasingly complex social problems. Many of these initiatives are pursued at the local level and are based on the dynamic capabilities of a given territory. Through the analysis of the Cooperative Terra Chã, we assess whether dynamic capabilities of a territory can generate opportunities for social innovation and how they can be exploited by local communities. We observe that by using a integrated strategy for the management of the capabilities of a territory, new social ventures are able to cope with severe social issues that are not being adequately addressed by other stakeholders.

The connection between law and (imaginative) literature can still affect surprisingly. The theme of the present article is to summarize some of the basic features of the movement, which is called „Law and Literature” and to suggest some starting-points with which it is associated. These starting points include, for instance linguistic conception of law, narratology in law or the relations between law and culture. The article offers an overview of the classical approaches connecting law and literature and mentions the reasons for this connection: e.g. cultivation of law and lawyers, improvement of judicial decisions or improvement of legal interpretation. Some of the findings resulting from the joint of law and literature can be used in practice and goes beyond „mere” theory. The article is to be seen as an introduction to the movement of „Law and Literature”, presentation of ideas on which this movement is based and offering the possibility of its further development.

Zygmunt Ziembiński was one of the most prominent theoreticians of law in Poland in the second half of the 20th century. He developed an original theory of law defined as a theory of legal phenomena, which covered both logical-linguistic as well as real aspects of law. The theory served as a base for the development of a unique so-called advanced normative conception of sources of law, one of the greatest achievements of theory of law in Poland. This conception encompasses all the indispensable elements of a coherent system of binding legal norms: 1) indication of a political justification (ideological assumptions) of the entire system of law; 2) pre-judgment of law-making competence of government agencies; 3) determination of the status of custom and precedent; 4) compilation of a catalogue of permissible interpretation rules; 5) compilation of a catalogue of permissible inferential rules (permissible rules of legal inferences); 6) compilation of a catalogue of permissible collision rules.

Notre étude porte le western crépusculaire et cherche plus précisément à extraire le « crépusculaire » du genre. L'épithète « crépusculaire », héritée du vocabulaire critique des années 1960 et 1970, définit généralement un nombre relativement restreint d'œuvres dont le récit met en scène des cowboys vieillissants dans un style qui privilégie un réalisme esthétique et psychologique, fréquemment associé à un révisionnisme historique, voire au « western pro-indien », mais qui se démarque par sa propension à filmer des protagonistes fatigués et dépassés par la marche de l'Histoire. Par un détour sur les formes littéraires ayant comme contexte diégétique l’Ouest américain (dime-novel et romans de la frontière), nous effectuons des allers et retours entre les formes épique et romanesque, entre l’Histoire et son mythe, entre le littéraire et le filmique pour mieux saisir la relation dyadique qu’entretient le western avec l’écriture, d’une part monumentale et d’autre part critique, de l’Histoire. Moins intéressée à l’esthétique des images qu’aux aspects narratologiques du film pris comme texte, notre approche tire profit des analyses littéraires pour remettre en cause les classifications étanches qui ont marqué l’évolution du western cinématographique. Nous étudions, à partir des intuitions d’André Bazin au sujet du sur-western, les modulations narratives du western ainsi que l’émergence d’une conscience critique à partir de ses héros mythologiques (notamment le cow-boy). Notre approche est à la fois épistémologique et transhistorique en ce qu’elle cherche à dégager du western crépusculaire un genre au-delà des genres, fondé sur une incitation à la narrativisation crépusculaire de la part du spectateur. Cette dernière, concentrée par une approche deleuzienne de l’image-cristal, renvoie non plus seulement à une conception existentialiste du personnage dans l’Histoire, mais aussi à une mise en relief pointue du hors-cadre du cinéma, moment de clairvoyance à la fois pragmatique et historicisant que nous définissons comme une image-fin, une image chronogénétique relevant de la contemporanéité de ses figures et de leurs auteurs.

