Interest in the epidemiology of emerging diseases of humans and livestock as they relate to wildlife has increased greatly over the past several decades. Many factors, most anthropogenic, have facilitated the emergence of diseases from wildlife. Some livestock diseases have ‘‘spilled over’’ to wildlife and then ‘‘spilled back’’ to livestock. When a population is exposed to an infectious agent, depending on an interaction of factors involving the host, agent, and environment, the population may be resistant to infection or may become a dead-end host, a spillover host, or a maintenance host. Each exposure is unique; the same species of host and agent may respond differently in different situations. Management actions that affect the environment and behavior of a potential host animal may allow the emergence of a new or as yet undetected disease. There are many barriers in preventing, detecting, monitoring and managing wildlife diseases. These may include political and legal hurdles, lack of knowledge about many diseases of wildlife, the absence of basic data on wildlife populations, difficulties with surveillance, and logistical constraints. Increasing interaction between wildlife and humans or domestic animals may lead to disease emergence and require innovative methods and strategies for disease surveillance and management in wildlife.

The article discusses the trajectory of Manuel Luis da Veiga which, as a merchant in Portugal (where he was born) invested to install a factory in Pernambuco after the arrival of Real Family in the Rio de Janeiro, considering the changes, in these days, in the Portuguese Empire. It focuses the political sociabilities, remarking the role of Veiga in the court and his writings on political economy, understanding both as two linked dimensions of his social practice. It points out that his trajectory shows a deeply changing world in terms of paradigms, impossible to be understood simply in patterns of what was old or new in the beginning of XIX century.

The objective of this intervention study was to map instituted and instituting movements present in the work of the Family Health Strategy in the development of their care practices. The theoretical framework is based on institutional analysis, using the schizoanalytic approach. Group meetings were carried out with the staff to discuss how they provided collective care in continuing health education. The study subjects were professionals from the team and students who were engaged in academic activity in the service. The average attendance was twelve people per meeting, and there were a total of eight meetings from March to July 2010. Data were grouped into two immanent strata: the relationships of the team and the relationship with clients. The strata point to the intersection of education and legal institutions and the social and technical division of labor. Collective thinking in groups appeared to be effective in denaturalizing established processes and interrogating places, knowledge and practices.

[ES] El concepto de gobernanza del sector pesquero ha evolucionado notablemente a nivel mundial en los últimos años, conectando a instituciones económicas, administrativas, políticas y sociales, legitimando y equilibrando las interacciones entre todos los actores del sector, dentro de un marco de dimensión local, nacional e internacional. En este trabajo se describe el contexto en el que se inscribe la gobernanza del sector pesquero grancanario en la actualidad y los actores involucrados en dicha actividad, así como sus perfiles sociales, funciones e interacciones. Se analiza la gestión pesquera desde el punto de vista de la agilidad en sus funciones de cada una de las partes implicadas en la misma, en base al estudio de las competencias y cometidos otorgados por ley, el papel real ejercido por cada una y la percepción y concepción de las razones que conducen a la actual crisis del sector. La información analizada se obtuvo a partir de una revisión bibliográfica y la realización de entrevistas y encuestas a distintas personalidades relacionadas con la actividad pesquera. Se proponen medidas generales para promover un mejor funcionamiento organizativo del sector y fomentar su cohesión. Este trabajo proporciona una visión general de la gobernanza de la pesca en Gran Canaria, como punto de partida para la generación de políticas de gestión que integren la dinámica y la complejidad del sector a partir de un mejor conocimiento del mismo.

