O mercado de gás liquefeito de petróleo brasileiro passou por profundas mudanças após a desregulamentação governamental iniciada a partir da segunda metade da década de 1990. Neste período, a intervenção estatal foi substituída por um modelo de livre concorrência que impulsionou a expansão das quatro principais empresas do setor para uma atuação nacional. Estes movimentos criaram um novo cenário competitivo no mercado. Após uma década destas mudanças, e apesar da forte competição entre as quatro grandes companhias que detém 86 % do mercado, a liderança do segmento residencial em cada estado brasileiro continua sendo exercida pela mesma marca do passado (ou sua sucessora). Este fato indica a necessidade das companhias adotarem uma nova abordagem de marketing para alterar de maneira significativa a percepção do consumidor em relação à sua preferência de marca. Logo, o conhecimento dos fatores críticos na escolha de botijões de gás para uso residencial é fundamental para esta mudança. Este estudo propõe uma nova abordagem das estratégias de mercado na indústria do GLP no Brasil, baseada numa perspectiva antropológica, que tenha como pilar o estudo do consumo doméstico deste produto como um processo de natureza cultural e simbólica, contradizendo a visão utilitarista que o estrutura como um simples reflexo de uma razão prática, fundamentada em critérios econômicos. Para atingir este objetivo, o pesquisador realizou uma análise do comportamento do consumidor de botijões de gás para uso doméstico apoiado nos principais estudos sobre o consumo na base da pirâmide, abordando os aspectos culturais brasileiros que possuem influência relevante nesta decisão de compra. Este estudo também contemplou os principais conceitos sobre a formação de hábitos de compra bem como a teoria sobre a lógica dominante em serviços. Os dados primários foram obtidos no município de Petrópolis/RJ, através de metodologia qualitativa, utilizando as entrevistas em profundidade como técnica de coleta de dados. Como resultado deste trabalho, foi proposto pelo autor um modelo teórico para explicar o fenômeno de compra do botijão de gás para uso doméstico no Brasil. Este modelo explica que a formação do hábito de compra do botijão de gás tem início na transmissão familiar da preferência por determinada marca para os membros mais novos da família, através do convívio e observação da rotina de escolha. Em seguida a nova consumidora experimenta o produto habitual da família e confirma as promessas de serviço embutidas na preferência familiar. Após esta fase, a consumidora consolida a preferência e coloca a recompra do botijão de gás no modo automático, disparando o loop do hábito de consumo deste produto. Segundo esta proposta, apenas uma dissonância cognitiva gerada pelo não cumprimento da promessa de serviço prestado é capaz de interromper o loop do hábito de compra da marca preferida pela família.

Com o fenômeno da globalização, verificou-se o aumento do volume de transações comerciais entre os países, bem como da concentração de poder econômico das organizações empresariais. Esse aumento das operações comerciais e, consequentemente, do montante de dinheiro nelas envolvido, criou ambiente mais favorável à corrupção. Pelo fato de a corrupção trazer prejuízos à ordem econômica mundial e ao sistema democrático, a comunidade mundial passou a demandar um regime de intervenção estatal maior no seu combate, principalmente a partir dos anos 90. O combate à corrupção se deu por meio dos compromissos assumidos pelos países, que assinaram Convenções nesse sentindo. O presente estudo abordou os reflexos negativos da corrupção na economia e sociedade brasileiras, e os instrumentos internacionais que foram adotados pelo país numa tentativa de diminuí-la. Tratou-se, ainda, do sistema legislativo brasileiro de combate à corrupção e dos aspectos da Lei nº 12.846/13, chamada de lei anticorrupção. Ponto importante do estudo foi a análise da possibilidade de redução das sanções trazida pela referida Lei nº 12.846/13, pela existência dos "mecanismos e procedimentos internos de integridade, auditoria e incentivo à denuncia de irregularidades e a aplicação efetiva de códigos de ética e de conduta", ou seja, os "programas de Compliance". Procurou-se analisar as implicações jurídicas da adoção de programas de Compliance anticorrupção, quais os elementos daquilo que pode ser considerado um programa efetivo com base nos parâmetros internacionais, se esses elementos podem ser eficientes e em que medida no combate à corrupção. Por fim, foi realizada uma pesquisa na companhia Localiza Rent a Car S/A, empresa locadora de veículos, a fim de verificar quais elementos constam do seu programa e se possuem os elementos tidos como mínimos e essenciais extraídos das referências internacionais e nacionais.

