Resumen: El uso jurídico como método de resolución de los conflictos de normas en el Derecho Internacional Privado reclama al Derecho Público extranjero con la única limitante del orden público aplicado a posteriori y como conjunto de principios. Si asumimos el problema de la adaptación de la norma desde el uso jurídico, puede hablarse de una teoría del “envío pleno” al derecho extranjero y a partir de allí todo el ordenamiento extranjero debe ser tenido en cuenta y no solo el Derecho Civil o una parte de él. Se debe rescatar la concepción sistémica del Derecho en un mundo jurídico donde la distinción clásica entre el Derecho Público y el Derecho Privado ha perdido su sentido y vigencia.

Resumen: En la carrera por obtener la corona de Aragón, que ha quedado vacante, el Infante don Fernando de Castilla se enfrenta a cinco contrincantes con las mismas expectativas. Luego de un lapso de dos años de Interregno y de confrontación en todos los frentes, el parlamentario, el militar, el económico y hasta el religioso, el Infante es elegido como nuevo monarca en el Compromiso de Caspe. Si durante el proceso electivo las relaciones habían sido de pura competencia, luego del mismo los conflictos continúan, en especial con uno de los candidatos, el Conde de Urgel. Este artículo tiene como objetivo describir este conflicto, como un proceso vivo que se transforma, adquiere nuevas dimensiones, involucra a otras partes, con intervenciones de terceros conciliadores e infructuosas negociaciones para dar una solución a esta disputa, que finalmente se define a través de la lucha armada.

Resumen: La dificultad con las redes radica en que, al ser de uso colectivo, generan conflictos sobre sus derechos de propiedad y obligaciones de pago. Por eso, existe una controversia sobre el más eficiente modo para su provisión, que se extiende desde el laissez faire hasta la dictadura. En el camino, se puede detener en algún tipo de consenso, basado en el diseño de mecanismos, adecuado para hacer revelar sus preferencias a los participantes. El proceso implica un intercambio de derechos entre los agentes para arribar a la asignación definitiva. Si, mediante una subasta, se obliga a los participantes a realizar ofertas de intercambio de derechos, los costos de transacción se reducen y la fluidez no puede sino ser mayor. Y ante una mayor fluidez en el intercambio, siempre será posible alcanzar una asignación más eficiente de esos derechos de propiedad. Para mostrar la conveniencia de esta alternativa, en este trabajo se presenta un modelo simplificado de diseño de mecanismos en donde se analiza la eficiencia asignativa de la regla propuesta.

Resumen: El trabajo propone una lectura del ejemplo XXXIIII del Libro del conde Lucanor (“De lo que conteçió a un falcón sacre del infante don Manuel con un águila et con una garça”) que atiende a cómo don Juan Manuel evalúa y discute la figura de autoridad real. Sin embargo, su relación con el rey se entiende como la síntesis de los conflictos entre proyecto nobiliario y proyecto regio, y es enfocada desde la perspectiva ideológica de los grandes señores de Castilla. Al mismo tiempo se intentará una lectura comparada con Mocedades de Rodrigo que trata la misma problemática con similar perspectiva ideológica, pero con una resolución diferente del conflicto

This paper re-examines the determinants of mutual fund fees paid by mutual fund shareholders for management costs and other expenses. There are two novelties with respect to previous studies. First, each type of fee is explained separately. Second, the paper employs a new dataset consisting of Spanish mutual funds, making it the second paper to study mutual fund fees outside the US market. Furthermore, the Spanish market has three interesting characteristics: (i) both distribution and management are highly dominated by banks and savings banks, which points towards potential conflicts of interest; (ii) Spanish mutual fund law imposes caps on all types of fees; and (iii) Spain ranks first in terms of average mutual fund fees among similar countries. We find significant differences in mutual fund fees not explained by the fund’s investment objective. For instance, management companies owned by banks and savings banks charge higher management fees and redemption fees to nonguaranteed funds. Also, investors in older non-guaranteed funds and non-guaranteed funds with a lower average investment are more likely to end up paying higher management fees. Moreover, there is clear evidence that some mutual funds enjoy better conditions from custodial institutions than others. In contrast to evidence from the US market, larger funds are not associated with lower fees, but with higher custody fees for guaranteed funds and higher redemption fees for both types of funds. Finally, fee-setting by mutual funds is not related to fund before-fee performance.

