China’s urbanization and industrialization are occupying farmland in large amounts, which is strongly driven by land finance regime. This is due to the intensified regional/local competition for manufacturing investment opportunities that push local governments to expropriate farmland at low prices while lease land at high market value to property developers. The additional revenue obtained in this way, termed financial increment in land values, can drive local economic growth, and provide associated infrastructure and other public services. At the same time, however, a floating population of large numbers of inadequately compensated land-lost farmers, although unable to become citizens, have to migrate into the urban areas for work, causing overheated employment and housing markets, with rocketing unaffordable housing prices. This, together with various micro factors relating to the party/state’s promotion/evaluation system play an essential role leading to some serious economic, environment and social consequences, e.g., on migrant welfare, the displacement of peasants and the loss of land resources that requires immediate attention. Our question is: whether such type of urbanization is sustainable? What are the mechanisms behind such a phenomenal urbanization process? From the perspective of institutionalism, this paper aims to investigate the institutional background of the urban growth dilemma and solutions in urban China and to introduce further an inter-regional game theoretical framework to indicate why the present urbanization pattern is unsustainable. Looking forward to 2030, paradigm policy changes are made from the triple consideration of floating population, social security and urban environmental pressures. This involves: (1) changing land increment based finance regime into land stock finance system; (2) the citizenization of migrant workers with affordable housing, and; (3) creating a more enlightened local government officer appraisal system to better take into account societal issues such as welfare and beyond.

Tax evasion and fraud threaten the economic and social objectives of modern tax systems, precluding the state funding for the satisfaction of collective needs and the fair distribution of wealth, being a violation of basic principles and values of our society. In tax law, to give tax administration the necessary powers to supervise and control the information provided by taxpayers and combat tax evasion and fraud, over the last years the grounds for a derogation of bank secrecy without judicial authorization have been extended, which raises some constitutional compatibility issues. Similarly, this tendency of making this legal regime more flexible and increasing automatic exchange of information has been followed by the European Union and the international community. Banking secrecy, as a professional secrecy, is an instrument to protect the right to privacy but also appears as an anti-abuse and repressive mechanism of evasive and fraudulent behaviors. Because of the conflict of interests will always be necessary to make a practical agreement between them, ensuring the legality and the due guarantees of the taxpayers but also an effective way to combat tax evasion and fraud. Bank secrecy cannot be one method to, behind the right to privacy, taxpayers practice illegal activities. But the practice of these irregular conducts also does not justify a total annihilation of the right to banking secrecy, uncovering all documents and bank information’s. Although considering the legislative changes, the administrative derogation of bank secrecy will always be what the tax administration does of it.

In China, the history of the establishment of the private housing market is pretty short. Actually in less then two decades, the market has grown from almost the scratch to playing an important role in the economy. A great achievement! But many problems also exist. They need to be properly addressed and solved. Price problem---simply put, housing price is too high--- is one of them, and this paper is focused on it. Three basic questions are posed, i.e. (1) how to judge the housing affordability? (2) why the housing price is so high? (3) how to solve the housing price problem. The paper pays particular attention to answering the second question. Except the numerous news reports and surveys show that most of the ordinary city dwellers complained about the high housing price, the mathematical means, the four ratios, are applied to judge the housing affordability in Shanghai and Shenzhen. The results are very clear that the price problem is severe. So why? Something is wrong with the price mechanism. This research shows that mainly these five factors contribute to the price problem: the housing reform, the housing development model, the unbalanced housing market, the housing project financing and the poor governmental management. Finally the paper puts forward five suggestions to solve the housing price problem in first-hand private Chinese housing market. They include: the establishment of real estate information system, the creation of specific price management department, the government price regulation, the property tax and the legalization of "cushion money".

En ocasiones las administraciones tributarias han errado en la comprensión del contenido y alcance de la facultad determinadora. Al constituir una actividad reglada, la determinación tributaria debe observar rigurosamente las normas relativas a materia, oportunidad y competencia. La sentencia materia de la presente recensión se refiere precisamente al ejercicio de la facultad determinadora en lo que hace relación con los actos administrativos que se encuentran impugnados judicialmente. Considerando que uno de los efectos de la judicialización del acto administrativo es abstraerlo de la órbita competencial de la administración tributaria, esta no puede ejercer sobre él ninguna de sus facultades, entre ellas, la verificadora. El criterio de juzgamiento analizado confirma este particular, dejando en claro las consecuencias que la impugnación judicial comporta tanto para los actos administrativos como para la administración tributaria.

Não é tarefa fácil abordar um tema como o de tributos, principalmente em um país como o Brasil, com grandes e históricas dívidas sociais, que permanece com uma das cargas tributárias mais elevadas do Mundo e com uma qualidade na oferta de serviços públicos que, na maioria das vezes, deixa a desejar. Pior ainda é discutir a eficácia do papel do Auditor Fiscal, já que temos a missão de prover o Estado de recursos públicos para a implementação e manutenção de políticas necessárias para a sociedade. Nem sempre para cumprir esse papel conta-se com o apoio integral da classe política e da população. Para compensar tal desafio, a maior motivação e certeza é que há na Secretaria da Fazenda do Estado de Pernambuco verdadeiros empreendedores com capacidade técnica e vontade de mudar algumas realidades, já não tão sintonizadas com os desafios dos tempos modernos. Partindo da premissa que a introdução do Planejamento, por meio da criação da Diretoria de Planejamento e Controle da Ação Fiscal no início de 2002 na estrutura organizacional da Administração Tributária, resultou em um salto de qualidade no resultado da ação fiscal, esse estudo apresenta uma avaliação dos processos fiscais comparando-se a partir de 1998 até o início de 2002 e daí até o ano de 2006. Percebe-se que não houve incremento em relação à efetividade da ação fiscal, constatando-se correlação estatística entre os valores recuperados pelo Fisco quando comparados o período posterior à mudança organizacional com o anterior, verificado pelo Teste de Wilcoxon. Ao mesmo tempo, percebeu-se uma necessidade clara do Estado rever suas leis, prazos e condições de trabalho no que se refere à execução fiscal, sob pena de não conseguir reaver parcela de tributo sonegado em tempo hábil, já que 84,9% dos processos não tiveram suas defesas administrativas apresentadas ou saldos devedores regularizados. Na pesquisa dirigida aos gerentes da Diretoria de Planejamento, suas respostas indicam que o caminho precisa ser mantido, buscando contínua evolução e coerência do planejamento estratégico e permanente aperfeiçoamento do modelo de gestão adotado em busca de resultados, com sensibilidade social e respeito profissional a cada integrante do Órgão.