Nesta tese tive por objetivo analisar a relação entre o campo burocrático do Estado em ação e o espaço social de favelas, no contexto da “pacificação”. Para tal, me propus a responder a três questões de pesquisa: Como os agentes do campo burocrático do Estado se fazem presentes no espaço social de favelas? Qual é a relação entre o campo burocrático do Estado em ação nas favelas e os processos de organizar dos agentes do campo? Qual é a relação entre os processos de organizar dos agentes do campo burocrático do Estado em ação nas favelas e o espaço social? Para o desenvolvimento da pesquisa, realizei um trabalho de campo em duas favelas da cidade do Rio de Janeiro, durante 1 ano e 4 meses (de janeiro de 2013 a abril de 2014). Nesse sentido, a coleta de dados se deu por meio de observação participante e 91 entrevistas com moradores e representantes do Estado. Os dados foram analisados com base em teoria fundamentada, conforme proposta por Strauss e Corbin (2008), bem como por meio de análise retórica. Com base nos conceitos de campo proposto por Bourdieu, na literatura sobre processos de organizar, e na noção de espaço social cunhada por Lefebvre (2007), busquei demonstrar como os agentes do campo burocrático do Estado inserem-se nas favelas a partir de lógicas institucionais distintas, o que serve para incentivar disputas e inibir a cooperações. Mostro como as estratégias retóricas de legitimação utilizadas pelos agentes apontam para as posições de incumbentes e desafiadores do campo, o que é reforçado pela análise da distribuição de capitais. Aponto como alguns agentes conseguem ter acesso ao capital social e informacional, os quais se retroalimentam, enquanto outros possuem uma concentração maior de capital econômico, espacial e simbólico, aproximando-se das posições de incumbentes. Em seguida, busco mostrar como os processos de organizar, imbricados ao campo, assumem, como consequência da dinâmica do campo, padrões de lentidão, descontinuidades, dispersão e (des)materialização. Por fim, analiso a produção do espaço social de favelas a partir de um choque entre o campo burocráticos do Estado e o campo das favelas, o que se expressa em hibridismos e ambiguidades. Há a produção de hibridismos no espaço, ambiguidades de leis nas favelas, e ambiguidades na própria noção de organizar, aqui reinterpretada para processos de (des)organizar, tendo em vista que organizam ou desorganizam para diferentes pontos de vistas. Chego, enfim, à noção de “maquiagem do espaço”, com base em uma metáfora utilizada pelos moradores para descrever a favela “pacificada” como uma favela que emite, por meio da dimensão simbólica da matéria, significados de segurança e progresso, quando é, para seus habitantes, uma favela também insegura, submetida a uma “administração da pobreza”.