Por el sector de actividad en el que se encuentra, así como por su propia vocación empresarial, Danka ha experimentado desde sus inicios un proceso paulatino de crecimiento. Este crecimiento está siendo cada más vez progresivo y, por ello, la empresa se está viendo obligada a hacer frente a una serie de problemas derivados del mismo. Estos conflictos derivados del crecimiento, comunes a todo tipo de empresa, se ven acrecentados en el caso de Danka Multimedia por su personalidad jurídica, los valores y cultura que ello conlleva y el sector de actividad en el que desarrolla su actividad. La gestión de este crecimiento, por parte de Danka Multimedia, es el tema central que se aborda a lo largo del caso.

The territory of the European Union is made up of a rich and wide-ranging universe of languages, which is not circumscribed to the «State languages». The existence of multilingualism is one of Europe’s defining characteristics and it should remain so in the constantly evolving model of Europe’s political structure. Nonetheless, until now, the official use of languages has been limited to the «State languages» and has been based on a concept of state monolingualism that has led to a first level of hierarchization among the languages of Europe. This has affected the very concept of European language diversity. The draft of the treaty establishing a European Constitution contains various language-related references that can be grouped in two major categories: on the one hand, those references having to do the constitutional status of languages, and on the other, those regarding the recognition of European language diversity. Both issues are dealt with in this article. In analyzing the legal regime governing languages set forth in the draft of the constitutional treaty, we note that the draft is not based on the concept of the official status of languages. The language regulation contained in the draft of the constitutional treaty is limited in character. The constitutional language regime is based on the concept of Constitutional languages but the official status of languages is not governed by this rule. The European Constitution merely enunciates rights governing language use for European citizens vis-à-vis the languages of the Constitution and refers the regulation of the official status of languages to the Council, which is empowered to set and modify that status by unanimous decision. Because of its broad scope, this constitutes a regulatory reservation. In the final phase of the negotiation process a second level of constitutional recognition of languages would be introduced, linked to those that are official languages in the member states (Catalan, Basque, Galician, etc.). These languages, however, would be excluded from the right to petition; they would constitute a tertium genus, an intermediate category between the lan guages benefiting from the language rights recognized under the Constitution and those other languages for which no status is recognized in the European institutional context. The legal functionality of this second, intermediate category will depend on the development of standards, i.e., it will depend on the entrée provided such languages in future reforms of the institutional language regime. In a later section, the article reflects on European Union language policy with regard to regional or minority languages, concluding that the Union has not acted in accordance with defined language policy guidelines when it has been confronted, in the exercise of its powers, with regional or minority languages (or domestic legislation having to do with language demands). The Court of Justice has endeavoured to resolve on a case by case basis the conflicts raised between community freedoms and the normative measures that protect languages. Thus, using case law, the Court has set certain language boundaries for community freedoms. The article concludes by reflecting on the legal scope of the recognition of European language diversity referred to in Article II-82 of the European Constitution and the possible measures to implement the precept that might constitute the definition of a true European language policy on regional or minority languages. Such a policy has yet to be defined.

The food and feeding habits of Polyprerus cncllicheri and Polypterus senegalus was carried out in the months of September to October. The food of 33 Polypierus endlicheri as observed include Tilapia species (89.3%), Eutropius niloticus (28.6%), Mayfly nymph (39.3%), Dragon fly larva (56.6%) fish remains (21.4%) and detritus (7.1%). The food of27 Polypterus senegalus as observed include Tilapia sp (88.4%), Eutropius niloticus (27.9%), may fly nymph (23.3%), Dragonfly nymph (34.9%) remains (21.1%) detritus (23.3%). (9 page document) The percentage occurrence of food item found in the stomach of Polypterus endlieheri is 93.3% while that of Polyprerus senegalus is 67.4%. The dominance of Tilapia sp was establish in the study, and there is no significant difference between the feeding habit of Polypterus endlicheri and Polyprerus senegalus.