This text thematizes the performance of the Brazilian-American Commission of Industrial Education (CBAI) since its installation at Rio de Janeiro, on 1947, and extinction in Curitiba, on 1963. The general goal consists in identifying if are there any relation between Gramsci’s Americanism and Fordism elements and the CBAI’s performance, by means of a speech analysis from de Newsletter of CBAI and other documental sources related to the organizations performance. The specifics objectives intend to contextualize the political and economic situation that Brazil was going through before and concomitant to CBAI’s performance, emphasizing some aspects of the Cold War feature that contributed to narrow the relations between United States and other countries of Latin America, especially Brazil. On the following, it intends to present the main aspects of Gramsci’s thought and the Americanism and fordism and Passive Revolution as key categories for a better understanding of the presence of an Americanization project on Brazilian’s professional education. As so, the object of this study are the Newsletters of CBAI. Finally, the speech’s analisys of the Newsletter was the methodology used to demonstrate CBAI as an Americanism diffuser. The documental research and sources served as groundwork, especially the Newsletters, were found at Departamento de Documentação Histórica of Universidade Tecnológica Federal do Paraná (DEDHIS) and at Biblioteca de Educação of Universidade de São Paulo (FEUSP). The theoretical foundation has as a workline for the conception of the categories the studies of Gramsci about the of work (and the Newsletters itself), and the speech’s analysis of main concepts from Bakhtin, Voloshinov’s and the Circle of studies about language philosophy. At last, this paperwork concludes that the attempt to disseminate an amerizanization project in Brazil obtneined significant results on the industrialization of the country according to the fordism’s racionalization standarts, nevertheless, this research considers that such a project corroborates the comprehension about the consolidation of a Passive Revolution’s project.

Terms like Internet, cyberspace, virtual reality, in short, globalization, have been frequently words for all of us, in recent years. This refers to the phenomenon that has shaken the people of this world. Are rapidly changing due to technological advances and complex levels reaching relations between countries, corporations, partnerships and people.The attempt to understand the phenomenon of globalization is compounded when we try to understand the term, coined by Marshall McLuhan.McLuhan was born in Edmonton, Alberta, Canada and studied at the Universities of Manitoba and Cambridge, the latter of which he received his degree of Doctor of Philosophy specializing in English Literature. He taught at the universities of Wisconsin and St. Louis and University of the Assumption and Saint Michael's College, University of Toronto, where he was director of the Center for Culture and Technology.Marshall McLuhan and B. R. Powers, wrote the play, The Village Global1. The universe has become a village is the future predicted for them in the 60's. Today reality has overtaken the theory. However, this phenomenon is presented in this work, so whimsical style reminiscent of Jules Verne, but does not clarify the content of the term. While we believe that in the past there were attempts; globalize these attempts were very different from what we understand by globalization.

Maintaining accessibility to and understanding of digital information over time is a complex challenge that often requires contributions and interventions from a variety of individuals and organizations. The processes of preservation planning and evaluation are fundamentally implicit and share similar complexity. Both demand comprehensive knowledge and understanding of every aspect of to-be-preserved content and the contexts within which preservation is undertaken. Consequently, means are required for the identification, documentation and association of those properties of data, representation and management mechanisms that in combination lend value, facilitate interaction and influence the preservation process. These properties may be almost limitless in terms of diversity, but are integral to the establishment of classes of risk exposure, and the planning and deployment of appropriate preservation strategies. We explore several research objectives within the course of this thesis. Our main objective is the conception of an ontology for risk management of digital collections. Incorporated within this are our aims to survey the contexts within which preservation has been undertaken successfully, the development of an appropriate methodology for risk management, the evaluation of existing preservation evaluation approaches and metrics, the structuring of best practice knowledge and lastly the demonstration of a range of tools that utilise our findings. We describe a mixed methodology that uses interview and survey, extensive content analysis, practical case study and iterative software and ontology development. We build on a robust foundation, the development of the Digital Repository Audit Method Based on Risk Assessment. We summarise the extent of the challenge facing the digital preservation community (and by extension users and creators of digital materials from many disciplines and operational contexts) and present the case for a comprehensive and extensible knowledge base of best practice. These challenges are manifested in the scale of data growth, the increasing complexity and the increasing onus on communities with no formal training to offer assurances of data management and sustainability. These collectively imply a challenge that demands an intuitive and adaptable means of evaluating digital preservation efforts. The need for individuals and organisations to validate the legitimacy of their own efforts is particularly prioritised. We introduce our approach, based on risk management. Risk is an expression of the likelihood of a negative outcome, and an expression of the impact of such an occurrence. We describe how risk management may be considered synonymous with preservation activity, a persistent effort to negate the dangers posed to information availability, usability and sustainability. Risk can be characterised according to associated goals, activities, responsibilities and policies in terms of both their manifestation and mitigation. They have the capacity to be deconstructed into their atomic units and responsibility for their resolution delegated appropriately. We continue to describe how the manifestation of risks typically spans an entire organisational environment, and as the focus of our analysis risk safeguards against omissions that may occur when pursuing functional, departmental or role-based assessment. We discuss the importance of relating risk-factors, through the risks themselves or associated system elements. To do so will yield the preservation best-practice knowledge base that is conspicuously lacking within the international digital preservation community. We present as research outcomes an encapsulation of preservation practice (and explicitly defined best practice) as a series of case studies, in turn distilled into atomic, related information elements. We conduct our analyses in the formal evaluation of memory institutions in the UK, US and continental Europe. Furthermore we showcase a series of applications that use the fruits of this research as their intellectual foundation. Finally we document our results in a range of technical reports and conference and journal articles. We present evidence of preservation approaches and infrastructures from a series of case studies conducted in a range of international preservation environments. We then aggregate this into a linked data structure entitled PORRO, an ontology relating preservation repository, object and risk characteristics, intended to support preservation decision making and evaluation. The methodology leading to this ontology is outlined, and lessons are exposed by revisiting legacy studies and exposing the resource and associated applications to evaluation by the digital preservation community.