As intervenções do Poder Público em entidades privadas são necessárias em certas circunstâncias. Independentemente do tipo de intervenção, os agentes intervenientes devem zelar pelo interesse público e esforçar-se para que a intervenção ocorra na medida necessária, com qualidade e com eficiência. Será abordado assunto relacionado à intervenção do Poder Público, na figura da Superintendência de Seguros Privados (Susep), autoridade que recebeu do Ministério da Fazenda competências de controlar, regular e fiscalizar importantes instituições: seguradoras, resseguradores locais, entidades abertas de previdência complementar e entidades de capitalização. Nesse contexto, os estudos se restringirão à Liquidação Extrajudicial, intervenção que ocorre quando há indícios de crises econômicofinanceiras, de insolvência ou de gestão, dentre outras circunstâncias. A Susep nomeia um liquidante para executar os procedimentos e acompanha a respectiva gestão, cujo foco principal deve ser a quitação das dívidas com os credores. Tem sido observada baixa eficiência na gestão das entidades em Liquidação Extrajudicial, o que pode em parte relevante ser decorrente da falta de diretrizes para a elaboração de um Manual do Liquidante que induza a práticas eficientes de gestão. É, pois, objetivo desse trabalho propor diretrizes para a elaboração desse Manual. A metodologia de pesquisa será a revisão bibliográfica, pesquisa documental e a coleta da opinião de liquidantes e de especialistas em Liquidação Extrajudicial. Será pesquisado como algumas autoridades nacionais ou internacionais lidam com a Liquidação Extrajudicial. Acreditamos que o assunto aqui tratado é de grande relevância social, pois ineficiências na execução dessas Liquidações Extrajudiciais podem prejudicar credores, acionistas e gerar desperdícios de tempo e de recursos do Poder Público quando do acompanhamento do regime liquidatário. No final do trabalho encontramos o resultado da pesquisa: as diretrizes propostas para a elaboração do novo Manual do Liquidante da Susep.

O mercado de capitais no âmbito do sistema financeiro apresenta-se como um instrumento capaz de definir e aumentar a eficiência da alocação de bens e recursos entre poupadores e investidores em uma sociedade. Não obstante, o mercado é passível de falhas, necessitando, portanto, da intervenção estatal para corrigir eventuais falhas. Dentre as falhas mais comuns apresentadas no mercado de capitais, destaca-se a assimetria de informações, que basicamente consiste na falta de plena informação para todos os agentes participantes do mercado acionário. Neste cenário, o Estado elegeu o regime de divulgação de informações para nortear e fiscalizar o mercado de valores mobiliários, objetivando corrigir as assimetrias de informações decorrentes, sendo o modelo adotado por inúmeros países atualmente. Deste modo é importante compreender os motivos pelos quais levaram o Estado a primeiramente intervir nos mercados por meio da regulação e os motivos pelos quais levaram a adoção do regime de divulgação obrigatória de informações como pedra angular do mercado de valores mobiliários, analisando os aspectos positivos e negativos que justificam tal regime.

This research tried to follow up with the way of intervention that a developing State promotes it regional development, once its action departs from a quantitative conception until its acting focused in maintenance, like the strategy of local development input in the Northeastern of Brazil in the 90 s. particularly, the attention was focused onto Banco do Nordeste which, between 1995 and 2002, achieved a organization changing process to get fit itself to the new conception of development and State, that advocates the maintenance and the participation of the society in its accomplishment, becoming itself the main agent of the Federal Government in the Region. By taking over the strategy of local development, Banco do Nordeste starts, at least in speech, to be less of a bank to become more of a development agent , representing some development and hope to overcome the social and economical inequalities of the Region. The hypothesis that surrounds this essay is that this reorientation experienced at Banco do Nordeste is related to three factors: timing; the Institution of a project of international technical cooperation with PNUD; the unrest of an employees group, who used to fight for the acting increase of the Bank to beyond the credit acting; and, above all, the juncture created in Ceara from the second half of the 80 s, expressed, mainly, for the political rise of a group of businessmen, who took over and modernized the standards of public management in the State, transforming the cearense experience into reference in Brazil and the world. The research was developed from information got through the use of semi-structured interviews and documental research and, as complementary resource, field observation. The interviews were done with BNB managers between 1995 and 2003, some of them current administrators (2003-2006), plus one of CAPEF directors and the present president of AFBNB. The research revealed that strategic place taken by BNB in the period studied did not come to represent a rupture in its organizational culture, being strongly attached to factors that allows its operation. When some of these elements stopped existing, it was observed a retracing in the pattern of state intervention in the Region. This conclusion restates the vision of State that guided this thesis, identified as relationships field, of different interests; space where social conflicts are established; incarnated through the institutions