The Cape Canaveral, Florida, marine ecosystem is unique. There are complex current and temperature regimes that form a faunal transition zone between Atlantic tropical and subtropical waters. This zone is rich faunistically and supports large commercial fISheries for fish, scallops, and shrimp. Canaveral is also unique because it has large numbers of sea turtles year-round, this turtle aggregation exhibiting patterned seasonal changes in numbers, size frequency, and sex ratio. Additionally, a significant portion of this turtle aggregation hibernates in the Canaveral ship channel, a phenomenon rare in marine turtle populations. The Cape Canaveral area has the largest year-round concentration of sea turtles in the United States. However, the ship channel is periodically dredged by the U.S. Army Corps of Engineers in order to keep Port Canaveral open to U.S. Navy vessels, and preliminary surveys showed that many sea turtles were incidentally killed during dredging operations. In order for the Corps of Engineers to fulfill its defense dredging responsibilities, and comply with the Endangered Species Act of 1973, an interagency Sea Turtle Task Force was formed to investigate methods of reducing turtle mortalities. This Task Force promptly implemented a sea turtle research plan to determine seasonal abundance, movement patterns, sex ratios, size frequencies, and other biological parameters necessary to help mitigate dredging conflicts in the channel. The Cape Canaveral Sea Turtle Workshop is a cooperative effort to comprehensively present research results of these important studies. The objectives of these Technical Guidelines are to provide a focus on small-scale fisheries and their current and potential role in contributing to poverty alleviation and food security by expanding on the guidance on small-scale fisheries offered by the Code. The Guidelines are complementary to existing Technical Guidelines for Responsible Fisheries. Most small-scale fishers are in developing countries and many live in communities characterized by poverty and food insecurity. Small-scale fishing communities are faced with an array of serious problems, including overexploitation and depletion of resources, lack of alternative sources of employment, rapid population growth, migration of populations, displacement in coastal areas due to industrial development and tourism, pollution and environmental degradation and conflicts with large commercial fishing operations. However, small-scale fisheries are critical for food security and poverty alleviation in many countries. The first part of the Guidelines discusses the current contribution, role and importance of small-scale fisheries in poverty alleviation and food security. It examines the importance of small-scale fisheries for poverty alleviation at a national, local and household level. It also notes the nutritional qualities of fish and thus the particular role of fish in nutritional aspects of food security. The fact that about half of all fish caught for human consumption comes from small-scale fisheries underlines the importance of this subsector for the world fish supply. In many countries small-scale fisheries contribute to national food security both directly – where fish is a crucial part of the daily diet, and indirectly – by generating foreign exchange earnings that enable the purchase through trade of a range of food products. The second part of the Guidelines explores ways through which the contribution of small-scale fisheries to poverty alleviation and food security could be enhanced. A vision for the future of small-scale fisheries is presented as a goal towards which the subsector should develop. Ensuring greater participation by small-scale fishers and their communities in the formulation of policies, the development of related legislation and regulations, and in management decision-making and implementation processes, is vital to the realization of this vision. The central role of effective fisheries management, the importance of considering cross sectoral uses of fisheries and related resources, the special role of women in fish marketing, processing and value addition, the significant scope for trade, the critical role that adequate financing may have in enabling transitions for effective fisheries management and the role of knowledge in making informed decisions are all discussed in these Guidelines. The sprat of the Baltic Sea is not as short-lived as inother Seas probably because fish predator species arerestricted mainly on cod and salmon. Sea bird popula-tions are much smaller and marine mammals are rare inthe Baltic Sea. The sprat stock biomass is fluctuatingstrongly. The fluctuation is mainly influenced by thestock recruitment and is also dependent on the strengthof the cod stock. After a strong decrease during the1980ies sprat catches increased again from 1992 onwardsand reached a peak with over half a million tonnes in 1997. At about the same time the character of the BalticSea sprat fishery changed from catches mainly for hu-man consumption to catches mainly for industrial pur-poses initiated by the fishery of Sweden. The recentrecord high catches of sprat have been possible only dueto the low level of the cod stock of the main Baltic SeaBasins over some years. A sprat fishery on such a highcatch level might cause conflicts with a recovering codstock in future.

[ES] El objetivo del artículo es explorar la potencialidad de la Evaluación Multi-criterio Social como enfoque metodológico para evaluar Espacios Naturales Protegidos (ENP) e iniciar un proceso de discusión sobre la conveniencia de incorporar esta metodología para la gobernanza de la Red Natura 2000 de la Comunidad Autónoma de Euskadi. Del caso de estudio analizado se desprende que la inclusión de la población local en un proceso participativo dirigido a la planificación y manejo de los ENP contribuiría a reducir el número y calado de conflictos potenciales. Asimismo, facilitaría la gobernanza efectiva de los ENP, lo que parece un reto ineludible para que las áreas protegidas logren sus objetivos y funciones.