One of the ways by which the legal system has responded to different sets of problems is the blurring of the traditional boundaries of criminal law, both procedural and substantive. This study aims to explore under what conditions does this trend lead to the improvement of society's welfare by focusing on two distinguishing sanctions in criminal law, incarceration and social stigma. In analyzing how incarceration affects the incentive to an individual to violate a legal standard, we considered the crucial role of the time constraint. This aspect has not been fully explored in the literature on law and economics, especially with respect to the analysis of the beneficiality of imposing either a fine or a prison term. We observed that that when individuals are heterogeneous with respect to wealth and wage income, and when the level of activity can be considered a normal good, only the middle wage and middle income groups can be adequately deterred by a fixed fines alone regime. The existing literature only considers the case of the very poor, deemed as judgment proof. However, since imprisonment is a socially costly way to deprive individuals of their time, other alternatives may be sought such as the imposition of discriminatory monetary fine, partial incapacitation and other alternative sanctions. According to traditional legal theory, the reason why criminal law is obeyed is not mainly due to the monetary sanctions but to the stigma arising from the community’s moral condemnation that accompanies conviction or merely suspicion. However, it is not sufficiently clear whether social stigma always accompanies a criminal conviction. We addressed this issue by identifying the circumstances wherein a criminal conviction carries an additional social stigma. Our results show that social stigma is seen to accompany a conviction under the following conditions: first, when the law coincides with the society's social norms; and second, when the prohibited act provides information on an unobservable attribute or trait of an individual -- crucial in establishing or maintaining social relationships beyond mere economic relationships. Thus, even if the social planner does not impose the social sanction directly, the impact of social stigma can still be influenced by the probability of conviction and the level of the monetary fine imposed as well as the varying degree of correlation between the legal standard violated and the social traits or attributes of the individual. In this respect, criminal law serves as an institution that facilitates cognitive efficiency in the process of imposing the social sanction to the extent that the rest of society is boundedly rational and use judgment heuristics. Paradoxically, using criminal law in order to invoke stigma for the violation of a legal standard may also serve to undermine its strength. To sum, the results of our analysis reveal that the scope of criminal law is narrow both for the purposes of deterrence and cognitive efficiency. While there are certain conditions where the enforcement of criminal law may lead to an increase in social welfare, particularly with respect to incarceration and stigma, we have also identified the channels through which they could affect behavior. Since such mechanisms can be replicated in less costly ways, society should first try or seek to employ these legal institutions before turning to criminal law as a last resort.

Dopo gli indubbi sviluppi politici e legali tendenti all’uniformazione è inevitabile non sostenere che anche il mercato della gestione delle infrastrutture e del trasporto aereo a terra costituisce un fattore determinante del trasporto aereo con una più stretta necessità di uniformazione del quadro regolamentare. La gestione aeroportuale e i servizi connessi è collocata all’interno del diritto aereo. Perché si configuri il “trasporto aereo” (nozione dinamica base che caratterizza il diritto del trasporto aereo) si ha la necessità di un accordo tra due paesi – un permesso di volo designato – una finestra di orario di decollo e atterraggio e la regolamentazione delle relative attività connesse, affinché si svolgano in situazione di safety, quale conditio sine qua non di tutte le attività di aviazione. Tuttavia, la migliore dottrina sente il bisogno di una trattazione separata della materia diritto aereo in senso stretto e quella della disciplina aeroportuale, benché i due ambiti sono tra di loro contigui. Questo è legittimato da esigenze contrapposte fra gli operatori dei due settori. In ultima considerazione possiamo sostenere che gli sviluppi legislativi, sia nel diritto aeronautico e in quello marittimo, portano all’abbraccio della impostazione di un diritto dei trasporti inclusivo di ogni forma dell’attuazione del fenomeno trasporto, scollegandosi al solo fenomeno dell’esercizio nautico quale elemento caratterizzante della disciplina. Quale futuro legislativo si prospetta per la gestione del bene aeroporto? Quale sarà la sua dimensione legale su questioni importanti sulle quali esiste una normazione europea come l’allocazione delle bande orarie, tasse aeroportuali e assistenza a terra oppure su quelle che hanno un carattere prevalentemente nazionale? E infine, quale sarebbe la strada da seguire per regolare il nuovo mercato aeroportuale che è passato dalla idea della competizione per il mercato esplorando anche la competizione nel mercato, con aeroporti che si comportano come operatori in concorrenza tra loro?