This paper is about the objective dimension of fundamental rights, aiming to present a concept well-designed for this dimension, and establish a systematic teaching of the subject, presenting the developments of this dimension of fundamental rights. The objective dimension of fundamental rights arises related to the idea of linking the state of fundamental rights, transforming these rights as the foundation and purpose of the state. It is distinguished from that perspective of the subjective dimension of fundamental rights, which includes the fundamental rights in an individual-state relationship. Under the subjective prism, rights are seen as limits required by the individual, the state intervention in the lives of individuals. A new dimension goes beyond the perspective of the rights of the individual as a mere resistance in the face of the state, assigning those rights also an active mission, which generates a series of legal repercussions. These developments or "effectiveness" the objective dimension are studied. The first consists of Binding Effectiveness, and demonstrated a new respect for fundamental rights within the state structure, which creates concepts such as "linkage of state functions fundamental rights" and "state s duty to protect". There is also the Radiant Effectiveness in which are examined topics such as the "constitutionalization of Law" and the "application of fundamental rights to particular relationships". Studies are still Procedure Effectiveness, in the case of "objectification of the mechanisms of protection of fundamental rights" and "opening of the processes of state protection of fundamental rights to public participation"

The Liberal Constitutionalism emerged from the late eighteenth century, a period of major revolutions (French and American), fruit of the struggle for libertarian rights. Although the time of the first written constitutions, these were linked to mere political letters, did not provide for fundamental human rights, as it is, so only on the state organization, structure of powers, division of powers of the state and some relations between state and individuals. There was a clear division between the civil codes and constitutions, those governing private relations and acted as barriers to non-state intervention. After the Second World War, the constitutions are no longer Letters political order to establish how the human person, in order to enshrine the fundamental rights, the primacy of constitutional principles and take their normative function against ordinary legislator. Constitutional evolution gave the name of contemporary constitutionalism, based on repersonalization or despatrimonialização of Private Law, ceasing the separation of legislative civil codes and constitutions, in favor of the protection of fundamental rights of the human person. And this tendency to the Brazilian Federal Constitution of 1988 brought higher ground the dignity of the human person, the epicenter axiological legal to govern private relations, including family law. The constitutionalization of family law motivates the adoption of desjudicialização family issues, so as to respect the direio intimacy, privacy, private autonomy and access to justice. Conflictual family relationships require special treatment, given the diversity and dynamism of their new compositions. The break in the family relationship is guided in varied feelings among its members in order to hinder an end harmonic. Thus, the judiciary, through performances impositive, not to honor the power of decision of the parties, as also on the structural problems faced to operate on these cases, the environment is not the most appropriate to offer answers to the end of family quarrels. Situation that causes future demands on the dissatisfaction of the parties with the result. Before the development of the Family Law comes the need to adopt legal institutions, which monitor the socio-cultural, and that promote an effective assistance to people involved in this kind of conflict. In obedience to the private autonomy, before manifestations of volunteers involved in family mediation, among autocompositivos instruments of conflict resolution, is indicated as the most shaped the treatment of family quarrels. Remaining, then the state a minimal intervention to prevent excessive intrusion into private life and personal privacy