L’idée selon laquelle les enfants sont des sujets à part entière de considérations de justice n’est pas très contestée. Les enfants ont des intérêts qui leur sont propres et ont un statut moral indépendant de leurs parents : ils ne sont ni la propriété de ces derniers ni une simple extension de leur personne. Pourtant, les travaux des plus grands théoriciens de la justice en philosophie politique contemporaine ne contiennent pas de discussion systématique du statut moral et politique des enfants et du contenu de nos obligations à leur égard. Cette thèse contribue à remédier à cette omission à travers l’examen de quatre grandes questions principales. (1) Quelles sont les obligations de justice de l’état libéral envers les enfants ? (2) Quels types de politiques publiques en matière d’éducation des enfants sont moralement légitimes ? (3) Jusqu’à quel point est-il moralement acceptable pour les parents de délibérément forger la vision du monde de leurs enfants ? (4) Quels critères moraux devraient guider l’élaboration de politiques en matière d’éducation morale dans les écoles ? Cette thèse est constituée de quatre articles. Le premier, « Political Liberalism and Children’s Education », aborde les questions du fondement normatif et des implications du principe de ‘neutralité éducative’ ou ‘anti-perfectionnisme éducatif’. Selon ce principe, il n’est pas légitime pour l’État libéral de délibérément promouvoir, à travers ses politiques publiques en éducation, une conception particulière de la vie bonne. L’article défend les idées suivantes. D’abord, ledit principe est exclusivement fondé sur des raisons de justice envers les parents. Ensuite, l’anti-perfectionnisme libéral n’est pas, pour autant, ‘mauvais pour les enfants’, puisqu’une vaste gamme d’interventions politiques dans la vie familiale et l’éducation des enfants sont, de manière surprenante, justifiables dans ce cadre théorique. Le deuxième article, « On the Permissibility of Shaping Children’s Values », examine la question de savoir si les parents ont un droit moral de forger délibérément l’identité, la conception du monde et les valeurs de leurs enfants. L’article développe une critique de la conception anti-perfectionniste des devoirs parentaux et propose un nouvel argument libéral à l’appui d’un droit parental conditionnel de forger l’identité de leurs enfants. L’article introduit également une distinction importante entre les notions d’éducation compréhensive et d’« enrôlement » compréhensif. Le troisième article, « Common Education and the Practice of Liberal Neutrality: The Loyola High School Case », défend trois thèses principales à travers une analyse normative de l’affaire juridique de l’école Loyola. Premièrement, il est légitime pour l’État libéral d’adopter un modèle d’éducation commune fort. Deuxièmement, la thèse selon laquelle la neutralité comme approche éducative serait impossible est injustifiée. Troisièmement, il existe néanmoins de bonnes raisons pour l’État libéral d’accommoder plusieurs écoles religieuses qui rejettent le modèle de la neutralité. Le quatrième article, « Which Moral Issues Should be Taught as Controversial? », critique à la fois le critère ‘épistémique’ dominant pour déterminer quels enjeux moraux devraient être enseignés aux jeunes comme ‘controversés’, et à la fois la manière dont le débat sur l’enseignement des enjeux controversés fut construit au cours des dernières années, d’un point de vue substantiel et méthodologique. L’article propose une manière alternative d’aborder le débat, laquelle prend adéquatement en compte la pluralité des objectifs de l’éducation et un ensemble d’autres considérations morales pertinentes.