La tesi analizza i rapporti tra l’ordinamento italiano e la Cedu, in particolare la collocazione della Cedu all’interno del sistema delle fonti alla luce della modifica dell’art. 117, comma 1 Cost. Si tratta di un tema molto dibattuto in dottrina, specialmente a seguito dell’entrata in vigore del Trattato di Lisbona. Questa tematica risulta strettamente connessa al profilo dell’interazione tra la Corte di Strasburgo e la Corte costituzionale e i giudici ordinari. L’analisi del profilo statico concernente lo status della Cedu nel sistema italiano deve quindi essere accompagnata dall’esame del profilo dinamico, relativo al ruolo della giurisprudenza della Corte di Strasburgo nell’esperienza dell’ordinamento nazionale. Entrambi i profili di indagine sono esaminati alla luce delle indicazioni provenienti dalla giurisprudenza della Corte costituzionale, della Corte di Cassazione e della Corte di Strasburgo. Prima di essere esaminate singolarmente, queste tematiche richiedono la preliminare ricognizione dei termini della dicotomia tra i due modelli concettuali di riferimento in tema di rapporti interordinamentali: il monismo e il dualismo. Trasferite nel peculiare contesto del sistema Cedu, tali categorie dogmatiche si arricchiscono di ulteriori profili, che esorbitano dalla sistemazione del rapporto tra fonti. La tenuta dei due paradigmi concettuali, che sono nati ed operano nel contesto della teorica delle fonti, deve essere verificata anche rispetto all’attuale fenomeno della produzione europea di diritto giurisprudenziale ed alla capacità paradigmatica assunta dalla giurisprudenza di Strasburgo. Il diritto e le istituzioni giuridiche tendono ad assumere sempre più sembianze giurisdizionali, generando un’osmosi che porta a trasferire il focus dai rapporti interordinamentali ai rapporti tra giurisprudenze.

El análisis económico de las instituciones jurídicas ha adquirido una importancia considerable en los últimos años. Precisamente, el objetivo esencial de este trabajo se centra en el estudio del análisis económico del contrato de depósito irregular de dinero mediante tres enfoques metodológicos diferentes. El primer capítulo de este trabajo analiza la naturaleza jurídica del contrato de depósito irregular de dinero, examinando las principales características respecto al contrato de préstamo o mutuo. Igualmente, este capítulo estudiará la lógica jurídica propia de ambas instituciones, y cómo los principios generales del derecho fueron descubiertos desde el derecho romano clásico. El segundo capítulo trata de analizar la historia de los hechos económicos y, en particular, el proceso histórico de la violación de los principios tradicionales del derecho en relación al contrato de depósito irregular de dinero. Por último, el capítulo tercero examina los distintos intentos doctrinales realizados para elaborar un nuevo tipo de contrato de depósito bancario de dinero, con el único objetivo de legitimar un sistema bancario con un coeficiente de caja de reserva fraccionaria.

This study seeks to address a gap in the study of nonviolent action. The gap relates to the question of how nonviolence is performed, as opposed to the meaning or impact of nonviolent politics. The dissertation approaches the history of nonviolent protest in South Asia through the lens of performance studies. Such a shift allows for concepts such as performativity and theatricality to be tested in terms of their applicability and relevance to contemporary political and philosophical questions. It also allows for a different perspective on the historiography of nonviolent protest. Using concepts, modes of analysis and tropes of thinking from the emerging field of performance studies, the dissertation analyses two different cases of nonviolent protest, asking how politics is performatively constituted. The first two sections of this study set out the parameters of the key terms of the dissertation: nonviolence and performativity, by tracing their genealogies and legacies as terms. These histories are then located as an intersection in the founding of the nonviolent. The case studies at the analytical core of the dissertation are: fasting as a method in Gandhi's political arsenal, and the army of nonviolent soldiers in the North-West Frontier Province, known as the Khudai Khidmatgar. The study begins with an overview of current theorisations of nonviolence. The approach to the subject is through an investigation of commonly held misconceptions about nonviolent action, such as its supposed passivity, the absence of violence, its ineffectiveness and its spiritual basis. This section addresses the lacunae within existing theories of nonviolence and points to possible fertile spaces for further exploration. Section 3 offers an overview of the different shades of the concept of performativity, asking how it is used in various contexts and how these different nuances can be viewed in relation to each other. The dissertation explores how a theory of performativity may be correlated to the theorisation of nonviolence. The correlations are established in four boundary areas: action/inaction, violence/absence of violence, the actor/opponent and the body/spirit. These boundary areas allow for a theorising of nonviolent action as a performative process. The first case study is Gandhi's use of the fast as a method of nonviolent protest. Using a close reading of his own writings, speeches and letters, as well as a reading of responses to his fast in British newspapers and within India, the dissertation asks what made fasting into Gandhi's most favoured mode of protest and political action. The study reconstructs his unique praxis of the fast from a performative perspective, demonstrating how display and ostentation are vital to the political economy of the fast. It also unveils the cultural context and historical reservoir of body practices, which Gandhi drew from and adapted into 'weapons' of political action. The relationship of Gandhian nonviolence to the body forms a crucial part of the analysis. The second case study is the nonviolent army of the Pashtuns, Khudai Khidmatgar (KK), literally Servants of God. This anti-imperialist movement in the North-West Frontier Province of what is today the border between Pakistan and Afghanistan existed between 1929 and 1948. The movement adopted the organisational form of an army. It conducted protest activities against colonial rule, as well as social reform activities for the Pashtuns. This group was connected to the Congress party of Gandhi, but the dissertation argues that their conceptualisation and praxis of nonviolence emerged from a very different tradition and worldview. Following a brief introduction to the socio-political background of this Pashtun movement, the dissertation explores the activities that this nonviolent army engaged in, looking at their unique understanding of the militancy of an unarmed force, and their mode of combat and confrontation. Of particular interest to the analysis is the way the KK re-combined and mixed what appear to be contradictory ideologies and acts. In doing so, they reframed cultural and historical stereotypes of the Pashtuns as a martial race, juxtaposing the institutional form of the army with a nonviolent praxis based on Islamic principles and social reform. The example of the Khudai Khidmatgar is used to explore the idea that nonviolence is not the opposite of violent conflict, but in fact a dialectical engagement and response to violence. Section 5, in conclusion, returns to the boundary areas of nonviolence: action, violence, the opponent and the body, and re-visits these areas on a comparative note, bringing together elements from Gandhi's fasts and the practices of the KK. The similarities and differences in the two examples are assessed and contextualised in relation to the guiding question of this study, namely the question of the performativity of nonviolent action.