The right to artistic expression, freedom granted in the western democratic constitutionalism, is a fundamental right that cyclically, compared to other cohesive rights of expression, has been forgotten and put in an irrelevant juridical-dogmatic position. The first reason for this behaviour that disesteems artistic freedom is the valorisation of rationalism and scientificism in the modern society, subordinating academic researches to utilitarianism, relegating the purpose of feelings and spirituality on men s elocution, therefore, we investigate, guided by philosophy, the attribution of art on human formation, due to its capacity in harmonising reason and emotion. After that, we affirm the fundamental right to artistic expression s autonomy in the 1988 valid constitutional order, after a comparative explanation of freedom in the Fundamental Laws of United States, Portugal, Spain and Germany; and the construction historic-constitutional of the same right in the Brazilian Constitutions. In this desiderate, the theoric mark chosen is the Liberal Theory of the fundamental rights, guiding the exam through jusfundamental dimensions: juridical-subjective and juridical-objective. Whilst the first, classical function of resistance, delimitates the protection area of the artistic expression right from its specific content, titularity and its constitutional and subconstitutional limits, the other one establishes it as cultural good of the Social Order, defining to the State its rendering duties of protection, formation and cultural promotion. We do not admit artistic communication, granted without legal reserve, to be transposed of restrictions that belong to other fundamental rights and, when its exercise collides with another fundamental right or juridical-constitutional good, the justification to a possible state intervention that tangentiates its protection area goes, necessarily, through the perquisition of the artist s animus, the used method, the many viable interpretations and, at last, the correct application of the proportionality criteria. The cultural public politics analysis, nevertheless, observes the pluralism principle of democratic substratum, developer of the cultural dialogue and opposed to patterns determined by the mass cultural industry. All powers are attached, on the scope of its typical attributions, to materialise public politics that have the cultural artistic good as its aim, due to the constant rule contained in §1, art. 5º of the Federal Constitution. However, the access and the incentive laws to culture must be constantly supervised by the constitutional parameter of fundamental right to equality

The study aims to investigate the limits of state intervention via induction on Economic Order, especially in cases regarding tax equality, through the analysis of their effects on economic development and on free competition from the perspective of economic efficiency and the Constitution. Thus, the work seeks to demonstrate that the achievement of equality in taxation is important in that it strengthens the economic relations in terms of efficiency, protects competition and fosters economic development to reduce regional and social inequalities and other constitutional desiderata. A dissertation is characterized by interdisciplinarity and was divided into two parts. The first is to discuss the legal meaning of equality from the doctrinal analysis of the principle and the relationship between equality and justice in the economic sense without rejecting its philosophical content. It is noteworthy that hermeneutics and the philosophy of language are useful tools for achieving equality in presenting the pragmatic methodologies applicable to the subject in terms of corrective justice. Based on these general assumptions, is going to study the tax equality and their characteristics, the corollary of the ability to pay and its relation to the economic capacity and the issue of progressivity in taxation as an ideal of distributive justice. The second part concerns the legal foundations of Economic Order and its relation to extrafiscality as a means of economic regulation in order to investigate the efficiency of this induction in order to promote economic development, free competition and tax equality itself to reduce inequalities and distributing wealth. Within this context, we investigated the scope of the constitutional principles of economic order, free enterprise and free competition, and favored differential treatment for small and medium enterprises, the issue of regional development for the reduction of regional and social inequalities, the problem the "fiscal war" and finally the efficiency from the perspective of Economic Analysis of Law

The object of this study involves the eolian energy and the scenario the training of wind pole in Rio Grande do Norte. The aim is to investigate how far the implementation of the potiguar eolian pole may represent a regional development policy with real change in the structure of the traditional local productive base. About the interaction between the public and private to development of the local eolian activity, the hypothesis is that there is no coordination between the sectors responsible for eolian activity in the state. The theoretical approach follows the developmental current and theory of growth poles, and methodology adopted is a search of exploratory and documentary, with analysis of relevant documents on the subject. As a result of the study it was found that owing to the fragility of the productive structure potiguar and imbalances produced by the concentration of capital in the Northeast, the eolian activity in the state, needs a greater state-owned intervention to ensure a basis of development based on the study and strengthening local productive chain