This article offers an analysis of a struggle for control of a women’s development project in Nepal. The story of this struggle is worth telling, for it is rife with the gender politics and neo-colonial context that underscore much of what goes on in contemporary Nepal. In particular, my analysis helps to unravel some of the powerful discourses, threads of interest, and yet unintended effects inevitable under a regime of development aid. The analysis demonstrates that the employment of already available discursive figures of the imperialist feminist and the patriarchal third world man are central to the rhetorical strategies taken in the conflict. I argue that the trans-discursive or “borderland” nature of development in general and women’s development in particular result in different constructions of “development” goals, means and actors based not only on divergent cultural categories but on historically specific cultural politics. I argue further that the apolitical discourse of development serves to cloak its inherently political project of social and economic transformation, making conflicts such as the one that occurred in this case not only likely to occur but also likely to be misunderstood.

Recent evidence on malnutrition and poverty raise important questions on the role of food assistance policies and programs. In this review article, we examine evidence on the economic and nutritional impacts of international food assistance programs (FAPs) and policies. The returns on investments in FAPs are, on average, high but depend considerably on the targeting and cost structures as well as on food quality and role of complementary activities. We disaggregate findings into four classes of recipients. Returns to FAPs are highest for children under two. But, FAPs oriented towards early childhood interventions are less well funded than are interventions aimed at school-age children or at the broader, largely adult population even though available evidence indicates that these latter classes of interventions offer considerably lower average returns in economic, health, and nutrition terms. Nonetheless, FAP effectiveness in achieving any of several objectives varies with a range of key factors, including targeting, additionality, seasonality, timeliness, incentive effects, social acceptability and political economy considerations. This article examines the effects of market–oriented economic reforms on foreign direct investment (FDI) flows to Latin America from 1985 to 2006. In contrast with most existing scholarship, we disaggregate FDI into its destination in the primary resource, manufacturing, and service sectors allowing us to determine that different kinds of investments exhibit distinct behavior. Notably, manufacturing FDI appears to be erratic; previous investment is not a predictor of current investment. FDI across sectors is associated with varying policy environments, with service and primary resource investment attracted to hosts with policies associated with more stable economic and political contexts. Overall, manufacturing FDI appears to function more like “hot” portfolio investment and is less likely to provide some of the positive spillover effects thought to be associated with more permanent FDI. These findings have an array of implications for economic, development, and industrial policies throughout Latin America and the developing world.

This paper examines the effect of social spending in developing countries on foreign direct investment (FDI). Existing studies on the race to the bottom in social services attempt to discern the extent to which FDI affects social expenditure. However, it remains an open question whether FDI is actually attracted to lower spending levels. We find no indication that FDI is repelled by social spending; indeed there is strong evidence that investment is associated with greater programmatic emphases on health and education. These findings have important implications for leaders seeking to attract investment and for those attempting to expand social programs.