The present study analyses the actual relations and work conditions found in the third sector in Natal city, in the context of productive restoration and increasingly retraction from the State in providing Social Service before the new approach that has been destined to the social issue. The study talks about the work of the social worker when fighting the different expressions the social issue has, such as social service provision as a way of teamwork associated to work relations and conditions, to accessible resources and quality control management. These are elements that affect and interfere in the accomplishment and in the work of the social worker itself. The State s improvement, according to neoliberal-political precepts and increasingly retraction from the public investment in the areas of social concern (health, social welfare, assistance) and in the wage and employment policy, besides expanding the partnership with the public and private areas, in search for social services with quality, it has diversified the structures of the professional work with the growth of the so called third sector institutions. However, the absorption of the social workers by the third sector groups in general, has as major features the impoverishment of work relations, the maintenance of an unequal salary model, pointing out the deadline contracts and/or single tasks that generate work instability. The research debates, with a critical view and full perspective, over the conception of the third sector, interpreted as an action that expresses functions and values, treated as a real phenomenon generated from the restoration of the capital based on neoliberal principles. This study aims for responding what the established work relations are and under what work conditions the social worker has been fitting in the third sector and how such a reality echoes in the current work conditions for a social work in the city of Natal, before this new model of state intervention that transfers part of the social service provision to distinctive divisions of society, among them the so called third sector. The research results have shown that like the other workers the social worker passes through the same crises, dilemmas, advances and challenges that occur in the world of employment and which are expressed in the drop of salary average in the growth of contemporary contracts, unemployment, and in the ever more selective requirements to one be included in the social spaces, where the professional work is done, having as a result a greater impoverishment of work relations and conditions as well as more vulnerability as a salaried occupation

Nowadays, there is a tourism phase in the city of Natal/RN called internationalization of tourism , which shows a tourism model with a planning and an administration, based on the needs of the visitors. Such process shows that the production as well as the reproduction of the city spaces with the goal of favor tourism excludes of its composition the effective participation of local subjects. Thus, the research is a result of the perception of tourism as an activity with a meaningful power of transformation of the social and natural space taking into account the low participation of the residents in the decisions of the tourism activities in the city of Natal/RN. Despite that reality, it is possible to note Natal that civil society, starts to mobilize its citizens trying to develop collective actions to low the negative impacts caused by the bad planning as wells not efficient tourism administration, trying to put in action the right of the local population to take part in the decisions of the city activities. Having this panorama as background, this paper aims at investigating in which way the mobilizing action of the social capital in Natal has contributed to change the spatial production which is part of the process of expansion of tourism in Natal/RN? The research presents a temporal picture which starts in the year of 1980, when occurs the first effective state intervention aiming to develop tourism in the capital, taking into account an analysis of 2012. Concerning the spatial picture, the research investigates the beaches of Natal which concentrates criteria and actions such as: visitation, tourism appeal and focus of investments, highlighting the following beaches: Ponta Negra, Areia Preta, Praia dos Artistas, Praia do Meio, Praia do Forte and Redinha. This study is of a descriptive and exploratory nature concerning its goals. With respect to the treatment of its object it is a qualitative research. The data was collected through structural interviews, with open questions. Regarding the methodological choices, it was used the content analysis proposed as well as the collective discursive subject methodology. The results show that there´s not yet in Natal a meaningful social capital related to tourism, capable to change the spatial production related to the activity. It should be stressed that Natal social capital presents difficulties concerning the incentive to trust, spontaneous cooperation and the civic participation, which are the foundation for the development of an effective social capital, which makes it harder for a more expressive articulation in the reality in Natal/RN. It should be stressed, as an answer to the research questions, that tourism in Natal/RN is represented by social and spatial segregation. In other words it emphasizes mainly the action of hegemonic agents (State and market), leaving little room for the participation of society. It can be noticed that the actions related to tourism in Natal keeps the popular participation out of the way. Thus, it can be said that the social capital in Natal/RN does not yet contribute to a more fair spatial production related to the expansion of the tourism as well as the well being of the population of Natal/RN. In conclusion, it should be taken into account that this participation do exists but not in a meaningful way. In other words, it´s not enough yet to cause meaningful changes in the actions which tourism needs nowadays in Natal/RN
